CALL TO ORDER 7 The regular meeting was called to order at 5:59 p.m. by Chair Hansen. 8 II. PLEDGE OF ALLEGIANCE 9 III. ROLL CALL 10 Members Present: 11 Chair Randolph Hansen, Vice Chair Erez Sela, L. Marc Cohn, Christopher Oftedal, First Alternate 12 Robert Savel and Second Alternate Zachary Seth Mansfield (serving in the absences of Roma 13 Josephs and Timothy Coppage). 14 Members Absent: Roma Josephs and Timothy Coppage. 15 Also Present: City Attorney, R. Max Lohman; Director of Planning & Zoning, Natalie Crowley; 16 Assistant Planning & Zoning Director, Peter Hofheinz; Planning Manager, Joann Skaria and Planner, 17 Olivia Ellison. 18 IV. ADDITIONS, DELETIONS, MODIFICATIONS 19 None. 20 V. REPORT BY DIRECTOR OF PLANNING AND ZONING: NATALIE CROWLEY 21 None. 22 VI. APPROVAL OF MINUTES 23 First Alternate Savel made a motion to approve the August 10, 2021 meeting minutes. 24 Second Alternate Mansfield seconded. 25 Motion passed 6-0. 26 VII. PUBLIC HEARINGS 27 Those preparing to give testimony were sworn in. 28 Chair Hansen asked for ex parte communication for Item 1 PPUD-20-06-000061 and Item 2 CUMJ- 29 20-06-000062. 30 All Board Members declared ex parte communication for having met with the applicant and staff 31 during separate agenda review meetings. 32 1. Recommendation to City Council (Public Hearing) — QUASI-JUDICIAL HEARING 33 PPUD-20-06-000061 - 7-Eleven requesting a PUD rezoning and site plan approval for 34 convenience store, gas station and car wash at Northlake Square (Pep Boys & Applebee's) 35 A request by McPhail Associates, LLLP to rezone a 3.89-acre parcel of land from General 36 Commercial (CG-1) to a Planned Unit Development (PUD) Overlay with an underlying zoning 37 designation of General Commercial (CG-1), and a PUD Master Plan approval with a Major 38 Conditional Use approval to allow a convenience store with gasoline sales and an accessory car 39 wash located at Northlake Square (Pep Boys & Applebee's). The property is located at the 40 northwest corner of the intersection of Northlake Boulevard and Congress Avenue. 41 Chair Hansen opened the public hearing. 42 Petitioner presentation: Joshua Long, Gunster, Yoakley and Stewart, P.A. 43 Combined presentation with Item 2 CUMJ-20-06-000062. 44 Staff presentation: Planning Manager, Joann Skaria. 45 Staff recommended approval of PPUD-20-06-000061 - 7-Eleven requesting a PUD rezoning and 46 site plan approval for convenience store, gas station and car wash at Northlake Square (Pep Boys 47 & Applebee's).
