PLEDGE OF ALLEGIANCE 8 II. ROLL CALL 9 PRESENT: Mayor Joseph Russo, Vice Mayor David Levy, Councilmember Eric Jablin, 10 Councilmember Jody Barnett, Councilmember Robert Premuroso. 11 ABSENT: None. 12 III. ADDITIONS, DELETIONS, MODIFICATIONS 13 MODIFICATIONS 14 PUBLIC HEARING PART I — Quasi - Judicial 15 Ordinance 32, 2009 and Resolution 84, 2009 — Temple Beth David. 16 The petitioner did not prepare the 113 certified/receipt mailings required for public notices 17 and has asked for a postponement to date certain of December 3, 2009. 18 PUBLIC HEARINGS Part II — Non - Quasi - judicial 19 Ordinance 15, 2009 — Ballenlsles West Outparcel. 20 The applicant for the property owner has requested a postponement until date certain of 21 January 21, 2010. 22 Vice Mayor Levy made a motion for approval. 23 Councilmember Jablin seconded. 24 Motion passed 5 -0. 25 IV. ANNOUNCEMENTS AND PRESENTATIONS 26 a. Recognition of the sponsors for Harvest Festival and the Youth Triathlon. 27 Presented item: Recreation Resource Manager Ann Schilling. Mayor Russo awarded 28 certificates and thanked the sponsors for their support. 29 b. City of Palm Beach Gardens — Winner of the 2009 Eden Public Sector Excellence Award. 30 Presented item: Information Technology Administrator Eric Holdt. Mayor Russo thanked 31 Code Enforcement Operations Director David Reyes, Building Services Resource 32 Manager Jennifer Mikulski and Software Systems Manager Matthew Doherty for their 33 work on the Eden system and presented the 2009 Eden Public Sector Excellence Award. 34 V. ITEMS OF RESIDENT INTEREST AND BOARD /COMMITTEE REPORTS 35 Councilmember Barnett reported attending Parks and Recreation Advisory Board meeting. 36 Vice Mayor Lew reported attending the Water Resource Task Force meeting and requested 37 City Council support him representing the City regarding nutrient standards in surface waters, 38 to which the Council agreed and attended the Riverside Youth Enrichment Center 39 Thanksgiving program. Councilmember Premuroso announced the December 9, 2009 40 Historical Society meeting. Councilmember Jablin announced the joint meeting of the Art in 41 Public Places Advisory Board and Parks and Recreation Advisory Board. Mayor Russo 42 thanked staff for the Veterans Day celebration, reported on events he attended and the 43 upcoming 50th Anniversary celebration. 44 VI. CITY MANAGER REPORT 45 Recreation Director Charlotte Presensky presented an update on the 50th Anniversary 46 celebration and announced the John D. MacArthur statue has arrived. 47 Construction Services Director Todd Engle and Code Enforcement Operations Director 48 David Reyes reported on Begonia Street. CONSENT AGENDA 4 Vice Mayor Lew made a motion for approval. 5 Councilmember Jablin seconded. 6 Motion passed 5 -0. 7 IX. PUBLIC HEARINGS 8 Part I — Quasi - iudicial 9 Mayor Russo announced the procedures for tonight's proceedings. 10 a. Ordinance 32, 2009 — (2nd reading an adoption) Temple Beth David. An Ordinance of 11 the City Council of the City of Palm Beach Gardens, Florida relating to the expansion of the 12 Temple Beth David, located on Hood Road approximately 600 feet West of Military Trail, at 13 4657 Hood Road; amending Ordinance 29, 2001, which approved the Temple Beth David 14 Conditional Use. In order to transfer and amend the Conditional Use and site plan approval 15 and related conditions to a separate Resolution; providing that future amendments to the 16 Conditional Use may be made by Resolution of the City Council; providing a conflicts clause, 17 a severability clause, and authority to codify; providing an effective date; and for other 18 purposes. 19 Resolution 84, 2009 is a companion item to Ordinance 32, 2009 and will require Council 20 action. 21 Resolution 84, 2009 - Temple Beth David. A Resolution of the City Council of the City of 22 Palm Beach Gardens, Florida amending the Temple Beth David Conditional Use and site plan 23 to allow a 1,800- square -foot expansion, as described more particularly herein; providing 24 conditions of approval; providing an effective date; and for other purposes. 25 Vice Mayor Lew made a motion for postponement to date certain December 3, 2009. 26 Councilmember Jablin seconded. 27 Motion passed 5 -0. 28 Part II — Non - Quasi - iudicial 29 The City Clerk read Ordinance 15, 2009 by title. 30 a. Ordinance 15, 2009 — (1st reading) BallenIsles West Outparcel. An Ordinance of the 31 City Council of the City of Palm Beach Gardens, Florida adopting a small -scale amendment 32 to its Comprehensive Development Plan in accordance with the mandates set forth in Chapter 33 163, Florida Statutes, specifically Section 163.3187(1)(c), et seq., Florida Statutes, which 34 provides for an amendment to the City's Future Land Use Map designating one (1) parcel of 35 real property comprising approximately 7.31 acres, more or less, in size as "(PO) Professional 36 Office "; such parcel of land is located at the Southwest corner of the intersection of PGA 37 Boulevard and BallenIsles drive, informally known as "Ballenlsles West Outparcel "; 38 providing for compliance with all requirements of Chapter 163, Florida Statutes; providing a 39 conflicts clause and a severability clause; providing an effective date; and for other purposes. 40 Mayor Russo opened the public hearing. 41 Public Comment: Robert W. Erickson, 123 San Maritz Way, Palm Beach Gardens. 42 Vice Mayor Lew made a motion for continuation to January 21, 2010. 43 Councilmember Jablin seconded. 44 Motion passed 5 -0. 45 X. A Resolution of the City Council of the City of Palm Beach Gardens, Florida awarding semi - finalist Agreements for Phase I Artistic Bus Shelters to Winslow Wedin, Carlos Alves, McMow Art and Glass, Inc., Mark Fuller (yellow), and Mark Fuller (green) providing an effective date; and for other purposes. Presented item: Resource Manager Allyson Black. Vice Mayor Levy made a motion for approval. Councilmember Jablin seconded. Motion passed 5 -0. XI. ORDINANCES (For Consideration on First Reading) None. XII. ITEMS FOR COUNCIL ACTION/DISCUSSION a. Council Budget Directives Establishing a non -ad valorem assessment for residential solid waste collection and recycling. Issuing debt to fund needed items in the Capital Improvement Program. Alternative revenue sources. Presented item: Finance Administrator Allan Owens. Discussion ensued. City Council did not support the items presented. XIII. CITY ATTORNEY REPORT None. ADJOURNMENT Vice Mayor Lew made a motion to adjourn. Councilmember Jablin seconded. Motion passed 5 -0.
