CITY OF PALM BEACH GARDENS PLANNING, ZONING AND APPEALS BOARD REGULAR MEETING August 11, 2020 CALL TO ORDER 7 The regular meeting (held via Zoom teleconference) was called to order at 6:02 p.m. by Chair Hansen. 8 Agenda Coordinator, Renata Schwedhelm, provided Zoom instructions for participants. 9 II. PLEDGE OF ALLEGIANCE IO Director of Planning & Zoning, Natalie Crowley, showed the United States flag as all said the Pledge 11 of Allegiance. 12 III. ROLL CALL 13 Members Present: 14 Chair Randolph Hansen, Vice Chair Michael Panczak, L. Marc Cohn, Roma Josephs, Christopher 15 Oftedal, Erez Sela and Second Alternate Timothy Coppage Goining in the excused absence of Carl 16 Sabatello). 17 Members Absent: Carl Sabatello -he was on but due to technical difficulty could not participate. 18 Excused Absence. 19 Also Present: City Attorney, R. APPROVAL OF MINUTES 27 Vice Chair Panczak made a motion to approve the June 9 , 2020 meeting minutes and the July 28, 28 2020 meeting minutes. 29 Board Member Josephs seconded. 30 Motion passed 7-0. 31 VII. PUBLIC HEARINGS 32 Those preparing to give testimony were sworn in. 33 1. Recommendation to City Council (Public Hearing) -QUASI-JUDICIAL HEARING 34 SPLN-19-12-000038-Site Plan approval for FPL Avenir Substation. 35 A request by Florida Power and Light Company for Site Plan approval of a minor utility electrical 36 substation on a 4 .8-acre parcel. The site is located west of the planned Coconut Boulevard extension 37 within the Avenir Planned Community Development (PCD). The Avenir PCD is generally located 38 on the north side of Northlake Boulevard, east of Grapeview Boulevard, west of Bay Hill Drive, and 39 south of Beeline Highway. 40 Chair Hansen asked for any ex parte communication for quasi-judicial hearing SPLN-19-12-000038 41 -Site Plan approval for FPL A venir Substation. 42 Chair Hansen, Board Member Cohn, Board Member Josephs, Board Member Oftedal, Board 43 Member Sela, and Second Alternate Coppage declared ex parte communication for having met with 44 the applicant and staff during separate Zoom meetings. 45 Chair Hansen opened the public hearing. 46 Petitioner presentation: Robert Beaulieu, Florida Power & Light Company. 47 Staff presentation: None. Discussion ensued. 5 Board Member Jospehs made a motion to approve SPLN-19-12-000038 -Site Plan approval for 6 FPL A venir Substation. 7 Second Alternate Coppage seconded. 8 Motion passed 7-0. 9 2. Recommendation to City Council (Public Hearing) -QUASI-JUDICIAL HEARING 1 o SPLA-19-12-000056-Avenir SP 1 (POD 2 -K. Hovnanian) requesting approval of model homes 11 and an entry feature. 12 A request by Avenir Development, LLC for a site plan amendment to approve single-family home 13 architectural floorplans and elevations, lot landscaping, an entry feature, and a model home and sales 14 center for La Terre at A venir (Residential Pod 2 -Site Plan # 1) within the A venir Planned Community 15 Development (PCD). The Avenir PCD is generally located on the north side of Northlake Boulevard, 16 east of Grapeview Boulevard, west of Bay Hill Drive, and south of Beeline Highway. 17 Chair Hansen asked for any ex parte communication for quasi-judicial SPLA-19-12-000056-A venir 18 SP 1 (POD 2-K. Discussion ensued. 30 Board Member Cohn made a motion to approve SPLA-19-12-000056-Avenir SP 1 (POD 2 -K. 31 Hovnanian) requesting approval of model homes and an entry feature. 32 Board Member Josephs seconded. 33 Motion passed 7-0. 34 3. Recommendation to City Council (Public Hearing) -QUASI-JUDICIAL HEARING 35 PUDA-19-10-000075-The Learning Experience requesting PUD Amendment to allow a 10,000- 36 sf day care at Banyan Tree PUD. 37 A request by Northlake Place II, LLC for a Planned Unit Development (PUD) Amendment approval 38 to allow a 10,000-square-foot day care facility with 175 students and associated site modifications 39 within the Banyan Tree PUD Phase II. The subject site is located at the northwest comer of Northlake 40 Boulevard and MacArthur Boulevard. 41 Chair Hansen asked for any ex parte communication for quasi-judicial PUDA-19-10-000075 -The 42 Learning Experience requesting PUD Amendment to allow a 10,000-sf day care at Banyan Tree PUD. 43 Chair Hansen, Board Member Cohn, Board Member Josephs, Board Member Oftedal, Board 44 Member Sela, and Second Alternate Coppage declared ex parte communication for having met with 45 the applicant and staff during separate Zoom meetings. 46 Chair Hansen opened the public hearing. PLANNING, ZONING AND APPEALS BOARD REGULAR MEETING 08-11-20 Page 2 Petitioner presentation: Nicole Plunkett, Cotleur and Hearing. 2 Staff presentation: Planner, Samantha Morrone. 3 Police Officer, Robert Seay, confirmed the project has been thoroughly reviewed and applauded the 4 applicant for meeting the City's life safety standards including access control, traffic calming criteria, 5 site circulation, and most importantly , child safety measures. Additionally, stated the Police Department 6 supports the cross traffic circulation that is currently present. 7 Fire Marshall, Neil Rosenberger, affirmed life safety measures have been met for the Fire Department, 8 especially noting child safety considerations, concurred approval and shared support for the two-way 9 traffic flow. IO Staff recommended approval of PUDA-19-10-000075 -The Learning Experience requesting PUD 11 Amendment to allow a 10,000-sf day care at Banyan Tree PUD. 12 Public comment: None. 13 Chair Hansen closed the public hearing. 14 Chair Hansen brought the item back for discussion. Recommendation to City Council (Public Hearing) -QUASI-JUDICIAL HEARING 21 CUMJ-19-11-000058 -Major Conditional Use to allow for The Learning Experience Day Care. 22 A request by Northlake Place II, LLC for a Major Conditional Use approval to allow a 10,000-square- 23 foot day care facility with 175 students and associated site modifications within the Banyan Tree 24 PUD Phase II. Recommendation to City Council (Public Hearing) 8 CPTA-20-07-000038 -Comprehensive Plan Text Amendment to amend the Future Land Use 9 Element with a new objective and policies related to transit oriented development, in 10 accordance with the Palm Beach Gardens TOD Master Plan, prepared by Treasure Coast 11 Regional Planning Council (TCRPC). 12 City-initiated Text Amendments to the Future Land Use element of the City's Comprehensive Plan 13 to incorporate a Transit Oriented Development (TOD) objective and associated policies based on the 14 strategies and recommendations presented in the City's TOD Master Plan, prepared by Treasure 15 Coast Regional Planning Council. 16 Chair Hansen opened the public hearing. 17 Petitioner presentation: None. 18 Staff presentation: Senior Planner, Dawn Sonneborn and Planning Manager, Joann Skaria. 19 Kim DeLaney, Director of Strategic Development and Policy, Treasure Coast Regional Planning 20 Council, shared her support for the City's collaborative efforts in setting a new regional standard. 21 Staff recommended approval of CPTA-20-07-000038 -Comprehensive Plan Text Amendment to 22 amend the Future Land Use Element with a new objective and policies related to transit oriented 23 development, in accordance with the Palm Beach Gardens TOD Master Plan, prepared by Treasure 24 Coast Regional Planning Council {TCRPC). 25 Public comment: None. 26 Chair Hansen closed the public hearing. 27 Chair Hansen brought the item back for discussion.
