HomeMy WebLinkAboutMinutes P&Z 021301• CITY OF PALM BEACH GARDENS PLANNING AND ZONING COMMISSION February 13, 2001 MINUTES The Regular Meeting of the Planning and Zoning Commission of the City of Palm Beach Gardens, Florida, was called to order by Chair John Glidden at 6:30 P.M. in the Council Chambers of the Municipal Complex, 10500 North Military Trail, Palm Beach Gardens, Florida, and opened with the Pledge of Allegiance to the Flag. ANNOUNCEMENTS There were no announcements. CITY COUNCIL LIAISON City Council Liaison Carl Sabatello welcomed the new members of the Planning and Zoning Commission and those staying on, and advised that at a future meeting with a short agenda discussion would be held regarding how to make the process better. Councilman Sabatello commented that it was the responsibility of the new members to work with staff to prepare for meetings, and if they had questions they should visit the site and spend as much time as necessary to be as prepared as possible. Councilman. Sabatello advised that the members of the Commission must follow the direction the City was trying to put into place to develop the highest possible planned community, rather than doing what was right for them, and must rule on what was in front of them rather than on their personal opinion. Councilman Sabatello stressed that the City Council was looking to the Commission for their knowledge, and indicated he would speak in more detail at a future meeting. Chair Glidden commented that the tracking sheets on projects as they proceeded through City Council had been very helpful, and suggested focusing on crucial things where the City Council differed from the view of the Commission. It was noted that signage was currently coming back to Planning and Zoning for review. PLANNING AND ZONING COMMiUSSION The roll was called by Betty Laur, Secretary for the meeting. Public Hearing Petition PUD- 00-05: Speedway Service Station Bob Basehar4 agent forMarathon Ashland Petroleum, L.L. C., is requesting a rezoning from CG-1 General Commercial to CGI General Commercial and Planned Unit Development (PUD) for the redevelopment of a convenience store with gasoline service pumps at the southeast corner of PGA Boulevard and Prosperity Farms Road The 0.8 acre site will contain a 2,339 square foot convenience store with twelve gasolinepumps. The existing 2,177 square foot building, canopy and pump stations will be demolished as part of this redevelopment. (7- 42S -43E) Senior Planner Ed Tombari provided an update since the last meeting, and indicated the agent had responded to comments by the Commission and that staff supported all waivers except two regarding the front setback and sign location. Bob Basehart, agent for the petitioner, introduced others present on behalf of the petitioner. Mr. Basehart indicated that the number of signs had been reduced and a cross connection to the east to the adjacent shopping center had been provided. A lighting plan had been submitted. Mr. Basehart described the non - conforming property and the re- design for the site to comply with code, which would dramatically reduce the non - conformities. Mr. Basehart explained that the project would also meet the landscape code when the right -of -way was widened. Mr. Basehart described the signage request, and indicated that all issues brought up by the Commission had been addressed. Still at issue was a lighting waiver, and petitioner requested recessed lighting with 90 degree baffles on lighting outside the canopy. The foot candle reading was 116, with the average for the site only 32 and .8 at the property lime, and with no spillover or glare. Mr. Glidden indicated that in the staff report wall signage had been reduced to six wall signs but he did not see that on the elevation. Petitioner responded there were only four wall signs, and clarified their locations. Mr. Calcutt, operator of the service station, indicated that NASA's standard was 50 footcandles and the State requirement was 50; and that 116 would only be directly under the canopy. Mr. Tarr commented this would be a great improvement to the site and that newer gas stations were lit so well that people felt comfortable going into them at night. Mr. Tarr indicated that the City might need to revisit their restrictions, and that he had no problem with the lighting. Mr. Tarr commented the sign would look good at the corner if properly landscaped. Both Mr. Ansay and Mr. Volante indicated they had no problems with the sign being at the corner of PGA and Prosperity Farms Road and that they were comfortable with the overall site. Mr. Kunkle commented the site plan was well done and indicated that vertical landscaping on the west side of the canopy would provide glimpses ofthe building. Mr. Kunkle indicated he had no problem with the sign at the corner but suggested it might be oriented 45 degrees. Mr. Calcutt indicated the sign was perpendicular to PGA Boulevard. Mr. Kunkle requested intermediate plantings to improve the background for the sign. Jon Schmidt, Landscape Architect, indicated there was a problem because of overhead power lines on all 2 • Planning & Zoning Commission Minutes February 13, 2001 sides ofthe property except along PGA Boulevard. , Chair Glidden commented this would be a welcome upgrade to the site. Applicant clarified that the roofmaterial would match the rest ofthe shopping center. The flashing at the building parapet entry was discussed, which Mr. Calcutt indicated could be easily removed. Mr. Glidden indicated he would like approximately 80 footcandles. Chair Glidden declared the Public Hearing open. Hearing no comments from the public, Chair Glidden declared the Public Hearing closed. Vice Chair Solomon made a motion to recommend approval of PUD4XO -05 to City Council with the following conditions: 1. "Food and drink provided within the food mart shall be limited to self- service items only, including (but not limited to) such items as hot dogs, doughnuts, coffee, or fountain soda drinks, which customers must select and purchase without assistance, preparation, or assembly by the employees of the service station. One microwave oven, for self - service heating or re- heating of food shall be allowed." 2. All outstanding comments from the City Engineer's Office and Seacoast Utilities shall be satisfied prior to scheduling for city Council review. • 3. Prior to construction plan approval, the applicant shall provide a letter of authorization from the appropriate utility owners allowing the applicant to pave, landscape and place stormwater management features within their respective utility easements. 4. Prior to construction plan approval, the applicant needs to call out the curb transitions on the Site Plan and provide a detail for the curb transitions at the entranceways. 5. The applicant shall utilize lighting shields or other similar mechanics on lights located under the canopy to minimize the lighting glare emanating from the site. 6. Landscaping shall be modified by increasing the height of the Ligustrum trees to 12' height with 6' spread and increased density around the sabal palms. 7. The saddle flashing above the front entry shall be removed. 8. Lighting shall be reduced to be not in excess of 100 footcandles under the canopy. Mr. Kunkle seconded the motion. During discussion of the motion, Mr. Tarr asked if staff was recommending denial of the corner sign. Mr. Solomon commented he intended his motion to approve all the requested waivers. Discussion ensued. On the staff recommendations for denial • of three requested waivers, the wall sign denial item 136(a), staff agreed to drop their 3 • Planning & Zoning Commission Minutes February 13, 2001 recommendation for denial if the one sign was moved from the canopy to the building, to which applicant had agreed. Second, on the other sign waiver to which staff objected because of the 15- foot setback from the right -of -way, staff agreed to withdraw their objection so long as the sign was moved to the southwest corner. Mr. Solomon clarified that his motion was that the waiver be granted to place the sign in the northeast corner-. Mr. Tombari explained that the waiver for the front setback for the canopy would be accepted by staff if the sign was moved from the canopy to the building. Mr. Glidden commented that in simple terms, the canopy could stay where it was with two signs on it. Mr. Ansay stated it was his understanding that the sign the City was asking the applicant to remove was on the canopy on the west side and relocate it on the west side of the building because the building was set farther back from the roadway. Applicant stated they agreed. Motion carried by unanimous 7-0 vote. Public Hearing and Recommendation to City Council Petition DRf 99 -05 & PCD -99 -05: Parcel 27 Resident, NOPC Koller Regional Center Urban Design Studio, agent, seeks to modify the Development Order of the Regional Center DR[ by reconfiguring the water management tract, converting hotel rooms to residential units, designating an eight -acre preserve, and reconfiguring the internal roadways of the Koller property. • Senior Planner Talal Benothman reviewed the five changes proposed by the applicant, explained that the Treasure Coast Regional Planning Council had designated the S acre preserve site in 1999, had raised no objection to the amendment but recommended more land be preserved. Staffrecommended approval of all the proposed changes since none of them were a substantial deviation, but after visiting the site recommended moving the roadway alignment. Mr. Ansay noted he would like the roadway alignment moved even farther to the south. Mr. Benothman indicated this was not a NOPC issue. In response to inquiry by Mr. Tarr whether the Commission could require more preserve, Mr. Benothman clarified that would be a decision of the City Council. Mr. Tarr questioned why the road looped around, to which the response was that these roads were part of the linkages plan approved by the City and adopted by the County, intended to relieve traffic ogthe main east -west artery into the mat Mr. Benothman indicated a letter of opposition from Commissioner Marcus to the oak preserve size and to the alignment of the road had been received. Dodi Glas, agent for the petitioner, agreed to review the site plan next. Public Hearing and Recommendation to City Council Petition SP-99 - -13: Parcel 27 Regional Center DRI/PCD - KolterlThe Grande Urban Design Studio, agentforKolterProperties and theNorthern Palm Beach County Improvement District ( "Northern'), is requesting a Site Plan Review within a Planned Community District (PCD) approval for a multsfamily residential community. The site is within the Regional Center Planned Community District and is located north of Gardens Parkway and east of Prosperity Farms Road The 49.37 acre site will contain 492 residential units in Phase Z Phase 2, which will contain 503 • units on 63.17 acres, will be subject to a future petition. (7- 42S -43E) 4 • Planning & Zoning Commission Minutes February 13, 2001 Senior Planner Ed Tombari reviewed the staff report. Mr. Tombari clarified for Mr. Solomon that the oak preserve would be part of the overall plat. Mr. Tombari responded to Mr. Tarr that a 50' setback was not being required and a 50' buffer would have to include drainage facilities running through it and would not be unencumbered. Mr. Tombari indicated the major issue was the location of several large oak trees and a large forest of oak treesiust to the south of Edgewater Drive particularly in the western portion and how to install drainage and a roadway within that area and still protect these oaks. The linkages plan was shown. Dodi Glas, agent for the petitioner, explained there were 25' buffers on the original NOPC approval and the applicant's revised site plan would eliminate a roadway through the parcel and place the roadway around the parcel Ms. Glas described the drainage, explained that the oaks were scattered through the site and it was not the petitioner's intent to disturb the area along Edgewater. Ms. Glas explained this was a DRI approved in 1984, and a minimum of 8 acres were to be preserved. Ms. Glas indicted Kolter had put drainage for Edgewater on their site, and that there were no unresolved issues with the NOPC. Ms. Glas described density, color palettes, signage changes, the requested amendment from the MacArthur Center sign code, waiver requests, and indicated the petitioner believed there were errors in some of the conditions. Specifically mentioned were references to "this road" without indicating the road, "change the plan" without indicating where the plan should be changed, etc., and wanted to work with staff on those items. The petitioner took issue with the condition regarding all oaks 13" and greater, which petitioner believed went beyond what should be required, and indicated it was the petitioner's intent to protect the trees. Ms Glas described how the berm could be installed in • order to protect the trees. Ms. Glas explained to Mr. Ansay that this project had been in process for two years and the NOPC and drainage issues had to be resolved first, and staff had suggested dividing into Phase I and H. Mr. Tarr asked how many oaks were 13" or more, to which petitioner responded there was a substantial amount and relocation was addressed in the landscape plans for Phase H. Ms. Glas explained that the intent was not to change the character of the Edgewater site. Mr. Tarr requested a view ofthe buffer fromEdgewater Drive that would show the density ofthe buffer. Mr. Kunkle indicated he had reviewed the proposed buffer and indicated it was much better than the one to the west, that it was in two sections with a sidewalk meandering through, and estimated 3 -5 years for the buffer to mature and fill in which he indicated was reasonable. Chair Glidden declared the public hearing open for the NOPC item. Palm Beach County Commissioner Karen Marcus explained the site was surrounded by unincorporated Pahn Beach County, expressed concern regarding Phase H, and explained that the County had entered into appraisals for negotiation but the owner had not been interested in selling the property at that price to the County. Ms. Marcus explained that the DRI requirement was a minimum 8 -acre preserve, that the City could require more, that flooding of homes in the area took place in 1998, and there were options that would not include drainage through the preserve area. Ms. Marcus asked that active discussion be held for more purchase or set aside ofthe property, and 'indicated this could help resolve traffic on PGA Boulevard. Ms. Marcus indicated the linkages were maintained but expressed concern regarding the roadway proximity to the north property line, and indicated the area ofbiggest concern on the graphic, which was the preserve and the northeast corner of the site. Mr. Cramer confirmed that only the layout of phase 1 was being • approved at this point. Commissioner Marcus indicated if there was an opportunity to extend drainage 5 • Planning & Zoning Commission Minutes February 13, 2001 to Prosperity Farms Road the County would like to do that. Jinn Jesteodt, 2590 Edgewater Drive, indicated he had been present at the meetings in the early 1980's when a 70 -foot buffer was discussed. Mr. Jesteodt thanked Commissioner Marcus for her efforts on behalf ofthe Edgewater Drive, and requested this development look like the depiction on the City shield and the trees be preserved and more preserve space be designated. John Perkins indicated he had lived in this area for 20 years and when his daughter had been a student at Eisenhower Elementary she had participated in field trips to the oak preserve where the students had learned about nature and species of wildlife, and recommended 30 acres of preserve. Mr. Perkins expressed his opinion that 8 acres was not enough. Fred Schultz expressed concern that the change in the site plan would open road configurations off Prosperity Farms and 'increase traffic there, and reducing roadways would not reduce development. Mr. Schultz expressed concern that traffic impacts to Prosperity Farms and other roads were not being addressed. Tony Pando, 3818 Dunes Road expressed concern regarding dual parallel roads, recurring flood areas, that hardscape would conflict with natural drainage and asked if the developer would be responsible if his drainage failed. Mr. Pando expressed concern with traffic near Eisenhower Elementary and that the developer was lacking in concern for the environment and wildlife. Mr. Pando indicated he desired meetings to continue to address these issues. Barry Present arrived at this point in the meeting at 8:45 P.M. Gloria Cornell, expressed concern regarding the drainage problem, and although she appreciated the oaks and the wildlife, indicated the reality must be considered, and asked the City to be sure development was justified. Mildred Gruner, 12006 Edgewater, spoke for the oaks and wildlife which were like old Florida, a unique and rare piece ofland. Ms. Gruner requested 25.8 acres be preserved and indicated she was in favor of 100' buffer the entire length of west Edgewater. Ms. Gruner expressed concern that 2,000 cars would be dumped from this project onto Prosperity Farms Road. Ms. Gruner commented that during one of the floods she had lost her seawall, and septic system, which were not covered by flood insurance, and that the last flood had cost her $15,000 out of pocket. Bill Bouchard, 2206 Driftwood Circle, indicated many of his concerns had been addressed by Commissioner Marcus and Ms. Gruner and challenged the Commission to address the 8 -acre issue. • Bud Siebenrock, 2620 Oak Drive, submitted for the record a copy of 492 signatures on a petition for the 6 Planning & Zoning Commission Minutes February 13, 2001 preservation of the Prosperity Oaks Ecosite located west of Prosperity Farms Road and south of West Edgewater Drive in Palm Beach Gardens, Palm Beach County, be preserved in perpetuity as a natural area for public educational and passive recreational use and enjoyment. The copy ofthe petition has been attached to and made a part of these minutes. Mr. Siebenrock pointed out there were a lot of people in Northern Palm Beach County were concerned and asked that whatever number of acres were preserved that they be open to the public. Mr. Siebenrock indicated that the Jupiter Farms Conservation Committee had sent a letter to the Planning & Zoning Commission making the same request, which has been made a part of these minutes, and that the County wanted to purchase 25.8 acres, that Treasure Coast Regional Planning Council had asked that more than 8 acres be preserved. and that Tim Schnelle, Environmental Consultant for the City, had indicated 69.63 acres as environmentally significant. Chuck Jones, South Wallen Drive, indicated his home had been flooded, and asked that more than 8 acres be preserved. Augustin Hernandez passed out two reports of 1991 and 1994, both of which recommended Basin 4 be used as a preserve and that at least 8 acres of drainage were needed, and asked if the lake was 8 acres in size. Mr. Hernandez indicated the people were not against the development but were against the plans as submitted and would like to work further with the developer. Mr. Hernandez indicated many of the oaks were 30 "-48" in girth with 100' canopies, that this was an opportunity to change the flooding by • incorporating engineering recommendations, recommended curvilinear roads, and requested this be postponed so that an improved plan could be developed. Mr. Hernandez indicated that a lot of the significant oaks were outside the 8 acre designated preserve. Laura Henning, 2442 Laurel Lane, asked that as many of the large oaks be preserved as possible. Paul Rushfeld ofBay Village suggested the preserve be extended south and a substantial buffer be built on the east end of the property west of Prosperity Farms Road. Hearing no fixrther comments from the public, Chair Glidden declared the public hearing closed. Senior Planner Talal Benothman clarified that ifthe Commission approved the NOPC they would be approving the 8 acres and the alignment of the road. Commissioner Marcus commented the County would like to purchase as much land around the preserve as possible in order to expand the preserve. Russ Devek, Gee & Jenson, engineer for the petitioner, described drainage improvements and indicated he believed the drainage issues had been satisfied and would alleviate the flooding that had taken place during the past two years. Mr. Devek pointed out high and low areas at the request of Mr. Channing, described the cross section widths in response to Mr. Kunkle, and answered Mr. Solomon that southwest runoff was not being increased and that some of the property owners' existing drainage problems had been addressed. Mr. Tarr asked ifthe lake on the southeast comer was needed for drainage or ifthat area could be used as a preserve, to which Mr. Devek responded the lake was needed. City Engineer Dan . Clark indicated that the eight lakes were part of a regional drainage solution, and were required prior to 7 • Planning & Zoning Commission Minutes February 13, 2001 the site plan. Mr. Clark explained that the size of the swale was still being calculated. Dodi Glas presented the site plan, and explained that Phase 2 would contain the buildings. John Gary, attorney for the developer, advised that since the Unit 19 drainage plan was so critical that Koper had decided to try to get the drainage plan approved before the rest of the project. In order to make Unit 19 drainage work, Koher had agreed to give those lakes to Northern Palm Beach Improvement District free of charge, but in order for that to happen the developer had to know they could develop all their property. Mr. Gary advised that his legal opinion was that Koher would satisfy the DRI requirement by setting aside eight acres, but would also try to preserve every tree they could outside the eight acres. Mr. Gary indicated that the developer must know that all the rest of the property could be developed, or otherwise must delay and try to bring in both Phase 1 and 2 at the same time. Mr. Devek indicated that altered topography could prevent the applicant being able to save some trees. Chair Glidden listed the options open to the Commission in the approval process. At Mr. Channing's request, the City Forester provided an overlay by which he indicated the locations of the large oaks and heavy concentrations. Mr. Channing questioned if the petitioner went to taller buildings whether they could preserve more of the trees, to which Mr. Hendrickson responded he felt Mr. Channing could do that. Mr. Solomon commented he could see both sides and felt the developer should have been able to rely on the 8 acres required by Treasure Coast, and it would now cause a hardship for the developer. Mr. Solomon indicated it would have been nice if the County could have come through with more dollars, and might have condemnation rights on a part ofthe property; and recommended the developer consider volunteering to reconfigure his plan and make taller buildings which could solve the problem and provide goodwill with the neighbors. Mr. Ansay commented the developer was willing to give eight acres and asked if the County would be interested in purchasing additional land at a price that could be economically feasible to the developer. Commissioner Marcus responded the eight acres was for the entire regional mall, and that the County would like to purchase additional property. Mr. Kunkle disagreed with asking the developer to design more stories and indicated he would like the developer to agree to deleting two units if the County would be willing to pay for the loss of revenue for those two units. Attorney Gary indicated the County's offer had been substantially less than the price paid for the property two years ago, and the County had not made their appraisals available. Mr. Gary indicated if there was an offer to purchase the land under those two units at a price that proved no loss to the developer in order to provide more preserve area, that was a possible area ofnegotiation but that it could make the rest of the project undevelopable. Mr. Kunkle indicated the Commission was trying to find middle ground. Attorney Gary indicated Kolter tried to cooperate whenever asked. Mr. Channing requested a tree survey showing how many trees could be saved, and that the applicant demonstrate what they could do to preserve trees in Phase 2. Mr. Tarr agreed with getting a tree survey and questioned whether the County could condemn the property, to which Commissioner Marcus responded the County could not condemn environmentally sensitive lands. Mr. Tarr questioned Attorney Gary as to whether legally ifthe City required more preserve than eight acres that the extra acres would be basically a taking. Mr. Gary responded that in his legal opinion that would be a violation of F. S. 163 where the developer had vested rights under 380, and that the DRI in 1984 required eight acres, which was still the legal 8 • Planning & Zoning Commission Minutes February 13, 2001 • requirement. City Attorney Rubin indicated he needed to research the legal issues. Chair Glidden suggested moving this project along with conditions, specificallynot giving site plan approvalto anything except Phase 1 and the infrastructure and suggesting they study the eastern parcel and the western edge of the Phase 2 property to the east ofthe Phase 1 property with the intent of saving existing trees not in the oak hammock; studying the site plan for a better design for the east parcel; and working with the County to find common ground on minimal land areas to add to the preserve — namely the land now planned for buildings 41 and 46. Mr. Kunkle agreed. Attorney Gary discussed the motion. Chair Glidden clarified that the motion would carry a strong recommendation to negotiate with the County on acquisition of additional preserve land but would not require it; but would require the developer to work hard to save oak trees along the entire eastern part of the site. Attorney Gary indicated the developer would have to know which trees they were to preserve. Chair Glidden expressed his opinion that working with a good tree survey the developer would be able to identify the trees. Ms. Glas indicated what would have to be done to accurately place the tree locations on the plan. Setbacks were discussed by Architect Mark Wiener. Mr. Tarr suggested moving the loop road farther west. Discussion ensued. Chair Glidden passed the gavel to Vice Chair Solomon. Chair Glidden made a motion to recommend to City Council approval of the NOPC and the PCD of the Regional Center DRI, Petition DRI 99 -05 & PCD -99 -05, with the condition that the eight acre set aside be further studied with specifics to follow in the site plan approval motion. Mr. Kunkle seconded the motion. During discussion of the motion, Mr. Benothman explained that the actual things being changed were road realignment and location and size of the oak hammock. Mr. Glidden clarified that the size of the oak hammock would be determined during the next motion. The City Attorney clarified that by approval of this motion the roadways would be set generally like the sketch presented. Motion carried 6-1 with Mr. Tarr opposed. Chair Glidden made a motion to recommend to City Council approval of the site plan application for Petition SP -99 -13 with the following conditions: 1. The landscape drawings for Gardens Boulevard should be modified prior to issuance of the road construction permit for said boulevard to include the Canary Island Date Palm berms. 2. Prior to the Certificate of Occupancy (C.O.) for each building, the landscaping shall be complete for the building and associated parking. The Landscape Architect (L.A.) Shall sign off on the first C.O. and last CO. on phases one and two. The last CO of each phase shall be an inspection of the entire site for verification that all landscaped areas meet the approved landscape plan. 3. All public road landscaping shall be complete and signed off by the L.A. prior to the first C.O. 0 • Planning & Zoning Commission Minutes February 13, 2001 4. All PCD buffers shall be complete and signed off by the L.A. prior to the first C.O. 5. Prior to any lake excavation, the City Engineer, Growth Management Department and North Palm Beach Improvement District shall approve the littoral planting plan prepared by the petitioner. The plan shall be consistent with the DRI condition and the City's requirement to have a 20 -foot wide lake maintenance easement or equivalent for access around each lake. 6. Lake littoral planting shall be completed and signed off by the L.A. prior to the nearest building C.O. 7. The construction drawings for the new loop road shall be revised prior to issuance of the construction permit for the new loop road to indicate the off-site sidewalk connection to Atlantic Avenue, and the petitioner shall install said sidewalk. 8. Within 60 days of the petition approval, detailed PCD buffer landscape plans shall be prepared by the petitioner for the northern PCD buffer associated with Edgewater Drive and the eastern PCD buffer adjacent to Prosperity Farms Road. The PCD buffers shall be approved by City Council and shall be installed within 90 days of the completion of the • stormwater management system. 9. That the petitioner attempt to study more carefully the Site Plan especially all those lands lying on either side of the eastern roadway running north -south and all those lands lying on the eastern parcel surrounding the oak preserve in an attempt to accomplish the following items: 1. Modify the site plan in a way that will optimize the saving of existing oak trees in and around the parking and building areas through a careful study of the existing tree survey and the proposed building and parking layout. 2. To work closely with the County between now and the date of the next City Council review of this project to determine if a reasonable accommodation could be made for transfer of land to the County through a purchase to expand and enhance the oak preserve, especially in the areas relating to buildings 41 and 46. 10. The phase two public road alignment shall be determined by using the tree inventory. The alignment of the road shall avoid as many Oak trees as possible. 11. The minimum eight acre Oak preserve shall not be encumbered by any utility, drainage or maintenance easement. Within 60 days of petition approval, the petitioner shall submit an Oak Preserve Management Plan for review and approval by the Growth Management Department The Management Plan shall include a vegetation replacement plan to be implemented by the petitioner or assigns if vegetation dies for any reason. Prior to Site Plan approval, the applicant will need to remove the pool deck from the lake maintenance easement on Site Plan 7. This occurs particularly in areas abutting curving drive aisles. The applicant needs to extend the landscape median to protect the parked vehicles from traffic. • The applicant needs to remove the catch basin from the crosswalk, on sheet SP -2. • The applicant needs to relocate the pedestrian crosswalks near the stop signs/bars. The crosswalks should be located at or near the travel lane. The stop bars and stop sign should be located approximately 4 feet in advance of the crosswalk. • The applicant needs to show yield signs at each of the three entrances to the roundabout. • It is unclear if there are 6 or 7 covered parking spaces at the bottom of sheet SP -6. If there are 6 covered parking spaces, then the additional parking space must be free of obstruction. If there are 7 covered parking spaces, then the Site Data will need to be revised to specify 49 covered parking spaces. • There appears to be a partial parking space to the west of building 10. The applicant should either extend the landscape median or realign these spaces. • The applicant needs to show all proposed drainage easements to the lakes along with the proposed width of the drainage easement. Prior to Site Plan approval, the following Preliminary Paving, Grading and Drainage Plan revisions need to be made: • Due to adhesion difficulties, paint or thermoplastic will not be permitted on paver bricks. A 100 foot buffer for the entire length of West Edgewater .Drive would lessen the negative impact on the residents, and help provide a better stormwater drainage system. The DRI for the Regional Center dictates the preservation of it minimum of 8.6 acres of Oak Hammock be preserved. However, the City can request more. The Jupiter Farms Conservation Committee strongly supports a larger preservation area on this site. This site is 47 acres of undisturbed oak hammock, one of the last remaining in the Prosperity Farms area. The preservation of this area, particularly the large oaks would retain a park like natural area that is critical to the life. style that people have enjoyed in Palm Beach Gardens. Beyond that, this oak hammock is one of the last remaining high quality areas in Northeast Palm`Beach County. These areas are irreplaceable. Once they are destroyed, they are gone forever. Our children will be deprived of enjoyment of an invaluable natural resource. We urge the Palm Beach Gardens City Council to work with the owner to arrive at a solution that will retain this beautiful natural area This is one of the high priority natural areas identified by the Palm Beach County Land Acquisition Board for possible retention as a park. now sites are key to the strategy of controlled growth in Palm Beach County and Palm Beach Gardens.
