INTRODUCTION
On
behalf
of
Woolbright
Development,
Inc.,
the
Applicant,
we
are
requesting
a
PUD
Amendment
for
the
commercial
portion
of
the
Gardens
East
PCD
(a.k.a.
Promenade
Shopping
Center)
to
convert
the
25,500
square
feet
of
Theater
Use
to
Retail
and
Health,
Physical
Fitness,
Weight
Reduction
and
Spa
use,
an
Amendment
to
the
Development
Order,
Resolution
44-‐87
to
simplify
the
entitlements,
and
revise
the
parking
calculations
to
be
consistent
with
the
current
City
Code
and
policies
of
the
City.
Promenade
Shopping
Center
is
located
just
north
of
the
intersection
of
Alternate
A1A
and
Lighthouse
Drive
on
the
east
side
of
Alternate
A1A
in
the
City
of
Palm
Beach

BACKGROUND
The
Promenade
Shopping
Center,
formally
known
as
Gardens
East
Plaza,
was
originally
approved
through
Resolution
44,
1987.
This
Resolution
approved
the
Gardens
East
Planned
Community
Development
(PCD).
The
PCD
included
two
parcels,
a
residential
parcel
and
commercial
parcel.
The
subject
of
this
request
is
only
for
the
commercial
portion
of
the
PCD.
The
residential
portion
of
the
PCD
includes
448
multi-‐family
dwelling
units.
The
commercial
center
was
approved
for
a
total
of
244,000
gross
square
feet.
The
shopping
center
includes
eight
outparcels
of
varying
uses.
The
uses
permitted
within
the
inline
retail
shops
are
those
uses
defined
within
the
General
Commercial
(CG-‐1)
Zoning
District.
Resolution
44,
1987
also
provided
for
restaurant
uses;
however,
a
limitation
of
a
maximum
of
709
seats
are
permitted
within
the
inline
retail
shops.
The
allowable
number
of
restaurant
seats
for
the
outparcels
were

defined
on
an
individual
basis.
The
Promenade
Shopping
Center
has
been
deemed
built-‐out
by
the
City.
The
City
issued
the
build-‐out
determination
letter
on
January
3,
2005.
LOCATION
Promenade
Shopping
Center
is
located
+/-‐
500
feet
north
of
the
intersection
of
Alternate
A1A
and
Lighthouse
Drive
on
the
east
side
of
Alternate
A1A
in
the
City
of
Palm
Beach
Gardens,
Florida.
The
total
PCD
is
+/-‐76.67
acres.
The
commercial
portion
of
the
PCD
is
approximately
+/-‐
32.25
acres
in
size.
LAND
USE
&
ZONING
The
property
has
a
land
use
designation
of
Commercial
(C).
The
zoning
designation
of
the
property
is
PCD
with
an
underlying
Planned
Unit
Development
(PUD)
Overlay
on
the
commercial
parcel.
The
underlying
zoning
designation
for
the
commercial
site
is
General,
Commercial
(CG-‐1).
SUBJECT
REQUEST
The
Applicant
is
proposing
to
amendment
Resolution
44,
1987
to
modify
the
approved
use
entitlements
and
revise
the
parking
calculations
to
be
consistent
with
the
current
City
Code
and
policies
of
the
City.
ENTITLEMENT
MODIFICATIONS
The
original
site
plan
approval
included
25,500
square
feet
of
theatre
use.
The
theatre
has
been
vacant
for
several
years
and
is
no
longer
a
viable
use
for
the
center.
The
Applicant
would
like
to
convert
this
use
to
retail
and
fitness
center.
The
Applicant
is
requesting
to
convert
the
theater
use
within
Building
900
to
7,468
square
feet
of
Retail
use
and
18,032
square
feet
of
Health,
Physical
Fitness,
Weight
Reduction
and
Spa
use.
The
existing
Planet
Fitness
tenant
will
be
relocated
from
its
current
location
to
the
theatre
space
upon
approval.
The
theatre
(Building
900)
will
provide
slightly
more
space
for
the
current
fitness
center
tenant.
Resolution
44,
1987
limits
restaurant
use
within
the
center
to
709
seats.
The
City’s
Code,
however,
limits
restaurant
use
within
an
inline
shopping
center
to
25
percent
of
the
total
center
square
footage.
Tracking
of
seats
within
a
given
restaurant
has
proven
a
cumbersome
task
over
the
years
and
has
been
extremely
difficult
to
monitor
from
a
property
management
perspective.
In
order
to
bring
the
current
project
into
compliance
with
today’s
parking
requirements
and
simplify
the
monitoring
process,
the
Applicant
is
proposing
to
remove
the
reference
to
a
maximum
of
709
seats
and
instead
utilize
the
25
percent
threshold
consistent
with
Code
Section
78-‐345,
Table
33.
The
25
percent
threshold
would
limit
restaurant
use
within
the
plaza
to
50,408
square
feet.
PARKING
The
approved
parking
for
Promenade
Shopping
Plaza
is
based
on
an
antiquated
method
that
is
no
longer
part
of
the
City’s
Code.
Resolution
44,
1987
required
1,362
parking
spaces
for
the
in-‐
Promenade
Shopping
Center
PUD
Amendment

line
retail.
Resolution
166,
2001
approved
the
Site
Plan
Amendment
to
allow
the
development
of
Outparcels
1,
2
and3
to
construct
a
CVS
drugstore.
The
staff
report
that
accompanied
Resolution
166,
2001
stated
that
1,653
parking
spaces
existed
within
the
plaza.
Over
the
years,
there
have
been
modifications
to
the
site
that
have
reduced
the
overall
number
of
approved
parking
spaces
provided.
Today,
1,404
parking
spaces
exist
on
site.
Once
the
parking
calculation
is
updated
to
current
code,
there
will
be
a
surplus
of
parking
space
on
the
property.
The
Applicant
is
proposing
to
simplify
the
parking
requirements
to
be
consistent
with
the
current
Code
requirements.
The
parking
ratio
will
be
consistent
with
the
parking
requirement
for
Shopping
Center/Mixed
Uses
at
1
space
per
200
square
feet.
Updating
the
parking
calculation
will
result
in
a
surplus
of
provided
parking
at
the
center.
The
outparcels
are
parked
independently
from
the
inline
retail
at
their
respective
code
requirements.

1,925
theater
seats
in
the
main
plaza.
The
outparcels
are
approved
for
17,957
square
feet
of
retail,
a
1,000-‐square-‐foot
service
station,
a
148
seat
fast-‐food
restaurant,
a
1,228-‐square-‐foot
car
wash,
a
3,500-‐square-‐foot
bank,
and
a
200-‐seat
restaurant.
As
part
of
this
application
the
theater
use
within
Building
900
will
be
converted
to
7,468
square
feet
of
Retail
use
and
expand
the
already
existing
15,000
square
feet
of
Health,
Physical
Fitness,
Weight
Reduction
and
Spa
use
to
18,032
square
feet.

The
proposed
conversion
of
the
theater
use
to
retail
results
in
a
reduction
of
2,393
daily
trips
and
a
reduction
of
total
PM
Peak
Hour
trips
by
181.
The
conversion
of
uses
has
a
small
increase
in
total
AM
Peak
Hour
trips,
an
increase
of
18
trips.
A
complete
Traffic
Study
is
included
within
the
submittal
packets.
LANDSCAPING
The
Applicant
is
proposing
a
fairly
significant
enhancement
to
the
existing
landscape
that
occurs
on-‐site.
As
landscape
architects,
we
believe
that
the
existing
landscape
at
Promenade
Shoppes
has
“great
bones”
and
provides
a
lot
to
work
with.
The
landscape
enhancements
and
improvements
are
focused
predominantly
on
the
three
project
entrances
into
the
plaza
from
Alternate
A1A,
as
well
as
the
foundation
plantings
along
the
façade
of
the
inline
shops.
While
substantial
foundation
plantings
currently
exist,
much
of
it
is
old
and
has
outlived
its
useful
life.
We
also
anticipate
replacing
much
of
the
sod
that
exists
within
the
interior
parking
islands.
This
activity
will
be
more
than
simply
replacing
the
sod,
as
in
order
to
achieve
a
sustainable
landscape,
the
existing
grasses
and
surface
roots
need
to
be
removed
and
replaced
with
new
soil,
sod
and
irrigation.
The
proposed
landscape
modifications
at
Promenade
Shopping
Center
are
being
addressed
through
a
concurrent
Administrative
Amendment.
SIGNAGE
No
changes
to
the
approved
signage
on
site
is
proposed
with
the
subject
petition.
CONCLUSION
This
Applicant
is
requesting
approval
of
a
PUD
Amendment
for
Promenade
Plaza.
The
proposed
amendment
is
consistent
with
the
City’s
Comprehensive
Plan
and
zoning
regulations.
The
Applicant
looks

Staff

respond
to
any

issues

might
arise
as
a
result
of
your
