CALL TO ORDER 8 II. PLEDGE OF ALLEGIANCE 9 M. ROLL CALL 10 PRESENT: Chair Craig Kunkle, Vice Chair Douglas Pennell, Randolph Hansen, Barry Present, 11 Michael Panczak, Joy Hecht, Amir Kanel. 12 ABSENT: None. 13 ALSO PRESENT: Growth Management Administrator Kara Irwin, Senior Planner Stephen 14 Mayer, Planning Manager Nilsa Zacarias, Interim City Attorney R. Max Lohman. 15 IV. REPORT BY KARA IRWIN GROWTH MANAGEMENT ADMINISTRATOR 16 On January 19, 2009 City Council meeting had first reading of The Waterway Cafd application for 17 rezoning. The City Council adhered to the recommendation of the Planning, Zoning and Appeals 18 Board on the LA Fitness signage petition. 19 V. ADDITIONS DELETIONS AND MODIFICATIONS 20 None. 21 VI. APPROVAL OF MINUTES 22 None. 23 VII. PUBLIC HEARINGS 24 Ex parte communication regarding Ballen Isles was declared by Vice Chair Pannell, Joy Hecht, 25 Amir Kanel, Randolph Hansen, and Michael Panczak. 26 RECOMMENDATION TO CITY COUNCIL 27 Ex parte Communication (Public Hearing) 28 1. MISC -08-08-000047: Gardens Medical Center: Master S' na a Program. A request by 29 Anne Booth of Urban Design Studio, on behalf of Healthcare Property Investors, Inc, for approval of 30 the Master Signage Program for the Palm Beach Gardens Medical Center Planned Unit Development 31 (PUD), generally located at the southeast corner of the intersection of Burns Road and Gardens East 32 Drive. 33 The following individuals commented on this agenda item: Anne Booth, Urban Design Kilday 34 Studios, Mark Fuller, artist. 35 Chair Kunkle opened the public hearing. 36 Chair Kunkle closed the public hearing. 37 Douglas Pennell made a motion for approval. 38 Randolph Hansen seconded. 39 Motion passed 7 -0. 40 RECOMMENDATION TO CITY COUNCIL 41 Ex Parte Communication (Public Hearing) 42 2. CPSS-07 4)84000001: Balleables West Ou arcel (Parcel 13.01 A request by Cotleur & 43 Hearing, Inc., agent for E. W. Outparcels, LLC, for a Small Scale Comprehensive Plan Map 44 Amendment to modify the Future Land Use Map to change the designation from a Residential Low 45 (RL) Future Land Use category to a Professional/Office (PO) Future Land Use category of an PLANNING, ZONING AND APPEALS BOARD REGULAR MEETING Page 01-27-09 I approximately 7.31 -acre vacant parcel of land, known as the Ballenlsles West Outparcel, generally 2 located at the southwest corner of the intersection of PGA Boulevard and Ballenlsles Drive. 3 The following individuals commented on this agenda item: Donaldson Hearing, Cotleur & 4 Hearing, Senior Planner Stephen Ma er. 5 Interim City Attorngy R Max Lohman stated the site plan could not be considered tonight, only 6 the land use designation. 7 Growth Management Administrator Kara Irwin discussed the level of service analysis. s Chair Kunkle opened the public hearing. 9 Anne Booth, 477 South Rosemary Avenue, West Palm Beach, David Paulsen, 27 St. George 10 Place, Palm Beach Gardens. 11 Chair Kunkle closed the public hearing. 12 Interim City Attorney R. Max Lohman stated the recommendation is on a legislative act and the 13 application must be reviewed for compatibility of land use and the level of service requirement in 14 accordance with the Comprehensive Plan. Should the City Council deny the application, the 15 applicant can resubmit an application after one year. 16 Interim City Attorney IL Max Lohman reiterated that the sole question before the Board is the 17 recommendation to the City Council of the applicant's request to change the parcel with a current 18 land use designation of residential low (RL) to professional office (PO). 19 Vice Chair Pennell made a motion for approval. 20 Michael Panc ak seconded. 21 Motion passed 5 -2, Joy Hecht and Amir Kanal dissenting. 22 VIII.
