The City of Palm Beach Gardens is celebrating being incorporated for 50 years and is in search of an
artist to design, fabricate, and install outdoor art piece(s), or aesthetic enhancement(s) to be placed /
installed adjacent to a lake at the at the southern portion of Lake Catherine Park, site located at 9470
MacArthur Boulevard, Palm Beach Gardens, Florida. The selected artist will design a historical art work
which can be viewed from several different vantage ,ppints' The exterior art and amenities project should
be conceptually unique and shall include memorializing' important events in history for the City of Palm
Beach Gardens. The budget for the project is $195;000.00 and covers all costs associated with the
project including artist fee, design, fabrication, construction, installation, and travel / transportation. The
successful Artist will have demonstrated through the submission of proposal materials, the capability to
successfully complete the project with an innovative approach to the exterior space.

part, with or without cause, to waive any informalities and technicalities, and to award the Contract on
such coverage and terms it deems will best serve the interest of the City. Criteria utilized by the City of
Palm Beach Gardens for determining the most responsible Proposer includes, but is not limited to, cost,
whether the Proposer meets the City of Palm Beach Gardens published specifications, the Proposer's

PROJECT SUMMARY
Project: LAKE CATHERINE PARK HISTORY ART PROJECT - CALL TO ARTIST
Location: Lake Catherine Park- 9470 MacArthur Boulevard, Palm Beach Gardens, FL
33410
Budget: $195,000.00 covers all costs associated with the project including artist fee,
design, fabrication, lighting, construction, installation, and travel / transportation.
BACKGROUND
City of Palm Beach Gardens, Florida
The City of Palm Beach Gardens is residence to over 49,000 people and is located on the
southeast coast of Florida; approximately 10 miles north of West Palm Beach, FL (Exhibit 1).
The City was founded in 1959 and therefore is currently celebrating 50 years as a City.
Art in Public Places Ordinance `
The City has had in place an Art in Public Places Ordinance since 1988. This Ordinance
requires that all non-residential developments fluer $1-million in total development cost provide
a percentage of the development cost to public ar#, or contribute to the City's art fund. From the
art fund, the Art in Public Places Board is authorized ta rnake recommendation to the City
Council to purchase works of art for public spaces in and around the City.
Art in Public Places Board and Parks and Recreation Advisory Board
Both the Art in Public Places Advisory Board (AIPP) and Parks and Recreation Advisory Board
(RAB) are comprised of City; residents from a variety of professior�s, all with a strong interest
and commitment to ssnring in the best interest for the public, both in art and in parks.

PROJECT SCOPE
In order to commemorate ihe 50 years of history, the City of Palm Beach Gardens is in search
of an artist to design, fabricate, and i�tstall outdoor historical art piece(s), or aesthetic
enhancement(s) to be placed adjacent to the lake at the southern portion, located at 9470
MacArthur Boulevard, Palm Beach Gardens, Floric3a (Exhibit 2).
The selected artist will design work of art which can be viewed from several different vantage
points. The exterior art and amenities project should be conceptually unique and shall serve to
memorialize important events in history of the City of Palm Beach Gardens. The successful
Artist will have demonstrated through the submission of proposal materials, the capability to
successfully complete the project with an innovative approach to the exterior space as well as
incorporating the history of the City of Palm Beach Gardens.
Exhibit 3 includes ideas and concepts from the Palm Beach Gardens Historical Society,
however, it would be advantageous for the artist(s) to research the history and include their
graphic interpretation within the art piece(s). The art piece(s) should be developed as a place-
specific installation which responds to the characteristics of the designated space within the
park, including, but not limited to, the history, physical environment and diversity of the people
within the community. The project should have a clear benefit to and involvement of the
community. The project should support artistic excellence, and be of high quality. In addition, it
should also include a public outreach or education component. The project location is a passive
park across from a middle school, the ideal concept would allow those to use the park as well as

draw visitors to the park to learn about the history of the City. Exhibit 4 lists web links to audio
files of actual meetings and discussions.
BUDGET
The total not-to-exceed budget for the commission is $195,000.00. The budget includes artist
fees, gallery commission (if applicable), all materials, fabrication, transportation, on-site project
management, installation including any site modifications required, installation equipment,
engineering fees, insurance fees, all artist travel costs to and from the site, per diem expenses,
project documentation, plaques and/or signage, and a contingency to cover unexpected
expenses and all fees, including permits, for all items associated with the art piece(s).
ARTIST ELIGIBILITY
Open to all Artists at least 18 years old. An artist, as defined in Section 78-261 of the City's
Land Development Regulations, means a practitioner in the visual arts, generally recognized by
critics and peers as a professional of serious intent and ability. Indications of a person's status
as a professional artist include, but are not lirnited to, training in the arts, income realized
through the sole commission of artwork, frequent or consistent art exhibitions, placement of
artwork in public institutions or museums, and receipt of honors and awards in the art field.
Artists must be able to demonstrate through t�te submission of proposal materials, a proven
tract record for having successfully integrated artwork an�ilor amenities into outdoor areas
utilizing the materials necessary to meet the project goals and guidelines provided below.

PROJECT GUIDELINES
The artwork, amenities and enhancements must:
(1) Include shade and seating areas for visitors to see the art/history.
(2) History to be vievved from off the pathway as well as along the pathway (uses on

(3) Be fabricated in materials that will withstand the heat, humidity, wind, drought and
other environmental and climatic conditions common to the region as specified by
regulatory codes.
(4) Have an anticipated, 30 year life span.
(5) Have minimal maintenance requirements.

To be at�tisidered for��this project, the following items must be included in the preliminary
submissions. Submissions must be complete for consideration.
The twelve (12);compact discs shall be labeled with name of applicant and "Lake Catherine
History Art Project", The narne° of the single .pdf files shall be titled as follows: "artist
name lake_catherine history_art_project_(insert document title)". For example, "John-
Smith lake_catherine history,�art_project_application". Exception — Images must be in .jpeg
format.
The original hardcopy sheet/document should be labeled with name of applicant. Collate in
exact order, using 8-1/2" x 11" sheets:
(1) Application Form: Complete, sign and date application attached.
(2) Artist Resume: A current resume emphasizing public art experience including
budget size of past projects.
(3) Images: Not to exceed ten (10) digital images printed in color. On compact discs,
images must be in .jpeg format not to exceed 1.8 megabytes. Images must be
scanned at no less than 450 dpi and no greater than 600 dpi. The files should be
named on the disc with name and corresponding number as listed on a separate

visual image identification sheet. Discs not meeting these requirements will not be
eligible for review. These images should be indicative of the type of work that would
be appropriate for this project.
(4) Image List: An annotated image list identifying slides/digital images by number,
artist surname, title of work/project, location of project, major materials used,
dimensions, project timeline (from contract to completion), budget, name of
commissioning agency, Project Manager's name and phone number, and
commissioning agency's goals for the project.
(5) Preliminary Concept Drawings: It is at the Artist's discretion to submit no more
than five drawings to illustrate a preliminary proposal and design concepts. Bonus
points shall be awarded for submitted drawings that demonstrate exceptional
aesthetic quality.
(6) Written Proposal: No more than two pages outlining the relationship between the
slides presented and Artist's proposal; how the proposed work meets the project's
goals and guidelines; and background information that support the Artist's
qualification to complete the project together with all drawings and design concepts
to be attached.
SELECTION PROCESS
The selection process will occur in two phases. In the first phase, the Art in Public Places
Advisory Board and Parks and Recreation Advisory Board will review the submission material,
and select no more than XX semi-finalists. In the second phase, the semi-finalists will present
an in-person, fully-conceived proposal including images, scale models, or other materials which
will illustrate the concept of the proposal to the Board. An itemized budqet must also be included
in the proposal. Each semi-finalist that makes a live presentation will receive an honorarium of
$XX for all materials, transportation and lodging for site visits and presentation of the proposal,
and any other costs a$sqciated with the proposal. Following the presentations, the Art in Public
Places Advisory Board„and Parks and Recreation Advisory Board will select a finalist. The
finalist's proposal will be�reviewed �iy the Boards for comment, and then recommended to the
City Council for approval
SEMI-FINALISTS' REQUIREMENTS
The semi-finalists will be required to perform the work under contract with the City of Palm
Beach Gardens, a sample of which is attached hereto and incorporated herein as Exhibit 5.
Semi-finalists will be required to make a live presentation of their proposal to the Art in Public
Places Advisory Board and Parks and': Recreation Advisory Board on TBD. Presentation
materials must be delivered to the City Clerks Department that day and need to include:
(1) Conceptual Approach: Provide a three-dimensional model or up to four (4) detailed
drawings to define proposal and design concepts. Drawings will need to be disc in
pdf format.
(2) Written Statement: A typewritten proposal that specifies:
a. In detail the proposed public art project;
b. How the conceptual approach relates to the site;
c. How the artwork(s), amenities and/or enhancements address site needs; and
d. How the ar�work(s) will be maintained.
(3) Schedule: Provide a proposed schedule in days from "Notice to Proceed" through
"Ribbon Cutting"; total timeline can not exceed 18 months.
(4) Budget: Inciude a breakdown of the proposed project budget to include the
following: artist fees, gallery commission (if applicable), all materials, fabrication,
transportation, on-site project management, installation including any site

modifications required, installation equipment, engineering fees, insurance fees, all
artist travel costs to and from the site, per diem expenses, project documentation,

the project.

First of all let me thank yau for your efforts iri bringing the liistory' of our
city into the apen, publicly displaying it in an artful manner and making
it available to all current and f.uture residents of the city. VVe pledge our
full support to yaur effor�s.
In reflecting on the discussions at yaur joint meeting, it becazne apparent
to me that there is perhaps a bettei- way to combine history with art
forms. By setting up the individual vi.ewing areas that would be
embellished in some way by an art forzn and dividing these into blocks of
time would not be as meaningful as establishing themes for each of these
areas. In that way the artist/s would have different themes to
incoz-porate im the'ir work, as opposed to trying to capture time or one of
the events that occurred during the period.
May I suggest the following? Each af these items in the ca�e�ories would
be placed in chronological order, defining the locations where they
occurred and the people that were responsible.
• The Birth of Uur City
• People that shaped the City (Elected Ofiicials - Developers, etc.)
• Religions of Our City
• Schools .of Our City (private - public)
• Housing Developments of Our City (plats - gated communities)
• Commercial Developments of the City (shopping centers -- xnalls)
• Athletic Programs in the City (Khory league - PBGYAA)
• Special events that occurred in the City (Hetzel Pageant, World
Cup, Ryder Cup, Citizens tournament, the one day house, etc.)
The mission af the Palm Beach Gardens Historical Society is to collect,
preserve and share the rich history of the City of Palrn Beach Gardens Florida,
for the education and enjoyment of current and future generations.

These are a few suggested topics that could be considered. They like�nrise
could be grouped as indicated wzth several complimentary �hernes joining
them together at the sarn.� station.
By develaping the stations along the walk in this manner, specific items
could be added, when appropriate, in the future, as opposed to building
entirely new stations.
The bottom line is that visitors that view the history of the city vvhile
experiencing the walk would have a continuous story of one of the
thernes idea and not have to carry thoughts from one site tn the next.
This is th.e saxne concept which is used in publishing mathematics books
... each chapter completes a particular concept.

At the joint Art in Public Places (AIPP) and Parks & Recreation Advisory Board (RAB) meeting
on September 3U, 2009, the Boards requested that staff contact the Palm Beach Gardens
Historical Society in order to request that the Society provide a more detailed list of significant
dates/events tllat could be used in a commemorative art design for the Lake Catherine Park. The
Boards would like to include a more defined list of historical events in categorized decades in
order to �llow an artist to depict the past 50 years of Palm Beach Gardens.
The Boards woulci like to include this list of events in the Request for Proposal "Call to Artist"
and allow the artist to design a way to memorialize these events for the City of Palm Beach
Gardens, as well as, commemorate John D, and Catherine T. MacArthur.

I gave some more thought to the information the Lalce Catherine art project will need froin the Histoi•ical Group
to inalce it viable information for a visual and explanatory art project.
I thinic the information needs to be broken down into two categories: Dates and Quantities. The city has had
"historically significant changes" over time and "quantitative changes" over time. I thinlc we should have both
from the Historical Group to give aii artist all the necessary data to come up with an interesting aild informative
history wallc.
I will elaborate below.
To show how the city has grown and may continue to grow, I think it would provide visual significance to have
year dates aud quantities for various tangible items:
These categories might be:
Police cars
Fire trucics
Residents
Acreage or Sq. Miles
City budget
City staff size
Other categories that can be easily quantified over the 5 decades oi the city's life
Tl�.is inforinatioi� might be useful for an artist to graphically show years aiid people count to provide an
immediate understanding of the city's growth.
So, soinething like:

1960: 1 police car.
1970: 25 police cars
1980: 35 police cars
1990: 45 police cars

I thinlc you get the picture. My thought is that the quantitative information can be looked at like a mother's
charm bracelet. As each new child is added to a mother's family, another charm is added to the bracelet. This
quantitative information inight help provide an artist with something to grasp to show the city's growth over
time. It will allow future generations to then add to those graphic elements as the city continues to grow but at a
slower pace.
Other points of historical significance might be:
1. Years when the city hall location and structure changed. Photos of those various city hall buildings. An
artist then may make pre-cast models of each of those structures to visually show how the city went from using
a portable trailer to the building that is currently city hall.
2. Maps of the city boundaries when it was first established (1959) and then again in 1970, 1980, 1990, 2000,
and what its boundaries will look lilce in 2010.

911 Memorial / Art Piece

As you are aware, the Fire Rescue Department was recently advised that the September
11th Families' Association is releasing steel from the World Trade Center's buildings for
use as Memorial / Art Pieces. These steel pieces were salvaged from the buildings after
the disaster on September 11th 2001 and are available free of charge for use in
memorial projects.
I spoke with Fire Chief Bergel and Police Chief Stepp, who both support a 911 Memorial
for the City of Palm Beach Gardens. Myself and Chief Bergel also met with Mr. Ferris
and he agreed with the project and has allowed us to proceed. We have contacted noted
artist Mr. Mark Fuller, whose works are found throughout the City. In addition, Mr. Fuller
also created the City of Hoboken, New Jersey's 911 Memorial / Art Piece. As part of this
project, Mr. Fuller met with hundreds of 911 victims family members and has a great
deal of knowledge related to this endeavor. Mr. Fuller has agreed to donate his time on
this project.
Our goal is to create a Memorial in front of Fire Station Three at 5161 Northlake
Boulevard. We think an art piece with a landscaped area and seating around it, would be
a wonderful way to salute the September 11th victims and their family members. The
plan is to approach the Art in Public Places Board in an attempt to acquire approval and
funding for this project. We feel that the cost of the project would be between $60,000.00
and $70,000.00. This would include some donations of labor and materials from the
community. Mr. Fuller has already located Architectural and Engineering firms that would
donate their time in this effort.
Upon approval, Firefighters from Palm Beach Gardens Fire Rescue would go to New
Jersey to transport / escort the steel to Mr. Fuller's studio, here in Florida. Once here,
Mr. Fuller would create the Memorial / Art piece for placement at Fire Station Three on
Northlake Boulevard.

During the budget discussions for fiscal year 2009-2010, the topic of maintenance of Cit -
owned works of art became a concern. Currently, the City owns and maintains four public i ces
of art (Contiguous Currents, Tri p T yce, B e R i g h t B a c k a n d Dou b le Rain bow) and has ro os
e ig h t f u ture bus shelters and possibly more art at Lake Catherine. The drafted Ordinancd
addresses this concern by providing for the allowance of a portion of the art impact fund to be
used for maintenance of publicly-owned art. It also provides clarification on the selection rocess

a public hearing on October 20, 2009, and the Board recommended approval by a vote

WHEIREAS, the Gity Council deems approval of this Ordinance to be in the best

43 work, exhibition and sales history, and biography.
44 (3) Miscellane�us p/ans, renderings, and details. Artist°s color renderings
45 and/or photographs of proposed artwork; materials sample board; site plan depicting the
46 proposeci location of the artwork; landscape plan, if necessary, depicting additional

landscaping or modifications to existing landscaping; architectural elevations, if
necessary, depicting structures associated with the artwork; lighting location plan and
light fixture details; or other information requested by staff, the art in public places
advisory board, or the city council. All submittals shall be required to provide an
accurate representation of the proposed artwork.
{-E} � Violations. Violation of this chapter shall be subject to enforcement as provided
in article VII.
{�-} � Requirements for art or fee in lieu of art. All new development, except city
projects, where total vertical construction costs of all buildings on a project site are
equal to or greater than $1,000,000.00 shall provide art valued in an amount of one
percent of the total vertical construction costs, as provided in this section and section
78-262. All buildings within planned unit developments and planned community districts
shall be assessed cumulatively towards the art in public places requirement, even if
they are permitted separately. If the aggregate cost of the entire project exceeds the
$1,000,000.00 threshold, each phase of development shall contribute the required one
percent of construction cost towards art in public places for the building project. The art
fee for redevelopment of an existing building shall be calculated based on the
construction costs of the new development, excluding the assessed value of the existing
buildings that are replaced or redeveloped.
(1) Private development. A private developer may choose either to provide
artwork on the project site or to contribute one percent of the total vertical construction
costs to the city's art impact fund. The city's art impact fund shall be interest bearing
with all interest to be retained by the city.
a- b (These subsections shall remain in full force and effect as
previously adopted.)
(2) Art impact fund. When the developer provides a fee in lieu of artwork
pursuant to subsection 78-261(d)(1)b., the following shall apply to the use of the funds:
a. The fee shall be placed in the city's art impact fund. Funds from the
art impact fund may be spent anywhere in the city, and such funds may be spent
on any art or art-related costs such as, but not limited to, lighting, consulting,
landscaping, aesthetic features or enhancements and maintenance of art work.

3 i. Call to artists. If a preferred artist has not been determined, the cit�y
4 issue a call to artists to procure a work or works of art. A selection
5 committee will review the submitted proposals and shall select at least two
6 (2) finalists for consideration by the art in public places advisory board.
7 The art in public places advisory board shall review the finalists' proposals
8 and make a recommendation to the citv council on the selection and
9 commission of the artist and the artwork. The selection and commission
10 of the artist and artwork shall be by written contract between the city and
11 the artist. Final decision making authority regarding the artwork and artist
12 shall be at the sole discretion of the City council.

ii. Artist/artwork selection. The city may utilize funds allocated from the art
impact fund to retain a specific artist for a specific artwork on city-owned
land, a city-owned buildinq, or a facility that is leased or rented by the city.
The selection and commission of the artist and artwork shall be by written
contract between the city and artist. Final decision makinq authority
reqardinq the artwork and artist shall be at the sole discretion of the Citv
council.
iii. Contracts for artwork. Artists, as a part of any commission or contract
with the city for the provision of artwork, shall be required to submit to the
city a"Maintenance and Inventory Sheet", which shall include an annual
cost estimate for the annual maintenance necessary in order to properlx
preserve and maintain the artwork in substantially the same condition that
it was in when accepted by the city.

ii. Art maintenance requirement. When the city council approves the
acguisition a public work of art, the city council shall desiqnate funds from
the art impact fund dedicated to the continual maintenance and
preservation of the subject work of art for a period of no less than twentv-
five (25) years.

to cover any and ali expenses reasonably associated with the
maintenance and areservation of public works of art.
SECTION 2. Chapter 78, Land Development of the Code of Ordinances of the
City of Palm Beach Gardens, Florida is hereby amended at Section 78-751.
"Definitions." by adding new definitions for the terms "Construction cost",
"Development", "Art, artwork, or works of art", and "Artist or professional artist" each of
which shall be placed in alphabetical order in the list of definitions, providing that
"Construction cost", "Development", "Art, artwork, or works of art", and "Artist or
professional artist" shall hereafter be defined and read as follows:
Construction cost means total costs of buildinqs constructed on the site. This
includes total vertical construction of all buildings on a project site, but excludinq site
infrastructure (includinq parkinq garaqes).
Development means anv project to construct or remodel anv private or public
development, except residential and/or residential components of a mixed-use
development, or any portion thereof within the limits of the citv, where total construction
cost equals or exceeds $1,000,000.00.
Art, artwork, or works of art means all tanqible creations by artists exhibitinq the
hiqhest quality of skill and aesthetic principles and includes all forms of the visual arts
conceived in anv medium, material, or combination thereof, including but not limited to
paintinq, sculpture, fountains, enqravinq, carvinq, frescos, mobiles murals collages
mosaics, bas-reliefs, tapestries, photographs, drawinqs, artist-desiqned seating or
other functional art pieces and collaborative design projects between architects and/or
landscape architects and artists, toqether with all hard costs and soft costs such as but
not limited to, liqhtinq, landscaping, or other aesthetic effects or enhancements
inteqrated with the art and approved by the qrowth manaqement administrator. The citv
council shall not consider for approval art objects which are mass-produced in unlimited
quantities.
Artist or professional artist means a practitioner in the visual arts, generally
recoqnized by critics and peers as a professional of serious intent and abilit rL.
Indications of a person's status as a professional artist include, but are not limited to
traininq in the arts, income realized through the sole commission of artwork frequent or
consistent art exhibitions, placement of artwork in public institutions or museums, and
receipt of honors and awards in the art field.
SECTION 3. All ordinances ar parts of ordinances in conflict be and the same are
hereby repealed.
SECTION 4. Should any section or provision of this Ordinance or any portion
thereof, any paragraph, sentence, or word be declared by a court of competent jurisdiction

As you are aware, the Fire Rescue Department was recently advised that the September
11'h Families' Association is releasing steel from the World Trade Center's buildings for
use as Memorial / Art Pieces. These steel pieces were salvaged from the buildings after
the disaster on September 11'h 2001 and are available free of charge for use in
memorial projects.
I spoke with Fire Chief Bergel and Police Chief Stepp, who both support a 911 Memorial
for the City of Palm Beach Gardens. Myself and Chief Bergel also met with Mr. Ferris
and he agreed with the project and has allowed us to proceed. We have contacted noted
artist Mr. Mark Fuller, whose works are found throughout the City. In addition, Mr. Fuller
also created the City of Hoboken, New Jersey's 911 Memorial / Art Piece. As part of this
project, Mr. Fuller met with hundreds of 911 victims family members and has a great
deal of knowledge related to this endeavor. Mr. Fuller has agreed to donate his time on
this project.
Our goal is to create a Memorial in front of Fire Station Three at 5161 Northlake
Boulevard. We think an art piece with a landscaped area and seating around it, would be
a wonderful way to salute the September 11'h victims and their family members. The
plan is to approach the Art in Public Places Board in an attempt to acquire approval and
funding for this project. We feel that the cost of the project would be between $60,000.00
and $70,000.00. This would include some donations of labor and materials from the
community. Mr. Fuller has already located Architectural and Engineering firms that would
donate their time in this effort.
Upon approval, Firefighters from Palm Beach Gardens Fire Rescue would go to New
Jersey to transport / escort the steel to Mr. Fuller's studio, here in Florida. Once here,
Mr. Fuller would create the Memorial / Art piece for placement at Fire Station Three on
Northlake Boulevard.
In closing, I hope that you can look favorably upon this request. I am available at any

The City of Palm Beach Gardens is a 57 square mile municipality in northern Palm Beach
County, Florida. We were incorporated in 1959 and are a tax exempt government agency.
We are requesting an artifact that was salvaged from the World Trade Center's after

Our organization is planning to use this artifact to create a 911 Memorial Art Piece, which will

The Port Authority of New York and New Jersey is open to requests from organizations that
would like to request a piece of World Trade Center steel. The steel was recovered from the
World Trade Center site after September 11, 2001 and secured at JFK Airport by The Po�t
Authority of NY and NJ until now.
The September 11"' Families Association is proud to be part of this great effort to distribute steel
to organizations interested in creating memorials. The steel withstood the most horrific attack
on American soil that took the lives of 2,973 innocent people — one of whom was my son
Jonathan lelpi a firefighter with FDNY Squad 288. This is an extraordinary opportunity to obtain
a piece of World Trade Center steel.
The steel must be used in a memorial open to the general public such as in parks, training
grounds for uniformed personnel or places of public assembly. The stee/ is not intended for
and may not be used in personal collections, sold or used for fundraising. All requests for
steel need to be in writing on o�cial letterhead from an officer of a federal, state or local agency,
or a not for profit organization. Requests from outside the United States are also welcome.
This is a rare opportunity to create a lasting memorial honoring the lives lost and educating
future generations about the events of September 11, 2001. Everyday, your work as
emergency personnel demonstrates the power of good. A public memorial to the victims and
