LOCAL PLANNING AGENCY
FEBRUARY 19, 1998
The February 19, 1998, meeting of the Local Planning Agency was
called to order was called to order at 7:30 p.m. in the City Council
Chambers of the Municipal Complex located at 10500 North Military
Trail, Palm Beach Gardens, Florida; and opened with the Pledge of
Allegiance to the Flag.
ROLL CALL: The roll was called by the Deputy City Clerk and the following elected
officials were found to be in attendance: Mayor Joseph R. Russo,
Councilwoman Linda Monroe, Councilman Eric Jablin and
Councilman David Clark. Vice Mayor Lauren W. Furtado was absent
from the meeting.
EAR -BASED
AMENDMENTS: Kim Glas, Principal Planner, stated that this was a public hearing for
consideration of a recommendation to the City Council for transmittal
of the EAR -Based Amendments. Ms Glas stated that the amendments
were based on the Evaluation Appraisal Report as well as the City's
vision.
Ms. Glas presented the Council with the adopted portion of the
Comprehensive Plan which consisted of the goals, objectives and
policies as well as the future land use map and future transportation
map. Ms. Glas also presented the Council with a copy of
documentation which consisted of supporting data and analysis
required by 9J5.
Ms. Glas stated that the staff reported included summarized changes
as requested by the Council and changes recommended by staff. Ms.
Glas also presented the Council with an errata sheet. Ms. Glas stated
that the Comprehensive Plan was being updated from a 2010 plan to
a 2015 plan and that most of the changes were in the goals and
objectives policies. She stated that there were a few land use changes
which reflect the County's acquisition and eco -sites and the City's
acquisitions of park and public areas. Ms. Glas stated that the only
private type property being changed was the Nativity Lutheran Church
on Holly Drive, from Commercial to Residential Medium. Ms. Glas
stated that the Police Department had hired new computer specialists
and have a better idea of the number of service calls they have
historically handled as well as the ability to project future service
• calls. Therefore, staff will review their numbers and would possibly

back before Council adopts the amendments to recommend changes
to the Police Department's level of service.
Ms. Glas stated that after the amendments are transmitted to DCA,
they have 90 days to review them. She stated that the amendments
would not be brought back before the City Council for consideration
of adoption until June.
Mayor Russo declared the public hearing open, which was duly
advertised on February 12, 1998.
Ms. Glas stated that the City used the IPARC process and that the
Town of Jupiter was the only entity who reviewed the amendments.
Ms. Glas stated that the MacArthur Foundation had an interest in how
the amendment would affect their property. Ms. Glas stated that the
amendments were reviewed by the Comprehensive Plan Amendment
Review Committee which was a subcommittee of the Planning and
Zoning Commission.
. In response to a question by Councilwoman Monroe, Ms. Glas stated
that she had no problem with leaving the minimum number of acres to
250. Ms. Glas stated that others could request a wavier if there was
a legit parcel today under the 250 acres.
Rick Warner, MacArthur Foundation representative, stated that the
Foundation had worked with staff to discuss their concerns. He stated
that the City staff felt that the remaining issues by the Foundation
were Council policies and/or DCA policies. Mr. Warner presented the
Council with a letter from the Foundation outlining their areas of
concerns and asked that it be entered into the record.
Mayor Russo suggested that staff schedule a workshop with the
Foundation to discuss their concerns. City Manager Herakovich
stated that a workshop could be scheduled the 2nd or 4th Thursday in
March.
There being no further comments from the public, Mayor Russo
declared the public hearing closed.
Councilman Clark made a motion to recommend the EAR -Based
Amendments of the Comprehensive Plan to the City Council for
approval with the amendment on Pages 1 -20 and 1021, changing 90
acres to 250 acres in Policy 1.1.5.1.A.1. and Policy 1.1.5.1.A.2 and

also in both provisions changing the last sentence that refer to a
waiver from the minimum size threshold to read as follows: "a waiver
from the minimum size threshold maybe granted by the City Council
for existing parcels of lesser size as of February 19, 1998, and changes
on the ERATA Sheet. Councilman Jablin seconded the motion which
carried unanimously with a vote of 4 -0.
ADJOURNMENT: There being no further business to discuss, the meeting was adjourned
at 7:55 p.m.
