THE CITY CHARTER AT ARTICLE IV. SECTION 4-1. IN ORDER TO MOVE
THE DATE OF THE 2016 MUNICIPAL ELECTION TO THE THIRD TUESDAY
OF MARCH TO COINCIDE WITH THE 2016 FEDERAL PRESIDENTIAL
PRIMARY ELECTION; FURTHER AMENDING SECTION 4-1 TO REVISE THE

THIS AMENDMENT NO . 1 is made and entered into this __ day of

Beach Gardens, a Florida municipal corporation (hereinafter referred to as "City"), whose
address is 10500 North Military Trail, Palm Beach Gardens, Florida 33410, and
Advanced Data Processing, Inc., dba lntermedix, a Florida corporation (hereinafter
referred to as "Contractor"), whose principal address is 6451 North Federal Highway,
Suite 1000 , Fort Lauderdale, Florida 33308.
WHEREAS, the City executed an Agreement with the Contractor, under Request
for Proposals No. RFP2012-004FR, for the provision of Emergency Medical Services-
Third-Party Billing and Reporting Services; and
WHEREAS, the Agreement became effective on August 9, 2012 , and expires on
July 31 , 2015, with an option to renew for an additional two (2) years at the City 's sole
discretion ; and
WHEREAS, in accordance with Section 3.28 of the RFP , the City and the
Contractor may mutually amend and modify the Agreement.
NOW, THEREFORE , in consideration of the mutual covenants and promises
hereafter set forth , the Contractor and the City agree to amend the Agreement as follows:
1. The City and the Contractor agree to renew the Agreement for an additional
two (2) years , effective August 1, 2015, and expiring July 31 ,2017 .
2 . The City and the Contractor agree that as of the effective date of this
Amendment the Contractor shall no longer provide EMS reporting services to
the City under the Agreement. The City shall exercise its discretion and right
to contract for EMS reporting services elsewhere .

W HEREAS , the City wishes to retain the services of Wagner to serve as the City 's
Code Enforcement Special Magistrate .
NOW, THEREFORE , in consideration of the promises , mutual covenants , conditions ,
provisions , and undertakings herein contained , and for other good and valuable
consideration , the parties do mutually covenant and agree with each other as follows :
SECTION 1. DUTIES
A. Wagner shall serve as the City 's Code Enforcement Special Magistrate at all
scheduled Code Enforcement hearings in accordance with Chapter 2 , Article IV,
Div ision 1 of the City's Code of Ordinances and shall devote such time as is
necessary to perform the duties therein .
B. Wagner shall exercise all authority granted by Section 2-213 of the City 's Code of
Ordinances .
SECTION 2 . TERMS AND TERMINATION
A. This Agreement shall remain in effect for a period of three (3 ) years , unless
terminated earlier.
B. This Agreement may be terminated at any time by either party , for any or no
reason , by serving notice on the other party in accordance with Section 5 herein .
Such notice shall be effective on the day it is delivered or mailed .
C. In the event of termination , Wagner will be compensated for all services actually
performed prior to the date of termination .

SECTION 3. INDEPENDENT CONTRACTOR

Agreement for Special Magistrate Services
A. The parties acknowledge and agree that the City is retaining Wagner as an
independent contractor , and Wagner shall not, for any purpose, be considered a
City employee. The parties stipulate that this Agreement is not an employment
contract and does not create an employer/employee or principal/agent relationship ,
nor will such a relationship be created by reason of Wagner's performance of the
services herein specified .
B. Wagner is responsible for providing a professional service, and Wagner will be
solely responsible for all payroll taxes, including , but not limited to, federal income
tax, FICA, and federal and state unemployment taxes. Wagner will be responsible
for the filing of an IRS Form 1099 and the payment of applicable self-employment
taxes.
SECTION 4. COMPENSATION
A. As compensation for performing the services contemplated by this Agreement, the
City will pay Wagner the sum of One Hundred Fifty Dollars ($150.00) for each hour
worked .
B. The City shall pay Wagner on a monthly basis, upon receipt of an invoice detailing
all services performed and the amount of time expended to the nearest one-tenth
( 1/1 0) of an hour.
SECTION 5. NOTICES
A. All written notices required under, or contemplated by, this Agreement shall be
hand delivered , telecommunicated , mailed by certified mail, return receipt

SECTION 6. GENERAL PROVISIONS

Agreement for Special Magistrate Services
A. This Agreement shall constitute the entire understanding between the parties and
shall be modified and amended only in writing and executed with the same
formalities as the original.
B. If any provision, or any portion thereof, contained in this Agreement is held to be
unconstitutional, invalid , or unenforceable, the remainder of this Agreement, or
portion thereof, shall be deemed severable, shall not be affected , and shall remain
in full force and effect.
C . This Agreement may not be assigned without the prior written consent of all parties
to this Agreement.

designed to boost the spirits of hospitalized kids; and
WHEREAS, Kay/a is the founder and Chief Kid Officer of Kay/a Cares 4 Kids, a non-profit
organization that collects and distributes entertainment items for hospitalized children; and
WHEREAS, Kay/a, recently completed 7th grade in Palm Beach Gardens, Florida, and was named the
winner of the National Young Entrepreneurs Academy (YEA!) Saunders Scholarship competition, beating out
five other finalists invited to pitch their businesses to a panel ofjudges at the U.S. Chamber of Commerce's
America's Small Business Summit in Washington, DC; and
WHEREAS, Kay/a won over judges with her business plan for Kay/a Cares 4 Kids, a non-profit
organization that collects and donates entertainment and educational materials, such as DVDs and video
games, to hospitals; and
WHEREAS, what began as a single collection of 100 DVDsfor a Miami hospital has blossomed into a
major enterprise, with more than 8,300 DVDs, books, video games and electronics collected and donated to
hospitals, medica/facilities and Ronald McDonald Houses in 45 states since 2013; and
WHEREAS, she learned valuable business skills in building the non-profit through the YEA! Chapter
sponsored by the Northern Palm Beach Chamber of Commerce. YEA! is supported by the U.S. Chamber of

BACKGROUND: Section 4-1 of the City Charter establishes the date for City municipal
elections as the second Tuesday of March and the fourth Tuesday of March for any
necessary runoff election in the calendar year of 2016.
In March 2015, the Florida Legislature established the date of the Federal Presidential
Preference Primary (PPP) as the third Tuesday of March-March 15, 2016. Governor
Scott has approved and signed the date into law.
Though moving the dates of the City's 2016 municipal election requires an amendment to
Article IV, Section 4-1 fthe City Charter, Sections 100.3605, 101 .75, and 166.021 , Florida
Statutes, permits the City to amend its Charter in order to change the date of its municipal
election and associated qualifying period by ordinance and without referendum.
In an April10, 2015 memorandum to the Municipal Clerks of Palm Beach County, Susan
Bucher, Palm Beach County Supervisor of Elections (SOE) is requiring all municipalities to
move their municipal election date to March 15, 2016 to coincide with the federal
Presidential Primary election.
Ms. Bucher has informed us that the voting equipment currently used by the elections
office only allows input of one election cycle at a time. Holding elections one week apart
would not allow enough time for Ms. Bucher to perform the tasks required by law preceding
each election, i.e. programming voting machines, arranging the translation of ballots,
preparing absentee ballots and sample ballots, delivery and pick up of voting equipment,
preparing precinct scanners and ADA equipment and tabulation of the final election results.

19 WHEREAS, Article IV, Section 4-1 of the City Charter establishes the date for City
20 municipal elections as the second Tuesday of March of each year in which there is a City
21 municipal election, establishes the date for any necessary runoff election as the fourth
22 Tuesday of March, and further establishes the date for qualifying for City municipal
23 elections as the last fifteen (15) days of January in the year of the election ; and
24
25 WHEREAS, in the year 2016, the federal presidential primary election will fall on
26 the third Tuesday of March; and
27
28 WHEREAS, the City Council desires to move the City's 2016 municipal election to
29 the third Tuesday of March in order to coincide with the federal presidential primary
30 election, and to adjust the dates for the associated qualifying period and any necessary
31 runoff election accordingly; and

33 WHEREAS, moving the dates of the City's 2016 municipal election , qualifying
34 period , and runoff election requires an amendment to Article IV. Section 4-1. of the City
35 Charter; and
36
37 WHEREAS, Sections 100.3605, 101 .75, and 166.021, Florida Statutes, permit the
38 City to amend its Charter in order to change the date of its municipal election and
39 associated qualifying period by ordinance and without referendum ; and
40
41 WHEREAS, the City Council deems approval of this Ordinance to be in the best
42 interest of the health, safety, and welfare of the residents and citizens of the City of Palm
43 Beach Gardens.

1 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
2 OF PALM BEACH GARDENS, FLORIDA that:

4 SECTION 1. The foregoing facts and recitals set forth hereinabove are hereby
5 adopted and incorporated by reference as if fully set forth herein.

7 SECTION 2. The Charter of the City of Palm Beach Gardens, Florida is hereby
8 amended at Article IV. Section 4-1 . Election; terms, general elections; filing fees; notice;
9 runoff elections. in order to change the date of the 2016 municipal election to the third
10 Tuesday of March to coincide with the federal presidential primary election , and to revise
11 the dates for the associated qualifying period and any necessary runoff election; providing
12 that Section 4-1 . shall hereafter read as follows:

14 ARTICLE IV: THE CITY COUNCIL

16 Section 4-1. Election; terms, general elections; filing fees; notice; runoff elections.
17
18 The elective officers under this Charter shall be the five (5) members of the city
19 council. The selection of members of the city council shall be by groups to be known as
20 Groups 1, 2, 3, 4 and 5. The council members in Groups 2 and 4 shall, in the year 1977,
21 be elected for a term of three (3) years, and for three-year terms thereafter; council
22 members in Groups 1, 3 and 5 shall be elected for a term of three (3) years in the year
23 1978 and for three-year terms thereafter. The term of office of council members shall
24 commence on the first regularly scheduled meeting of the city council following date of
25 their election and shall continue for three (3) years thereafter until their successors are
26 elected and qualified . No individual shall be elected to the office of council member for
27 more than two (2) consecutive full terms. Service in a term of office which commenced
28 prior to the effective date of any term limit enacted on council members will be credited
29 against any term limitation approved by the Palm Beach Gardens' electorate.

31 General elections shall be held on the second Tuesday of March. except in year 2016.
32 when the election shall be held on the third Tuesday of March to coincide with the federal
33 presidential primarv. Any candidate seeking election as council member shall file with
34 the city clerk a written notice to such effect during the last fifteen (15) calendar days of
35 January in the year of the election, except in the year 2016. when the written notice shall
36 be filed during the last fifteen (15) days of November, 2015, and shall pay such filing fee
37 as shall be set by ordinance. Such notice shall state the number of the group to which he
38 or she seeks to be elected, and any other data required by ordinance. All candidates and
39 council members shall be electors of the city. Whenever a general or special election is
40 held to fill any elective office in the City of Palm Beach Gardens, the candidate receiving
41 a majority of the votes cast at such election to fill such office shall be declared to be duly
42 elected ; provided that in the event no candidate for a particular elective office shall receive
43 a majority of the votes cast for such election to fill such office, then a runoff election shall
44 be held on the fourth Tuesday in March of the same calendar year said general election
45 was held. except for the year 2016, when any required runoff election shall be held on
46 the fifth Tuesday of March; and in the event a special election is held, and a runoff election

1 is required, then said runoff election shall be held two (2) weeks from date of said original
2 special election; provided further, that in such event only the names of the two (2)
3 candidates having received the greatest number of votes in the general or special election
4 for such office shall be submitted to the voters and the one of these two (2) receiving the
5 majority number of votes in such runoff election shall be declared to be duly elected to
6 such office; provided further, that should two (2) or more candidates receive an equal
7 number of votes to any such office, so that it cannot be determined which two (2) had
8 received the greatest and the next greatest number of votes, then the names of all such
9 candidates shall be submitted at the runoff election and the candidate receiving the
10 greatest number of votes at such election shall be declared elected to such office,
11 regardless of whether such candidate received a majority of the votes cast to fill such
12 office at such runoff election.

14 SECTION 3. All ordinances or parts of ordinances in conflict be and the same are
15 hereby repealed.

17 SECTION 4. Should any section or provision of this Ordinance or any portion
18 thereof, any paragraph, sentence, or word be declared by a court of competent jurisdiction
19 to be invalid, such decision shall not affect the validity of the remainder of this Ordinance.

21 SECTION 5. Specific authority is hereby given to codify this Ordinance.

23 SECTION 6. This Ordinance shall become effective immediately upon adoption.

The Florida Legislature has changed the date of the Presidential Preference Primary to March 15, 2016.
I have been asked to provide documentation regarding the need to change Municipal Elections in 2016 to
the Presidential Preference Primary Election date of March 15, 2016.
The voting equipment currently utilized by the Palm Beach County Supervisor of Elections Office only allows
input of one election cycle at a time; from beginning of preparation of the ballot, through final election
results. Therefore, the voting system will not be available to conduct Municipal Elections on the usual
second Tuesday in March, known as the Uniform Municipal Election Date.
As a result of current state and federal laws that require overseas and military absentee ballots to be
mailed 45 days prior to state or federal elections, we will need to prepare ballots and have our first large
mailing of ballots preprinted as soon as the law requires the state to provide the names of the Presidential
Preference Primary candidates. F.S. 103.101(3} requires the Department of State to certify to each
supervisor the name of each candidate for political party nomination to be printed on the ballot no later
than 12/15/15; therefore, the deadline for municipal candidate names will also be on 12/15/15. If your
municipality intends to have ballot questions on the ballot, the deadline to provide the language for ballot
questions to the supervisor will be 12/11/15, so that we may provide time for the ballot language to be
interpreted, as required by law.
In accordance with F.S . 101.75, the law allows the governing body of a municipality, by ordinance, to move
the date of any municipal election, to change the dates for candidate qualifying and the term of office for
any elected municipal official to a date concurrent with any statewide or countywide election, as provided
by relevant municipal charter or ordinance.
I have provided the attached calendar of dates and copies of the laws for your review. If I may provide any
additional information, please do not hesitate to contact me.

(1) Each political party other than a minor political party shall, at the presidential preference
primary, elect one person to be the party's candidate for nomination for President of the United States
or select delegates to the party's national nominating convention, as provided by party rule. The
presidential preference primary shall be held in each year the number of which is a multiple of 4 on the
first Tuesday that the rules of the major political parties provide for state delegations to be allocated
•without penalty. Any party rule directing the vote of delegates at a national nominating convention shall . . . . .
reasonably reflect the results of the presidential preference primary, if one is held.
(2) By November 30 of the year preceding the presidential preference primary, each political party
shall submit to the Secretary of State a ·ust of its presidential candidates to be placed on the
presidential preference primary ballot or candidates entitled to have delegates appear on the
presidential preference primary ballot. The Secretary of State shall prepare and publish a list of the
names of the presidential candidates submitted not later than on the first Tuesday after the first
Monday in December of the year preceding the presidential preference primary. The Department of
State shaH immediately notify each presidential candidate listed by the Secretary of State. Such
notification shall be in writing, by registered mail, with return receipt requested.
(3) A candidate's name shall be printed on the presidential preference primary ballot unless the
candidate submits to the Department of State, prior to the second Tuesday after the first Monday in
December of the year preceding the presidential preference primary, an affidavit stating that he or she
is not now, and does not presently intend to become, a candidate for President at the upcoming
nominating convention. If a candidate withdraws pursuant to this subsection, the Department of State
shall notify the state executive committee that the candidate's name will not be placed on the ballot.
The Department of State shalL no later than the third Tuesday after the first Monday in December of
the year preceding the presidential preference primarf, certify to each supervisor of elections the name
of each candidate for political party nomination to be printed on the ballot.
(4) The names of candidates for political party nominations for President of the United States shall
be printed on official ballots for the presidential preference primary election and shall be marked,
counted, canvassed, returned, and proclaimed in the same manner and under the same conditions , so
far as they are applicable, as in other state elections. If party rule requires the delegates' names to be
printed on the official presidential preference primary ballot, the name of the presidential candidates
for that political party may not be printed separately, but the ballot may reflect the presidential
candidate tQ whom the delegate is pledged. If , however, a political party has only one presidential
candidate, neither the name of the candidate nor the names of the candidate's delegates shall be

printed on the ballot.
(5) The state executive committee of each party, by rule adopted at least 60 days prior to the
presidential preference primary election, shall determine the number, and establish procedures to be
followed in the selection, of delegates and delegate alternates from among each candidate's
supporters. A copy of any rule adopted by the executive committee shall be filed with the Department
of State within 7 days after its adoption and shall become a public record. The Department of State shall
review the procedures and shall notify the state executive committee of each political party of any
ballot limitations.
(6) All names of candidates or delegates shall be listed as directed by the Department of State.

101.75 Municipal elections; change of dates for cause.-
{1) In any municipality, when the date of the municipal election falls on the same date as any
statewide or county election and the voting devices of the voting system used in the county are not
available for both elections, the municipality may provide that the municipal election may be held
within 30 days prior to or subsequent to the statewide or county election.
(2} The date of the municipal election shall be set by the municipality by ordinance.
(3) Notwithstanding any provision of local law or municipal charter, the governing body of a
municipality may, by ordinance, move the date of any municipal election to a date concurrent with any
statewide or countywide election. The dates for qualifying for the election moyed by the passage of
such ordinance shall be specifically provided for in the ordinance. The term of office for any elected
municipal offfcial shall commence as provided by the relevant municipal .charter or ordinance.

BACKGROUND: Section 4-1 of the City Charter establishes the date for City municipal
elections as the second Tuesday of March and the fourth Tuesday of March for any necessary
runoff election in the calendar year of 2016 .
In March 2015 , the Florida Legislature established the date of the Federal Presidential
Preference Primary (PPP) as the third Tuesday of March -March 15 , 2016. Governor Scott
has approved and signed the date into law.
Though moving the dates of the City's 2016 municipal election requires an amendment to
Article IV, Section 4-1 f the City Charter, Sections 100 .3605 , 101 .75, and 166.021 , Florida
Statutes, permits the City to amend its Charter in order to change the date of its municipal
election and associated qualifying period by ordinance and without referendum .
In an April 10, 2015 memorandum to the Municipal Clerks of Palm Beach County , Susan
Bucher, Palm Beach County Supervisor of Elections (SOE) is requiring that all municipalities
change the dates of their candidate qualifying in order for her to meet the statutory
requirements for mailing overseas and military absentee ballots .
The Supervisor of Elections has set the PPP calendar as follows:

Our current qualifying dates for the Alternative Method (Petition) and Filing Fee Method would
not allow the SOE to be within the required timeline for sending overseas or domestic ballots,
therefore, the following qualifying periods are proposed for consideration.
Section 26-24 Alternative Method of Qualifying:
Current Filing Requirements:
• Any time after the first Monday in December of the year prior to the year in which the
election is to be held, but prior to noon on the second Monday of January of the year in
which the election is to be held .
Current Dates:
• Begins Monday, December 7 , 2015 at 8:00a.m. (first Monday)
• Ends Monday, January 11 ,2016 prior to Noon (second Monday)
Proposed Filing Requirements:
• Any time on or after the third Tuesday in September 2015, but prior to noon on the
second Monday in October 2015.
• Proposed Dates:
• Begins Tuesday, September 15, 2015 at 8:00 a.m. (third Tuesday)
• Ends Monday, October 12, 2015 prior to Noon (second Monday)
Each candidate shall submit the petitions for verification to the city clerk no later than noon of
the 35th day preceding the first day of qualifying (October 12, 2015).

5 WHEREAS, Sections 100.3605, 101 .75, and 166.021 , Florida Statutes, permit the
6 City to amend its Charter in order to change the date of its municipal election and
7 associated qualifying periods by ordinance and without referendum , which was
8 accomplished by Ordinance 7 , 2015; and

10 WHEREAS, adoption of this Ordinance is required in order to conform to the
11 requirements of the City's Charter; and

13 WHEREAS, the City Council deems approval of this Ordinance to be in the best
14 interest of the health, safety , and welfare of the residents and citizens of the City of Palm
15 Beach Gardens.

21 SECTION 1. The foregoing facts and recitals set forth hereinabove are hereby
22 adopted and incorporated by reference as if fully set forth herein .

31 (a) A person may qualify as a candidate for city council in accordance with section 26-
32 3 during the last 15 days of the month of January next preceding a city general election
33 no later than 4:30 p.m . of the last day of such qualifying period , provided , that if such day
34 falls on a Saturday, Sunday or city holiday , then the filing date shall be extended to 4:30
35 p.m. the next full business day. except in year 2016. when such qualifying shall take place
36 during the last fifteen (15) days of November. subject to the same contingencies as set
37 forth hereinabove.

39 (b) The candidate shall not be required to appear in person before the city clerk in
40 order to qualify as a candidate. An agent of the candidate so designated in writing may
41 present to the clerk all required documents and filing fee on behalf of the candidate during
42 the qualifying period .

SECTION 3. Chapter 26. Elections is hereby amended by repealing Section 26-6.
Calling of election. in order to change the date of the 2016 municipal election to the third
Tuesday of March to coincide with the federal presidential primary election and to change
the dates for any necessary runoff election; providing that Section 26-6. shall hereafter
read as follows:
Sec. 26-6. Calling of election.
(a) City general elections shall be held on the second Tuesday of March. except in
year 2016. when the election shall be held on the third Tuesday of March to coincide with
the federal presidential primarv.
(b) Whenever a general or special election is held to fill any elective office in the city,
the candidate receiving a majority of the votes cast at such election to fill such office shall
be declared to be duly elected; provided that if no candidate for a particular elective office
shall receive a majority of the votes cast for such election to fill such office, then a runoff
election shall be held on the fourth Tuesday in March of the same calendar year the
general election was held; and in the event a special election is held, except for the year
2016. when any required runoff election shall be held on the fifth Tuesday of March, and
a runoff election is required, then the runoff election shall be held two weeks from date of
the original special election; provided further, that in such event only the names of the two
candidates having received the greatest number of votes in the general or special election
for such office shall be submitted to the voters and the one of these two receiving the
majority number of votes in such runoff election shall be declared to be duly elected to
such office; provided further that should two or more candidates receive an equal number
of votes to any such office, so that it cannot be determined which two had received the
greatest and the next greatest number of votes, then the names of all such candidates
shall be submitted at the runoff election and the candidate receiving the greatest number
of votes at such election shall be declared elected to such office, regardless of whether
such candidate received a majority of the votes cast to fill such office at such runoff
election.
(c) Upon a vacancy in the office of the city council, a special election, if required to fill
such vacancy, shall be established by resolution of the council. The date of election, the
qualifying period and notice of requirements pertaining to such election shall be set forth
therein.
SECTION 4. Chapter 26. Elections is hereby amended at Section 26-24.
Alternative method of qualifying. by repealing subsections (c) and (f) in order to revise the
period for qualifying by alternative method for the 2016 municipal election and readopting
same, as revised; providing that Section 26-24. shall hereafter read as follows:

(a)-(b) These subsections shall remain in full force and effect as previously
adopted.

1 (c) The notice of intent to qualify alternatively, and the oath if applicable, shall be filed
2 at any time after the first Monday in December of the year prior to the year in which the
3 election is to be held, but prior to noon on the second Monday of January of the year in
4 which the election is to be held. except for the election held in the year 2016. such notice
5 shall be filed at any time on or after the third Tuesday in September 2015. but prior to
6 noon on the second Monday in October 2015. The city clerk shall prescribe the form to
7 be used in the notice of intent.

9 (d)-(e) · These subsections shall remain in full force and effect as previously
10 adopted.

12 (f) Each candidate shall submit the petitions for verification to the city clerk no later
13 ·than noon of the .:t-()tR35th day preceding the first day of qualifying . The city clerk shall
14 cause the signatures to be verified as to their status as electors of the city. Upon rece ipt
15 of verification from the supervisor of elections, the city clerk shall notify each cand idate of
16 the status of.his or her petition. If the required number of signatures has been obtained,
17 the candidate shall, during the time prescribed for qualifying for office , submit a copy of
18 such notice and file his or her qualifying papers and oath with the city clerk. The candidate
19 shall reimburse the city provide a check made payable to the Palm Beach Countv
20 Supervisor of Elections for the cost of verification of the electors' signatures.

22 (g) This subsection shall remain in full force and effect as previously adopted.

24 SECTION 5. All ordinances or parts of ordinances in conflict be and the same are
25 hereby repealed.

27 SECTION 6. Should any section or provision of this Ordinance or any portion
28 thereof, any paragraph , sentence, or word be declared by a court of competent jurisdiction
29 to be invalid, such decision shall not affect the validity of the remainder of this Ordinance.

31 SECTION 7. Specific authority is hereby given to codify this Ordinance.

33 SECTION 8. This Ordinance shall become effective immediately upon adoption.

The Florida Legislature has changed the date of the Presidential Preference Primary to March 15, 2016.
I have been asked to provide documentation regarding the need to change Municipal Elections in 2016 to
the Presidential Preference Primary Election date of March 15, 2016.
The voting equipment currently utilized by the Palm Beach County Supervisor of Elections Office only allows
input of one election cycle at a time; from beginning of preparation of the ballot, through final election
results. Therefore, the voting system will not be available to conduct Municipal Elections on the usual
second Tuesday in March, known as the Uniform Municipal Election Date.
As a result of current state and federal laws that require overseas and military absentee ballots to be
mailed 45 days prior to state or federal elections, we will need to prepare ballots and have our first large
mailing of ballots preprinted as soon as the law requires the state to provide the names of the Presidential
Preference Primary candidates. F.S. 103.101(3) requires the Department of State to certify to each
supervisor the name of each candidate for political party nomination to be printed on the ballot no later
than 12/15/15; therefore, the deadline for municipal candidate names will also be on 12/15/15. If your
municipality intends to have ballot questions on the ballot, the deadline to provide the language for ballot
questions to the supervisor will be 12/11/15, so that we may provide time for the ballot language to be
interpreted, as required by law.
In accordance with F.S.101.75, the law allows the governing body of a municipality, by ordinance, to move
the date of any municipal election, to change the dates for candidate qualifying and the term of office for
any elected municipal official to a date concurrent with any statewide or countywide election, as provided
by relevant municipal charter or ordinance.
I have provided the attached calendar of dates and copies of the laws for your review. If I may provide any
additional information, please do not hesitate to contact me.

(1) Each political party other than a minor political party shall, at the presidential preference
primary, elect one person to be the party's candidate for nomination for President of the United States
or select delegates to the party's national nominating convention, as provided by party rule. The
presidential preference primary shall be held in each year the number of which is a multiple of 4 on the
first Tuesday that the rules of the major political parties provide for state delegations to be allocated
·without penalty. Any party rule directing the vote of delegates at a national nominating convention shall
reasonably reflect the results of the pres.idential preference primary, if one is held.
(2) By November 30 of the year preceding the presidential preference primary, each political party
shall submit to the Secretary of State a Ust of its presidential candidates to be placed on the
presidential preference primary ballot or candidates entitled to have delegates appear on the
presidential preference primary ballot. The Secretary of State shall prepare and publish a list of the
names of the presidential candidates submitted not later than on the first Tuesday after the first
Monday in December of the year preceding the presidential preference primary. The Department of
State shall immediately notify each presidential candidate listed by the Secretary of State. Such
notification shall be in writing, by registered mail, with return receipt requested.
(3) A candidate's name shall be printed on the presidential preference primary ballot unless the
candidate submits to the Department of State, prior to the second Tuesday after the first Monday in
December of the year preceding the presidential preference primary, an affidavit stating that he or she
is not now, and does not presently intend to become, a candidate for President at the upcoming
nominating convention. If a candidate withdraws pursuant to this subsection, the Department of State
shall notify the state executive committee that the candidate's name will not be placed on the ballot.
The Department of State shalL no later than the third Tuesday after the first Monday in December of
the year preceding the presidential preference primary, certify to each supervisor of elections the name
of each candidate for political party nomination to be printed on the ballot.
(4j The names of candidates for political party nominations for President of the United States shall
be printed on official ballots for the presidential preference primary election and shall be marked,
counted, canvassed, returned, and proclaimed in the same manner and under the same conditfons, so
far as they are applicable, as in other state elections. If party rule requires the delegates' names to be
printed on the official presidential preference primary ballot, the name of the presidential candidates
for that political party may not be printed separately, but the ballot may reflect the presidential
candidate tQ whom the delegate is pledged. If, however, a political party has only one presidential
candid ate, neither the name of the candidate nor the names of the candidate's delegates shall be

printed on the ballot.
(5) The state executive committee of each party, by rule adopted at least 60 days prior to the
presidential preference primary election, shall determine the number, and establish procedures to be
followed in the selection, of delegates an d delegate alternates from among each candidate's
s up porters. A copy of any rule adopted by the executive committee shall be filed with the Department
of State within 7 days after its adoption and shall become a public record. The Department of State shall
review the procedures and shall notify the state executive committee of each political party of any
ballot limitations.
(6) All names of candidates or delegates shall be listed as directed by the Department of State.

101.75 Municipal elections; change of dates for cause.-
{1) In any munkipality, when the date of the munidpal election falls on the same date as any
statewide or county election and the voting devices of the voting system used in the county are not
available for both elections, the municipality may provide that the municipal election may be held
within 30 days prior to or subsequent to the statewide or county election.
(2) The date of the municipal election shall be set by the municipality by ordinance.
(3) Notwithstanding any provision of local law or municipal charter, the governing body of a
municipality may. by ordinance, move the date of any municipal election to a date concurrent with any
statewide or countywide election. The dates for qualifying for the election moyed by the passage of
such ordinance shall be specifically provided for in the ordinance. The term of office for any elected
municipal official shalt commence as provided by the relevant municipal .charter or ordinance.

BACKGROUND: After posting the recently approved budget amendments, which
adjusted October 1, 2014 budgeted fund balances to actual audited amounts, the General
Fund Budget Stabilization Reserve account totals $5,918,310 , which is an increase of
approximately $3.5 million from the inception of the account in 2011 . As you remember,
this account was initially funded with the transfer of $2.4 million dollars from the Series
2003 Debt Service Reserve Fund which was eliminated when the Series 2003 Bonds
were refinanced in 2011 . The growth of this account provides the City with a unique
opportunity to augment and accelerate investments in City infrastructure and pay down
some of the City's existing debt, while still maintaining adequate reserves. These areas
of opportunity include the Police Tactical Training Facility, Golf Course Clubhouse, City
Park, and pension unfunded liabilities. A discussion of each of these items , and staff's
recommendation , follows:
• A review of the recently completed design criteria package for the Police Tactical
Training Facility indicates that the total cost to construct the facility is approximately
$3,005,000 . This amount includes all necessary planning, design, construction ,
site work, equipment and fixtures. The current FY 2015 budget appropriated
$1 ,880 ,000 million for this project. In order to move forward with a contract, staff
recommends transferring $550,000 from Law Enforcement Confiscated Funds and
$575,000 from Budget Stabilization Reserves to this project, increasing the current
year appropriation to $3,005,000 .
• In addition to the Police Tactical Training Facility, staff has been working on
refining the cost estimates for the Golf Course Clubhouse. The first phase of this
project is being funded with $1,300,000 that was appropriated in FY 2015. From
this allocation , $1,264,974 has been identified for items such as design , planning,
sewer, parking/lighting , FPL upgrade/connections, demolition and other various
site work. In addition to these costs, staff recently received the design criteria
package with preliminary construction cost estimates of $4,623,570 million. When
adding this cost to the $1,264,974 planning , design, and site work costs, the total
estimated cost of the project is $5,888,544 . Of this amount, $1 ,300,000 is
available in FY 2015, leaving a balance of $4,588,544 needed to complete
construction . In looking at the current Recreation Impact Fund Five (5) -Year
Capital Improvement Plan (CIP), $2,300,000 is allocated to this project in FY 2016.
This would leave a remaining balance of $2,288,544 required to fully fund the
estimated cost. In order to optimize the use of the Budget Stabilization Reserves,
and to provide full funding for this project so that a contract could be awarded in
October of this year, staff recommends transferring $2,288,544 from Budget
Stabilization Reserves to the Golf Course Clubhouse CIP project in FY 2015.

• In order to accelerate the completion of all phases of renovations at City Park ,
including two (2) illuminated multi -purpose fields , bike trail , pav ilion , restrooms,
maintenance building , playground expansion , and landscaping , staff is
recommending a transfer of $1,200 ,000 from Budget Stabilization Reserves to the
City Park CIP project in FY 201 5. This project is currently be i ng funded over
several years using Recreation Impact Fees, with scheduled completion of all
phases in FY 2018 . The proposed transfer this year will provide full funding so
that construction can begin immediately after adoption of the budget amendment,
and be completed next fiscal year .
• In addition to capital projects , staff has been reviewing other areas to maximize
and leverage the use of Budget Stabilization Reserves . One such use is to pay
down outstanding debt. Although there are currently no bonds that are callable ,
the largest single debt of the City , public safety unfunded liabilities , requires no
such provision , and , accordingly , can be prepaid at any time.
In reviewing the most recent actuarial valuations, the unfunded liabilities of the
Plans total $39 .1 million ($23.4 for Police , and $15.7 for Fire ), while the funded
ratios are 7 1% and 77% for Police and Fire, respectively . The annual payments
to amortize the unfunded liabilities in 2016 total $1 ,392 ,761 ($601,407 for Police ,
and $791 ,354 for Fire ). In order to accelerate the City 's goal to achieve a minimum
of 80% funding for each plan , staff is recommending that $1 ,392 ,761 be transferred
from Budget Stabilization Reserves , and used to pay towards the unfunded
liabilities of the Police and Fire Pension Plans in FY 2015.
Summary of Impacts on General Fund Budget Stabilization Reserve Fund
T o summarize , the recommended transfers contained in Ordinance 10 , 2015, which
impact General Fund Budget Stabilization Reserves , include the following :
1. Supplemental appropriation for Golf Course Clubhouse
2. Additional payment towards unfunded public safety liabilities
3. Supplemental appropriation for City Park
4. Supplemental appropriation for Police Tactical Training Facility

1. Ballenisles -$11 ,500 for a Life Fire Simulator
2. Frenchman 's Creek -$10 ,000 for digital combustion equipment and software for
the Fire Department
3. Intergovernmental revenue of $11,664 for add-on module for OSSI System for
PBC Court Interface for citations
CITY COUNCIL : On June 4, 2015, the City Council approved Ordinance 10 , 2015 on first
reading by a vote of 5 to 0 .
STAFF RECOMMENDATION : Staff recommends approval of Ordinance 10 , 2015 as

BACKGROUND: The City is required to file with the County Property Appraiser and Tax
Collector a proposed millage rate that will be sent out on the Notice of Proposed Taxes
in August. The proposed operating millage rate is 5.67 , and debt service is .1375, for a
total millage of 5.8075 , which is less than the current year total rate of 5.8315.
Once the tentative millage is filed with the County, these rates can be lowered at the
budget hearings, but they cannot be increased .
The detailed proposed line-item budget will be distributed to Council and the Budget
Oversight Committee under separate cover .
In addition , the County needs to be notified of the date , time , and place of the City 's first
public budget hearing . These dates cannot conflict with the scheduled hearings of the
Board of County Commissioners (BCC) and the School Board . We have been advised
by the BCC and School Board of the following dates for their hearings :
• BCC : September 8 and September 21 , 2015
• School Board : July 29 and September 9 , 2015
In order to conform to the timetable required by the State TRIM process , the first public
hearing cannot be held earlier than September 3 . Therefore , staff recommends the first
public hearing be held on September 10, 2015.
STAFF RECOMMENDATION: Staff recommends approval of Resolution 27 , 2015 as
presented .

12 WHEREAS, the City Council of the City of Palm Beach Gardens , Florida must
13 determine a proposed millage rate within 35 days of July 1, as required by Section
14 200 .065, Florida Statutes; and

16 WHEREAS, the City Council must set the time, date , and place of the first public
17 hearing on the budget within 35 days of July 1, as required by Section 200 .065, Florida
18 Statutes; and

20 WHEREAS, the City Council must notify the County Property Appraiser of the
21 proposed millage rate and the time, date, and place of the first public hearing on the
22 Fiscal Year 2015/2016 Budget within 35 days of July 1, 2015; and

24 WHEREAS, the City Council deems approval of this Resolution to be in the best
25 interest of the health , safety, and welfare of the residents and citizens of the City of
26 Palm Beach Gardens and the public at large.

WHEREAS, Kay/a Abramowitz, a 13-year-oldfrom southeast Florida was honored June 9, 2015 for
her entrepreneurial spirit, securing $30,000 in college scholarships after presenting plans for a non-profit
designed to boost the spirits of hospitalized kids; and
WHEREAS, Kay/a is the founder and Chief Kid Officer of Kayla Cares 4 Kids, a non-profit
organization that collects and distributes entertainment items for hospitalized children; and
WHEREAS, Kay/a, recently completed 7th grade in Palm Beach Gardens, Florida, and was named the
winner of the National Young Entrepreneurs Academy (YEA!) Saunders Scholarship competition, beating out
five other finalists invited to pitch their businesses to a panel of judges at the US. Chamber of Commerce's
America's Small Business Summit in Washington, DC; and
WHEREAS, Kayla won over judges with her business plan for Kayla Cares 4 Kids, a non-profit
organization that collects and donates entertainment and educational materials, such as D VDs and video
games, to hospitals; and
WHEREAS, what began as a single collection of 100 DVDsfor a Miami hospital has blossomed into a
major enterprise, with more than 8,300 DVDs, books, video games and electronics collected and donated to
hospitals, medical facilities and Ronald McDonald Houses in 45 states since 2013; and
WHEREAS, she learned valuable business skills in building the non-profit through the YEA! Chapter
sponsored by the Northern Palm Beach Chamber of Commerce. YEA! is supported by the US. Chamber of
Commerce Foundation and Sam's Club; and
WHEREAS, Kay/a's persona/life experience dealing with health issues motivated her to bring comfort
to other children facing similar challenges; and
WHEREAS, Kay/a has received numerous honors for her charitable work, including but not limited to:
