ITEMS BY CTROWTH MANAGEMENT DIRECTOR Growth Management Director Roxanne Manning announced a workshop meeting with City Council would be held July 15. APPROVAL OF MINUTES Minutes of June 22, 1999 - Mr. Rauch made a motion to approve the minutes of the June 22, 1999 meeting with the following changes: On page 1 to change the date from Lune 29 to Lune 22, on page 3, Glean Pate; Plumbing Contractor, to Glenn Pate; Architect and on page 4, # 9 to change see attached memo of March 31st to see attached memo of lure I& Mr. Solomon seconded the motion, which carried 6 -0. Joel Channing, Chair John Nedvins, Vice Chair - arrived at 6:35 p.m. John Glidden; Chair Pro Tern Daniel Lee Cruz Craig Kunkle, Jr. Ted Rauch, Alternate Dennis Solomon Diane Carlin Joseph Love, Jr., Alternate Also present at the meeting were City Attorney Carole Post, Principal Planners Kim Glas- Castro, James Norquest, and Steve Cramer, City Forester Mark Hendrickson, Planner I Angela Csinsi, and City Council Liaison Carl Sabatello: 40 Public Hearing - continued-from 6122199 • Planning & Zoning Commission Minutes July 13, 1999 Petition PUD- 98 -09: Catalina Lakes Townhomes Cotleur & Hearing, agent for DiVosta & Company, is seeking Planned Unit Development (PUD) approval for 262 townhome units on a 44.54 -acre parcel of land located at the intersection of Alternate AIA and Burns Road, on the northern side of Burns Road and the eastern side of Alternate AIA. (07 -42E -435) Planner I Angela Csinsi presented the staff report dated 7/13/99. Staff conditions 11 and 12 were clarified by City Forester Mark Hendrickson, who explained that the only landscaping being proposed in the right -of -way was in the median, and that ISTEA funds would allow FDOT to add landscaping to the west side of Alternate Al A. Mr. Hendrickson commented in regard to the waiver request for curbing that although curbing was used to protect landscaping in rental unit lots which needed more protection than in fee simple lots, the waiver had been proposed to avoid a commercial look, because the new landscape code provided protection for all landscaping, and explained that wheel stops would be used in the guest parking areas. Donaldson Hearing, Agent for the petitioner, reported petitioner was in agreement with all 12 staff recommendations. Responding to questions from the Commissioners, Mr. Hearing explained that swales were adequate to handle runoff from the roofs; and that the last row of units would contain three different designs to provide diversity. Mr. Nedvins expressed his opinion that the petitioner had responded positively to comments and criticisms and that he was ready to move • forward with approval. Mr. Hearing commented that existing sidewalks would not be changed except for relocating the sidewalk at the RCA Boulevard entry. Mr. Glidden requested the sidewalk on Burns Road be shown on any replat. The number and location of parking spaces were described. Mr. Hearing explained that the HOA would maintain front yards only, not rear yards. During discussion of drainage, Mr. Smiley explained specifics were not yet known since the City Engineer was still working on this issue, but that drainage concerns would be resolved prior to this petition going to City Council. Mr. Hearing explained that the HOA would assume responsibility for maintaining any perimeter walls built on the Catalina Lakes property. Charles Hathaway commented that the HOA would maintain both sides of the wall. Mr. Kunkle recommended larger coconut palms on both sides of the entry, and that additional landscaping to provide color be added at the Al A and Burns Road intersection, to which Mr. Hearing responded the corner had been treated in a different manner than the landscaping along the roadway. Mr. Hearing agreed to work with the City Forester regarding providing more color at the intersection. Chair Channing commented he was very pleased with the plan. Hearing no comments from the public, Chair Charming declared the public hearing closed. Planner Norquest recommended a condition regarding drainage. Discussion of drainage ensued. Mr. Glidden made a motion to recommend to the City Council approval of Petition PUD -98 -09 with the following conditions and with the provision that some wording be added to Condition 11 to further clarify what landscaping does not need to be completed until after the first certificate of occupancy, and also that there be a further review by the City Staff to add some landscaping with color at the Burns Road and Alternate AlA intersection. • 2 Planning & Zoning Commission Minutes • July 13, 1999 1. Prior to scheduling this petition for City Council, the applicant shall provide a landscape plan for Alt. AIA and Burns Road. (City Forester) 2. Prior to the issuance of the first building permit, the applicant shall provide a revised site plan that demonstrates a 55' Alt. AIA buffer at the narrowest point of the right turn lane right -of -way. (Planning & Zoning) 3. The applicant shall work with staff and Southern Bell to move the Catalina Lakes buffer wall and landscaping out of the Santa Barbara Drive right -of way when Southern Bell amends their site and landscape plan. (Planning & Zoning) 4. Prior to the adoption of the Property Owner Association documents or the issuance of the first Certificate of Occupancy, whichever comes first, the applicant shall submit these documents, which shall be subject to review and approval by the City. (Legal) 5. Prior to the issuance of the first building permit, the applicant shall provide documentation demonstrating compliance with the SFWMD master surface water management permit 50- 01046S. (City Engineer) • 6. Prior to the issuance of the first building permit, the applicant shall provide a letter of authorization form the appropriate utilities allowing landscaping and paving within the utility easements. (City Engineer) 7. Within 8 months of construction plan approval, or within 30 days of the issuance of the Certificate of Occupancy of the model unit, whichever comes first, the temporary sales center and its associated paving and landscaping shall be removed. (Planning & Zoning) 8. The buildout date for the project shall be December of 2002. (Development Compliance Officer) 9. No two adjacent homes shall have the same color combinations. (Development Compliance Officer /Code Enforcement) 10. The construction of this project shall be in accordance with the following phasing schedule: (Building Division) A. First stage shall include clearing of the land, earthwork, water management/retention lakes and road and utilities infrastructure. B. Landscaping will be installed as the townhomes are constructed; all buffer walls • 3 • Planning & Zoning Commission Minutes July 13, 1999 shall be in place prior to housing construction. C, Housing construction shall start with the building of the entry feature and the townhomes in the northern section of the parcel. D. After this, the construction will proceed southward until total build -out. E. The recreation center shall be constructed after at least 50% of the development is completed. 11. The applicant shall install the Alternate A1A and Burns Road landscaping as approved by City Council within one year of the first Certificate of Occupancy. The applicant, his successors and /or assigns shall maintain the Alternate AI A and Burns Road landscaping per City maintenance standards, or shall pay to the City, or special roadway maintenance district if one is adopted, the total cost of maintenance. A reasonable fee shall be determined annually, to be paid in quarterly installments by the applicant and his successors and /or assigns commencing on the first of November following the installation. Specific provisions for payment, and revisions thereto, may be addressed by separate agreement between the City and applicant, his successors and /or assigns. (City Forester) 12. The Alt. AIA, Burns Road, and perimeter landscape buffers shall be installed concurrent with the construction of the adjacent interior roadways or townhouse, • whichever occurs first. (City Forester) 13. Prior to scheduling this petition for consideration by the City Council, the applicant shall meet all requirements set forth by the City Engineer with respect to drainage issues. Mr. Solomon seconded the motion. During discussion of the motion, the following addition was made by Mr. Glidden: 14. All exterior walls shall be maintained in a consistent manner and repainting shall be provided on both sides of the wall whenever repainting occurs. Mr. Solomon seconded the addition to the motion. Motion carried by unanimous 7 -0 vote. The applicant received clarification that by approval of the application, approval of all waivers was inherent. 0 4 Planning & Zoning Commission Minutes July 13, 1999 Public Hearing - continued from 6122199 - to be further continued to 7127199 Petition PCD- 99 -01: Amendment to Golf Digest PCD Hank Skokowski, agent for Taylor Woodrow Communities, is requesting an amendment to the Golf Digest Planned Community District approved October, 1998. The proposal includes modifications to the master plan, amendments to the parkway cross - sections, revisions to conditions of approval, and related changes to other plans and illustrations. The proposed changes do not affect the overall dwelling unit count or mix of uses. The 2,305 -acre site is located north of PGA Blvd, west of Florida's Turnpike, east of the Loxahatchee Slough and south of Hood Road (3, 4 &S- 42S -42E and 32, 33&34 -41S- -42E Chair Channing announced the Public Hearing would be continued; however, those present who had come to speak regarding this petition would be heard. Principal Planner Kim Glas Castro reported receipt of a letter from the petitioner advising that they concurred with the continuance and would not attend tonight's meeting. Paula Fandry expressed concern that PGA National residents would be affected by the widening of PGA Boulevard and that issues must be addressed in regard to safety, privacy, noise, and protection of property values, and expressed a desire for a wall behind her house on the PGA National side of the roadway. Paula Fandry's mother also expressed concern for safety issues, vagrant problems, drainage issues of flooding and mosquitos, and property values, and expressed a desire for a wall on the PGA National side of the roadway. Principal Planner Kim Glas Castro explained that a curb and gutter would be installed. The date of the next meeting was clarified. City Attorney Post clarified that this public hearing would remain open. Adele Sullivan reported some residents had met with Golf Digest representatives, who had agreed to give a 2 -mile strip of 10' of property to allow the lanes of PGA Boulevard to be built on the northern side, and expressed concern that 14' would come from the southern side behind their homes, which Golf Digest would not protect. Ms. Sullivan reported she had received no correspondence regarding this project from either the City or Golf Digest. Ms. Sullivan requested assistance from the Commission to assure that the PGA road widening would not adversely affect the PGA National residents. Ms. Sullivan reported that severe drainage problems presently existed and requested that the City be sure that the Golf Digest project would not add to those problems. Hearing no further comments from the public, Chair Channing declared the Public Hearing continued to July 27, 1999. Public Hearing - continued from 618199 - to be further continued to 7127199 Petition PCD- 99 -05: Regional Center DREPCD Amendment Relating to the Commercia!Qo ce/Business Square Footage Mr. Kenneth Blair, agent for Catalfumo Construction Company, is proposing a change to the DRI/PCD, which includes an increase in the amount of regional commercial square footage from 1,390,000 sf. to 1,440,000 sf. and reduces office- business square footage from 1,210,000 to 1,091,800 sf. and designates particular parcels on the master plan as being potential sites for regional commercial use The subject property is located north of PGA Boulevard between Alternate AIA and Prosperity Farms Road (5&6- 42S - -43E) Mr, Solomon made a motion to continue the Public Hearing for Petition PCD -99 -05 to July 27, 1999. Motion was seconded by Mr. Rauch and carried by unanimous 7 -0 vote.. Public Hearing - continued from 6122199 • Petition PCD- 99 -06: Regional Center DRUPCD Amendment Relating to the Level of Det ail for Required Open Space Mr. Kenneth Blair, agent for Catalfumo Construction Company, is proposing a change to the DRI/PCD master plan, which increases the level of detail for the required open space for the project by clarifying items such as open space, roadways, and buffers The subject property is located north of PGA Boulevard between Alternate AIA and Prosperity Farms Road (5&6 -42S -43E) Planner Kim Glas Castro reviewed the staff report dated July 13, 1999. Kenneth Blair, agent for the Petitioner, had no comments. Hearing no comments from the public, Chair Charming declared the Public Hearing closed. Mr. Solomon made a motion to recommend approval of Petition PCD -99 -06 to the City Council. Mr. Nedvins seconded the motion, which carried by unanimous 7 -0 vote. Workshop TXT 99 -09: Zoning Text Amendment Regarding Landscaping and Vegetation Protection A City - initiated zoning text amendment application to amend Chapter 98, Landscaping and 0 6 Planning & Zoning Commission Minutes July 13, 1999 Vegetation Protection, in the City's Land Development Regulations. Principal Planner Steve Cramer reviewed the staff report dated July 13, 1999. Mr. Kunkle congratulated staff on a good job. Mr. Solomon expressed concern regarding the application to existing single family homes and projects already underway. Mr. Cramer clarified that only the maintenance would be retroactive, not the proposed amendments. City Forester Hendrickson pointed out that maintenance language began on page 33 of the amendments, and reviewed enforcement addressed on page 15. Mr. Hendrickson explained that language would be further studied and clarified. The meaning of the wording "new lawns" was discussed. Mr. Glidden expressed the following concerns: On page 5, item 3e, to remove the word with and replace with to; on page 6, item 4b, to clarify elevation, on page 6, item 4.d.2, to add the word with following data table; and on page 7, item 6, to add be accurately scaled to between the words shall and show. Mr. Glidden clarified that drawings should be accurate and in perspective, and recommended the addition of the wording with respect to scale and material type at the end of item 6. Other recommendations by Mr. Glidden were: On page 7, item 9, to remove the word conceptually, although following discussion agreed it could stay; on page 24 under planting unless additional buffers are required by the Code, with which others disagreed; and on page 25 concerning foundation planting commented that flexibility was needed rather than the 5' requirement. • Following discussion, Mr. Glidden suggested allowing a certain percentage of the 5' to be covered by roof and a percentage around the total perimeter. Chair Channing commented he would like to see something which would make it clear that alternative designs would be considered to encourage innovative design, to which Planner Norquest responded with a suggestion for an alternative landscape betterment provision to allow the option to present other plans in cases where standard plans did not work well. Mr. Glidden questioned the wording on page 26 that palms are not trees, to which Mr. Hendrickson responded he had dealt with property associations who had tried to replace shade trees with palms. Mr. Glidden left at this point in the meeting at 8:20 p.m. Mr. Nedvins questioned whether Code Enforcement had been dealing with any cases regarding landscaping of individual homes, to which Mr. Hendrickson responded typical liens were on abandoned properties or vacant lots. Liens were discussed. City Attorney Post reported a civil action had been taken against Mr. Vavrus, and explained foreclosure issues and code enforcement procedures. Mr. Nedvins expressed the wish that DOT would better maintain medians. A comment was made that for code enforcement purposes the certification should be recorded as a part of the lien.
