CALL TO ORDER 8 The regular meeting was called to order at 6:0lp.m. by Chair Hansen. 9 II. PLEDGE OF ALLEGIANCE 10 III. REPORT BY DIRECTOR OF PLANNNING AND ZONING: NATALIE 21 CROWLEY 22 Wished everyone a Happy Valentine's Day; Reported at the February 9, 2017 City Council 23 meeting the City Council approved the 2nd reading of the Balsamo annexation, Ballenlsles 24 Country Club Site Plan Amendment, Olympus signage at Corporate Center of the Gardens, 25 Loehman's Plaza request for Live Entertainment, Alton Parcel G, and the Artistic Entrance 26 Feature at Alton PCD adjacent to Parcel B. 27 VI. APPROVAL OF MINUTES 28 Board Member Savel made a motion to approve the January 10, 2017 minutes. 29 Board Member Rosenkranz seconded. 30 Motion passed 7-0. 31 Chair Hansen asked for any ex-parte. 32 All Board members met with the City staff for all items on the agenda. 33 VII. PUBLIC HEARINGS 34 Those preparing to give testimony were sworn in. 35 1. Recommendation to City Council -(Public Hearing) -QUASI JUDICIAL HEARING 36 PCDA-16-12-000030: Ballenlsles Community Association Planned Community 37 Development Amendment (PCD) -A request from Ballenlsles Community Association to 38 amend the property development standard for the screen and deck side setbacks from five feet to 39 zero feet for residential properties in Coral Cay (aka Parcel One) within Ballenlsles Planned 40 Community Development (PCD). The subject site is located on the west side of Ballenlsles 41 Drive approximately 1,500 feet south of the PGA Boulevard and Ballenlsles Drive intersection. 42 The Ballenlsles PCD is bordered by PGA Boulevard to the no~ Northlake Boulevard to the 43 south, the Florida Turnpike to the west, and Military Trail to the east. 44 Chair Hansen opened the public hearing. 45 Petitioner: Stephen Mathison, Stephen S. Recommendation to City Council (Public Hearing) -QUASI JUDICIAL HEARING 7 PPUD-16-03-000040 & CUMJ-16-03-000041: Business Center at the Gardens Planned Unit 8 Development (PUD) and Major Conditional Use -A request from Riverside Drive Investors, 9 LLC to rezone a 3.44-acre parcel of land from Light Industrial (MIA) to a Planned Unit 10 Development (PUD) Overlay with an underlying zoning designation of Light Industrial (MIA), 11 along with Site Plan approval for an I8,650-square-foot building with laboratory, research and 12 development use, and Major Conditional Use approval for a 99,I83-square-foot self-storage 13 building located at the Business Center at the Gardens. The subject site is generally located at the 14 northwest comer of the intersection of Riverside Drive and Buckeye Street. 15 Chair Hansen opened the public hearing. 16 Petitioner: Michael Sanchez, Managed Land Entitlements. 17 Staff Presentation: Staff recommends approval of PPUD-I6-03-000040 and CUMJ-I6-03- 18 000041. 19 Public Comment: None. 20 Chair Hansen closed the public hearing. 21 Board Member Panczak made a motion to recommend to City Council PPUD-I 6-03-000040 22 and CUMJ-I 6-03-00004 I. 23 Board Member Savel seconded. 24 Motion passed 7-0. 25 3. Recommendation to City Council (Public Hearing)-QUASI JUDICIAL HEARING 26 SPLA-16-07-000042: Frenchman's Reserve Country Club Site Plan Amendment A request 27 from Frenchman's Reserve Country Club, Inc., for a Site Plan Amendment to the Clubhouse 28 parcel to allow a 3,I28-square-foot expansion to the existing fitness center and spa, the 29 construction of a new I,590-square-foot one-story tennis center, a new 6,750-square-foot one- 30 story restaurant building, modifications to the clubhouse architecture, along with an additional 31 porte-cochere, and modifications to the loading zone and parking lot. The Clubhouse parcel of 32 the Frenchman's Reserve Planned Community Development (PCD) is generally located on the 33 south side of Grand Comiche, approximately one-half mile east of the intersection at Hood Road 34 and Alternate AIA. 35 Board Member Glidden recused himself and completed form 8B. 36 Chair Hansen opened the public hearing. 37 Petitioner: Nicole Plunkett, Cotleur and Hearing. 38 Staff Presentation: Staff recommends approval of SPLA-I6-07-000042. 39 Public comment: Chas Berle, 625 Hermitage Circle, Palm Beach Gardens. 40 Chair Hansen closed the public hearing. 41 Board Member Lewis made a motion to recommend to City Council SPLA-I6-07 000042. 42 Board Member Rosenkranz seconded. 43 Motion passed 6-0. 44 4. Recommendation to City Council (Public Hearing) -QUASI JUDICIAL HEARING 45 PCDA-16-06-000028: Frenchman's Reserve Country Club Planned Community 46 Development Amendment (PCD)-A request from Frenchman's Reserve Country Club, Inc., to PLANNING, ZONING AND APPEALS BOARD REGULAR MEETING 02-14-17 Page 2 I allow modifications to the existing configuration of the golf course and upland preserve areas 2 within the Frenchman's Reserve Planned Community Development (PCD). The Frenchman's 3 Reserve PCD is located on the east side of Alternate Al A, at the intersection of Hood Road and 4 Alternate AlA. 5 Board Member Glidden recused himself and completed form 88. 6 Chair Hansen opened the public hearing. 7 Petitioner: Nicole Plunkett, Cotleur and Hearing. 8 Staff Presentation: Staff recommends approval of PCDA-16-06-000028. 9 Public comment: None. INSTRUCTIONS FOR COMPLIANCE WITH SECTION 112.3143, FLORIDA STATUTES A person holding elective or appointive county, municipal, or other local public office MUST ABSTAIN from voting on a measure which inures to his or her special private gain or loss. Each elected or appointed local officer also is prohibited from knowingly voting on a mea- sure which inures to the special gain or loss of a principal (other than a government agency) by whom he or she is retained (including the parent organization or subsidiary of a corporate principal by which he or she is retained); to the special private gain or loss of a relative; or to the special private gain or loss of a business associate. Commissioners of community redevelopment agencies under Sec. 163.356 or 163.357, F.S., and officers of independent special tax districts elected on a one-acre, one-vote basis are not prohibited from voting in that capacity. For purposes of this law, a "relative" includes only the officer's father. mother, son, daughter, husband, wife, brother, sister, father-in-law, mother-in-law, son-in-law, and daughter-in-law. A ·business associate• means any person or entity engaged in or carrying on a business enterprise with the officer as a partner, joint venturer, coowner of property, or corporate shareholder {where the shares of the corporation are not listed on any national or regional stock exchange). * * * * * * * * * * ELECTED OFFICERS: In addition to abstaining from voting in the situations described above, you must disdose the conflict: PRIOR TO THE VOTE BEING TAKEN by publicly stating to the assembly the nature of your interest in the measure on which you are abstaining from voting; and WITHIN 15 DAYS AFTER THE VOTE OCCURS by completing and filing this form with the pef$)n responsible for recording the min- utes of the meeting, who should incorporate the form in the minutes. * * * * * * * * APPOINTED OFFICERS: Although you must abstain from voting in the situations described above, you otherwise may participate in these matters.
