Recommendation to City Council (Public Hearing) LDRA-17-01-000061: LDR Amendment for Operation of Mobile Food Trucks City initiated request to amend Chapter 78 of the City’s Code of Ordinances to provide regulations pertaining to the operation and sale of food from Mobile Food Trucks within the City of Palm Beach Gardens. Exact legal description and/or survey for the cases may be obtained from the files in the Gr owth Management Department. g:\share\administration\pzab agenda\p & z agenda 2017\07-11-2017\pzab agenda 07.11.2017.docx LDRA-17-01-000061 Planning, Zoning and Appeals Board July 11, 2017 Background •Increasing request for Mobile Food Trucks for lunch options and special events. •Currently only approval of Mobile Food Trucks is via a special event permit Background •Fire Marshals Association of Palm Beach County has collectively been discussing rules and regulations regarding the inspections of such vehicles •Food trucks raise concerns regarding the kitchen systems (open flame, suppression systems, fuel supply and grills) and the inspections necessary for public safety Proposal Sec 78-196. Operation and Sale of Food from Mobile Food Trucks •Define Mobile Food Trucks •Create regulations and prohibitions •Create a permit process for regulations including Fire Rescue inspections annually •Create Operating Requirements for the Mobile Food Trucks Definitions -Mobile Food Trucks A vehicle which is used to vend food and beverage •Class I-Mobile Kitchens-cook, prepare and assemble food items on or in the unit and serve a full menu •Class II-Canteen Trucks-vend pre-cooked foods, pre-packaged drinks. No assembly of food or preparation of food. (No open flame or grease laden vapor) •Mobile Food Truck Vendor-Person who prepares, dispenses or otherwise sells food from a Mobile Food Truck Exemptions Class II –Canteen Trucks •provided such vehicles are only parked a maximum of 15 minutes, are exempt from the provisions of this section Proposed permit requirements •Property Owner Consent •Must obtain a Mobile Food Truck permit with annual renewals •Must provide copies of all applicable license approvals from the State and local authorities •Must make their vehicle available for Fire Rescue inspection •Once approved, must display the permit in a visible manner Proposed permit prohibitions •No selling or distributing of alcoholic beverages •Operating in a City park or public right-of-way unless via a special event permit •Operating in a residential area unless via special event permit •No sound amplification or balloons, banners or streamers •No selling or dispensing food to customers in a moving vehicle –no drive up sales •No parking in ADA spaces or ramps, in any driveway aisles, parking zones or loading areas and may not impede the on-site circulation of motion of vehicles Proposed General Regulations •Mobile Food Vendors shall remove all waste •No grease or waste shall be released into stormwater system, tree pits, sidewalks and must comply with all rules and regulations •Maintain a log containing a written record of control measures performed by exterminators and pest control •Maintained in good repair and clean condition •Must not engage in food prep if the vehicle does not have water and waste systems •Routine inspections may be conducted by City Staff •Signage must comply with Section78-285 (A frame sign and menu affixed to vehicle) Proposed Operating Regulations •Mobile Food Truck must be self contained •No more than 2 Mobile Food Trucks on one site at the same time unless via a special event •Mobile Food Truck can only be operated by the Mobile Food Truck Vendor or authorized employee of the vendor •If a state or local license gets revoked or suspended the Mobile Food Truck will also be revoked or suspended Public Outreach/Notification •Staff coordinated with the PGA Corridor Association and the Palm Beach North Chamber of Commerce •Staff met with the PGA Corridor to discuss the amendment •No issues or concerns to date Public Outreach/Notification •Effective immediately upon City Council approval •Staff will reach out to past Mobile Food Truck Vendors to notify them of requirements •Application and requirements will be posted on the City website •The first year, the City intends to work with the Mobile Food Trucks for proper notification prior to any code violation citation Recommendation •Staff recommends APPROVAL of LDRA-17-01-000061 Questions?
