17 The meeting took place in the Council Chambers of the City of Palm Beach Gardens on

20 Purpose of the Meeting
21 This Development Review Committee was held at the request of Cotleur & Hearing for
22 an approval of a site plan amendment to the BallenIsles Clubhouse facility. The applicant
23 is seeking approval for improvements to the clubhouse facility.

26 Growth Management
27 Brad Wiseman, Planning Manager, reviewed the Certification and Non - certification
28 issues. The future site plan must be labeled in regards to the replacement of parking
29 spaces with tennis courts. The applicant must show justification in the project narrative
30 for the utilization of 295 golf cart parking spaces in lieu of the standard parking spaces.

33 Ray Caranci, Forestry Technician, addressed the Certification and Non - Certification
34 issues. A landscape plan should be provided by Seacoast Utility Authority to the City
35 before scheduling for the Planning, Zoning and Appeals Board. A landscape permit and
36 irrigation permit shall be applied for as required by the Building Department.

39 Jim Orth, Assistant City Engineer, addressed the Certification and Non - certification
40 issues. The applicant is to identify all existing and proposed sidewalk widths. All other
41 issues were reviewed and accepted by the applicant.

44 Scott Fetterman, Deputy Fire Chief, reviewed Certification issues. Fire Rescue is
45 requesting that additional fire hydrants be required within 300 ft. of the proposed building
46 at the North and East locations.

2 Officer Jules Barone, Crime Prevention Officer, requested that under conditions for
3 approval, a construction site and security plan be submitted to the Police Department in
4 writing. Lighting issues and stairway ideas were suggested and agreed to by the

Based upon a review of the applicant's submittal we have the following
certification comments:
1. Based upon the square footage of the existing structure, the type of
construction for the existing structure, the occupancy classification, and the
area of the proposed additions, there is significant cause for concern that the
end result being proposed may exceed the building area allowable for the
type of construction and occupancy.
2. In reviewing the prior code requirements, the existing clubhouse facility
enclosed area is 52,925 SF according to Peacock and Lewis. Based upon
our review of the records for the original project the building was permitted
under the 1994 Standard Building Code as a Type IV "Unlimited Area ", Type
"A" Assembly Structure.
a. The designer was able to achieve this with certain specific alternative
methodologies being utilized to achieve this designation.
b. Part of the requirements necessary at the time in order to qualify was
to provide grade level access at all required exits or use approved
ramps for exiting.
c. Additionally, the golf cart storage area appears to have been limited
so as to be deemed to comply with the specific requirements outlined
in the code to qualify as a "basement ".
Each of these considerations is important to consider as we shift focus to look
at the current project.
3. In reviewing the current code requirements applicable to the project the
following requirements are clear:
a. Section 901 of the Existing Buildings Volume of the Florida Building
Code that the project shall not be allowed to create or extend a "non-
conformity" with regard to specific code requirements.
b. The occupancy classification today for the structure is "A -2 ".
c. The "Unlimited Area" allowance in the code does not apply for a type
1116" structure, so we cannot use the previous utilized methodology to
justify an increase in area.
d. The construction type utilizing the current code for the structure is
type 1116 ", for which does not require any alternate methodologies in
order for the building to qualify. Additionally this type allows up to 2
stories of A -2 occupancy without special consideration.
e. The maximum area allowable for a Type 116, A -2 occupancy is now
9,500 square feet, not considering any height or area modifications
allowed.
f. Utilizing general area modifications based upon open area frontage
and sprinklers the building area can be increased to 52,250 square
feet on the main floor
g. Additional areas can be added as long as they are separated by 4
hour fire walls.
h. Addition of these areas utilizing 4 hour walls will affect the general
area calculation listed above in item "f'.
4. Based upon these facts and following internal review and consultation, staff
believes that the proposed addition and renovation can comply more easily
with the current Florida Building code than to attempt to certify portions of the
building not being renovated under the 1994 Standard Building Code and the
renovated and added areas under the current code. Additionally by utilizing
the current code the specific level exiting language listed in the "Unlimited
Area" is no longer applicable as well as the single floor limitation.
5. Therefore, we are requesting to meet with the design professional to discuss
appropriate methodologies which can allow the increase in area.
6. Additionally, we are further requesting that the design professional prepare
an allowable area calculation for the type of construction and occupancy,
utilizing general area, frontage area and sprinkler area modifications,
including compartmentalization, which will allow the proposed increase in
area to take place.
Based upon a review of the applicant's submittal we have the following non -
certification comments:
Separate application, plan review and permitting shall be required for site
lighting, site landscaping, site irrigation, gas piping, fire alarm systems and
modifications, fire sprinkler systems and modifications, fire suppression
systems (Ansul / Cobra), type I or II hood systems, and interceptors
regardless of whether or not such systems and devices are shown on the
main building plans.
2. Separate application and approval shall be required for paving, grading,
drainage, water and sewer improvements through the City Engineering
Department.
3. Separate approval for your project may be required by the State Division of
Hotel and Restaurant, Department of Agriculture, Department of
Environmental Resource Management, or other agencies based upon the
type and nature of work proposed. Issuance of a permit from the Building
Division does not obviate the applicant from responsibility to comply with all
applicable restrictions.

Crime Prevention Through Environment Design is a branch of situational crime prevention
that maintains the basic premise that the physical environment can be designed or
manipulated to produce behavioral effects that will reduce the incident and fear of crime.
The review performed by the police officer listed above shall encompass but not be limited
to the following principles: natural surveillance, natural access control, territorial
reinforcement and maintenance. The police department has reviewed the site plan and
strongly recommends the following minimum conditions be met.
STANDARD CONDITIONS FOR APPROVAL:
Professional Office /Commercial /Industrial PUDs
1. Prior to the issuance of the first Certificate of Occupancy, all on -site lighting shall be installed. All
exterior pedestrian walkway lighting shall utilize 12 foot pedestrian scale light poles, and all on-
site lighting shall consist of metal halide or equivalent lighting approved by the Police Department
and, shall not conflict with planted landscaping. (Police Department)
2 Landscaping shall not obstruct the view from windows or walkways and should be avoided near lighting
fixtures as future growth could obscure the source. Ground cover should not exceed "24" in height and
high branched trees should be trimmed to seven feet. (Police Department)
3 Prior to the issuance of the first Certificate of Occupancy for the BallenIsles Clubhouse, the
Applicant shall provide for photocell sensor engaged lighting above or near entryways and
adjacent sidewalks for said building. (Police Department)
4 Prior to the issuance of the first Certificate of Occupancy for the Clubhouse all entry doors(non-
glass single /double) shall be equipped with astragal over the threshold of the locking mechanism
and case hardened deadbolt locks shall be provided on all exterior /interior doors with a
minimum one (1) inch throw or mechanical interlock. Doors secured by electrical operation shall
have a keyed - switch or signal locking device to open the door when in the locked position.
Exterior doors should have a holding force of at least 10001bs. Door hinges shall employ non -
removable hinges, and the main entries to the Clubhouse shall be wired for closed - circuit digital
camera surveillance system. (Police Department)
QPrior to the issuance of the first building permit, the Applicant shall submit a construction site
security and management plan for review and approval by the Police Department.
Noncompliance with the approved security and management plan may result in a stop -work
order for the PCD. (Police Department)

6 Prior to the issuance of the first CertificaY of Occupancy for the Clubhouse, numerical address
shall be placed at the front of the building. The numerical address shall be illuminated for
nighttime visibility, with an uninterruptible A.C. power source, shall consist of twelve (12) inch
high numbers, and shall be a different color than the color of the surface to which it is

7 Prior to the issuance of the first Certificate of Occupancy for the Clubhouse, member elevator cab
interior which is not completely visible when the door is open shall have shatter resistant mirrors
placed in a location approved by the Police Department. (Police Department)
Prior to the issuance of the first Certificate of Occupancy, buildings with a total square footage of
at least 10,000 square feet shall have roof top numbers placed parallel to the addressed street,
only visible from the air. The numerals should be blocked lettered, weather resistant material,
four feet in height and 18 inches wide. (Police Department) A ",oss (�6of) —
Prior to the issuance of the first Certificate of Occupancy for each building, interior stairwells
doors shall have glazing vision panels, five inches wide by 20 inches in height.(Police
Department)
Non- Certification Conditions of Approval:
Natural Surveillance
• Provide landscaping that does not create hiding spaces.
• Provide clearly marked transitional zones that indicate movement from public to semi-
public through use of brick pavers.
• Windows and exterior doors should be visible from parking area.
• If practical, designate separate parking area for employees
• Parking areas should be visible from windows not blocked by landscaping.
• Allow shrubbery to be no more than two feet high for clear visibility in vulnerable
areas.
All Structures shall be target hardened, to include but not limited to:
• Buildings shall be wired for an alarm system.
• Doors shall be equipped with metal plate over thresh- hold of the locking mechanism.
• Interior doors to offices shall have 180 degree peephole viewers or a vision panel.
• Case hardened commercial grade dead bolt locks shall be installed on all exterior doors with
minimum of one inch throw into the strike receiving the bolt. The cylinder shall have a
cylinder guard and a minimum of five -pin tumblers.
• Door hinges shall be installed on interior side of door or non — removable hinge pins or a
mechanical interlock to preclude removal of door from the exterior.
• Eliminate publicly accessible switches in such places as restrooms, lobbies and common
spaces.
• Glazing in interior doors, or 40 inches within of any locking device shall be rated burglary
resistant glazing.
• Enhance natural surveillance of restrooms by placing them in central areas and install maze
entrances; avoid double door entry systems.
• It is strongly recommended a digital CCTV system be installed to monitor all pedestrian
activity including golf cart storage and golf bag room.
• Bicycle racks should be placed in close proximity to the building and not within parking lots.
• All hatchway openings to roof shall be secured from inside with a slide bolt or slide bars.
Outside hinges shall be equipped with non - removable pins.
• Exterior /interior pedestrian doors which provide access into parking lots shall be solid core
and where applicable emergency doors shall have no exterior handles. Panic hardware shall
have self locking mechanism, may have one locking point and shall have a protective astragal
attached to the exterior of the door.
• Loading dock doors should have two lock receiving points; if slide bolts are utilized they
should have a minimum V2" bolt diameter and protrude at least 1 1/2" into the receiving
guide.

Fire Rescue has reviewed the above referenced site plan amendment
petition and has the following comments and concerns:
Clubhouse
• Fire Rescue has concerns with the existing site and proposed site
plan in reference to access to the rear of the existing clubhouse.
The approved site plan from 1999 indicated an area by the bag
drop that fire rescue could access cart path located on the north
side of the clubhouse. Currently and as indicated on the proposed
site plan the access area no longer exists. Fire Rescue will require
that access be provided.
The proposed parking of golf carts on the existing cart path will
reduce the width of the existing path. The path will need to
provide a minimum of 20 -ft in clear width for fire apparatus.
The relocation of the fire line to the clubhouse will need to be done
in a manner as to not place the existing system out of service for
more than a brief period of time.
Snorts Complex
• The round -about area in front of the building will need to be
modified to allow for fire apparatus to pass through and stop in
front of the building.
• Additional fire hydrants will be required within 300 ft. of the

1. Pursuant to Section 78 -344, a waiver is not required for the reduced parking stall
widths. However, please note that the reduced parking stall widths are subject to
final approval by the City Council. The applicant shall withdraw the waiver
request.
2. The applicant shall reflect the 1.5 additional square feet of open space for each
square -foot of asphalt that is reduced through the utilization of the 9 -foot wide

Certification Issues
1. In accordance with Section 78 -320 of the LDR, Table 31, minimum standards for
non- residential development require the trees to be a minimum of 12 feet at
installation. Please revise the plant list to show the minimum size of 12 feet for
the trees.
2. Please supply a landscape plan approved by Seacoast Utility Authority to the City
of Palm Beach Gardens before scheduling for Planning and Zoning.
Conditions of Approval
1. A Landscape permit and Irrigation permit shall be applied for as required by the
Building Department.
2. The completed landscaping shall be inspected and accepted by the City Forester
and Landscape Architect for compliance with the approved landscape plan.

• We have reviewed the Traffic Statement Letter dated June 27, 2007 prepared by
Kimley -Horn & Associates, Inc. and concur with its findings.
• The following issues relate to the proposed areas of the site modifications as
shown on the referenced plans.
Certification Issues
The applicant shall clearly show, label and dimension the site plan and
engineering plan, conforming to Section 78 -46 of the LDR, to clearly identify
all existing and proposed site feature (within and adjacent to the proposed work
areas) including but not limited to; curb (noting type), curb radii, pavement
width, drive aisle width, pavement radii where curb is not proposed, sidewalk
and their width (including public sidewalks on adjacent street right -of- ways),
handicap ramps (labeled "HR" or "CR "), flush walk with pavement ( "FW "),
raised walk in lieu of curb along the edge of the pavement, parking stalls
(standard and handicap), pavement areas versus grass areas, easements, utilities,

2. The applicant shall identify all existing and proposed sidewalk widths in
accordance with Section 78 -506 of the LDR. While some sidewalk widths are
noted, not all are shown. The use of "Typ" is appropriate only for areas where
all walk is the same width.
3. The applicant shall provide "complete horizontal control of the project
sufficient to construct the project and determine the dimensions of all site
improvements ", on the engineering plan and site plan or on a separate
Horizontal Control plan, in accordance with Section 78 -448 of the LDR.
4. The applicant shall show all existing and proposed regulatory and directional
signage and pavement marking within the area of the proposed work and so
label it, on the site plan, landscape plan and engineering plan, or provide a
separate signing and marking plan for the project for conformance with Section
78 -46 of the LDR.
5. We suggest that the applicant review the desirability of providing stop sign/stop
bars for the parking lot access aisles at the main drive to the sport complex.

6. We recommend that the applicant show pedestrian crossing signs for non -
controlled intersections, such as mid - block. The applicant is referred to the
crosswalk from the handicap parking area south of the clubhouse to the
clubhouse walk. The applicant is referred to Section 2C.41 of the 2003
MUTCD, which notes; "When used at the crossing, Nonvehicular signs shall be
supplemented with a diagonal downward pointing Arrow (W16 -7p) plaque (see
Figure 2C -11) showing the location of the crossing."
7. The applicant shall show and label the proposed signage on the landscape plan
consistent with the site plan and engineering plan to identify any possible

conflicts with existing and proposed landscaping for conformance with Section
78 -46 of the LDR.
8. In accordance with Section 78 -563 of the LDR, no permanent improvements
are permitted within the minimum 20' Lake Maintenance Easement (LME).
The applicant shall remove all landscaping shown to be within the proposed
LME, or provide the dimension and show the minimum clear zone for review
by the City Engineer (Sheet 3 of 7).
9. The applicant shall identify all existing and proposed curb ramps on the site
plan, landscape plan and engineering plan and shall label the handicap ramps as
"HR" or "CR ", or where it is proposed that the walk be flush with the pavement
the area of the handicap access shall be labeled as "FW ", at the time of the site
plan review for conformance with Section 78 -230 of the LDR. At time of
construction plan review FDOT Index 304 CR numbers shall be identified for
each location, in addition to the labeling of flush walk ( "FW ") where
appropriate.
10. The applicant shall provide a photometric plan conforming to Ordinance 26,
2006 and the City's lighting standards, which shows the areas of modification
including vehicle access areas, parking areas, recreational areas, pedestrian
access areas, etc.
11. The applicant shall review the note for the Standard & Handicap Parking
Layout (Sheet 4 of 7) which indicates that the appropriate FDOT CR #s are
shown on the site plan. However, the site plan does not identify curb ramp
numbers. While the CR# is not required at time of site plan review, the
applicant shall revise the note and /or the site plan for consistency.
12. The applicant shall revise the legend on the site plan (Sheet 2 of 7) to reflect
that the "LME" is the "Lake Maintenance Easement ", not the landscape
maintenance easement.
13. While the applicant has requested a waiver from the requirement for parkin
stall dimensions to permit nine (9') foot wide stall with 25 foot aisle width for
the project, due to restrictions of the existing parking areas, we recommend t at
the applicant provide parking stalls in conformance with the LDR for the
proposed additional parking lot south of the tennis courts (Sheet 3 of 7), as
these stalls are not affected by the existing parking lot dimensions and adequate
space exists to provide standard parking stalls.
14. The applicant shall provide a note on the plan stating, "All handicap accessible
ramps shall meet all applicable local, regional and state accessibility
guidelines and regulations. Any modifications shall be approved by the
engineer -of- record. "
15. The applicant shall provide a note on the plan stating, "All pavement marking
and striping, excluding parking stalls, shall be installed with thermoplastic

materials. Also, paver bricks of appropriate color shall be used on paver brick
areas, in lieu of paint or thermoplastic material," in accordance with Section
78 -344 of the LDR.
16. The applicant shall add the following note to the plan, "Handicap parking signs
shall be placed behind the sidewalk in areas where sidewalk abuts the stall and
outside the two and a half (N) foot overhang area where wheel stops are not
provided. " The 2V2' overhang is to be measured from the back of curb, edge of
pavement or back of wheel stop as applicable per Sections 78 -315 & 78 -344 of
the LDR.
Waiver Requests
1. The applicant is requesting a waiver from Section 78 -141 of the LDR which
specifies, "The maximum height permitted within residentially zoned property
of 36 feet. " The applicant is requesting 54 feet for the sports complex and 39.3
feet for the clubhouse. Please note we remain in support of the City's LDR
requirements. Please note we remain in support of the City's LDR

2. The applicant is requesting a waiver from Section 78 -344 of the LDR which
specifies, "The minimum parking stall width of nine (9 ) feet with twenty -six
(26 ) foot wide travel aisle. " The applicant is requesting nine (9') foot widths
with 25 foot aisle width. Please note we remain in support of the City's LDR
requirements.
3. The applicant is requesting a waiver from Section 78 -344 of the LDR which
specifies, "That wheel stops, bumper stops or non mountable curb shall be
installed within all parking spaces ". The applicant is requesting that it be
waived for golf cart parking areas. Please note we remain in support of the
City's LDR requirements.
4. The applicant is requesting a waiver from Section 78 -344 of the LDR which
specifies, "That a landscape island is required every nine (9) parking spaces,
in a row". The applicant is requesting that it be based on current conditions
which do not conform to the nine (9) space requirement. Please note we remain
in support of the City's LDR requirements.
Non - Certification Issues
NOTE: All engineering /infrastructure plans are considered conceptual during
the planning and zoning review phase and are subject to further review during
the final construction review. These non - certification comments shall be
satisfied prior to construction plan approval and the issuance of the first land
alteration permit.
1. The applicant shall provide a note on the engineering plan regarding the City's
requirement for the taking of test to certify the minimum compaction

specifications. The City's specifications shall apply, except where the specific
requirements of contract documents or Seacoast Utility Authority are greater.
The note shall read,
"Density Tests for trenches shall be taken in maximum one (I ) foot lifts,
measured from the top of pipe. The tests shall be taken, at a maximum
spacing of every 300 feet measured from the structure, or at least one test at
the center of the pipe segment between two structures if less than 300 feet.
Tests shall also be taken, on alternating sides of the structure with each lift
tested. The test location at the structure shall be within five (5) feet of the
structure. The location and depth of tests shall be clearly indicated in
the description area on the test report andlor on a location map which shall
be attached to the test report. Required testing at utility structures shall
include all manholes, inlets, vaults, or valves within any paved area,
including paver areas."
The applicant is further advised that the testing lab or engineer -of- record shall
certify, on the test report, the lift thickness for all subgrade, base and pavement
tests taken for construction.
2. The applicant shall provide a note on the engineering plan stating, "All
structure rim elevations shall be set to finished surface grade, unless otherwise
specifically noted on the plan. " Where the design proposes that the structure
rim shall be set above or below the finished surface grade, the applicant shall
show and label both elevations clearly on the plan view.
3. The applicant shall provide a note on the engineering plan stating, "All
pavement marking and striping, excluding parking stalls, shall be installed with
thermoplastic materials. Also, paver bricks of appropriate color shall be used
on paver brick areas, in lieu of paint or thermoplastic material," in accordance
with Section 78 -344 of the LDR.
4. The applicant shall provide a note on the engineering plan stating, "Handicap
parking signs shall be placed behind the sidewalk in areas where sidewalk
abuts the stall and outside the two and a half (2'/2 ) foot overhang area where
wheel stops are not provided. " The 2'/2` overhang is to be measured from the
back of curb, edge of pavement or back of wheel stop as applicable per Sections
78 -315 & 78 -344 of the LDR.
5. The applicant shall provide a note on the engineering plan stating, "All
handicap accessible ramps shall meet all applicable local, regional and state
accessibility guidelines and regulations. Any modifications shall be approved
by the engineer -of- record. "
6. Prior to the issuance of the first land alteration permit, the applicant shall
provide a copy of the following approved permits, as applicable:

7. The applicant shall provide a cost estimate for the project, including public
infrastructure and all landscaping and irrigation costs for review and approval
by the City in order to establish surety. The cost estimate shall be signed and
sealed by an engineer and landscape architect registered in the state of Florida.
Surety will be based on 110% of the total combined approved cost estimates
and shall be posted with the City, prior to the issuance of the first land
alteration permit.

12. The applicant shall provide "complete horizontal control of the project
sufficient to construct the project and determine the dimensions of all site
improvements ", in accordance with Section 78 -448 of the LDR.
13. The applicant shall label the area of the water surface at control /design
elevation, the area of the bottom of the retention/detention basin and the
elevation of the bottom of the retention/detention basin on the plan.
14. The applicant shall add an " Outfall at Lake - Section" detail to indicate a
minimum 2 -foot separation between the control water elevation and top of
outfall pipe.
15. The applicant shall provide a detail showing filter fabric, wrapped around all
pipe joints, a minimum 2 feet wide on center and overlapped by 2 feet per
MOT Index 280. The applicant shall also reference MOT Index 199, which
specifies the required geotextile material for the pipe wrap.
16. While it is understood that the use of CMP is to conform to the existing system,
the applicant shall provide approved pipe materials (RCP) for all pavement
areas, where practical.
17. The applicant shall identify any proposed roof drains, on the engineering plan
and indicate approved materials under all pavement areas. The applicant is
advised that DI, SDR -26 PVC or C -900 PVC are considered acceptable.
18. The applicant shall show the minimum road, building floor and perimeter berm
elevations per flood routing calculations for the SFWMD permit, on the
Drainage Plans.
19. The applicant shall provide a copy of the existing approved SFWMD and
NPBCID permits for the site as they relate to the design of the existing system
and proposed lake modifications.
20. The applicant shall provide calculations for the existing and proposed lake
design (Sheet 3) to verify that the proposed design conforms to the project
requirements.
21. The applicant shall clarify the design, regarding the existing ADS riser that is
shown (Sheet 3) in the pavement area of the parking lot south of the tennis
courts, as to whether it will be replaced by an inlet.
22. The applicant shall provide a detail of the wheel stops, which shall conform to
FDOT Index 300 detail for "Concrete Bumper Guard" with the exception of the
height being 6" as specified in Section 78 -228 of the LDR.

4. "The construction, operation and /or maintenance of any elements of the subject
project shall not have any negative impacts on the existing drainage of
surrounding areas. If, at any time during the project development, it is
determined by the City that any of the surrounding areas are experiencing
negative drainage impacts caused by the project, it shall be the applicant's
responsibility to cure said impacts in a period of time and a manner acceptable
to the City prior to additional construction activities. " (City Engineer)
5. "Prior to issuance of the first land alteration permit, applicant shall submit
signed /sealed /dated construction plans (paving /grading /drainage and
water /sewer) and all pertinent calculations for review and comment. (City
Engineer)
6. "Prior to construction plan approval and the issuance of the first land
alteration permit, applicant shall schedule a pre permit meeting with City
staff. " (City Engineer)
7. "Prior to the issuance of the first land alteration permit the applicant shall
provide to the City letters of authorization from the applicable utility companies
allowing landscaping and light poles to be placed within the utility easements. "

The applicant shall provide a written response to all comments, indicating
acknowledgement of each comment and how each comment has been
addressed. Compliance will expedite the subsequent review.
The applicant is reminded that all submittals are to be made to the City of
Palm Beach Gardens Growth Management Department.
