Vice Mayor Jablin made a motion to approve Resolution 36, 2016. Councilmember Levy seconded. Motion passed 4-0. XI. ITEMS FOR COUNCIL ACTION/DISCUSSION a. INFRASTRUCTURE SURTAX DISCUSSION Councilmember Levy asked for City Council 's support of the Palm Beach County 1 % sales tax proposal for infrastructure improvements. Discussion ensued. Councilmember Levy expressed his concerns regarding possible incorporation of the Town of Westlake, formerly known as Callery Judge Grove. Discussion ensued. Vice Mayor Jablin made a motion not to support the 1% discretionary local government infrastructure tax 2016. 42 Councilmember Premuroso seconded. 43 Motion passed 3-1. 44 · Councilmember Levy opposed. 45 Councilmember Levy made a motion not to support the incorporation of the Town of Westlake. 46 Vice Mayor Jablin seconded. 4 7 Motion passed 4-0. 48 XII. CITY ATTORNEY REPORT CITY OF PALM BEACH GARDENS REGULAR COUNCIL MEETING 06-14-16 PAGE 4 1 City Attorney Max Lohman provided a status on the election lawsuit. Requested the City 2 Council authorize him to join in the appeal with Councilmember Levy and the Supervisor of 3 Elections opposing the decision of the lower court. 4 Councilmember Levy recused himself and filled out form SB. 5 Vice Mayor Jablin made a motion authorizing the City Attorney to join the appeal. 6 Councilmember Premuroso seconded. 7 Motion passed 3-0. 8 Councilmember Levy returned to the dias. 9 Mayor Tinsley expressed the need for a Charter Review Committee to review the current 10 charter and recommend changes.
