6 I. CALL TO ORDER
7 The regular meeting was called to order at 6:00 p.m. by Chair Hansen.
8 II. PLEDGE OF ALLEGIANCE
9 III. ADMINISTER OATH OF OFFICE TO NEW MEMBERS
10 None. The new member, Second Alternate Elana Cooper was absent.
11 IV. ROLL CALL
12 Members Present:
13 Chair Randolph Hansen, Vice Chair Timothy Coppage, Christopher Oftedal, Robert Savel, Zachary
14 Seth Mansfield, Charles Millar, and First Alternate Nadia Spivak.
15 Members Absent: Linda Hess.
16 Also Present: City Attorney, R. Max Lohman; Director of Planning and Zoning, Natalie Crowley;
17 Assistant Planning and Zoning Director, Joann Skaria; Planning Manager, Samantha Morrone;

21 Vice Chair Coppage made a motion to appoint Randolph Hansen as Chair.
22 Board Member Millar seconded.
23 Motion passed 7-0.
24 ♦ Appointment of Vice Chair
25 Board Member Oftedal made a motion to appoint Charles Millar as Vice Chair.
26 Vice Chair Coppage seconded.
27 Motion passed 7-0.
28 VI. BOARD ORIENTATION
29 The board orientation will be rescheduled due to the absence of the new member.
30 VII. ADDITIONS, DELETIONS, MODIFICATIONS
31 None.
32 VIII. REPORT BY DIRECTOR OF PLANNING AND ZONING: NATALIE CROWLEY
33 Director of Planning and Zoning, Natalie Crowley reported the PGA Marina Planned Unit
34 Development (PUD) and Major Conditional Use, Resolution 58, 2023, and the Major Conditional Use
35 to allow a bar use for Tommy Bahama Marlin Bar Restaurant, Resolution 59, 2023 were approved at
36 the October 5, 2023, City Council meeting.
37 IX. APPROVAL OF MINUTES
38 Board Member Savel made a motion to approve the September 12, 2023, meeting minutes.
39 Board Member Oftedal seconded.
40 Motion passed 7-0.
41 Chair Hansen read the following into the record:
42 Comments from the public: Please submit a comment card to the Agenda Coordinator prior to the
43 commencement of the public hearing(s). You will be called to the podium where you will state your
44 full name and address and be given three (3) minutes to address the Board.

2 LDRA-23-02-000089 - City Initiated Land Development Amendment to Division 4 update
3 and revise the City's Impact Fees
4 A public hearing to consider amending the City's Land Development Regulations in order to
5 update and revise the City's Impact Fees for Parks and Recreation, Fire Rescue, Police, and Public
6 Facilities, including the Extraordinary Circumstances that necessitate the adoption of the updated
7 Impact Fees at the fully calculated rate as of the effective date of the updated Impact Fee
8 Ordinance.
9 Chair Hansen opened the public hearing.
10 Director of Planning and Zoning, Natalie Crowley gave a brief overview to LDRA-23-02-
11 000089, introducing Jonathan Paul, Principal and Founder of NUE Urban Concepts.
12 Consultant presentation: Jonathan Paul, NUE Urban Concepts.
13 Staff presentation: Assistant Planning and Zoning Director, Joann Skaria.
14 Staff recommended approval of LDRA-23-02-000089 - City Initiated Land Development
15 Amendment to Division 4 update and revise the City's Impact Fees.
16 Public comment: Max Ducharme, 2439 Treasure Isle Drive, 6, Palm Beach Gardens, Florida
17 33410.
18 Chair Hansen closed the public hearing.
19 Chair Hansen brought the item back for discussion. Discussion ensued.
20 Vice Chair Millar made a motion to recommend to City Council LDRA-23-02-000089 - City
21 Initiated Land Development Amendment to Division 4 update and revise the City's Impact Fees.
22 Board Member Savel seconded.
23 Motion passed 7-0.
24 • Item 2 LDRA-23-07-0004 and Item 3 CMJR-23-08-0001 were presented in one combined
25 presentation and all testimony and comments were incorporated in each item with separate votes
26 taken.
27 2. Recommendation to City Council (Public Hearing)
28 LDRA-23-07-0004 - Land Development Regulations Text Amendment to allow a major
29 conditional use for health, physical fitness, weight reduction and spa use in the PGA Overlay
30 LSREF6 Legacy LLC requesting a Land Development Regulations (LDR) Text Amendment to
31 the PGA Boulevard Corridor Overlay to allow Health, Physical Fitness, Weight Reduction, and
32 Spa use as a Major Conditional Use.
33 3. Recommendation to City Council (Public Hearing) — QUASI-JUDICIAL HEARING
34 CMJR-23-08-0001- Legacy Place requests a Major Conditional Use to allow a Health,
35 Physical Fitness, Weight Reduction, and Spa use
36 LSREF6 Legacy LLC requesting a Major Conditional Use approval for a Health, Physical Fitness,
37 Weight Reduction, and Spa use in the Legacy Place Planned Community Development (PCD). The
38 property is generally located on the southwest corner of PGA Boulevard and Fairchild Gardens
39 Avenue.
40 Chair Hansen asked for ex parte communication.

19 presentation and all testimony and comments were incorporated in each item with separate votes

21 4. Recommendation to City Council (Public Hearing)
22 CPSS-23-08-0001 - City Initiated Comprehensive Plan Small Scale Map Amendment for
23 Shops at Indian Trails following annexation
24 A City -initiated petition for a Small -Scale Comprehensive Plan Map Amendment to change the
25 land -use designation of approximately 29.53 acres known as the Shops at Indian Trails, a recently
26 annexed property, from Palm Beach County Commercial Low with underlying Rural Residential,
27 one (1) unit per five (5) acres (CL/RR-5), to Palm Beach Gardens Commercial (C). The Shops at
28 Indian Trails site is generally located immediately southwest of the intersection of Northlake
29 Boulevard and Coconut Boulevard.
30 5. Recommendation to City Council (Public Hearing) - QUASI-JUDICIAL HEARING
31 PPUD-23-08-0002- City Initiated PUD Overlay Rezoning for the Shops at Indian Trails
32 following annexation
33 A City -initiated petition to change the zoning designation of approximately 29.53 acres known as
34 the Shops at Indian Trails, a recently annexed property, from Palm Beach County Multiple Use
35 Planned Development (MUPD) overlay to Palm Beach Gardens Planned Unit Development (PUD)
36 overlay with an underlying zoning designation of General Commercial (CG-1). The Shops at
37 Indian Trails site is generally located immediately southwest of the intersection of Northlake
38 Boulevard and Coconut Boulevard.
39 Chair Hansen asked for ex parte communication.

Board Member Mansfield made a motion to recommend to City Council CPSS-23-08-0001 -

following annexation.
Board Member Savel seconded.
Motion passed 7-0.
Board Member Mansfield made a motion to recommend to City Council PPUD-23-08-0002-
City Initiated PUD Overlay Rezoning for the Shops at Indian Trails following annexation.
Board Member Savel seconded.
Motion passed 7-0.

XII. NEW BUSINESS
Board Member Oftedal inquired on the uses on the PGA Overlay map.
Director of Planning and Zoning, Natalie Crowley stated the City's Code of Ordinances provides
clarification on applicability, and the Planner On Call (POC) line is available for any questions.
