6 The May 1, 2008 Regular Meeting of the City Council of the City of Palm Beach
7 Gardens, Florida, was called to order at 7:03 p.m. in the Council Chambers of the
8 Municipal Complex, located at 10500 North Military Trail, Palm Beach Gardens, Florida,
9 by Mayor Eric Jablin.
10 I. PLEDGE OF ALLEGIANCE
11 II. ROLL CALL
12 The City Clerk called the roll and the following elected officials were found to be in
13 attendance: Mayor Eric Jablin, Vice Mayor David Levy, Councilmember Joseph Russo,
14 Councilmember Jody Barnett and Councilmember Robert Premuroso.
15 III. ADDITIONS, DELETIONS, MODIFICATIONS
16 Additions --None.
17 Deletions — None.
18 Modifications — Public Hearings — Part I, Quasi - judicial
19 Resolution 27, 2008 — North County Regional Library Site Plan Amendment. Applicant
20 is requesting additions to Condition 13 waiving surety and posting of bond for the North
21 County Regional Library Expansion.
22 Motion
23 Vice Mayor Levy made a motion for approval of the Additions, Deletions and
24 Modifications as read into the record by the Mayor. Councilmember Barnett seconded.
25 The motion carried unanimously, 5 -0.
26 IV. ANNOUNCEMENTS AND PRESENTATIONS
27 Mayor Jablin welcomed and recognized Boy Scout Troop 155 for their citizenship in the
28 community.
29 V. ITEMS OF RESIDENT INTEREST AND BOARD /COMMITTEE
30 REPORTS
31 Councilmember Jody Barnett announced that Thursday, May 1, 2008 is Law Day, which
32 is part of Law Week. For anyone who is interested free legal advice is available during
33 the week by calling the Florida Bar.
34 Vice Mayor David Levy stated the Palm Beach Gardens High School Men's Lacrosse
35 Team won the State Championship. It is a club, which means there is no division between
36 small and large schools, private or public; they are the best in the state for every high
37 school. Vice Mayor Levy also announced that Friday, May 16, 2008 is Ride Your
38 Bicycle to Work Day.
39 Councilmember Russo announced that he and Mayor Jablin visited the Veterans Hospital
40 on Monday, April 28, 2008 where they were recognized for the more than $20,000
41 contribution from the Mayor's Veterans Day Golf Classic. Mayor Jablin committed to
42 holding the event again this year. Councilmember Russo stated he attended a preliminary
43 meeting for the Honda Classic and the numbers are up from last year. The Honda Classic
44 will contribute more than $500,000 to local charities. Councilmember Russo requested
45 Mayor Jablin write a letter to Governor Crist should the Farm Bill pass. Councilmember
46 Barnett stated her support.

I Councilmember Premuroso stated he attended his first Budget Oversight Committee
2 meeting.
3 Mayor Jablin expressed his support for the Honda Classic's commitment to autism. He
4 announced the Give a Smile to a Child Golf Classic scheduled for Saturday, May 17,
5 2008 and announced the Town Hall Meeting on Wednesday, May 14, 2008 at 7:00 p.m.
6 in Council Chambers.
7 VI. CITY MANAGER REPORT
8 City Manager Ron Ferris asked Recreation Director Charlotte Presensky to give her
9 presentation. Recreation Director Presensky explained the survey conducted at the Tennis
10 Center. The majority of responses came in the categories of very good and excellent.
11 Summer camp operates from June 9 through August 15, 2008. Forty -seven different types
12 of camps are offered. On the first day of registration 44 percent of all of the camp slots
13 available were filled. Recreation Director Presensky stated she believes the present
14 economic conditions and the quality of the camp programs offered are what make them
15 so popular. Resident registration takes place until Monday, May 5, when non - resident
16 registration is open. Non - residents pay a 30 percent higher fee. All costs, except basic
17 maintenance and staff positions, are covered by program fees. Councilmember Russo
18 stated he is not sure the suggestion for higher camp fees so a profit is realized is a good
19 idea because these are services provided to our residents. Recreation Director Presensky
20 stated the Tennis Center is also revenue neutral except for basic maintenance.
21 Councilmember Premuroso inquired about non - resident attendance. Recreation Director
22 Presensky stated it is approximately 15 percent, but may be lower this year.
23 VII. COMMENTS FROM THE PUBLIC
24 Joan Elias, 1009 Diamond Head Way, Palm Beach Gardens, stated she was happy to hear
25 the Honda Classic did so well this year and made more money for charity. She
26 encouraged continued attendance and support for the event. Ms. Elias stated she visited
27 Hilton Head, South Carolina, recently and the traffic congestion there is much worse than
28 here. She is happy to live in Palm Beach Gardens.
29 Carolyn Chaplik, 715 Hudson Bay Drive, Palm Beach Gardens, stated the problem with
30 the lighting at the Paloma development. City Manager Ron Ferris stated staff is working
31 with the developer and the globes are being replaced with a type that directs the light
32 directly down onto the ground.
33 Tom DeRita, Palm Beach Gardens, stated he received an e -mail from Jordan Connor
34 informing him the Farm Bill is dead. Mr. DeRita stated the budget is tight and he will be
35 looking for innovative ways to bring new business to Palm Beach Gardens. Mayor Jablin
36 thanked Tom DeRita for his work.
37 Pat Hughey, Palm Beach Gardens, stated her intent to donate a plaza brick to the City in
38 honor of the Palm Beach Gardens Men's Lacross Team winning the State Championship.
39 Councilmembers unanimously agreed.

41 a. Approve Minutes from March 6, 2008 regular City Council meeting.
42 b. Approve Minutes from March 20, 2008 regular City Council meeting.

Motion
Vice Mayor Levy made a motion for approval of the Consent Agenda. Councilmember
Barnett seconded. The motion carried unanimously, 5 -0.
IX. PUBLIC HEARINGS
Part I — Quasi - judicial
Mayor Jablin announced the procedures that would be followed in tonight's quasi -
judicial proceedings. The City Clerk swore in all those intending to offer testimony in
any of tonight's public hearings. The City Clerk read Ordinance 5, 2008, Resolution 26,
2008 and Resolution 27, 2008 by title.
a. Ordinance 5, 2008 — (2nd reading and adoption) North County Government Center
Planned Community Development Amendment. An Ordinance of the City Council of the
City of Palm Beach Gardens, Florida relating to the rezoning of the North County
Government Center Planned Community Development (PCD) located at the Southwest
corner of PGA Boulevard and Campus Drive; amending Ordinance 18, 1995 and
Ordinance 54, 1997 to transfer and amend the master site plan approval and related
conditions to a separate Resolution; rezoning the 6.99 -acre Department of Motor
Vehicles parcel from (PCD) to Planned Development Area (PDA) with an underlying
zoning designation of public or institutional (P /I); and providing an effective date.
[Resolution 26, 2008 is a companion item to Ordinance 5, 2008 and will require
Council action.] Resolution 26, 2008 — Adoption of the North County Government
master site plan and conditions of ap rp oval. A Resolution of the City Council of the City
of Palm Beach Gardens, Florida amending the North County Government Center Planned
Community Development (PCD), located at the Southwest corner of PGA Boulevard and
Campus Drive, to reconfigure certain parcels, provide the required linkage roads
throughout the parcels, relocate the environmental preserve to the West side of the North -
South linkage road, eliminate the 6.99 -acre Department of Motor Vehicles parcel from
the limits of the PCD, as more particularly described herein; providing waivers;
providing conditions of approval; and providing an effective date. [Resolution 27, 2008
is a companion item to Ordinance 5, 2008 and will require council action.]
Resolution 27, 2008 — North County Regional Library Site Plan Amendment. A
Resolution of the City Council of the City of Palm Beach Gardens, Florida amending the
site plan for the North County Regional Library, located on the Northwest corner of
Campus Drive and Fairchild Avenue, to allow a 14,612 - square -foot addition to the
existing 24,920 - square -foot facility; providing waivers; providing conditions of approval;
and providing an effective date.
Mayor Jablin opened the public hearing and requested ex parte communication on
Ordinance 5, 2008, Resolution 26, 2008 or Resolution 27, 2008 as amended, to which
none was declared.
Donaldson Hearing, Cotleur & Hearing, representing Palm Beach County on the North
County Government Center PCD modification, introduced Melanie Borkowski and Eric
McClelland, Palm Beach County and Anna Cotrell, Senior Planner. Mr. Hearing
presented information on the linkage roads, reconfiguration of parcels to accommodate
the linkage road and the site plan for the previously approved library expansion. The
requested waivers include: 1) parking, the proposed expansion provides for more parking
than code requires; 2) sidewalk within the requirements of other PCDs, and 3)
requirement to have a boundary plat prior to the first building permit. Mr. Hearing

I explained Resolution 27, 2009 modification to Section 2, No. 13, is relative to the
2 financial surety that is typically posted with the City. The same procedure is requested
3 that was used when the courthouse was constructed which obligates the County to
4 document to the City that the funds are fully appropriated and available to complete the
5 project.
6 Mayor Jablin requested questions. Vice Mayor Levy stated his agreement.
7 Mayor Jablin opened the public hearing.
8 Pamela Porath, 11049 Monet Woods Road, Palm Beach Gardens, inquired if the
9 environmental preserve will be reduced in size and if it will remain natural. Donaldson
10 Hearing explained it will remain an environmental preserve with paths. It is not intended
11 to be a park.
12 Nancy Denholm, Director, Eissey Theater, Palm Beach Community College, 3160 PGA
13 Boulevard, Palm Beach Gardens, stated her support for the library project.
14 Steve Tipolt, 11186 Monet Terrace, Palm Beach Gardens, inquired about the parcel
15 directly next to the library. Donaldson Hearing explained the reconfiguration of the
16 property and should it ever be developed, a process such as the current one for the library,
17 will take place. It is Palm Beach County land and will always remain so according to the
18 PCD.
19 Katie Gardener, 11244 Monet Ridge Road, Palm Beach Gardens, inquired if the
20 environmental reserve will always keep that designation. Donaldson Hearing explained
21 the platting process and ensured it will always remain an environmental preserve. Ms.
22 Gardener also inquired about the planned connecting road from PGA Boulevard to
23 Fairchild Avenue. Mr. Hearing stated it is shown as a tertiary road and there is no plan in
24 the immediate future for the road's construction. Mayor Jablin assured Ms. Gardener that
25 surrounding residents would be notified of any changes to the area.
26 With no further public comments, Mayor Jablin closed the public hearing and brought
27 Ordinance 5, 2008 back up to Council for discussion.
28 Motion
29 Vice Mayor Levy made a motion for approval of Ordinance 5, 2008 on second reading
30 for adoption. Councilmember Russo seconded. Motion carried unanimously, 5 -0.
31 Motion
32 Vice Mayor Levy made a motion for adoption of Resolution 26, 2008 for approval.
33 Councilmember Barnett seconded. Motion carried unanimously, 5 -0.
34 Motion
35 Vice Mayor Levy made a motion for adoption of Resolution 27, 2008 as amended for
36 approval. Councilmember Russo seconded. Motion carried unanimously, 5 -0.
37 Part II — Non -Quasi judicial
38 X. RESOLUTIONS
39 a. Resolution 34, 2008 — Communications site lease Agreement. A Resolution of the
40 City Council of the City of Palm Beach Gardens, Florida approving a Communications
41 Site Lease Agreement with American Towers Asset Sub, LLC; authorizing the Mayor
42 and City Clerk to execute the Agreement; and providing an effective date.
43 City of Palm Beach Gardens Police Department Major Ernie Carr requested approval for
44 Resolution 34, 2008.

I Motion
2 Vice Mayor Levy made a motion for adoption of Resolution 34, 2008. Councilmember
3 Barnett seconded. Motion carried unanimously, 5 -0.
4 b. Resolution 35, 2008 — Procurement of radio subscriber units. A Resolution of the City
5 Council of the City of Palm Beach Gardens, Florida approving the purchase of radio
6 subscriber units (mobile and portable) from M /A -COM for use on the new radio system;
7 and providing an effective date.
8 Motion
9 Vice Mayor Levy made a motion for approval and adoption of Resolution 35, 2008.
10 Councilmember Barnett seconded. The motion was approved unanimously, 5 -0.
11 XI. ORDINANCES (For Consideration on First Reading)
12 None.
13 XII. ITEMS FOR COUNCIL ACTION/DISCUSSION
14 a. Select dates for the July and August Council meetings. Council chose July 17, 2008
15 and August 21, 2008.
16 XIII. CITY ATTORNEY REPORT

19 Councilmember Premuroso stated that the left turn signal coming from Gander Mountain
20 at Northlake Boulevard allows only five cars to pass. He asked that the proper department
21 be asked to lengthen the turning time.

motion to adjourn. Councilmember Barnett seconded. Motion carried unanimously, 5 -0.
