Crowley, AICP, Director of Planning and Zoning Joann Skaria, AICP, Assistant Director of Planning and Zoning FROM: Olivia Ellison, Principal Planner , DATE: July 31, 2023 SUBJECT: LDRA-23-05-0000 / CMJR-23-05-0000 -Veterinary Emergency Group requesting a LDR Text Amendment and Major Conditional Use for a 24- hour veterinary clinic in the PGA Boulevard Corridor Overlay The following comments are based on the applications received by the City on May 15, 2023, supplemental documentation submitted on June 6, 2023, and July 6, 2023 and found sufficient on July 6, 2023. Planning and Zoning LDRA-23-05o000 1. The Applicant has failed to address Staff comments and concerns that were issued during the review of LDRA-22-03-000085 on May 16, 2023, and at the pre - application meeting held with the Applicant on April 3, 2023 regarding proximity to incompatible uses, and potential impacts. 2. Staff does not support introducing an emergency use that will potentially be in an in -line shopping center adjacent to retail, restaurants, and food service establishments. 3. The proposed "veterinary clinic, including 24-hour service" use is not consistent with Table 21: Permitted, Conditional, and Prohibited Use Chart of Section 78-159 of the City Code. 4. The proposed note for "veterinary clinic, including 24-hour service" is unsuitable in this location within the PGA Boulevard corridor overlay code section. All additional standards notes should be addressed in Section 78-1590) of the City Code. CITY OF PALM BEACH GARDENS I0500 N. Staff does not support the proposed criteria that restricts outdoor areas or the proposed separation criteria. CMJR-2 3-o5 0000 6. The Applicant has failed to meet criteria number 3 of Section 78-52(d) of the City Code with regard to standards for the proposed use. Staff does not support the proposed additional standards note as written. 7. The Applicant has failed to meet criteria number 4 of Section 78-52(d) with regard to safe and efficient on -site circulation. The Applicant stated during the pre - application meeting on April 3, 2023 that patients may be transported from vehicles to the building by stretcher. The Applicant does not propose any site modifications to accommodate the stretcher transport or address potential conflicts with ongoing traffic within the drive aisle. 8. The Applicant has failed to meet criteria number 5 of Section 78-52(d) of the City Code with regard to mitigating impacts. Due to the proposed location of the proposed use, the Applicant does not have the opportunity to utilize landscaping, screening, and buffering to minimize impacts to adjacent uses. Additionally, the Applicant has not demonstrated how pet waste will not have an impact on the site. 9. The Applicant has failed to meet criteria number 12 of Section 78-52(d) of the City Code, minimization of potential impacts, due to the proposed location being an in - line shopping center without separation between uses. Engineering 1o. Please advise if there will be any proposed parking lot modifications. Police 11. In reference to transporting an incapacitated animal via gurney, will there be any parking lot or curb enhancements? Additionally, is the intent to reserve certain parking spaces for emergencies of this nature? 12. Due to the age of the building, additional crime prevention and Crime Prevention Through Environmental Design (CPTED) measures could be weathered, damaged, or non-existent. Please provide details on natural surveillance, lighting, and locksets due to the proposed 24-hour use. Fire Rescue No comments at this time. It is suggested that the Applicant clearly identify all changes to the plans by either "clouding", or otherwise highlighting, the location of all changes to further expedite the review.
