The property possesses an Industrial (I) Future Land Use classification and a Research & Light Industrial (M -1) Zoning district designation which allows for a fitness center use to be permitted as a minor conditional use. Stroud, Assistant City Attorney Stephen Stepp, Police Chief FINAL ORDER OF THE DEVELOPMENT REVIEW COMMITTEE CITY OF PALM BEACH GARDENS PETITION CUMN- 08 -05- 000006 PALM BEACH GARDENS BUSINESS PARK MINOR CONDITIONAL USE FOR A HEALTH, PHYSICAL FITNESS, WEIGHT REDUCTION AND SPA RE: A request by Brian Cheguis of Cotleur & Hearing, agent, on behalf of John Annunziato, for approval of the Minor Conditional Use of Health, Physical Fitness, Weight Reduction and Spa within Palm Beach Gardens Business Park, located at 4087 and 4089 Burns Road (Units B15 and B16). ORDER APPROVING MINOR CONDITIONAL USE THIS CAUSE came to be heard upon the above application, and the City of Palm Beach Gardens Development Review Committee (DRC), having considered the testimony and other evidence presented by the applicant, City staff, members of the pubic, and other interested persons at a public meeting called and properly noticed, hereby makes the following findings of fact: 1. In accordance with the Section 78 -24 of the City's Land Development Regulations (LDRs), the DRC has the right, power, and authority to approve, deny or approve with conditions, minor conditional use applications as identified in Section 78 -159, Table 21, Chart of Uses. 2. The DRC meeting held on June 12, 2008 was properly noticed in accordance with Section 78 -54 of the City's LDRs. 3. The property is zoned Research and Light Industrial (M -1). 4. The Petitioner is seeking approval for the Minor Conditional Use of Health, Physical Fitness, Weight Reduction, and Spa in accordance with Section 78 -52. Conditional Uses. and Section 78 -159. Table 21. Chart of Permitted Uses, of the City's LDRs. 5. The Development Review Committee has reviewed the petition, supporting materials and documentation and has considered the evidence and testimony presented at the meeting. IT IS THEREUPON CONSIDERED, ORDERED AND ADJUDGED BY THE DEVELOPMENT REVIEW COMMITTEE OF THE CITY OF PALM BEACH GARDENS, FLORIDA, AS FOLLOWS: Development Review Committee approval of a Minor Conditional Use, in Petition No. CUMN- 08 -05- 000006, in order to allow a Health, Physical Fitness, Weight Reduction and Spa within the Palm Beach Gardens Business Park Planned Unit Development, located on that certain real property, which is more particularly described hereinbelow and having a street address of 4087 and 4089 Burns Road (Units B15 and B16): LEGAL DESCRIPTION: A parcel of land lying in Section 12, Township 42 South, Range 42 East, City of Palm Beach Gardens, Palm Beach County, Florida, being more particularly described as follows: Section 12, Township 42 South, Range 42 East, Southerly 480 feet of Easterly 823.66 feet of Southeast quarter (SE 1/4) of Northerly quarter (N 1/4) lying West of and adjacent to 1 -95 and North of and adjacent to Burns Road Right -of -Ways (less South 50 feet Burns Road Right -of -Way) of, Palm Beach County, Florida. is hereby GRANTED since the DRC hereby finds that the petitioner meets all of the standards set forth at Section 78 -52(d) of the City's Land Development Regulations with the following special condition(s) of approval: ATTEST: 22 1.
