BACKGROUND: Highway Beautification Grants for landscaping and irrigation are available
through the Florida Department of Transportation (FOOT) along state roadways annually. Grant
applications are due by October 1st each year. The maximum grant amount differs from year to
year depending upon the legislative appropriation. For fiscal year 2015-2016, the maximum
grant amount is $100,000 .00 . Matching funds are not required ; however, they are highly
suggested . The following Resolution is required as part of the grant submittal process, which
authorizes the City Manager to apply for and execute grant documents in order to expedite the
process. Grant applications are reviewed and ranked by the Florida Highway Beautification
Council on behalf of FOOT. Award notifications are transmitted in December and funding
agreements the following March . Grantees are required to maintain the project area in
perpetuity.
The next grant application that will be submitted as part of this program is State Road 811
(Alternate A1A) from Burns Road south to the City limit. Alternate A1A is highly traveled by
thousands of motorists daily. This segment of roadway is bordered by the FEC railroad tracks
on the west and residential and commercial parcels on the east. The landscaping within the
center medians is very scarce , and there is no landscaping on the western road shoulder. It has
been a desire of City staff for many years to improve this segment of roadway in order to provide
a more aesthetically pleasing entrance into the City of Palm Beach Gardens .
STAFF RECOMMENDATION: Staff recommends approval of Resolution 42 , 2015 as
presented .

12 WHEREAS, many roadside areas and median strips within Florida Department of
13 Transportation rights-of-way must be maintained and attractively landscaped ; and

15 WHEREAS, the City Council of the City of Palm Beach Gardens desires to beautify
16 and improve various rights-of-way by landscaping within the City; and
17
18 WHEREAS, the City Council of the City of Palm Beach Gardens authorizes the
19 City Manager to apply for a Highway Beautification Council Grant from the Florida
20 Department of Transportation , and if awarded , to accept the grant and enter into a
21 Highway Beautification Grant, Landscape Construction, and Maintenance Memorandum
22 of Agreement between the City and the Florida Department of Transportation ; and
23
24 WHEREAS, the City Council deems approval of this Resolution to be in the best
25 interest of the health, safety, and welfare of the residents and citizens of the City of Palm
26 Beach Gardens and the public at large.

28 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
29 OF PALM BEACH GARDENS, FLORIDA that:

31 SECTION 1. The foregoing recitals are hereby affirmed and ratified .

33 SECTION 2. The City Council of the City of Palm Beach Gardens hereby
34 authorizes the City Manager to apply for a Highway Beautification Council Grant from the
35 Florida Department of Transportation , and if awarded , to accept the grant and enter into a
36 Highway Beautification Grant, Landscape Construction , and Maintenance Memorandum of
37 Agreement between the City and the Florida Department of Transportation .

39 SECTION 3. The City Clerk of the City of Palm Beach Gardens is hereby directed
40 to send copies of this Resolution to the Florida Department of Transportation and all other
41 persons as directed by the City Council.

WHE R EA S , the National Association of Town Watch (NATW) is sponsoring a unique,
nationwide crime, drug and violence prevention program on October 9, 2015 entitled "National
Night Out "; and
WHEREAS, the "34th Annual National Night Out" provides a unique opportunity for Palm
Beach Gardens to join forces with thousands of other communities across the country in promoting
cooperative, police-community crime prevention efforts; and
WHEREAS, Palm Beach Gardens Police, Fire-Rescue, and Community Services
Departments plays a vital role through joint crime, drug and violence prevention efforts in Palm
Beach Gardens; and are supporting "National Night Out 2015" locally; and
WHEREAS, it is essential that all citizens of Palm Beach Gardens be aware of the
importance of crime prevention programs and impact that their participation can have on reducing
crime, drugs and violence in Palm Beach Gardens; and
WHEREAS, police-community partnerships, neighborhood safety, awareness and
cooperation are important themes ofthe "National Night Out" program;

WHEREAS, change is constant and affects all cities, towns, suburbs, counties, boroughs, townships, rural areas,
and other places; and
WHEREAS, community planning and plans can help manage this change in a way that provides better choices for
how people work and live; and
WHEREAS, community planning provides an opportunity for all residents to be meaningfully involved in
making choices that determine the future of their community; and
WHEREAS, the full benefits of planning requires public officials and citizens who understand, support, and
demand excellence in planning and plan implementation; and
WHEREA S , the month of October is designated as National Community Planning Month throughout the United
States of America and its territories; and
WHEREAS, The American Planning Association and its professional institute, the American Institute of Certified
Planners, endorse National Community Planning Month as an opportunity to highlight the contributions sound
planning and plan implementation make to the quality of our settlements and environment; and
WHEREA S , the celebration of National Community Planning Month gives us the opportunity to publicly
recognize the participation and dedication of the members of planning commissions and other citizen planners
who have contributed their time and expertise to the improvement of the City of Palm Beach Gardens.

16 and a debt millage rate of .1371 ; and

18 WHEREAS, on September 17 , 2015, the City Council held a public hearing in
19 accordance with Section 200.065, Florida Statutes, to adopt the final millage rate for
20 Fiscal Year 2015/2016 and the adopted millage rate is 5.6871 per $1 ,000.00 and said
21 millage rate included an operating millage rate of 5.5500 and a debt millage rate of
22 .1371 ; and

24 WHEREAS, the value of real property not exempt from taxation within the City of
25 Palm Beach Gardens, Florida has been certified by the County Property Appraiser to
26 the City Council as $9 .440 Billion ; and
27
28 WHEREAS, the City Council deems approval of this Resolution to be in the best
29 interest of the health, safety , and welfare of the residents and citizens of the City of
30 Palm Beach Gardens and the public at large.

32 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
33 OF PALM BEACH GARDENS, FLORIDA that:

35 SECTION 1. The foregoing recitals are hereby affirmed and ratified.

BACKGRO UN D: This is the second of two (2) required public hearings on the proposed
budget for Fiscal Year 2015/2016 . The total of all funds is $137 ,068,059 .
The proposed operating millage rate for Fiscal Year 2015/2016 is 5.5500 mills and a debt
service millage rate of .1371 . The proposed operating millage rate of 5.5500 is 4 .02%
above the roll-back of 5.3354. When combined , the total operating and debt service
millage rate proposed for Fiscal Year 2015/2016 is 5.6871 mills, which is 2 .5% be low the
current year combined rate of 5.8315 mills.
CITY COU NC I L: On September 10 , 2015 , the City Council approved Ordinance 12 , 2015
on first reading by a vote of 5 to 0 .
STAFF RECOMM ENDATI ON :
o Staff recommends a motion that the City of Palm Beach Gardens adopt a final
millage rate of 5.6871 mills, which includes a debt service millage rate of .1371
and an operating millage rate of 5 .5500 , which is greater than the roll-back rate of
5.3354 by 4 .02%.
o Staff recommends a motion to approve Resolution 41 , 2015 , setting the final
millage rate for Fiscal Year 2015/2016 at 5.6871 .
o Staff recommends a motion to approve Ordinance 12 , 2015 as presented on
second and final reading , adopting the budget for Fiscal Year 2015/2016 .
Please note: The proposed Fiscal Year 2015/2016 budget has been distributed to
Mayor, Council , and staff under separate cover .

18 City Council determined that the tentative budget, as finalized by the City Council, will
19 meet the needs and requirements of the City of Palm Beach Gardens and its residents for
20 Fiscal Year 2015/2016; and

22 WHEREAS, the City Council deems approval of this Ordinance to be in the best
23 interest of the health, safety , and welfare of the residents and citizens of the City of Palm
24 Beach Gardens and the public at large .

27 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
28 OF PALM BEACH GARDENS, FLORIDA that:

WHEREAS, the National Association of Town Watch (NATW) is sponsoring a unique,
nationwide crime, drug and violence prevention program on October 9, 2015 entitled "National
Night Out"; and
WHEREAS, the "34th Annual National Night Out" provides a unique opportunity for Palm
Beach Gardens to join forces with thousands of other communities across the country in promoting
cooperative, police-community crime prevention efforts; and
WHEREAS, Palm Beach Gardens Police, Fire-Rescue, and Community Services
Departments plays a vital role through joint crime, drug and violence prevention efforts in Palm
Beach Gardens; and are supporting "National Night Out 2015" locally; and
WHEREAS, it is essential that all citizens of Palm Beach Gardens be aware of the
importance of crime prevention programs and impact that their participation can have on reducing
crime, drugs and violence in Palm Beach Gardens; and

Dear Mr. Norton:
I have been advised that the City of Palm Beach Gardens is proposing to continue bargaining on September 28 or
September 29, 2015. I do not know if the City checked the availability of the Fire Department on those dates, but there
is a Lieutenant promotional examination scheduled for September 29. All but one member of Local 2928's negotition
team is sitting for that exam. Accordingly, the Union is not availabl e on either of those dates. I trust that the City's
offering of these dates was mere coincidence and not intentional.
Local 2928 wants to resolve this matter as soon as possible. Now that the Union has withdrawn its proposal for a step
plan, which was the City's primary objection to our pay proposal, we should be able to sit down and resolve all
outstanding issues . The Union is available at or after 1:30PM on Tuesday, September 15, and Wednesday, September
16. Please advise as to whether the City is available on either of those dates.

id you know that in September 2004 the then part-
time Palm Beach Gardens City Council which included some of today's part-time City Council
members (Russo, Jablin, and Levy) conveniently approved an ordinance that doubled their existing
salaries to $24,000? They also provided themselves with profitable benefits, such as, self-serving
automatic annual cost-of-living raises, and health benefits for themselves and their dependents. In recent
years lucrative retirement benefits were added to the package. All of this compensation for a part-time
job is paid for by the taxpayers. Yet the public is not afforded any input!
Per the newly proposed 2016 City budget the part-time Palm Beach Gardens Mayor and City Council will
be compensated annually as follows ...

By virtue of a City Charter change instigated by these same Council members, the part-time Palm Beach
Gardens City Council is required to meet only once per month . There may be more time spent but is it
enough to justify the above?
In addition to the salary and benefits, the 2016 budget for the City Council pays for seminars and
conferences, memberships and dues, professional services, contingencies, materials and supplies,
business cards, and so on . The total of all annual2016 budget costs for the five part-time Palm Beach
Gardens Council members to the taxpayers is ...
$462,372.00
or
$92,474.40 each
The recent September 1Oth City Council of Palm Beach Gardens was gaveled to order promptly at 7 :00
PM. The meeting was adjoined approximately two hours later. Using the above budget figures each City
Council member collects in base salary $28,564 while the ceremonial part-time Mayor collects
$31,109. To illustrate, perhaps, to the extreme, based on the City Council's schedule of one regular
meeting per month, for those two hours the taxpayers paid the City Council members in salary
only approximately $2,380.34 each, or $1 ,190.1 7 each per hour, and the Mayor approximately
$2,592.42, or $1,296.21 per hour.
The five part-time Palm Beach Gardens Council members are among the highest compensated of all
local governments in Palm Beach County. As far as I can determine, it is the only City that holds regular
meetings with the public just once per month .
Owing to the unquestionable fact that City Council members are considered part-time city employees, I
query the legality of most of the salary, retirement, health and life insurance appropriations
on their behalf. Are other part-time City employees compensated with the same extravagance? Since
when does an organization, or government, or business, or otherwise, annually pay salary of$
145,541 as proposed, retirement benefits of$ 61,097 as proposed, and health benefits $ 96,987 as
proposed, for five part-time employees that are obliged by charter to work only one day a month for
possibly 1 to 4 hours.
Are the five part-time Palm Beach Gardens Council members serving their neighbors or
feathering their own nests?

The king of conuptiOn is complaining about salaries. I guess the current council can't extort
developers in buying substandard flooring .

History te lls us the Founding Fathers volunteered their time, often at great expense to their
, families. Yes, times have changed, yet the need to belong to a community and be a part of that
community is still real. I understand a workman is worthy his hire ... for the work he has done,
however, the "workman" at PBG cc seems to have delegated their responsibilities to the
staff/employees. City taxpayers are not provided opportunity for input in decision making, before
questions are asked and answers provided. Workshop meetings would be a good place to s1art to
rebuild trust, transparency and community involvement.

No one Council person can guarantee any action of the City Council. Staff
proposals are voted on by the entire council and as of today the proposed
boulevard is slated to handle 20,000 car trips.
First remove Shady Lakes Blvd from the City Thoroughfare Plan!!

And then Councilwoman Marcie Tinsley can address a proposed PGA Blvd.

Unfortunately, Councilwoman Marcie Tinsley cannot guarantee that without
support of the entire council a nd staff.

Stop Shady Lakes Blvd added 2 new photos.

The City Tennis Center not only added more courts, eliminated the tree
buffers for their lighting, added more parking, but now is promoting the four
lane road to increase their customer base and make it more convenient for
their tennis players to access from PGA Blvd.
It seems that they are not such good neighbors!
The City and the Tennis Center need to Stop Shady Lakes Boulevard and
support the wishes of the adjacent comm unity of Shady Lakes to stop the
road to 117th Court ... See More
