The Emergency Operations Communications Center (EOCC) mandatory pre-bid meeting will be held May 21, 2009 in council chambers. David Porter expressed the interest of the AIPP board members in being involved early on in planning for art work on the outside of the EOCC building and stated the art account does have funds available. Assistant Staff Liaison Black stated the bus shelter call to artists was not published because the City's attorney is not yet satisfied with the document, but a June 1, 2009 issue date is possible. However, since that time, the applicant has made some modifications to the art work and is required to come before the Art in Public Places Board again for consideration for final approval. The following are the modifications that were made since the last approval: • The applicant is proposing to change the materials of the mosaic art from the glass tile mosaic to ceramic mosaic tile; • There have been color modifications to two (2) art pieces previously approved for the east elevations of the office building; • In the previous approval, there was some confusion as to the locations of the exact art pieces to the exact locations; therefore, this final approval has the final locations of the artwork; and • Lastly, staff has included a recommendation of approval which provides a new date for the installation of the artwork, therefore, not restricting the issuance of the CO for the development. Ferris [X] Not Required • Lighting Proposal Meeting Date: June 16, 2009 Petition AIPP-08-12-000023 BACKGROUND On March 6, 2003, the City Council adopted Ordinance 7, 2003, which approved the Legends at the Gardens Mixed-Use Planned Unit Development (PUD). On September 4, 2007, the City Council adopted Ordinance 21, 2007 and Resolution 79, 2007, for the master site plan amendment and conditional use for a drug store and general office building on the 3.82-acre site of Legends at the Gardens Mixed-Use Planned Unit Development. Resolution 79, 2007 contains a condition of approval which states that the art in public places must be installed prior to the issuance of the first certificate of occupancy. DISCUSSION Orna Miller, Orna Miller Consulting, appeared before the Art in Public Places Board for a workshop on February 17, 2009, to discuss with the Board various artists and mosaic ideas for the project. The Board was supportive of the concept and encouraged the applicant to move forward with the selection of an artist. The Board also encouraged the utilization of a bioscience theme because of the proximity of the site to Scripps. On April 21, 2009, the applicant came before the Art in Public Places Board with concepts from two artists, Nadine Floyd and Janie Casoria. The Board encouraged the applicant to ask for more abstract artwork and asked the applicant to come back with final renderings. At the May 19, 2009, Art in Public Places Board meeting, the board members approved 7-0 the proposed five (5) mosaic art pieces for the Legends at the Gardens art in public places requirement. However, since that time, the applicant has made some modifications to the art work and is required to come before the Art in Public Places Board again for consideration of final approval. PROPOSED ART IN PUBLIC PLACES ANtist The applicant has decided to work with one artist, Valter De Morais. The art that is being proposed is five (5) separate contemporary and colorful mosaic art pieces that will reflect the abstract theme of Bio-science (please see biography and resume attachec�. Proposed ArtwoNk & Location The applicant is proposing five (5) separate wall mounted mosaics that each measure 8`x 6' and will be placed on the exterior second story walls of each of the buildings. The Walgreens building will have a total of three (3) mosaics; one (1) on the north elevation (facing Donald Ross Road), one (1) on the east elevation, and one (1) on the south elevation. The office building, which is adjacent to the Walgreens building, will have two (2) on the eastern elevations (facing the Walgreens building). 2 Meeting Date: June 16, 2009 Petition AIPP-08-12-000023 Lighting The applicant has contracted with a lighting company, Unique Lighting Systems, Inc., to provide two (2) fixtures at the base of each art piece (up-lighting the art) that will illuminate the face of the art. The lighting will be used to accentuate the texture of the surface of the artwork and at the same time define the overall portrait of the artwork for each of the pieces. BUDGET In accordance with Section 78-261(d) of the Land Development Regulations entitled Requirements for art or fee in lieu of art, all budgets for new construction of private developments shall include one percent (1 %) of the total budget for vertical construction as a fee for art in public places. The subject fee shall be utilized by the developer for the provision of artwork on the project site, ar the developer may choose to contribute one percent (1%) of the total vertical construction costs directly to the City for the provision of art on public property. Vertical construction costs for the Legends at the Gardens Walgreens and general office building are estimated at $3,100,000.00 which includes the 1% allocation for public art. The budget for the proposed AIPP program is estimated to be about $53,132, which is $22,132 over what is required. The public art allocation breaks out as follows: $12,500 for the concept, design, materials, fabrication, packing and transport, and over sight of installation; $24,282 for mosaic fabrication by Creative Mosaic Designs for the materials, complete fabrication of mosaic murals using hand glazed ceramic tile, packing & shipping, fabricator oversight of installation; $3,750 for the installation of all five art pieces; $4,500 for the lighting of the five pieces; and $8,100 for the art consultant professional services for a total of $53,132. STAFF RECOMMENDATION Staff is recommending approval of the subject petition with the following conditions of approval: 1. The Applicant shall submit digital photographs of the installed artwork within sixty (60) days of completion. (Planning and Zoning) 2. Prior to the acceptance of the art for the Legends at the Gardens, the Applicant shall submit a copy of its logo and any mission statement of its organization, with authorization for the City to use such information in future publications. Within 56 calendar days (8 weeks) after City Council approval, the installation of all approved artwork shall be complete or the City shall have the option of withdrawing the escrow for deposit being held per Section 78-261. WESTCO DEVELOPEMNT, with the help of ORNA ART CONSULTING, INC. (OAC) will make every effort to comply with and meet the standards of the code and city ordinances as it pertains to this project. Location and Scope: Approximately, two to four large scale works of art will be commissioned, acquired and installed at the planned site named LEGENDS @ PALM BEACH GARDENS, located at the south west corner of Donald Ross Road and Central Blvd, in Palm Beach Gardens. The dimensions for each artwork are 8'H x 6'W. The artwork will be installed on the exterior walls, at the 2"d floor level, as follows: one on the north elevation of the Walgreens' structure, one on the south elevation of the Walgreens' structure, and two on the east elevation of the office building. The exact number of works of art will be determined upon final pricing of artwork and materials selected. (see attached site map and elevation) Budget: The total budget for the art project is currently $31,000, which is in accordance with PBG city ordinances. A complete detailed and feasible budget will be produced. Art Program Conce�t: Contemporary and colorful2D works of the highest quality will be selected to complement the new structure, which is Mediterranean in style and decor. The artwork will be abstract in nature and encompass elements which may reflect themes related to bio-tech science (due to the site's proximity to Scripps and the developer's desire). To create enthusiasm and a meaningful source of enjoyment, it is important that the artwork is non controversial as the attempt is to appeal to as many of the building's tenants and the public at large Goals and benefits: • The art will help to create an environment of good taste for the people that live and work in the community, as well as for visitors. • The art will reflect qualities of integrity and sophistication that will contribute to the city's overall prestigious image. The artwork will be abstract in nature and encompass elements which may reflect themes related to bio-tech science (due to the site's proximity to Scripps). The art work will be colorful and complement the color scheme and Mediterranean style of the structure. Dimensions: Each piece will measure 8'H x 6'W. Medium: The commissioned art will be reproduced on tile. The tile will be of the highest quality, durable and suitable to withstand the elements. Individual tile size is to be determined based upon compatibility and the image selected. Installation and Maintenance: The art work will be installed by a professional installation crew, insured and bonded. This will insure proper installation, the appropriate maintenance over time, durability and long term enj oyment of the art. Li�hting: OAC will consult with the developer and his professional licensed team (particularly architect and electrical engineer) regarding the appropriate lighting for the art. Time Frame: OAC, in coordiriation with Westco, anticipates the completion of this art project to be around June of 2008. That's the Valter De Morais art world. His works reveal his visionary impression of our everyday life and also reflect his great sense of humor that is always present in all of his paintings. Morais was born in Sao Jose dos Campos, Sao Paolo, Brazil in 1948. He has been committed to fine arts since he was 15 years old. Morais opted to dedicate his life to painting a happy worid. ��It's a pleasure to know that my paintings can create a nice environment. Valter De Morais became a professional painter in 1981, when he received a bachelor of Fine Arts degrees from the University of Mogi das Cruzes in Sao Paulo. He also has had an academic experience teaching art for many years at the University, where he could contribute and share his knowledge and passion with hundreds of students. In 1988, he moved to the USA, and has been devoted to creating his art full time. Valter De Morais' works are deeply rooted in the cubism and pop art style, a movement that emerged in the late 1950's. His works are inspired by his own romantic feeling of the world. His medium is diverse as he specializes in, acrylics, oil, water color, air brush and large size murals. Valter's talents are very diverse ranging from pop art to Caribbean landscapes to portraits and hyper-realism. Valter's paintings are characterized by deep perspective, colorful backgrounds, and unexpected dimensions. His works are in galleries and collections world-wide, including a portrait of Princess Ann, which hangs in Buckingham Palace. Valter tremendous talent has won him numerous awards and first place in competitions since he has begun his artistic career in Brazil in the 70's. He is very active in charity work including his up-coming one man show in Italy to benefit the children of Tanzania. Other works of his have sold for tens of thousands of dollars to help Aids, Children Cancer and Parkinson. In 2000, Valter was chosen from among thousands of artists to participate in the Central Park Cow Parade, NY, to help find cure for Parkinson. Replicas of his vibrant and colorful Boca Bovine design are still selling all over the world. Valter's prolific commissioned artwork includes a design for Absolute Vodka, the official logo for the Ladies Professional Billiards Association (a hobby in which Valter has become very accomplished), as well as a poster for worid champion Allyson Fisher. Nature of Proposed Request On behalf of the petitioner, Land Design South of Florida, Inc. is requesting comments and recommendations by the Art in Public Places Advisory Board. The recently approved project is a redevelopment project that seeks to enhance the value of the site to the City of Palm Beach Gardens and the surrounding residents. The applicant, as required by the development order and Land Development Regulations, is proposing to enhance the project with Public Art at the terminus of the main pedestrian connection in the Parkway Buffer. This location has been coordinated with city staff during the site plan approval process and the applicant selected this location because of the high visibility from Hood Road as well as the enjoyment of those who visit the center. Property History & Site Characteristics The 10.00-acre subject property is located at the northwest corner of Hood Road and Alternate A-1-A. The subject property was recently annexed into the City of Palm Beach Gardens and recently received approval of a Comprehensive Plan Amendment and Rezoning to Commercial and Commercial General, respectively. The site is currently occupied by a campground/RV facility that will be replaced by the neighborhood commercial shopping center as proposed on the recently approved site plan. Land Development Regulations The stated intent of the Palm Beach Gardens Land Development Regulations are to provide artwork that is "tangible creations by artists exhibiting the highest quality of skill and aesthetic principals and includes all forms of the visual arts conceived in any medium, material, or combination thereof." The City's Land Development Regulations also require the City to "Protect and enhance the aesthetics and character of all parts of the city", and "Protect and conserve the value of land, buildings and improvements and minimize conflicts among uses of land and buildings." The quality and design of the artwork and development will enhance the aesthetics of this neighborhood and is consistent with the Land Development Regulations. The opportunities and uses provided, combined with the quality and nature of the artwork will result in an overall project that will serve as an asset to the surrounding community and be an aesthetically pleasing addition to the City of Palm Beach Gardens. Parkway Overlav District In addition to the meeting the guidelines set forth in the Art in Public Places Land Development Regulations, the applicant closely coordinated with city staff to locate the Public Art in a location that would benefit the community, the city, and the development. The applicant accomplished this by using the Palm Beach Gardens Parkway Overlay District requirements to satisfy a variety of objectives. These objectives include preserving the urban beauty through landscape requirements, provide residents with a safe and aesthetic multiuse pathway system, and provide a buffer between designated roadways and the adjacent development. These goals allowed for the applicant to use the pedestrian path that is incorporated into the 55- foot corridor buffer along the property's Hood Road frontage as required by the Parkway Overlay District. Art in Public Places The City of Palm Beach Gardens Chapter 78-261 of the Land Development Regulations details the creation of an Arts Advisory board and the requirements for new developments to provide art in public places. The proposed site plan has reserved a prominent position within the 55' corridor buffer to site the public artwork. The developer will coordinate with the City to assure that the requirements for the purchase and maintenance of the public art is met. a. Visibility: The proposed public art location is visible to both internal and external pedestrian and vehicular traffic. b. Planning Integration: Again, all public art locations are highly visible and serve as integral components of the proposed development. c. Landscape Integration: All landscape has been designed to complement the proposed art location and is further complimented by the proposed artwork. d. Lighting; All proposed public art will be tastefully lit in an unobtrusive manner. Proposed Construction Schedule and Budqet Fall 2009 — Site Clearing/Land Development Spring 2010 — Vertical Site Construction Fall 2010 — First Certificate of Occupancy Vertical Construction Budget = +/- $600,000 Art in Public Places Budget =+/- $60,000 Artists The applicant has a specific artist that they would like to commission however this application includes one other artist that could be considered by the Board. Both a►tists have said they are able to meet the project deadlines and budget. The attached information has been provided to better assist the Art in Public P/aces Advisory Board and City Staff to determine if the proposed artist and type of artwork meets the intent of the Land Development Regulations. Frenchman's Crossing Page 2 of 12 June 05, 2009 Robert St. Croix Contact Information 1400 Alabama Avenue #6 West Palm Beach, FL 33401 Phone:(561) 835-1753 Fax: (561) 835-1819 Biography/Personal Statement Robert St. Croix's career began in the early 1970's as a street artist in San Francisco however quickly gained a reputation for metal wall and table designs made of copper and brass sheet. He was also notorious for pioneering water sculptures in copper and driftwood, many of which were kinetic, utilizing water pressure to move metal wheels, bearings and cubs. In 1974 he opened an "Art and Crafts" gallery at Bodega Bay in Northern California. He a/so began showing water and metal sculptures in San Francisco area craft galleries. In 1976, he moved to Lake Tahoe, Nevada and opened a sculpture studio and art gallery to have freedom to create more complex metal sculptures, such as life sized figured, mobiles, and small figurative bronzed castings. Perfecting his craft, Robert moved to Hawaii in 1978 and enrolled in the University of Hawaii to learn art foundry practices and procedures. There he began showing sculptures in better known galleries, such as Gallery Hawaii and Center Art Galleries. Moving back to the Mainland (Minden, Nevada) in 1983, Robert opened his own art bronze foundry. Within two years he moved his art studio to Newcastle, California and La Porte, California. He began producing limited edition bronzes and exhibiting sculptures at Art Expo New York and Art Expo Los Ange/es. His gallery's exposure expanded into several states. He also opened his own gallery in Sausalito, California. His last move was in 1990 to West Palm Beach, Florida. There he opened his own studio and built an art bronze foundry. He established a reputation for building life size figurative bronzes. His first monumental bronze was completed in Michigan during 1996 (17 feet tall), and a second in 1997 at Key Largo, Florida (21 feet). He a/so opened his foundry to other artists for casting and restoration of art bronzes. In 1998, he began a series of life size limited edition bronzes, "Homage to the Masters'; which three dimensionlizes and adds to selected paintings of contemporary masters. He has been pioneering new techniques and applications of automotive lacquers and classical patinas on bronze sculptures. The gallery showings have expanded into some of the nations finest art galleries. His commissioned works are now exhibited in collections in Europe, Asia, North America, and Latin America. Because of the special nature of each session the CPA is sure to be very interesting, exciting and even a little fun. The format for the academy will be a three hour class that meets in the Palm Beach Gardens Police Headquarters on six consecutive Wednesday evenings from 6:00-9:00 pm starting September 16th and running through October 21, 2009. A graduation dinner will be held on Thursda_y, October 29th for recruits who complete the course, their guests, participating instructors and other invited guests. The CPA is funded by The Palm Beach Gardens Police Foundation. There is however, a$2�.00 fee for class materials and a class polo shirt. Recruits are required to commit to attend all six sessions to ensure the Academy's success. Your committee is invited to nominate two members to attend the Palm Beach Gardens Citizen Police Academy in September 2009. Please complete the attached interest form for your members and return it by July 15. 2009. Enrollment will be on a first- come, first served basis and is limited to only 25 recruits.
