PLANNING AND ZONING COMMISSION
January 9, 1996
MINUTES
The Regular Meeting of the Planning and Zoning Commission of the City of Palm Beach Gardens,
Florida, was called to order by Chairman Carl Sabatello at 7:30 P.M. in the Assembly Room at the
Municipal Complex, 10500 North Military Trail, Palm Beach Gardens, Florida, and opened with
the Pledge of Allegiance to the Flag.

Golis, Planning and Zoning Director Richard Walton, and Principal Planner Bristol Ellington.

APPROVAL OF MINUTES:
Minutes of December 12, 1995 - Mr. Lyddon made a motion to approve the minutes as submitted.
The motion was seconded by Mr. Chris Jones. Vice Chair Carlino and Mr. Chris Jones abstained
from voting since they had been absent at the December 12, 1995 meeting. The motion was
approved by a 5 -0 vote.

PLANNING AND ZONING COMMISSION
Public Hearing: Petition PCD- 95 -02, by Dominick Lioce, agent for CTB Realty Ventures,
Inc., to amend Ordinance No. 1, 1990, for the Northcorp Center Planned Community
District (PCD). Located, in general, by RCA Boulevard to the north, Burns Road to the
south, Interstate 95 to the west, and the FEC Railway. (7- 42S -43E)
Principal Planner Ellington requested postponement of this Public Hearing to the first meeting in
February, 1996, since staff had not had sufficient time to review items submitted by the Petitioner.
Mr. Ellington commented that the Petitioner had objected to the postponement.
Chairman Sabatello declared the Public Hearing open. Jeff Lis questioned why the postponement
needed to be five weeks rather than two weeks. Planning and Zoning Director Walton explained
it would take five weeks to obtain the City Engineer's report. In response to Chairman Sabatello's
question whether the Petitioner and the City were close or far apart on the drainage issue, Mr. Lis
commented that the drainage was never going to be reduced from 28 % to 20 %, and that the original
general permit issued for Northcorp prior to construction of the original building had assumed that
the elevations for the parking lot would be at 13.5' and that there would be swale and dry retention
depressed areas in the elevation down to 12'5 ", which did not happen. Mr. Lis explained that the
existing parking lot elevation was at 141" and that there were no depressed areas; therefore, the
• latest report from Gee & Jenson was calling for compensative storage in the form of 30% open space
on any undeveloped land and a .8 -acre lake since the actual elevation was higher than the elevation
allowed by the permit. Mr. Lis commented that the City Engineer would review that report and
make comments. During ensuing discussion, Mr. Glidden inquired whether Petitioner would agree
to 30% open space, to which Mr. Lis responded he did not believe that Mr. Lioce would agree.
Other issues were identified. Chairman Sabatello commented that the major issues were beyond the
scope of the Planning and Zoning Commission and must be resolved. Mr. Glidden suggested a 2-
week postponement which could then be postponed again if necessary. Planning and Zoning
Director Walton explained that the City Engineer had indicated two weeks would not be sufficient
to complete his review and report.
Hearing no other comments from the public, Chairman Sabatello declared the Public Hearing closed.
Mr. Jones made a motion that this matter be postponed to February 13, 1996. Mr. Lyddon seconded
the motion, which carried by unanimous 7 -0 vote.
Public Hearing: Petition TXT- 95 -03, by Bonnie L. Miskel, agent for Value Rental Car, is
requesting to amend the City of Palm Beach Gardens' Zoning Code, Sections 159.046(K)
Zoning Districts: CG -1, 159.046(L) Zoning Districts: CG -2, 159.059(C) (1) (b) PGA
Boulevard Corridor Overlay: Site Development Guidelines, and the City's Chart of
Permitted Uses, to permit automobile leasing and storage facilities as an accessory use to an
approved hotel use.

Principal Planner Ellington stated that Bonnie L. Miskel from Ruden, McClosky, Smith, Schuster
& Russell, P.A., was not present, however, Valerie Chancey from the same firm was in attendance
at the meeting and would represent the Petitioner. Principal Planner Ellington reviewed the staff
report dated January 4, 1996, and explained that Value Rental Car wished to operate at the Holiday
Inn on PGA Boulevard and that apparently a rental car business had been operating under previous
ownership at the Holiday Inn for the past several years, for which no occupational license could be
found. Mr. Ellington explained that staff recommendation was for conditional use, which would
require a Public Hearing and approval by the Planning and Zoning Commission.
Mr. Lyddon inquired whether operation of a rental office without storage on premises would be
allowed, to which Mr. Ellington responded he was unsure whether a license would be needed for
only a rental office. Mr. Glidden inquired how many hotels would be affected by the requested
change, to which the response was Holiday Inn, the hotel at the Admiralty II, and the hotel which
had been approved for the Regional Center. Mr. Ellington explained the City parking requirements
which would have to be met. Discussion ensued regarding distinction between cars and trucks.
Planning and Zoning Director Walton recommended use of the definition used by the State of
Florida. Mr. Walton explained that the location where cars could be parked could be worked out
during conditional use approval for a specific case, however, recommended that it be included in the
ordinance. Chairman Sabatello raised signage questions regarding signs placed in car windows and
whether a vehicle with advertising operated as an airport shuttle could be allowed to park at the
• hotel.
Valerie Chancey explained that Thrifty had previously operated a rental car business at the Holiday
Inn and that they had been granted a sign permit by the City. Ms. Chancey stated that Petitioner
had no objections to staff recommendations. In response to questions posed by Chairman Sabatello,
Ms. Chancey commented that 15 rental vehicles were now parked in the rear of the hotel; that she
would need to discuss with Value Rental Car whether they wished to store vans also, and whether
it would be agreeable to restrict parking for a shuttle van with advertising to the storage area. Ms.
Chancey explained that she believed a permit had been granted for the existing monument sign with
the name Thrifty on the top, but had not verified that with Building Official Jack Hanson.
Chairman Sabatello declared the Public Hearing Open. Hearing no comments from the public,
Chairman Sabatello declared the Public Hearing closed.
During discussion of staff recommendation regarding location of storage parking, Planning and
Zoning Director Walton suggested use of language which had been used for previous covered
parking approval. Mr. Lyddon favored the conditional use so that each individual hotel would have
to submit the exact location desired for parking. Mr. Walton agreed, so long as the City could
legally regulate the location. Assistant City Attorney expressed concern that this change would
permit rental of automotive vehicles in both the CG -1 and CG -2 Zoning Districts, rather than only
in CG -2.
Mr. Glidden made a motion to recommend approval of this Petition subject to the following
conditions:

1. Automobile leasing and storage of inventory shall be allowed as a conditional accessory use
to an approved hotel of not less than one hundred (100) rooms.
2. The maximum number of leasable cars allowed to be stored on site shall not exceed fifteen
(15).
3. An applicant shall demonstrate compliance with the City's parking requirements when
seeking a conditional use approval for the leasing and storage of automobiles.
4. No shuttle van parking storage parking shall be allowed between the building and the public
right -of -way.
5. Advertising, graphics, and /or signage shall not be permitted to be displayed on rental agency
vehicles parked for greater than one hour between the public right -of -way and the hotel
building.
Motion was seconded by Mr. Mignogna, and carried by unanimous vote of 7 -0.
OLD BUSINESS
• There was no old business to come before the Commission.
NEW BUSINESS
Planning and Zoning Director Walton requested direction regarding timing of meetings and
advertising for an upcoming conditional use petition by a church on Riverside Drive which had
requested an expedited process. Consensus of the Commission was to advertise before holding the
workshop.
Chairman Sabatello brought up the fence issue at Cypress Hollow and BallenIsles, and questioned
whether the Commission had proceeded properly in this instance and was following proper procedure
in general. Discussion ensued regarding the fence issue in this specific case. Assistant City
Attorney Golis advised that the Commission was using proper procedure.

ADJOURNMENT
There being no further business, upon motion by Vice Chair Carlino, seconded by Mr. Mignogna,
and unanimously carried, the meeting was adjourned at 8:15 P.M. The next meeting will be held
January 23, 1996.

It is with regret that I hereby tender my resignation from the Planning and Zoning

Commission. My personal commitments have recently caused my absence at meetings to
become too frequent. I would be happy to serve the city in any special projects that
could utilize my skills. I have enjoyed the three years that I have been on the Commission.
It has been suggested that a permanent member of the P &Z Commission be appointed
from Frenchman's Creek. To that purpose I heartily recommend Richard Masters who
is very enthusiastic about serving the City in this cappacity. Enclosed is his resume.
