ROLL CALL 9 PRESENT: Mayor Joseph Russo, Vice Mayor David Levy, Councilmember Eric Jablin 10 Councilmember Jody Barnett and Councilmember Robert Premuroso. 11 HL ADDITIONS, DELETIONS, MODIFICATIONS 12 MODIFICATION TO CONSENT AGENDA 13 b. Resolution 41.2009 — Dog Days Plat was pulled from the Consent Agenda and moved to 14 Public Hearings Part 1, Quasi - judicial as new item "d." 15 Vice Mayor Levv made a motion approving the modification to the agenda. 16 Councilmember Jablin seconded. 17 Motion passed 5 -0. 18 IV. ANNOUNCEMENTS AND PRESENTATIONS 19 a. William T. Dwyer School Boy's Lacrosse Team — Mayor Russo recognized the team 20 members and coaches for their IA Club Lacrosse State Championship and awarded 21 achievement certificates. 22 b. Chili Cook Off Sponsor &g2gtion — M&Ar Russo and Recreation Director Mike 23 Kel v recognized the Palm Beach Gardens Medical Center, John D. and Catherine T. 24 MacArthur Foundation, Palm Beach Post and The Gardens Mall for their sponsorship of the 25 event. 26 c. Recognition of the Community Action Support Team (CAST) for their work on the 27 Strassler's home on 5th Court in cooperation with the Re- building Together Program of the 28 Palm Beaches. Marilyn Jacobs and Joanna Akin thanked City employees who volunteered 29 on their own time and participated in the re- building effort. 30 V. ITEMS OF RESIDENT INTEREST AND BOARD /C0MNUTTEE REPORTS 31 Councilmember Barnett reported on and recommended the Self - Defense Awareness & 32 Familiarization (SAFE) program, the Parks and Recreation Advisory Board meetings for June 33 and July, 2009 are canceled, the Dog Park has reopened, suggested Oaks Park be considered 34 for art/playground equipment. 35 Vice Mayor Lew reported on the League of Cities Directors meeting, attended the William 36 T. Dwyer High School graduation. 37 Councilmember Premuroso reported on the objectives of the Business Development Board 38 (BDB), attended the Palm Beach Gardens High School graduation. Reported the original 39 Palm Beach Gardens High School will be torn down this summer. 40 Councilmember Jablin acknowledged Councilmember Barnett's suggestion for 41 playground art/equipment and would put the suggestion before the Art in Public Places 42 Advisory Board, reported on the Metropolitan Planning Organization (MPO) meeting and 43 discussed SB 360. Councilmember Barnett suggested working with the other North County 44 cities to discuss the impacts of SB 360. 45 Mayor Russo reported on the Board of Directors meeting of the Children's Healthcare 46 Charity, met with Ro>eter Dean Sta&uw Manager Joe Pinto reported on the Bioscience 47 Land Protection Advisory Board (BLAB) meeting, attended the breakfast with Congressman CITY OF PALM BEACH GARDENS REGULAR COUNCIL MEETING PAGE 1 05.2109 I Klein and requested that each Council Member advise City Manager Ferris of their 2 upcoming schedules so a budget meeting can be scheduled. 3 VL CITY MANAGER REPORT 4 City Manager Ferris introduced Growth Management Administrator Kara Irwin who 5 reported on property annexation and specific considerations regarding Osprey Isles and 6 Carlton Oaks. Council Members directed City Manager Ferris to draft a letter informing 7 Carlton Oaks and Osprey Isles that the City of Palm Beach Gardens is not interested in 8 annexation at this time. 9 VII. It applies equally to members of advisory and non- advisory bodies who are presented with a voting conflict of interest under Section 112.3143, Florida Statutes. Your responsibilities under the law when faced with voting on a measure in which you have a conflict of interest will vary greatly depending on whether you hold an elective or appointive position. For this reason, please pay close attention to the instructions on this form before completing the reverse side and filing the form. INSTRUCTIONS FOR COMPLIANCE WITH SECTION 112.3143, FLORIDA STATUTES A person holding elective or appointive county, municipal, or other local public office MUST ABSTAIN from voting on a measure which Inures to his or her special private gain or loss. Each elected or appointed local officer also is prohibited from knowingly voting on a mea- sure which inures to the special gain or loss of a principal (other than a government agency) by whom he or she is retained (including the parent organization or subsidiary of a corporate principal by which he or she is retained); to the special private gain or loss of a relative; or to the special private gain or loss of a business associate. Commissioners of community redevelopment agencies under Sec. 163.356 or 163.357, F.S., and officers of independent special tax districts elected on a one -acre, one -vote basis are not prohibited from voting in that capacity. For purposes of this law, a "relative" includes only the officer's father, mother, son, daughter, husband, wife, brother, sister, father -in -law, mother -in -law, son -in -law, and daughter -in -law. A "business associate" means any person or entity engaged in or carrying on a business enterprise with the officer as a partner, joint venturer, coowner of property, or corporate shareholder (where the shares of the corporation are not listed on any national or regional stock exchange). ELECTED OFFICERS: In addition to abstaining from voting in the situations described above, you must disclose the conflict: PRIOR TO THE VOTE BEING TAKEN by publicly stating to the assembly the nature of your interest in the measure on which you are abstaining from voting; and WITHIN 15 DAYS AFTER THE VOTE OCCURS by completing and filing this form with the person responsible for recording the min- utes of the meeting, who should incorporate the form in the minutes.
