CALL TO ORDER 7 The regular meeting was called to order at 6:00 p.m. by Chair Hansen. 8 II. PLEDGE OF ALLEGIANCE 9 III. ROLL CALL 10 Members Present: 11 Chair Randolph Hansen, Erez Sela, Christopher Oftedal, Robert Savel, Zachary Seth Mansfield, 12 Charles Millar, and First Alternate Linda Hess. 13 Members Absent: Vice Chair Timothy Coppage. 14 Also Present: City Attorney, R. Max Lohman; Director of Planning and Zoning, Natalie Crowley; 15 Assistant Planning and Zoning Director, Joann Skaria; Planning Manager, Martin Fitts; Principal 16 Planner, Olivia Ellison; Planner, Christopher Yerkes and Planner, Anne Bestland. 17 IV. ADDITIONS, DELETIONS, MODIFICATIONS 18 None. 19 V. REPORT BY DIRECTOR OF PLANNING AND ZONING: NATALIE CROWLEY 20 Director of Planning and Zoning, Natalie Crowley reported the Vintage Oaks project was approved 21 at the September 5, 2023, City Council meeting, consisting of the small-scale land use amendment, the 22 rezoning, and the site plan for the 111 townhomes (Ordinance 14, 2023 and Ordinance 15, 2023 and 23 the Resolution 48, 2023). 24 VI. APPROVAL OF MINUTES 25 Board Member Mansfield made a motion to approve the August 8, 2023, meeting minutes. 26 Board Member Oftedal seconded. 27 Motion passed 7-0. 28 Chair Hansen read the following into the record: 29 Comments from the public: Please submit a comment card to the Agenda Coordinator prior to the 30 commencement of the public hearing(s). You will be called to the podium where you will state your 31 full name and address and be given three (3) minutes to address the Board. 32 VII. PUBLIC HEARINGS 33 Those preparing to give testimony were sworn in. 34 1. Recommendation to City Council (Public Hearing) - QUASI-JUDICIAL HEARING 35 CUMJ- 23-03-000072 - Tommy Bahama Marlin Bar requests a major conditional use to 36 allow for a bar 37 A request by The Gardens Venture LLC for a Major Conditional Use approval to allow a 38 Nightclub, Bar, or Lounge use for Tommy Bahama Marlin Bar within the Gardens Mall. The 39 Gardens Mall is generally located north of PGA Boulevard, east of Fairchild Gardens Avenue, 40 south of Gardens Parkway, and west of Kew Gardens Avenue. 41 Chair Hansen asked for ex-parte communication for Item 1. 42 No ex parte communication declared. 43 Chair Hansen opened the public hearing. 44 Petitioner presentation: Martin Holland, L.D. Reeves & Associates. 45 Staff presentation: Planner, Christopher Yerkes. 46 Staff recommended approval of CUMJ- 23-03-000072 - Tommy Bahama Marlin Bar requests a 47 major conditional use to allow for a bar. Discussion ensued. 4 First Alternate Hess made a motion to recommend to City Council CUMJ- 23-03-000072 - 5 Tommy Bahama Marlin Bar requests a major conditional use to allow for a bar. 6 Board Member Savel seconded. 7 Motion passed 7-0. 8 e Item 2 PUDA-18-01-000069 and Item 3 CUMJ-19-12-000059 were presented in one combined 9 presentation and all testimony and comments were incorporated in each item with separate votes 10 taken. 11 2. Recommendation to City Council (Public Hearing) - QUASI-JUDICIAL HEARING 12 PUDA-18-01-000069 - PGA Marina & Soverel Harbour requesting a PUD Amendment for 13 re -development of the Marina 14 A request by PGA Marina Partners LLC for a Planned Unit Development (PUD) Amendment to 15 allow the redevelopment of the approximately 7.52-acre marina with 451 dry boat storage slips, 16 20 wet boat storage slips, and marina retail, boat and watercraft showroom, and ship store uses. 17 The subject site is located on the north side of PGA Boulevard approximately 0.25 miles east of 18 the intersection of PGA Boulevard and Prosperity Farms Road. 19 3. Recommendation to City Council (Public Hearing) - QUASI-JUDICIAL HEARING 20 CUMJ-19-12-000059- Major Conditional Use for PGA Marina use on the 7.52-acre site 21 A request by PGA Marina Partners LLC for a Major Conditional Use approval for a Commercial 22 Marina on approximately 7.52 acres. The subject site is located on the north side of PGA Boulevard 23 approximately 0.25 miles east of the intersection of PGA Boulevard and Prosperity Farms Road. 24 Chair Hansen asked for ex parte communication for Item 2 and Item 3. 25 All Board Members declared ex parte communication for having met with the applicant and staff 26 during separate agenda review meetings. 27 Chair Hansen opened the public hearing. 28 Petitioner presentation: Austin Schell, CEO Port 32; Ken Tuma, Urban Design Studio; Lauren 29 Sands, Urban Design Studio. 30 Staff presentation: Planning Manager, Martin Fitts. 31 Staff recommended approval of PUDA- 18-01-000069 - PGA Marina & Soverel Harbour 32 requesting a PUD Amendment for re -development of the Marina and CUMJ-19-12-000059- Major 33 Conditional Use for PGA Marina use on the 7.52-acre site. 34 Public comment: Joey Eichner, PGA Corridor Association, Inc., 4440 PGA Boulevard, Suite 600, 35 Palm Beach Gardens, Florida 33410; Glenn MacLean, 11439 Kidd Lane, Palm Beach Gardens, 36 Florida 33410. 37 Chair Hansen closed the public hearing. 38 Chair Hansen brought the item back for discussion. Discussion ensued. 39 Board Member Oftedal made a motion to recommend to City Council PUDA-18-01-000069 - 40 PGA Marina & Soverel Harbour requesting a PUD Amendment for re -development of the Marina. 41 Board Member Mansfield seconded. 42 Motion passed 7-0. 43 Board Member Oftedal made a motion to recommend to City Council CUMJ-19-12-000059- 44 Major Conditional Use for PGA Marina use on the 7.52-acre site. 45 Board Member Mansfield seconded. 46 Motion passed 7-0. Recommendation to City Council (Public Hearing) 5 CPSS-23-08-0000- City Initiated Small -Scale Comprehensive Plan Amendment for Ritz- 6 Carlton Residences, Palm Beach Gardens 7 A City -initiated petition requesting a Small -Scale Comprehensive Plan Map Amendment to 8 change the land -use designation of approximately 13.45 acres from Palm Beach County 9 Commercial High with underlying High Residential, 12 units per acre (CH-12), High Residential, 10 12 units per acre (HR-12) and Residential Low, 3 units per acre (RL-3) to Palm Beach Gardens 11 Residential High (RH) with a Marina District Overlay for recently annexed property. The property 12 is generally located on the southwest corner of the intersection of PGA Boulevard and Ellison 13 Wilson Road. 14 5. Recommendation to City Council (Public Hearing) - QUASI-JUDICIAL HEARING 15 PPUD-23-08-0001 - City Initiated Rezoning to PUD/RH for the Ritz -Carlton Residences 16 Palm Beach Gardens 17 A City -initiated petition requesting to rezone approximately 13.45 acres from Palm Beach County 18 Residential Planned Unit Development (PUD) and Multi -Family Residential Medium Density 19 (RM) to a Palm Beach Gardens Planned Unit Development (PUD) overlay with an underlying 20 zoning designation of Residential High (RH) for recently annexed property. The property is 21 generally located on the southwest corner of the intersection of PGA Boulevard and Ellison Wilson 22 Road. 23 Chair Hansen asked for ex parte communication for Item 5 PPUD-23-08-0001. 24 No ex parte communication declared. 25 Chair Hansen opened the public hearing. 26 Petitioner presentation: Not applicable. 27 Staff presentation: Principal Planner, Olivia Ellison. 28 Staff recommended approval of CPSS-23-08-0000- City Initiated Small -Scale Comprehensive 29 Plan Amendment for Ritz -Carlton Residences, Palm Beach Gardens and PPUD-23-08-0001 - City 30 Initiated Rezoning to PUD/RH for the Ritz -Carlton Residences Palm Beach Gardens. 31 Public comment: None. 32 Chair Hansen closed the public hearing. 33 Chair Hansen brought the item back for discussion. Discussion ensued. 34 Board Member Mansfield made a motion to recommend to City Council CPSS-23-08-0000- City 35 Initiated Small -Scale Comprehensive Plan Amendment for Ritz -Carlton Residences, Palm Beach 36 Gardens. 37 Board Member Savel seconded. 38 Motion passed 7-0. 39 Board Member Mansfield made a motion to recommend to City Council PPUD-23-08-0001 - 40 City Initiated Rezoning to PUD/RH for the Ritz -Carlton Residences Palm Beach Gardens. 41 Board Member Savel seconded. 42 Motion passed 7-0. 43 VIII. OLD BUSINESS 44 Board Member Savel inquired about the advertisement of public notices in The Palm Beach Post 45 newspaper instead of online publication. Max Lohman explained 2 legislation was approved last session to allow for website advertising on approved county websites. 3 The City is advertising in the newspaper to be compliant with Florida State law. Discussion ensued. 4 Chair Hansen thanked and commended staff for their work in providing quality projects in the City. 5 IX. NEW BUSINESS 6 Director of Planning and Zoning, Natalie Crowley introduced Planner, Anne Bestland to the 7 Board as she has recently joined the Planning and Zoning Department and is attending her first 8 Planning, Zoning and Appeals Board meeting.
