CALL TO ORDER 6 The regular meeting was called to order at 6:00 p.m. by Chair Hansen. 7 II. PLEDGE OF ALLEGIANCE 8 III. ROLL CALL 9 Members Present: to Chair Randolph Hansen, Vice Chair Michael Panczak, Carl Sabatello, L. Marc Cohn (arrived at 11 6:03 p .m .), Roma Josephs, Debra Canney, Christopher Oftedal (sitting in for John Glidden) 12 Members Absent: John Glidden. 13 Also Present: Assistant City Attorney, Abigail Joranby; Acting Director of Planning and Zoning, 14 Planning Manager, Peter Hofheinz. 15 IV. ADDITIONS, DELETIONS, MODIFICATIONS 16 Planning Manager Peter Hotheinz requested the agenda be reordered moving item #2 PPUD- 17 14-12-000038 to Item #1. 18 Vice Chair Panczak made a motion to reorder the agenda as requested by staff. 19 Board Member Josephs seconded. 20 Motion passed 7-0. 2 1 V. REPORT BY ACTING DIRECTOR OF PLANNING AND ZONING PETER 22 HOFHEINZ: 2 3 Reported at the January 4, 2018 City Council meeting, the City Council approved the small scale 24 comprehensive plan amendment and rezoning for the City's Fleet Operations Building, and the 25 Alton Artistry modification to the conditions of approval and wall. 26 VI. APPROVAL OF MINUTES 27 Chair Hansen requested that the minutes be amended to change "electronic automobile 28 showroom" to "electric automobile showroom". 29 Vice Chair Panczak made a motion to approve the minutes as amended. 30 Board Member Cohn seconded. 3 1 Motion passed 7-0. 32 Chair Hansen asked for any ex-parte. 33 Chair Hansen met with applicant and petitioner; Board Member Cohn met with staff; Board 34 Member Josephs met with staff. 35 VII. PUBLIC HEARINGS 36 Those preparing to give testimony were sworn in. 37 2. Recommendation to City Council (Public Hearing) QUASI-JUDICIAL HEARING 38 PPUD-14-12-000038-Ballenlsles East Outparcel PUD Rezoning 39 *** ON JANUARY 4, 2018 APPLICANT REQUESTED A POSTPONEMENT *** 40 A request from E.W. Outparcels L LC to rezone a 5.27-acre site located at the southeast comer of 4 1 PGA Boulevard and Ballenlsles Drive from Neighborhood Commercial (CN) to Planned Unit 42 Development (PUD) overlay with an underlying zoning designation of CN. Recommendation to City Council (Public Hearing) -ANNX-17-11-000012 -Voluntary 11 Annexation request for 12220/12194 Alt AlA -A request from AlA Cabana Partners LLC for 12 the approval of a voluntary annexation petition for a parcel of real property comprising 0.85 acres, 13 more or less, generally located on the southeast comer of the intersection of Alternate AlA and 14 Florida Boulevard, approximately one-half mile south of Hood Road 15 Chair Hansen opened the public hearing. 16 Petitioner: Kevin Dalton, AlA Cabana Partners LLC. 17 Staff Presentation: Planner, Martin Fitts. 18 Public comment: None. 19 Chair Hansen closed the public hearing. 20 Board Member Sabatello made a motion to recommend to City Council ANNX-17-11-000012. 21 Board Member Josephs seconded. 22 Motion passed 7-0. 23 VIII. It applies equally to members of advisory and non-advisory bodies who are presented with a voting conflict of interest under Section 112.3143, Florida Statutes. Your responsibilities under the law when faced with voting on a measure in which you have a conflict of interest will vary greatly depending on whether you hold an elective or appointive position. For this reason, please pay close attention to the instructions on this form before completing the reverse side and filing the form. INSTRUCTIONS FOR COMPLIANCE WITH SECTION 112.3143, FLORIDA STATUTES A person holding elective or appointive county, municipal., or other local public office MUST ABSTAIN from voting on a measure which inures to his or her special private gain or loss. Each elected or appointed local officer also is prohibited from knowingly voting on a mea- sure which inures to the special gain or loss of a principal (other than a government agency} by whom he or she is retained (including the parent organization or subsidiary of a corporate principal by which he or she is retained}; to the special private gain or loss of a relative; or to the special private gain or loss of a business associate. Commissioners of community redevelopment agencies under Sec. 163.356 or 163.357, F.S., and officers of independent special tax districts elected on a one-acre, one-vote basis are not prohibited from voting in that capacity. For purposes of this law, a "relative• includes only the officer's father. mother, son, daughter, husband, wife, brother, sister, father-in-law, mother-in-law, son-in-law, and daughter-in-law. A •business associate• means any person or entity engaged in or carrying on a business enterprise with the officer as a partner, joint venturer, coowner of property, or corporate shareholder (where the shares of the corporation are not listed on any national or regional stock exchange). * * * * * • * • • • • • * * ELECTED OFFICERS: In addition to abstaining from voting in the situations described above, you must disclose the conflict: PRIOR TO THE VOTE BEING TAKEN by publicly stating to the assembly the nature of your interest in the measure on which you are abstaining from voting; and · WITHIN 15 DAYS AFTER THE VOTE OCCURS by completing and filing this fonn with the person responsible for recording the min- utes of the meeting, who should incorporate the form in the minutes. * * * * * * APPOINTED OFFICERS: Although you must abstain from voting in the situations described above, you otherwise may participate in these matters.
