CALL TO ORDER 7 The regular meeting was called to order at 6:00 p.m. by Chair Michael Panczak. 8 I1. PLEDGE OF ALLEGIANCE 9 III. ROLL CALL 10 Members Present: Chair Michael Panczak, Randolph Hansen, Charles Hathaway, Joy Hecht, 11 Roma Josephs, Douglas Pennell, Howard Rosenkranz (first alternate sitting for Amir Kanel). 12 Members Absent: Amir Kanel. 13 Also Present: City Attorney R. Max Lohman; Director of Planning and Zoning Natalie Wong, 14 Planner Martin Schneider. 15 IV. OATH OF OFFICE 16 Second alternate Robert Savel was sworn in by the Municipal Services Coordinator. 17 V. ADDITIONS, DELECTIONS, MODIFICATIONS 18 None. 19 VI. REPORT BY DIRECTOR OF PLANNNING AND ZONING 20 Director of Planning and Zoning Natalie Wont reported on items approved by the City Council 21 at the October 21, 2010 meeting and announced the City Council has approved a change of meeting 22 schedule beginning in January 2011 to one meeting per month with two meetings in September and 23 special meetings called as required. 24 VII. APPROVAL OF MINUTES 25 Roma Josephs made a motion to approve the September 14, 2010 and October 12, 2010 minutes. 26 Charles Hathaway seconded. 27 Motion passed 7 -0. 28 VIII. PUBLIC HEARINGS 29 Those preparing to give testimony were sworn in. 30 Charles Hathaway declared ex parte communication. 31 1. Recommendation to City Council (Public Hearing) - QUASI - JUDICIAL HEARING 32 REZN- 10 -10- 000010: Rezonine of Parcel 18.AO7 from County RS & RE Zoning Districts to 33 Palm Beach Gardens RL -2 Zoning 34 A request by 95 Hood, LLC., to rezone a 12.39 acre parcel, informally known as "Parcel 18.AO7", 35 from Palm Beach County Residential Single Family (RS) and Residential Estate (RE) to City of 36 Palm Beach Gardens Residential Low (RL -2), such parcel being generally located at the northwest 37 corner of Hood Road and the Florida Turnpike. 38 Presentation by: Ken Tuma, Urban Design Kilday Studios. 39 Staff Presentation: Planner Martin Schneider. 40 Chair Panczak opened the public hearing. 41 Public Comment: None. 42 Chair Panczak closed the public hearing. 43 Discussion ensued. 44 Douglas Pennell made a motion for approval. 45 Joy Hecht seconded. 46 Motion passed 7 -0. 47 PLANNING, ZONING AND APPEALS BOARD REGULAR MEETING Page 11-09-10 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 2. Recommendation to City Council (Public Hearing) - OUASI4UDICIAL HEARING SPLA- 10 -10- 000020: Major Site Plan Amendment for an Outdoor Bar at Midtown A request from Mainstreet at Midtown LP, for approval of an outdoor bar to be located in an existing patio area between the Cantina Laredo and III Forks restaurants in the Midtown PUD, which is located on the north side of PGA Boulevard west of Gardens Square Shoppes. Presentation by: Alessandria Kalfm' Cotleur & Hearing; Bob Skinner, Ram Real Estate; Donaldson Hearing, Cotleur & Hearing. Discussion ensued. Chair Panczak opened the public hearing. Public Comment: Robert Savel, 3855 Buttercup Circle South, Palm Beach Gardens. Chair Panczak closed the public hearing. Discussion ensued. Randolph Hansen made a motion for approval.
