ADDITIONS, DELETIONS, MODIFICATIONS 14 None. 15 IV. ANNOUNCEMENTS AND PRESENTATIONS 16 a. RECOGNITION OF OFFICER ANDREW FLINK -AWARDED THE "OUTSTANDING 17 DEDICATION TO DUI ENFORCEMENT" AWARD. 18 Police Chief, Clinton Shannon presented the Outstanding Dedication to DUI Enforcement 19 Award given by Mothers Against Drunk Driving (MADD -Florida) to Police Officer, Andrew 20 Flink for his hard work and dedication in stopping impaired driving. Mothers Against Drunk 21 Driving selected him out of 115 nominations submitted throughout the State. 22 b. AMERICAN HEART ASSOCIATION MISSION LIFELINE AWARD. 23 Assistant Fire Chief Operations, Cory Bessette introduced Kayla Fox, Executive Director of 24 the American Heart Association Palm Beach County, who presented the American Heart 25 Association's Mission: Lifeline Emergency Medical Services (EMS) Gold Plus Award to the 26 Palm Beach Gardens Fire Rescue Department. 27 c. COLLECTIVE BARGAINING AGREEMENT WITH THE SERVICE EMPLOYEES 28 INTERNATIONAL UNION (SEIU) / FLORIDA PUBLIC SERVICES UNION (FPSU). 29 Human Resources Administrator, Sheryl Stewart presented the Collective Bargaining 30 Agreement with the Service Employees International Union (SEIU)/Florida Public Services 31 Union (FPSU) for fiscal years 2023-2024, 2024-2025, and 2025-2026 (Resolution 57, 2023 on 32 the Consent Agenda). 33 V. COMMENTS FROM THE PUBLIC 34 Jay Goldwasser, 5200 Donald Ross Road, Palm Beach Gardens, Florida 33418. 35 VI. CITY MANAGER REPORT 36 City Manager, Ron Ferris introduced Community Services Administrator/Director of 37 Emergency Management, David Reyes who provided an update on the City's assistance to 38 the City of Crystal River, which was severely impacted by Hurricane Idalia on August 30, 2023. 39 On September 5, a City Response Team was dispatched to assess their needs. On September 6, 40 a Public Works Team was deployed to provide aid, remove debris, repair fencing, and open 41 storm water drains. On September 14, a second deployment team with supplies, furniture, office 42 equipment, and a used Ford Taurus earmarked for auction, was delivered to Crystal River. Since 43 one Crystal River employee lost their home in the storm, Palm Beach Gardens has partnered 44 with the City of Callaway and Christ Fellowship to help with additional assistance. An Amazon 45 Wishlist has also been made available. Palm Beach Gardens Public Works Strike Team 46 Members were recognized. Discussion ensued. 47 Public Media Relations Director, Candice Temple shared the award-winning Fire Rescue 48 video, Stroke Wars, produced in-house by the City, which received national recognition and 49 won the 2023 Savvy Award for best video in education and training at the City-County CITY OF PALM BEACH GARDENS REGULAR COUNCIL MEETING 09-19-23 PAGE 1 L__ 1 Communication and Marketing Association's (3CMA) Annual Conference in Orlando, Florida 2 on September 7, 2023. 3 VII. CONSENT AGENDA 4 a. APPROVE MINUTES FROM THE SEPTEMBER 5, 2023, CITY COUNCIL MEETING. 5 b. RESOLUTION 57, 2023-APPROVING AND RATIFYING A COLLECTIVE BARGAINING 6 AGREEMENT. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM BEACH 7 GARDENS, FLORIDA, APPROVING AND RATIFYING THE COLLECTIVE BARGAINING 8 AGREEMENT WITH THE SERVICE EMPLOYEES INTERNATIONAL UNION 9 (SEIU)/FLORIDA PUBLIC SERVICES UNION (FPSU) FOR FISCAL YEARS 2023-2024, 10 2024-2025, AND 2025-2026; AUTHORIZING THE MAYOR AND CITY MANAGER TO 11 EXECUTE SAID AGREEMENT; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER 12 PURPOSES. 13 c. RESOLUTION 60, 2023 -PASTEUR PLAT TWO (AL TON MEDICAL CENTER). A 14 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM BEACH GARDENS, 15 FLORIDA, APPROVING THE PASTEUR PLAT TWO WITHIN THE ALTON PLANNED 16 COMMUNITY DEVELOPMENT (PCD); PROVIDING AN EFFECTIVE DATE; AND FOR 17 OTHER PURPOSES. 18 d. FIRST AMENDMENT TO THE INTERLOCAL AGREEMENT FOR ADMINISTRATIVE 19 SERVICES BETWEEN THE PALM BEACH TRANSPORTATION PLANNING AGENCY 20 AND THE CITY OF PALM BEACH GARDENS. 21 Councilmember Premuroso made a motion to approve the Consent Agenda. 22 Councilmember Tinsley seconded. 23 Motion passed 5-0. 24 VIII. PUBLIC HEARINGS: (*Designates Quasi-Judicial Hearing) 25 Those preparing to give testimony were sworn in. 26 The City Clerk read Resolution 40, 2023 by title. 27 a. RESOLUTION 40, 2023 -ADOPTING A TAX LEVY AND MILLAGE RATE. A 28 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM BEACH GARDENS, 29 FLORIDA, ADOPTING A TAX LEVY AND MILLAGE RATE FOR THE CITY OF PALM 30 BEACH GARDENS FOR THE FISCAL YEAR COMMENCING OCTOBER 1, 2023, AND 31 ENDING SEPTEMBER 30, 2024; DIRECTING THE CITY CLERK TO FORWARD A 32 CERTIFIED COPY OF THIS RESOLUTION TO THE PALM BEACH COUNTY PROPERTY 33 APPRAISER AND TAX COLLECTOR WITHIN THREE (3) DAYS AFTER ITS ADOPTION; 34 PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. 35 Mayor Reed opened the Public Hearing for Resolution 40, 2023. 36 Petitioner presentation: None. 37 Staff presentation: Finance Administrator, Arienne Panczak. No changes to the budget 38 presentation from the September 5, 2023, City Council meeting. 39 Staff recommended a motion that the City of Palm Beach Gardens adopt an operating and total 40 millage rate of 5.1700 mills, which is greater than the rolled-back rate of 4.7456 by 8.94%. 41 Public comment: None. 42 Mayor Reed closed the Public Hearing. 43 Vice Mayor Woods made a motion to approve Resolution 40, 2023, setting the final millage 44 rate for fiscal year 2023/2024 at 5.1700 mills. 45 Councilmember Middleton seconded. 46 Mayor Reed brought the item back for discussion. ORDINANCE 16, 2023 -(1 5 T READING) CITY-INITIATED EVALUATION AND 19 APPRAISAL REVIEW COMPREHENSIVE PLAN AMENDMENTS. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM BEACH 44 GARDENS, FLORIDA, AMENDING CHAPTER 38 -FIRE PREVENTION AND 45 PROTECTION BY REPEALING AND READOPTING SECTION 38-89. -SPRINKLERS., 46 AS REVISED, IN ORDER TO REQUIRE AUTOMATIC SPRINKLER SYSTEMS IN 47 CERTAIN RESIDENTIAL STRUCTURES; FURTHER AMENDING CHAPTER 38 BY 48 ADOPTING NEW SECTION 38-92. Discussion ensued. 43 Motion passed 5-0. 44 IX. RESOLUTIONS 45 None. 46 X. ITEMS FOR COUNCIL ACTION/DISCUSSION AND ITEMS OF INTEREST: 47 a. ANNEXATION. 48 Deputy City Manager, Lori Laverriere and Planning Manager, Martin Fitts presented an 49 overview of Palm Beach Gardens proposed initiative to annex five areas along the City's eastern CITY OF PALM BEACH GARDENS REGULAR COUNCIL MEETING 09-19-23 PAGE 4 1 boundary. Councilmembers will formally consider five ordinances for first reading at the 2 November 2, 2023, City Council meeting and for second reading at the December 6, 2023, City 3 Council meeting. The voter referendum would occur on March 19, 2024, the date of the 4 Presidential Preference Primary. Discussion ensued. 5 Councilmembers provided consensus to proceed forward with the proposed annexation 6 initiative. 7 Councilmember Tinsley wished a Happy New Year for Rosh Hashanah and thanked the Fire 8 Rescue Department for providing free CPR training classes for the community. 9 Mayor Reed thanked Councilmembers for their support and availability in attending many 10 event invitations. 11 XI.
