Public Comments Doris Semon,1301 -A, Sabal Ridge, Palm Beach Gardens, asked what the satellite college is and the number of people coming and going. Ann Booth, Planner, Urban Design Studio, explained the site plan will not be changed and the use by a college will not increase traffic. A specific college has not been identified yet. Ms. Semon asked if there would be a set timeframe when the offices can operate. Anne Booth explained there was no restriction on the time when offices can operate, but the college offices may have people leaving in the evening, but not arriving in the evening. Motion A motion for approval of petition CUMN- 07 -12- 000004 was made by Leo Giangrande. Ray Caranci seconded. Motion was approved unanimously, 3 -0. The meeting adjourned at 9:19 A.M. ORDER APPROVING MINOR CONDITIONAL USE THIS CAUSE came to be heard upon the above application, and the City of Palm Beach Gardens Development Review Committee (DRC), having considered the testimony and other evidence presented by the applicant, City staff, members of the pubic, and other interested persons at a public meeting called and properly noticed, hereby makes the following findings of fact: 1. In accordance with the Section 78 -24 of the City's Land Development Regulations (LDRs), the DRC has the right, power, and authority to approve, deny or approve with conditions, minor conditional use applications as identified in Section 78 -159, Table 21, Chart of Uses. 2. The Pointe PUD is located at the point of the intersection of Military Trail and I -95, north of PGA Boulevard. This site has a PUD - Planned Unit Development overlay with an underlying zoning designation of Professional Office (PO), and a Future Land Use Plan designation of Professional Office (PO). The site has approval for the construction of 150,000 sf with two (2) 75,000 square foot, four -story office buildings and a four and one -half level parking garage. No additional square footage is required as a result of this request and no changes are proposed to the approved plans. The Sabal Ridge property to the north of this project is residential, zoned RM - Residential Medium Density with a FLUP designation of RM. Paloma, which is also to the north has been approved as a PUD with a FLUP designation of RM - Residential Medium Density. Concurrency The property was granted Conditional Concurrency Certification on February 02, 2005 for 150,000 square feet of professional office space. Project buildout is scheduled for the end of 2008. History /Zoning/Future Land Use The PUD was approved by the City Council through Ordinance 37, 2005. Phasing This development is approved for construction in two phases. Parking Parking has been provided at a ratio of 1 space per 260 s£ The required parking ratio for both professional office and the satellite university is 1 space per 300 s£ No additional parking spaces are required as a result of this request. Conditional Uses, the following is an analysis of the criteria as set forth in that section. (1) Comprehensive Plan. The proposed use is consistent with the comprehensive plan. Currently the site has a Future Land Use Plan designation of PO which is consistent with the approved PUD. The proposed Minor Conditional Use is an approved use in the underlying PO- Professional Office District. The approved PUD site plan allows for the construction of 150, 000 sf of professional office space along with the associated parking. The proposed satellite university use is compatible and similar to the approved professional office use and will not require any modification of the approved site plan, architectural elevations or other elements of the approved PUD. (2) Chapter requirements. The proposed use is consistent with all applicable requirements of this chapter. The proposed conditional use does not require modification of the approved plans and is consistent with the Land Development Regulations for uses within the underlying zoning district of PO- Professional Office. (3) Standards. The proposed use is consistent with the standards for such use as provided in Section 78 -159. Satellite Universities were approved as a minor conditional use by the City Council under Ordinance 28, 2004. According to "78- 159(c)(2): Minor Conditional Use. Any use that may be allowed, subject to review and consideration by the development review committee as provided for in this chapter" this application is requesting approval of the DRC for this use on this site. (4) Public welfare. The proposed use provides for the public health, safety, and welfare by: (a) Providing for a safe and effective means of pedestrian access; Pedestrian access has been provided as part of the approved PUD site plan. (d) Providing for a safe and efficient onsite traffic circulation, parking, and overall control; and The approved PUD site plan has been reviewed and approved for traffic circulation and control. (e) Providing adequate access for public safety purposes, including fire and police protection. Access for public safety purposes has been addressed and approved as part of the PUD site plan. (5) Screening and buffering. The proposed use utilizes such techniques as landscaping, screening, buffering, site or building design, or business operation procedures to mitigate impacts on surrounding properties, including such impacts as: (a) Noise; (b) Glare; (c) Odor; (d) Ground, wall, or roof - mounted mechanical equipment; (e) Perimeter, interior, and security lighting; (f) Signs; (g) Waste disposal and recycling; (h) Outdoor storage of merchandise and vehicles; (i) Visual impact; 0) Hours of operation; Screening and buffering of the adjacent properties has been addressed as part of the approved PUD site plan. The proposed use minimizes or eliminates the impact of utility installation, including underground and overhead utilities, on adjacent properties. Adding a Satellite University use as a minor conditional use to the potential uses on this site does not change the utility requirements for the site. (7) Dimensional standards. The proposed use meets or exceeds all dimensional requirement required by the chapter. All dimensional requirements were met when the project was originally approved. (8) Neighborhood Plans. The proposed use is consistent with the goals, objectives, policies, and standards of neighborhood plans. There currently is not an approved neighborhood plan for this area. The proposed use is, however, consistent with the goals and objectives of the Economic Development Element of the Comprehensive Plan and the intent of the BRPO. Approval of this use could assist the city in improving the availability of education and training opportunities for the community. A satellite university use is compatible and consistent with the approved office use and will not require modification of the approved plans. (9) Compatibility. The overall compatibility of the proposed development with adjacent and area uses, and character or area development. The approved PUD allows for 150, 000 sf of professional office space. Adding satellite university as a permitted use will not require modifications to the site plan, landscape or preserve area buffer plans. The proposed use will not change the character of the site or the impacts to the adjacent properties. (10) Patterns of development. The proposed use will result in logical, timely, and orderly development patterns. The requested use approval will allow for an acceleration of the phased construction of the project as a whole. Development of the site as professional offices, and similar uses has been anticipated as an appropriate use in this location due to it's proximity to the major roadways. (11) Purpose and intent. (12) Adverse impact. The design of the proposed use and structures will minimize any adverse visual impacts or impacts caused by the intensity of the use. Adding satellite university as a potential use will not require modification of the approved PUD site, landscape, or architectural plans. (13) Environmental impact. The design of the proposed use minimizes any adverse impacts that may be created, including impact on environmental and natural resources including air, water, storm water management, wildlife, vegetation, and wetlands.
