The statement of use indicates expansion of a one story structure (building F) to a two story structure and additional parking spaces. The police department recommends the following conditions be met: A photometric plan should be submitted that meets the City of Palm Beach Gardens lighting code, utilizing metal halide lighting for parking lot lighting. The luminaires should provide uniform light distribution that enhances visibility while min light spill, glare and up lighting. Landscaping shall not conflict with lighting locations nor obstruct view from windows or walkways. Ground cover shall not exceed three feet in height. Applicant should take appropriate measures to target harden the expansion building by installing alarm door contacts, motion detectors where needed, equip the exterior doors with security hinges and three point contact doors. The emergency doors with panic hardware should not have exterior door handles. Interior administrative offices and storage rooms shall be equipped with double cylinder deadbolts with a bolt projection exceeding one inch to engage the strike sufficiently to prevent spreading. Prior to the issuance of the first building permit, the Applicant shall submit a constriction site security and management plan for review and approval by the Police Department. Non - compliance with the approved security and management plan may result in a stop -work order for the CPUD. The applicant shall revise the plan to show the number of existing, proposed and required bicycle parking stalls on the project data chart, on the site plan, under parking for conformance with Section 78 -414, Table 38 of the LDR. The applicant indicates on the plan that six (6) bicycle spaces are proposed. However, based on the number of required parking stalls seven (7) bicycle spaces are required. 128 required parking spaces x 0.05 = 6.4 or 7 spaces required. 5. In accordance with Section 78 -305 of the LDR, landscape plans should clearly delineate and key landscape areas, landscape materials, and square footage of open space and impervious areas. The applicant shall clarify what areas were used in the calculation of required open space. The applicant shall provide documentation showing what areas were designated as open space for the property in CAD format on CD ROM. The CAD file shall contain a separate layer for each of the following categories: property boundary, impervious areas, pervious areas, sod area, areas designated as open space, and open space used in the calculation of required landscape points. Each layer shall be clearly labeled using the categories listed above. All drawings shall be defined as closed polygons. The Applicant shall also include a plan sheet showing the CAD layer drawings. 3. The plant list and landscape points shall be updated to include all the changes proposed. 4. In accordance with section 78- 320(a) (4) c. of the LDR, non residential buildings shall have at least one shade tree or palm cluster installed for each 30 linear feet, or fraction thereof, of facade width. Trees and palms shall be of an installed size relating to the height of the adjacent wall or facade, as indicated in Table 30. Please revise the landscape plan to indicate the location of the required number of trees or palm clusters, meeting the minimum height requirement for the building section that will be increased to 2 stories. 5. In accordance with Section 78 -372 (b) (8) of the LDR, Maintenance of grass parking, Forestry is recommending that the City Engineer require paving of the grass parking areas that have deteriorated. (see attached photos) 6. In accordance with Section 328 of the LDR, Pruning of trees, the Oak trees in the parking area, within the landscape buffer, and near the building have been pruned into rounded shapes and not left to grow in a natural shape and form. Some Oak trees have web tie downs left on the trees that are constricting the trunks, causing damage and decline of the health of the trees. Forestry Staff recommends an evaluation of the Oak trees by a Landscape Architect or a Certified Arborist to determine individually if the trees can be rehabilitated or should be removed and replaced. (see attached photos) 7. Forestry Staff recommends a Condition of Approval that will require the removal of all prohibited and invasive nonnative plants from the site in accordance with 78 -318 of the LDR. 8. In accordance with Section 78 -313 (d) (1) of the LDR, concerning specimen trees, please show the number and percentage protected in place or relocated on site for the future parking area. The Applicant shall submit a tree survey for the site. The applicant is required to save at least 25% of trees that exceed 13 inch DBH. 9. In accordance with Section 78 -329 of the LDR, maintenance of the landscaping on the site, there are dead trees that need to be removed, and planting beds need to be mulched. Also, please understand that additional information may be requested, and staff may have additional comments as the review process continues. CITY OF PALM BEACH GARDENS BUILDING DIVISION 10500 N. In order to ensure there are no defects in the footprint and conceptual design, please provide a Life Safety plan. Include building height and area limitations per Table 503 FBC, based upon building type, sprinklers and construction type. Please include all interior exiting strategies, and distances (common path of travel, exit access travel distance), as well as exit capacity tabulations. Please note, the financial responsibility form that was submitted to the City was signed by the owner, however it was not notarized. 2. The Applicant shall submit a signed and sealed survey of the property and landscape plan in accordance with the City Code. Please note the City may have the survey and landscape plans used far the original major conditional use approval in the project file. The Applicant will need to order the survey from the City Clerk's office. I have attached a public records request form for your convenience. 3. Cooperative establishment and use of facilities. (a) Establishment Two or more neighboring uses may establish common o$- street loading facilities, subject to approval by the city council. The total.number of common off street loading spaces shall not be less than the number required for individual users, unless otherwise approved by the city council. Criteria for reduction in the total number of off-street loading spaces include 6e following: (1) Times of usage of the truck loading facilities by the individual users; (2) The location of the proposed common facilities; and (3) The character of the merchandise involved. (b) Other requirements. In order to establish common -street loading facilities, the standards listed below are applicable. (1) Consent. Written, consent, in a form acceptable to the city attorney, is obtained from all affected property owners. (2) Written agreement. All. conditions relating to the use, location, construction, and maintenance of the common facilities will be provided in a form acceptable to the city attorney. (3) Use of common facility. All users and property owners participating in a common off -street truck loading facility shall agree, in a form: acceptable to the city attorney, that goods moved from the common facility shall not involve movement by truck, automobile, or other vehicle. (a) Requires[ parking. Handicapped parking, access ramps, and markings will be provided as required by FS, Section 316.1955. (Ord. No. 17 -2000, § 187, 7- 20-00) Sec. 78 -372. Grassed parking. Grassed parking areas may be approved by the city council for uses which have infrequent -•peak demand, subject to the standards and criteria established, below. Supp. No. 10 CD78:295 § 78-372 PALM BEACH GARDENS CODE (a) AppliQa wn- An application for the approval of grassed parking area shall be submitted to the growth management department in coolunction with any other application for development order approval: The application shall include the itms Ueted below. (1) A written statement and a site plan showin the area proposed for grassed panting, and the proposed method of traffic control to direct vehicular flow and parking, including the use of wheel stops. (2) A written statement documenting how the pgrkingarea proposed for grassed parking shall be used for parking on an average of not more than two days or nights, each week. This information shall contain the following: a. the proposed hours and days of the expected use of the grassed parking; and b. the expected average daily traffic and peak hour traffic counts as calculated by a professional engineer. (3) Description of the method to ensure that the grassed parking surface will be maintained in its entirety with a viable turf Mier due to infrequency of 'use. (4) A conceptual drainage plan for the entire parking area. (5) Description of the soil type of the area proposed for grassed parking. (b) Applicable standards. The standards listed below shall apply to the review of applica- tion to construct and utilized grassed parking areas. (1) Only stalls provided for peak demand may be approved as grassed perking. Paved parking shall be provided for average daily traffic, including weekday employees and visitors. (2) The city engineer may determine that site- specific factors, such as but not limited to soil type, exist, which necessitate that subsurface improvements be made to the area planned for grassed parking. (3) Existing or proposed landscaped areas, surface water management areas, or ease- ments. other than a utility easements shall not be included in the proposed grassed parking area. (4) Grassed parking areas shall not be utilized for handicapped parking spaces. (5) Grassed parking areas shall meet all minimum interior landscaping requirements normally associated with standard surface parking. (6) Grassed parking areas shall not be included in calculations to comply with minimum landscape or open space requirements. (7) Within grassed parking areas, all access aisles shall either be: a. paved and meet the same structural and surface requirements as for paved parking surfaces; or b. surfaced with paver block or other semi- pervious materials approved by the city engineer. Supp. Ho_ 10 CD78:296 4 LAND DEVELOPMENT § 78-374 (8) The city engineer may require grassed parking area to be paved, landscaped, and otherwise improved consistent with the requirements of this division if such areas deteriorate and create .a nuisance or hazardous conditions, or become unsightly. (Ord. No. 17 -2000, § .188, 7-20-00.) Sew 7&973. Drivo- through facWties. (a) Design. Drive- tbrough facilities shall be designed to minimize conflicts between pedes- trian and vehicular circulation, subject to the standards listed below. (1) Separation. Each drive - through lane shall be separated from the circulation routes necessary for ingress or egress from the property or access to any parking space. (2) Meking. Each drive- through lane shall be striped, marked, or otherwise distinctly delineated in a manner acceptable to the city engineer. (3) Queuing and stacidng. The queuing -or vehicle stacking capacity of a drive- though facility;, including a gated entrance to a residential, development, shall be at least 100 feet. The minimum distance shall be measured from the centerline of the window closest to the edge of right -of -way from which access is provided. The stacking capacity may be increased Based upon individual eitcumstances as determined by the city engineer. (4) Ordering and pickup facilities. The design and location of ordering and pickup facilities will be determined for a proposed use based on traffic engineering and planning data. Any request for a drive- through facility shall include the information listed below. a.. . Nature of the. product or service being, offered. b. Method by which the order is processed. C. Peak demand hour. d. Percentage of sales or business conducted via drive- through facilities. e. Anticipated vehicular stacking required. (b) Bypass lanes. Each drive - through facility shall provide a pass -by lane separate from the drive - through lanes, with a minimum width of ten feet. (c) Roofing. Roofs constructed as part of a drive- through facilities shall be consistent with the architectural style, materials, and colors of the principal structure. (Ord. No. 17 -2000, § 189, 7- 20-00) Sec. 7&374. Covered parking structures. C Covered perking structures shall be constructed and maintained in accordance with the specifications listed below. (1) Canvas shall be a prohibited material for covered parldng structures. vinyl coverings shall be a permitted material, provided a minimum 17 -ounce reinfbiftd grade or equivalent ghall be used. (2) Metal coverings shall be constricted of a solid material, such as nonferrous aluminum, copper, or steel. (d) Building cbdes:. All'. covered parking structures shall comply with applicable requim- ments of the building coda'. Covered parking structures shall not be constructed, or installed without a building permit. (e). Zoning. Cover ed. parking. structures shall comply with all zoning regulations. (f) Landscaping The installation of the covered parking structure shall not interfere with the natural growth of the required landscaping, (g) Maximum amount. Covered parking structures shall not exceed five percent of total required parking spaces for a site. (h) Location. Covered parking structures shall be located a minimum of 100 feet from any public right -of- -way and 60 feet from any residential-district. Unless otherwise approved by the city council, covered parking structures shall be located in the rear of the principal building to which the parking structure is accessory. The location of covered parking structures shall be subject to city approval during the development review or site plan review process, or as an amendment to an approved site plan. (i) Lighting. Vehicle repair in residential districts. The repairing of an, automobile or a motor vehicle in a residential zoning district is subject to the restrictions listed below. (a) Minor repairs. Only minor repairs and maintenance may be performed, which are defined as follows: (1) The changing and replenishment of fluid levels, such as hydraulic fluid, windshield washer fluid, and lubricating oil; (2) The replacement of wiper blades; Supp. No. 10 CD78 :298 ti. t RESOLUTION 71, 1997 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM BEACH GARDENS, FLORIDA, PROVIDING FOR THE APPROVAL OF A CONDITIONAL USE FOR THE EXPANSION AND RENOVATION OF THE EXISTING TEMPLE BETH DAVID SITE LOCATED AT 4575 HOOD ROAD; PROVIDING FOR CONDITIONS OF APPROVAL; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Palm Beach Gardens annexed the Temple Beth David property at 4675 Hood Road into the City by Ordinance 41, 1988; WHEREAS, Temple Beth David has petitioned for a conditional use for the existing religious facility and site plan approval for the expansion of the existing religious facility from 8,308 square feet to 23,778 square feint; WHEREAS, the Growth Management Department has reviewed said petition and determined that it is sufficient; WHEREAS, the Planning and Zoning Commission has recommended approval of this petition with conditions; and WHEREAS, the petition is consistent with the City's Comprehensive Land Use Plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PALM BEACH GARDENS, FLORIDA SECTION 1. The City Council of the City of Palm Beach Gardens, Florida, hereby approves a conditional use for Temple Beth David, located at 4657 Hood Road, for a 23,778 square foot religious facility as depicted on the Temple Beth David Site Plan, dated March 20, 1997, on file in the Planning and Zoning Department. SECTION 2. The conditional use is subject to the following conditions: The applicant shall submit a lighting plan that verifies the illumination requirements for parking lots as stated in Section 118-474(4) prior to the issuance of the Building Permit. ? , The applicant shall submit a permit from Palm Beach County for the proposed right !Um1uc.Vd median opening in Hood Road prior to the issuance of a building per m t If Palm Beach ounty s Access Management Plan prohibits the median opening, a method for eastbound traffic to access the project must be concluded to the satisfaction of the Growth Management Department and Palm Beach County Engineering Department prior to the issuance of a building permit. 3. The drainage easement and the Seacoast Utility Authority easement that extends off - site to the west through the Gardens Presbyterian Church site, and to the north through the MacArthur Foundation parcel shall adhere to all tree protection codes, and shall not encroach into the upland preserve sites, nor the future parkway area consisting of a 90' wide buffer area east of the Central Boulevard road right -of -way. Prior to land alteration/construction for improvements on the MacArthur Foundation parcel, a tree inventory of the parkway and drainage easement areas shall be provided to City staff. At a minimum, the land alteration/construction within said easements shall provide for the protection of trees greater than 10" in diameter, including but not limited to meandering the easement to avoid any large tree, preserve, and parkway area. Mitigation shall be required for all tree loss. A tree mitigation plan shall be prepared and approved by the City Forester, prior to off -site land alteration and prior to the easements being recorded. The receiver area for the tree ,mitigation shall be the parkway area. Trees less than 10" in diameter shall be replaced one tree for one tree. Trees greater than 10" in-diameter shall be replaced three trees for every one tree removed. The minimum size replacement tree shall be 12' tall. There shall be one hundred, one gallon container size, Saw palmetto plants installed within the parkway area. 4. The Site Construction Plans and the Boundary Plat for the drainage easement and for the legal positive outfall and the Seacoast Utility Authority shall be reviewed and approved by the City prior to the recordation of the plat. S. Temple Beth David shall landscape and irrigate 120' of the 500' Hood Road median. The Temple shall also be responsible for its portion of the landscape maintenance within the median. The landscaping shall adhere to the Hood Road landscape plan prepared by the Gardens Presbyterian Church and shall be installed at the same time the Gardens Presbyterian Church implements said improvements. b. All exotic invasive plants shall be removed from the site prior to the Certificate of Occupancy. 7. If the City finds the maintenance of the grass parking area is in disrepair or poor appearance, the City shall notify the property owner in writing that within thirty (30) days of said notice the deficiencies shall be rectified. Should the deficiencies not be corrected within the said thirty (30) days, the City may require the parking area to be totally or partially paved to City standards within one hundred fifty (150) days upon written notification. 8. Prior to the issuance of the first building permit, an executed agreement between Trustees of the Temple Beth David and Gardens Presbyterian Church concerning the sharing of infrastructure shall be recorded.
