REPORT BY KARA IRWIN, GROWTH MANAGEMENT ADMINISTRATOR 32 Growth Management Administrator Kara Irwin reported the following City Council actions: 33 9 City Council approved the North County Library. 34 • The Planning, Zoning and Appeals Board books will be distributed next Friday to allow 35 for time to review Evaluation and Appraisal Report (EAR) sections. 36 • Chair Kunkle inquired about the process for Joy Hecht, 1 st Alternate, to become a 37 regular member. Growth Management Administrator Irwin explained that all of the 38 boards having openings and all of the appointments will be done at one time by the City 39 Council. Chair Kunkle stated Joy Hecht has attended every meeting and is experienced 40 and he would like to see her have the appointment as regular member. 41 42 V. RECOMMENDATION TO CITY COUNCIL Ex Parte Communication (Public Hearing) Petition PUDA- 07 -08- 000009: Paloma Planned Unit Development (PUD) Amendment A request by Anne Booth, agent for M/I Homes of West Palm Beach, LLC, to modify Resolution 196, 2004. The modifications are related to pedestrian lighting along Hood Road, the removal of the requirement for a six -foot clear zone for access between the single - family homes, and a request for a waiver to allow additional entry signage for the project. The Paloma Planned Unit Development (PUD) is approximately a 156.47 -acre tract of land located at the southwest corner of the intersection of Hood Road and Military Trail. Chair Craig Kunkle requested ex parte communication. None was reported. • Anne Booth, Urban Design Studios gave a brief description of the property and requested three modifications: - Request to remove the six -foot clear zone that is required between the single - family homes - Waiver to add additional project identification signage to existing walls - Waiver and condition modification request to remove the requirement of pedestrian lighting along Hood Road. • Anne Booth explained the request for removal of the six -foot clear zones, which were established in an attempt to provide access from the front of the lot to the rear of the lot. Paloma does provide alternate access to the rear of the lot. Eliminating the requirement will allow everyone to use the full size of their yard in the rear. • Anne Booth explained the original location for primary entrance signage. The request is to allow adding the Paloma name to the other side of the street in the cases of Military Trail and Hood Road and to be added to the monument feature on Central Boulevard. It is consistent with other projects in the area including Frenchman's Reserve, San Michele, Bent Tree, Mirasol, etc. • The third request is to remove the requirement for placement of pedestrian lights along Hood Road. A condition of approval requires pedestrian lights along Central Boulevard, Hood Road and Military Trail. It took two years to get through the permitting process and installation of lights along Military Trail and Central Boulevard. They have been unable to get permits for the area along Hood Road because the County sidewalk meanders back and forth and adjacent to the right -of- way there is a 10 -foot and a 20 -foot Seacoast Utility Authority easement. There are three existing mains and a future main that are primary mains to the water plant. To meet the photometric levels the lights would have to be placed at the edge of the easement and increased to a foot candle power level that would be unacceptable. A request was made to the County to put the lights in the right -of -way but it was denied. Different alternatives were tried, but were unsuccessful. They do have a recommendation from staff. • Chair Kunkle declared the public hearing open. • Carolyn Chaplik, 715 Hudson Bay Drive, Palm Beach Gardens, stated she lives in The Isles and they would be very glad if there were no lights along Hood Road. Ms. Chaplik stated she is working with Police Chief Stepp regarding the light spillage from Paloma into surrounding neighborhoods. Ms. Chaplik would like to see the signage approved so the entryways would look even. PLANNING, ZONING AND APPEALS BOARD REGULAR MEETING 05-13-08 Page 1 • With no further comments, Chair Kunkle closed the public hearing. 2 • Dennis Solomon: The entry sign for La Paloma really looks too large and Mr. 3 Solomon does not believe it should have been approved at that size for even one side. 4 The other signs cited are less high and less obtrusive and the letters are smaller. 5 • Amir Kanel: Does not have a problem with signs or the entry ways to the yards. Mr. 6 Kanel believes the light would be an asset. Growth Management Administrator Irwin 7 stated the City has worked with the County. The County denied using the right -of- 8 way for pedestrian lighting because there is no street lighting. 9 • Michael Panczak: Inquired about the number of homes already built that the six -foot 10 clear zone affects. The clear zone alternates between every other house so it would 11 affect approximately 20 to 30 homes. It is at the owner's discretion if they want to 12 move the fences. The change would affect new homes going forward. 13 o Douglas Pennell: Stated he has no problem with the waiver requests and he does 14 support the applicant's petition. 15 o Barry Present: Balancing the signs makes sense. Mr. Present questioned if the 16 sidewalk along Hood Road is necessary since it won't be lit, therefore making it 17 unsafe. Anne Booth stated some projects along Hood Road do have sidewalks and 18 some do not. The sidewalks are in the County right -of -way so the County is 19 responsible for maintenance as part of the roadway. The homeowner's association is 20 responsible for landscaping in the median, shoulder and in the buffer. 21 • Joy Hecht: Asked for clarification of the six -foot clear zone. Anne Booth explained 22 the older homes do not have connecting fences because of the clear zone. With the 23 waiver they will be able to move the fences to the property line if they so wish. Joy 24 Hecht stated she felt it necessary to place the second sign for balance. The map shows 25 a right -of -way for Elm Avenue that could be built at some time in the future. The 26 Police Department asked the street name Victoria Falls be maintained. 27 MOTION 28 Douglas Pennell made a motion to approve the Recommendation to City Council of 29 agenda item PUD 07- 08- 000009 Paloma Planned Unit Development Amendment with 30 the two waivers. Michael Panczak seconded.
