MINUTES
The Regular. Meeting of the Planning, Zoning and Appeals Board of the City of Palm
Beach Gardens, Florida, was called to order by Chair Craig Kunkle at 6:30 P.M. in the
Council Chambers of the Municipal Complex, 10500 North Military Trail, Palm Beach
Gardens, Florida, and opened with the Pledge of Allegiance to the Flag.
REPORT BY GROWTH MANAGEMENT DIRECTOR
Talal Benothman reported action was taken by City Council at their November 18, 2004
meeting on the following cases: Fairway Office Center conditional approval to allow a
university on site; Mirasol parcels 17 and 25 with a minor change removing a condition
of approval requiring a 6 -foot clear zone between zero lot lines since there was already a
condition on the whole project requiring access to rear properties; Donald Ross PUD
amendment; Gardens Station rezoning of the site plan, and an amendment to the LDR for
administrative approvals.
APPROVAL OF MINUTES
Mr. Hansen moved approval of the minutes of the November 9, 2004 meeting with the
name Hansen changed to Pennell in line 3 on page 4. Mr. Bramson seconded the motion,
which carried by unanimous 7 -0 vote.

A request by Mr. William D. Waters of REG Architects, Inc., on behalf of RCA center
II, LLC, for approval of a rezoning from a Research and Light Industrial Park (MI)
Zoning designation to a Mixed -Use Planned Unit Development (MXDIPUD) Overlay
zoning designation and approval of a master development plan allowing for the
development of 150,000 square feet of retail use, 100,000 square feet of office use, and
50,000 square feet of industrial use. The approximately 30.03 -acre subject site,
referred to as "Parcel 5B, "is generally bounded by the PGA Flyover to the north, the
FEC Railway to the east, the proposed Gardens Station mixed -use development to the
south, and RCA Boulevard to the west.
Ex -parte communication was reported as follows: Mr. Hansen had met with the applicant
about two weeks ago. Mr. Pennell met with Mr. Marshall. Mr. Present spoke to Mr.
Marshall on the phone.
Senior Planner Michael Sanchez presented the staff report. Mr. Sanchez explained that
if this project did not receive a development order by the end of this year they would lose
their city traffic concurrency approval and would have to re -apply for traffic concurrency.
They would then run the risk of not receiving traffic concurrency due to the current
amount of trips on PGA Boulevard.
On the proposed connection between Gardens Station, Mr. Hansen asked if the
recommendation to close that off also would close the driveway that exits to RCA from
Gardens Station. Mr. Sanchez responded, no, it was just to eliminate having three
entrances from RCA. Mr. Hansen asked if there was concern about traffic using the drive
thru at the bank. Mr. Benothman commented that had been discussed with the applicant
for Gardens Station that afternoon, and they were reducing the bank by 1,000 square feet
and possibly eliminating the drive thru. The area resulting from the building decrease
would be used for parking.
Mr. Pennell noted the City Council approval for Gardens Station had included the
position of the access road, and asked what that meant in this approval. Mr. Benothman
responded the same condition was being proposed for 5B. Mr. Pennell asked what would
happen if this Board recommended it not be there, to which Mr. Benothman responded
that would be included in the recommendation to City Council.
Mr. Present asked if the developers of Gardens Station were okay with the changes. Mr.
Benothman confirmed they were fine with the changes.
Mr. Hereford asked if Gardens Station was a station for Tri Rail or a development
location for private businesses. Mr. Sanchez explained that Gardens Station was the site
plan shown and had nothing to do with Tri Rail —that was just the name of the
development. Mr. Sanchez pointed out the location where the Tri Rail station might be
built, and explained that a condition required the applicant to work with the City, RTA,
and Treasure Coast Regional Planning Council to redesign that portion to accommodate
proposed intensities and a transit station if it were deemed feasible in the future. Mr.

Present asked if enough provision for parking was being made in case that happened in
the future. Mr. Sanchez explained there was no provision for parking being made at this
point and part of that plan would address the parking situation, which he felt would have
to be a parking structure. Chair Kunkle asked if this project were approved before the
end of this year, if there was a possibility this might come back to this board in a year and
a half with a totally different site plan, which Mr. Sanchez confirmed was possible.
Donaldson Hearing, representing the applicant, introduced Rick Gonzales, President of
REG Architects, Inc, who gave a presentation regarding the architecture. Mr. Gonzales
described the model, scale, and urban design aspects, reviewed renderings showing
updated architecture, and advised that there would be two locations provided for art in
public places. Mr. Hearing continued the presentation, addressing items to which staff
had objected, including buffer size, covered parking, trademark corporate logos, and
signage. Interconnectivity was reviewed. The applicant objected to pedestrian
connectivity in the parking lot.
Chair Kunkle verified with Mr. Benothman that this was the opportunity for this Board
to get additional items of concern for this project listed for City Council approval.
Mr. Bramson recommended reducing the signage size by 6" or whatever was needed to
get the signage proportionate to the vertical platform the sign was attached to, which
would solve the sign problem. Also the color palette, which was a point of contention,
could be very easily corrected. Mr. Hearing stated the applicant agreed to work with staff
to address the colors staff had requested.
Mr. Hansen stated he would like to commend the applicant for their response to the
Board's previous concerns, particularly as it related to the architecture, which had been
significantly enhanced. Mr. Hansen stated he was not concerned about introducing
another architectural style, and described the varied architectural enhancements, which he
felt was a great improvement over the previous Mission style. Mr. Hansen commented in
the city of Santa Barbara there was a whole city with the same style of roofs, and yet that
city had a very exciting character. Mr. Hansen stated he understood the applicant's
concerns about parking, and had talked about parking structures with Mr. Gonzales and
about doing something with the one that semi - blocked the view of the end of the
building — building number one. Mr. Hansen favored pulling building number two closer
to the corner, and agreed with the applicant on the pedestrian connectivity issue in the
parking lot, and stated he felt the sidewalk added by the furniture building on the south
end of the project was a good one. Mr. Hansen commented on the easement
encroachment waiver and asked if there were utilities there, to which Mr. Hearing
responded there were Seacoast Utilities there and also FDOT drainage. The utility
providers had agreed to the landscaping where it was shown, and would be the amount
required only in a more defined, narrower strip. Mr. Hearing explained that the raised
railroad track served a function to hide the cars. Mr. Hansen commented he tended to
agree that the covered parking spaces helped the edge but would like to see the office
building pulled in a little closer to create more of an edge since he thought the building

would create a better edge than the parking structure; however, if it would not work, he
would like to see a full peaked roof. On the logo issue, he supported working this out on
a case -by -case basis with staff and agreed the Panera's logo at The Commons looked
good. Mr. Hansen stated he concurred with staff on the sign height, stating he felt
Catalfumo's sign could be more tastefully indicated, be more in scale, and commented
this building did not lend itself to a billboard type 5' high sign. Mr. Gonzalez indicated
the applicant would work with Mr. Bramson's suggestion regarding reducing the sign
proportionally. Mr. Hansen commented he felt the project overall was well done and the
architecture worked well, and was a positive improvement. Mr. Hansen stated if the few
outstanding items could be addressed he felt this would be a great project.
Mr. Pennell commented he agreed with staff on most of the items, but complemented the
applicant for putting in the roadway median and on the architecture. Mr. Pennell agreed
with staff there should be more color. Mr. Pennell indicated building one reminded him
of the Bascom Palmer building and was a nice touch. Mr. Pennell commented he was
comfortable with the location of building number two. Mr. Pennell disagreed with staff
on the covered parking and thought the 13 spaces at issue were less visible than if they
were moved to the south. Mr. Pennell stated he did not see people walking across the
parking lot, and felt it worked the way the applicant had presented it. Mr. Pennell
commented if he were the tenant in building 10, especially if it were a furniture store, it
seemed a very awkward place for an access road, but he did not know a solution except to
place the access road in the little parcel off to the west. Mr. Pennell agreed with staff on
all conditions and waivers except the one about the covered parking structure, and felt if
the one building was replaced with a train station that would work very nicely.
Mr. Present commented Mr. Hearing had done a fine job convincing him why the
easement encroachment was unique to this property. On the logos, Mr. Present stated he
would like to see the right and left side edges of the palette —with bright colors or edges
kept down - -and work with staff on that so bright colors would not be standing out like a
sore thumb. Mr. Present agreed with what had been said about sign size. Mr. Present
liked the location of building two where it was, and would like to see a separation in the
parking lot between retail and office parking. In the future if Loehmann's redeveloped
that would be a big factor in how the walkways would be used. Mr. Present commented
the dual access was too close and would have liked it worked out, but was sure it could
be worked out with staff. Mr. Present favored leaving the space for Tri Rail with nothing
done there, and for everyone to actively work on getting Tri Rail there and not waiting to
see if it happens. Mr. Present expressed his opinion that Tri Rail was the key to North
County, that it belonged on this piece and not on the northern piece, that it was an
amenity not only to this development but to PGA Boulevard and Palm Beach Gardens,
and he would not like the City to be sorry in the future that this development had been
done in a way that Tri Rail was boxed in so they could not use the site to their maximum.
Mr. Present encouraged the applicant to make it happen and do everything possible to
prepare for it, and for the staff to do whatever was possible with Treasure Coast, the
Council, and the Mayor to encourage it.

Mr. Rubins commented he was very impressed with the presentation. Mr. Rubins felt the
covered parking was located in the best spot. Mr., Rubins felt regarding the pedestrian
connectivity that it was very important that it stay where it was because people should
walk through the stores so they would spend their money there. Mr. Rubins was
concerned about the logos, since he would not like to see a bright yellow Subway logo..
Mr. Hereford commented he agreed with the comments that had been made, and strongly
seconded Mr. Present's comments about Tri Rail.
Chair Kunkle declared the public hearing open. Roger Blangey, Garden Woods, advised
he was the official representative from that area for the proposed railroad station, and
they were very much opposed to it being in Parcel 5A because it would be in their back
yard and it would be dangerous. The City had been working with them on that, which
they appreciated. Mr. Blangey expressed his opinion it was a very nice plan for 5B but
there should be a plan in case there was a Tri Rail station there, and felt it important to
have a plan to go either way. Chair Kunkle advised that he believed staff would take the
Board's suggestions to pursue getting a Tri Rail station, and this Board generally
supported this location for a Tri Rail station as opposed to 5A. Mr. Blangey commented
it was important parking for the station be in Parcel 5B if the station was there. Chair
Kunkle encouraged Mr. Blangey to make similar comments to the City Council when this
was heard. Hearing no further comments from the public, Chair Kunkle declared the
public hearing closed.
MOTION:
Mr. Hansen made a motion to recommend to City Council approval of PUD -04 -04
RCA Center (Parcel 5B) — Rezoning and Master Development Plan Approval
including comments that the general feeling of this Board is that the overall
architectural concept as presented is a significant improvement over the previous
and maintaining that particular style throughout is satisfactory to this particular
Board with the exception that multiple color palettes be looked at as far as
differentiation from building to building, however, the architectural character will
remain as it is; also recommend strongly that the City Council and staff and
whoever else is necessary pursue as vigorously as possible encouragement of a
timely time frame to incorporate the extension of Tri -Rail and incorporation of a
Tri -Rail Station on this particular site; and that all notes taken by staff of comments
made by each member of the Board be incorporated as a part of this motion. Mr.
Hereford seconded the motion, which carried by unanimous 7 -0 vote.

Re: Location of Future Tri -Rail Transit Station — City of Palm Beach Gardens.
Dear Mayor.
Further to my letter dated June 01, 2004 to Mr Jonathan Roberson of S.F.R.T.A
(enclosed) I would like to mention another reason why the future Tri -Rail transit Station
should not be located North of the PGA Blvd overpass in parcel 5A.
Mr J.L. Schonder Manager - Engineering FEC Railrway, in his letter dated 05/29/01 to
Mr R. Ferris City Manager, stated for Kyoto Drive quote "The crossing would be located
at the end of a curve in our mainline track and would not give our train Engineers time to
react should a motorist become stranded or stopped on the crossing" unquote. Therefore
if for any reason a TRI- RAIL, train has not completely cleared the mainline track near
the Kyoto Drive crossing when a southbound FEC train is approaching, the FEC train
Engineer will not be able to stop his train in time to avoid a catastrophic accident.
According to Mr Roberson the final decision for the location of the future Tri-Rail
Transit Station will be the responsibility of the City of Palm Beach Gardens. Therefore as
the representative of Garden Woods on that matter, I suggest to the City Council to pass a
Resolution stating that the future Tri-Rail Transit Station is to be located South of the
PGA Blvd overpass in parcel 5B.

Dear Mr. Roberson,
Further to our petition against a PGA railroad station in parcel 5A and in view of a decision
by S.F.R.T.A and the City to find the most suitable location for that station, I would like to
make the following comment:
A Tri -Rail train stationed north of PGA Blvd would stand directly south of the fixture Kyoto
Drive at -grade railroad crossing. A motorist heading Eastbound at that crossing would not be
able to see an approaching northbound train due to visual limitation caused by the Tri -Rail
train stationed at that location, thereby creating driver apprehension at the crossing and
leading to accidents.
Hoping this information along with our petition will be valuable to S.F.R.T.A and the City in
deciding not to consider the parcel 5A location for "the station ".

SUBJECT: Tri -Rail Transit Station FYI
In December of 2003, staff islet with representatives from the South Florida Regional
Transportation Authority (the `Authority') to identify possible sites fora Tri -Rail transit
station within the City in close proximity to PGA Boulevard. Two (2) sites were
identified as a result of that meeting, Parcel 5A (nonhwest corner of PGA Boulevard and
Alternate A 1 A) and Parcel 5B (southwest corner of PGA Boulevard and Alternate Al A).
In light of knowledge that the Authority is contemplating a Tri -Rail transit station at
either of the two (2) aforesaid locations, staff initiated an amendment to the City's Land
Development Regulations (LDR's) to allow "Passenger Stations" to be permitted as
Conditional Uses within the Research and Light Industrial Park (M1) zoning district. For
your information, Parcels SA and SB currently have Research and Light Industrial Park
(MI) zoning designations. Upon the rezoning of Parcel SB as is currently being
proposed, said parcel will retain, among others, the same underlying zoning designation.
At the City Council meeting of March 18, 2004, at which the aforementioned City -
initiated LDR text amendment was heard on First Reading, the City Council made it be
known to staff that it preferred the transit station to be located on Parcel 5B, rather than
on Parcel 5A; the reason being that Parcel 5A is directly adjacent to the Garden Woods
residential development and that a passenger transit station on Parcel 5A would adversely
affect the neighborhood.
The City has put the Authority on notice that the developer for Parcel 5A and Parcel 5B
is actively pursuing development approvals for both parcels from the City and is
expecting to obtain approval thereof by early -to -mid Fail of 2004 and that swift action is
required on the part of the Authority in order to have provisions made for a Tri-Rail
transit stop in the development approval of either parcel.

PGA RAILROAD STATION PETITION
According to South Florida Regional Transportation Authority (Tri- Rail), the City of Palm Beach
Gardens has proposed 2 sites for the PGA railroad station: 1) site south of PGA Blvd near RCA
Blvd or 2) site north of PGA Blvd (right in the backyard of the Garden Woods community).
According to S.F.R.T.A. a final decision on the location of the PGA railroad station site will be
made before the summer of 2004. It is well known that a railroad station is very noisy in train
starting procedure, has heavy engine pollution and a lot of activities with can and buses coming
in and out of a railroad station. Therefore the residents of Garden Woods are very opposed to a
railroad station north of PGA Blvd and are asking S.F.R.T.A, the Palm Beach Gardens Mayor and
Council to locate the future railroad station near RCA Blvd.
KYOTO DRIVE GRADE RAILROAD CROSSING DOT CASE 02 -004 and 006
The Administrative Hearing scheduled for September 15`h through 19, 2003 was cancelled
because the Florida East Coast railway accepted the future Kyoto Drive grade railroad crossing
location and the Patin Beach Gardens Mayor promised an A.H.S (Automated Horn System) to be
installed at the future Kyoto Drive grade railroad crossing itself. That system would permit the
train engineer not to blow the train horn' /. of a mile before the crossing except in case the A.H.S
would fail to work. According to Rail Manual, paragraph 3.2, FDOT is to consider the criteria for
noise due to additional whistle blowing on opening a railroad crossing. Therefore the residents of
Garden Woods are asking the FDOT Secretary not to give the authorization for the Kyoto Drive

KYOTO DRIVE GRADE RAILROAD CROSSING DOT CASE 02 -004 and 006
The Administrative Hearing scheduled for September 15th through 19, 2003 was cancelled
because the Florida East Coast railway accepted the future Kyoto Drive grade railroad crossing
location and the Palm Beach Gardens Mayor promised an A.H.S (Automated Horn System) to be
installed at the future Kyoto Drive grade railroad crossing itself. That system would permit the
train engineer not to blow the train horn 1/4 of a mile before the crossing except in case the A.H.S
would fail to work. According to Rail Manual, paragraph 3.2, FDOT is to consider the criteria for
noise due to additional whistle blowing on opening a railroad crossing. Therefore the residents of
Garden Woods are asking the FDOT Secretary not to give the authorization for the Kyoto Drive

PGA RAILROAD STATION PETITION
According to South Florida Regional Transportation Authority (Tri- Rail), the City of Palm Beach
Gardens has proposed 2 sites for the PGA railroad station: 1) site south of PGA Blvd near RCA
Blvd or 2) site north of PGA Blvd (right in the backyard of the Garden Woods community).
According to S.F.R.T.A. a final decision on the location of the PGA railroad station site will be
made before the summer of 2004. It is well known that a railroad station is very noisy in train
starting procedure, has heavy engine pollution and a lot of activities with cars and buses coming
in and out of a railroad station. Therefore the residents of Garden Woods are very opposed to a
railroad station north of PGA Blvd and are asking S.F.R.T.A, the Palm Beach Gardens Mayor and
Council to locate the future railroad station near RCA Blvd.
KYOTO DRIVE GRADE RAILROAD CROSSING DOT CASE 02 -004 and 006
The Administrative Hearing scheduled for September 15'' through 19, 2003 was cancelled
because the Florida East Coast railway accepted the future Kyoto Drive grade railroad crossing
location and the Palm Beach Gardens Mayor promised an AXLS (Automated Horn System) to be
installed at the future Kyoto Drive grade railroad crossing itself. That system would permit the
train engineer not to blow the train horn 1/4 of a mile before the crossing except in case the A.H.S
would fail to work. According to Rail Manual, paragraph 3.2, FDOT is to consider the criteria for
noise due to additional whistle blowing on opening a railroad crossing. Therefore the residents of
Garden Woods are asking the FDOT Secretary not to give the authorization for the Kyoto Drive
grade railroad crossing to start operation before an A.H.S. is installed and fully operational in
cooperation with the F.E.0 railway and other railroad companies using the F.E.0 railway line.
Because we have no Neighborhood Association in Garden Woods we authorize Roger Blangy, a
resident of Garden Woods, living at 11658 Hemlock Street, to be our representative in the matters
of the future PGA railroad station and the firture Kyoto Drive grade railroad crossing.
