HomeMy WebLinkAboutMinutes Council 120795ROLL CALL • ANNOUNCEMENTS PRESENTATIONS LEGISLATIVE UPDATE CITY COUNCIL REGULAR MEETING CITY OF PALM BEACH GARDENS DECEMBER 7, 1995 The Regular Meeting of the City Council of the City of Palm Beach Gardens, Florida, was called to order by Mayor Russo at 7:30 P.M. in the Assembly Room of the Municipal Complex, 10500 North Military Trail, Palm Beach Gardens, Florida, and opened with the Pledge of Allegiance to the Flag. The City Clerk called the roll and present were Mayor Russo, Vice Mayor Furtado, Councilwoman Monroe, Councilman Jablin, and Councilman Clark. Mayor Russo stated that the announcements were as posted on the City's bulletin boards. Representative Sharon Merchant provided updates on the following items: (1) Effective January 1, 1996 telecommunications legislation would become law to deregulate local exchange (BellSouth), so that a choice would be available to consumers. (2) In the current session, economic development would be discussed. Problems raised by consumers were taxing, regulating, and education. (3) Interstate banking and limits on insured CITY COUNCIL REGULAR MEETING, 12/7/95 PAGE 2 • deposits for any one banking institution. (4) Consideration of a voucher education systems. Representative Merchant expressed her opinion that no new state taxes would be passed in the current session, and explained that an RFP was out for a high speed rail system using new technologies. Representative Merchant explained that a Bill had been filed which if approved would generate a referendum since it would require a constitutional amendment to provide for smaller school district. Representative Merchant reported that the subject of changing the speed limit had not been discussed, and that she • welcomed any input on that subject. ITEMS BY MAYOR AND CITY COUNCIL VICE MAYOR FURTADO Vice Mayor Furtado provided staff with information she had obtained from the MPO which included the Paratransit Plan for Year 4, Long -range Transportation Plan Update with Cost Feasible Plan, and 2015 Plan Update. COUNCILWOMAN MONROE Councilwoman Monroe reported that she had attended a seminar in Deerfield and on that trip had observed use of the HOV lane traffic. Going to Deerfield, approximately 6 out of 8 vehicles which used the high occupancy vehicle lane had only one rider, while on the return trip 13 out of 17 vehicles which used the • CITY COUNCIL REGULAR MEETING, 12/7/95 PAGE 3 • HOV lane had only one rider. The seminar dealt with new legislation regarding probable reimbursement in cases where municipalities decreased someone's ability to develop their property based on land development regulations and comprehensive plans adopted after May, 1996. MAYOR RUSSO Mayor Russo had attended a meeting of the Recreation Advisory Board, who had strongly recommended that the City purchase the church across the street, possibly for use as a senior citizens' center. YAA representatives had been present at that meeting, and there was discussion regarding keeping communication • open. Mayor Russo suggested that Vice Mayor Furtado become liaison to both the Recreation Advisory Board and the PBG YAA. Mayor Russo requested an update at the next City Council meeting regarding the upcoming referendum, along with a schedule of the dates and locations for informational meetings. The City Manager reported staff had prepared a response to the Planning Forum comments which was scheduled for discussion at the December 21 City Council Meeting. It was note that the workshop for flood issues was scheduled for December 20, with different neighborhoods scheduled for different times. City Manager Herakovich also reported that SFWMD had been CITY COUNCIL REGULAR MEETING, 12/7/95 PAGE 4 • very responsive to the City's request that they change 0 • their policy regarding fixed weirs. In response to Mayor Russo, the City Manager reported that the plans for preserve restoration and mitigation had been submitted by The Sanctuary before their deadline, and would be evaluated by the City Engineer on Monday. A meeting with The Sanctuary representatives would be held on Tuesday. Thirteen Certificates of Occupancy had been issued since last Thursday, and the surety bond was in place. Mr. Perry from Pulte Homes questioned why the stop work order had not been released, which he felt had been the direction of the City Council at their last meeting. The majority of Council members who had been present at the last meeting agreed with Mr. Perry. CONSENT AGENDA Councilwoman Monroe made a motion to approve the Consent Agenda with an amendment to Resolution 145, 1995, which referenced when the Resolution would be effective. Councilman Clark seconded the motion, which carried by unanimous vote of 5 -0. The following items were approved on the Consent Agenda: 1. Approval of City Council Regular Meeting Minutes of 11/16/95. 2. Resolution 145, 195 - Directing the Mayor and City Clerk to execute an Agreement between The CITY COUNCIL REGULAR MEETING, 12/7/95 • U RESOLUTIONS• RESOLUTION 130, 1995 REORDER OF AGENDA PAGE 5 Island of PGA National and the City re: Traffic Control. Alfred Malefatto, agent for Petitioner, explained that the new owner of the former Radisson Hotel building, now Embassy Suites, wished to signal the change in ownership by repainting the building exterior in a pale pink with a darker pink accent trim. After discussion, Resolution 130, 1995 - Consideration of Approval of an Amendment to Admiralty II PUD re: paint color change, was withdrawn by the Petitioner. Councilwoman Monroe made a motion to reorder the Agenda to place Resolutions 132, 1995; 133, 1995; and 134, 1995 after Ordinances. Vice Mayor Furtado seconded the motion, which carried by unanimous vote of 5 -0. RESOLUTION 140, 1995 City Attorney Baird reported that in regard to Resolution 140, 1995 - Consideration of Approval of an interlocal Agreement between the City and Palm Beach County School Board re: cellular tower, that the School Board had indicated they would not sign the agreement. During ensuing discussion, City Attorney Baird explained that the agreement attempted to provide a review procedure for amendments to site plans and the basis for the School Board's objection • was that currently State law was silent as to whether CITY COUNCIL REGULAR MEETING, 12/7/95 0 0 PAGE 6 local governments had any regulatory authority over amendments to approved site plans for schools. After further discussion, this matter was tabled until the next City Council meeting in order to try to get a School Board representative to attend. RESOLUTION 144, 1995 Planning and Zoning Director Walton reported that Resolution 144, 1995 - Consideration of approval of Frenchman's Creek Tract G -1 would modify the parcel to change four townhouse lots to three custom zero -lot line home lots which had no `T' or `Y' turnaround. Attorney Stephen Mathison, agent for the Petitioner, reviewed the request. Councilwoman Monroe made a motion to approve Resolution 144, 1995 as presented. Councilman Jablin seconded the motion. Motion carried by unanimous vote of 5 -0. PUBLIC HEARINGS• RESOLUTION 125, 1995 Mayor Russo declared the Public Hearing open, which was duly advertised 11/10/95, and advertised for Second Public Hearing on 12/2/95. This Public Hearing was held on the intent of Resolution 125, 1995 - Consideration of Approval of a Conditional Use to allow agricultural uses in the PDA Planned Development Area District. After discussion by the City Council and staff, including requested changes to the Resolution, Dean Turney, agent for Petitioner John D. And Catherine T. MacArthur Foundation, explained that CITY COUNCIL REGULAR MEETING, 12/7/95 PAGE 7 • their request for a ten -year conditional use had been made because of existing leases which would run for that period. There being no comments from the public, Mayor Russo declared the Public Hearing closed. Due to the large number of changes requested by both City Council and Petitioner, it was agreed that this Resolution would be amended and included on the Consent Agenda at the next City Council meeting. ORDINANCE 11, 1995 Mayor Russo declared the Public Hearing open for Second Reading and Adoption, which was duly advertised 10/18/95, readvertised 10/23/95 and postponed at the 11/2/95 Regular Meeting, and held on the intent of • Ordinance 11, 1995 - Approval of a Site Plan for The Ale House, f /k /a the Bridge Center. City Attorney Baird explained that since this was a quasi judicial proceeding, any exparte communications which had been received must be disclosed and suggested that if one member of the public spoke in representation of several others that the 3- minute time limit might be extended as appropriate. Attorney Baird stated and that the City Council would need to determine whether any evidence presented was relevant to their decision. Mayor Russo reported that a videotape had been received by City Council members. Vice Mayor Furtado disclosed exparte communication with the attorney of CITY COUNCIL REGULAR MEETING, 12/7/95 PAGE 8 • record regarding closing hours and operations of other Ale Houses, which she stated would not affect her decision in this matter. Councilwoman Monroe disclosed viewing of the video received and discussion with Mr. Smith regarding said video, which she stated would not affect her decision in this matter. Councilman Jablin disclosed viewing of the video and stated that there was no accompanying identification as to where it came from and felt the petitioner should have the opportunity to view the video. Councilman Jablin indicated that the viewing of the video would not affect his decision in this matter. • Councilman Clark disclosed viewing of the video and conversations with Mr. Smith which had not affected his decision, and agreed that Petitioner should have the opportunity to view the video if desired. Councilwoman Monroe stated that whoever had provided the tape should go on record as to the date it was made and under what circumstances, which would help the City Council decide whether they should consider it, and that all parties should be able to view it as a matter of public record. Mayor Russo disclosed viewing the tape and conversations with Mr. Smith regarding scheduling of meetings, which had not affected his decision. Larry Smith, agent for the Ll CITY COUNCIL REGULAR MEETING, 12/7/95 PAGE 9 • Petitioner, objected to the manner of distribution and to showing of the tape. City Attorney Baird advised that the tape would be a part of the record and • • whoever made the tape should seek to show it as a part of this proceeding. Mr. Smith objected to the tape being made a part of the file for this proceeding. Staff review of the petition was presented. Mr. Smith offered the following exhibits into evidence: certified copies of warranty deeds for various properties in the area, certified copies of right -of- way deeds relating to this property, certified copies of the prior resolution relating to this property, and a copy of the City Manager's memo to City Council dated 12/4/95. Mr. Smith requested that previous testimony by experts on behalf of the Petitioner be made a part of the record of this proceeding, and requested that the entire Planning and Zoning file be incorporated into the record of this proceeding. Mr. Smith clarified that approval for restaurant was not requested under this petition, since the use had been established for this property in 1986, but only review and approval of a site plan for a restaurant within a PUD. After a short review of the petition, Mr. Smith read into the record a letter from Bernice Downs, who along with her son and husband are owners of the CITY COUNCIL REGULAR MEETING, 12/7/95 PAGE 10 • partnership which ownes the subject property. Mrs. Downs reported they had cooperated with everything the City had requested, and asked for approval of the petition by the City Council. Mr. Smith also read into the record a letter written to the City Manager from Frank Callendar, owner and operator of The River House restaurant and owner of property on Smith Drive, which stated he had no objections to the petition as proposed. RON VOLARDI Mr. Volardi stated he patronized the Jensen Beach Ale House frequently. Mr. Volardi stated he regarded the Ale House as a family restaurant and never noticed it to be a noisy establishment. MORTON LEVIN Mr. Levin, of 115 Lakeshore Drive, North Palm Beach, representing the North Palm Beach Community Action Association, requested that the City Council consider the size of the project in connection with the amount of traffic it would generate. Mr. Levin reported that a meeting had been held specifically to address traffic at the PGA Boulevard and U.S. Highway One intersection, by County Commissioner Karen Marcus and attended by DOT and the City Engineer. DOT stated they did not consider the bridge as a factor in their traffic evaluations for concurrency requirements, but did consider safety, and were bound solely by a E CITY COUNCIL REGULAR MEETING, 12/7/95 PAGE 11 • mathematical formula based on current development. HENRIETTA HAARDE Ms. Haarde, resident on Waterway Drive, urged the City Council to carefully consider homeowners as if they themselves lived in those homes. DARRYL EVANS Mr. Evans, reported he had sold his home but was present to support his old neighbors, and expressed regret that the City could not have the use of the property for a nature preserve. DON COLVIN Mr. Colvin, 2035 S. Waterway Drive, commented that 74% of proposed seating was for TV viewing of sports events and that the Ale House was a sports bar. Mr. Colvin expressed traffic safety concerns with the • addition of a left -hand turn lane on Ellison Wilson Road which he believed would have inadequate stacking. Mr. Colvin questioned whether the parking ratio was the same used for the Waterway Cafe, 1 space for every 3 seats, and stated that did not work and there were fatalities because of overflow. Mr. Colvin stated that this project included a parking lot across a S- lane highway and requested that parking be contained on the west side of Ellison Wilson road. NORMAN CHABRE Mr. Chabre expressed concern that the project was too large for the property and with hazards created by a parking lot across the street. RICHARD ARNOLD Richard Arnold, 2080 S. Waterway Drive, adjacent to • CITY COUNCIL REGULAR MEETING, 12/7/95 PAGE 12 the Ale House property, questioned the compatibility of the restaurant with the neighborhood, and stated the restaurant was only 2 car lengths from his house. Mr. Arnold expressed concern with increased boat traffic to the restaurant, the large size of the building for the area, hours of operation, and requested fixed windows on the side facing homes. GERALD ROSSOW Attorney Rossow, representing nearby homeowners, objected to the size of the building and his opinion that the petitioner had not operated according to the spirit of the law, only the letter of the law, and stated that the residents deserved consideration to • continue to enjoy their property. LARRY SMITH Mr. Smith questioned exactly who Mr. Rossow represented, which Mr. Rossow declined to answer. JOE POLLOCK Mr. Pollock of Kimley -Horn Associates, stated their firm had prepared traffic studies for the project and had developed a roadway improvement project which would provide a northbound left turn lane into the restaurant, which was a part of an overall improvement program for Ellison Wilson Road. Traffic details were discussed. LARRY SMITH Mr. Smith commented that the windows on the north side were fixed glass, that closing hours were proposed for 2 A.M., and that the size would accommodate larger CITY COUNCIL REGULAR MEETING, 12/7/95 PAGE 13 interior spaces for handicapped persons to move around. Further discussion included comments regarding traffic and building size. Councilwoman Monroe explained that she could not vote for this petition due to the building's close proximity to residential units at its proposed size and height. Mayor Russo expressed his position that he agreed with Councilwoman Monroe and believed the size of this building would interfere with the health, safety, and welfare of the residential neighbors. Councilman Clark disagreed, cited the petitioner's efforts to work with the residents and to meet • concerns expressed by the City Council, and stated he was prepared to approve the petition. Vice Mayor Furtado expressed support; however, suggested that something be devised to assist patrons back and forth across the road. Councilman Jablin expressed support and commented that he believed the petitioner had worked with the neighbors and had done the best he could possibly have done. After further comments, Mayor Russo declared the Public Hearing closed. Discussion ensued regarding the type of entertainment which would be allowed. Motion was made by Councilman Clark to place Ordinance 11, 1995 on Second Reading and to grant approval with the amendment of Section 2 • CITY COUNCIL REGULAR MEETING, 12/7/95 PAGE 14 • to change the colon at the end of the first sentence to a period and to add the following sentence: However, the following plans shall not be construed as authorizing approval of any signs contained therein. Condition 23 shall be changed from 12 P.M. to 12 midnight. Motion was seconded by Councilman Jablin. Discussion ensued regarding noise enforcement. Mayor Russo thanked the Petitioner for their cooperation and urged them to work further with the residents. Motion passed 3 -2. Councilwoman Monroe and Mayor Russo voted Nay for reasons previously stated. The City Clerk read, on second reading by title only, Ordinance 11, 0 1995. ORDINANCE 15, 1995 Marty Minor reviewed the staff report dated December 1, 1995 and stated that a letter had been received that day via fax from Dan Weisburg indicating Palm Beach County's objection to proposed comprehensive Land Use Plan Amendments. As Mayor Russo had left the room, Vice Mayor Furtado declared the Public Hearing open, duly advertised 11/22/95 and held on the intent of Ordinance 15, 1995 - 95 -2 Comprehensive Plan Amendments for consideration of Second Reading and Adoption. RAYMOND ROYCE Mr. Royce, agent for Sports and Recreation, Inc., discussed the merits of commercial land use property CITY COUNCIL REGULAR MEETING, 12/7/95 PAGE 15 along Northlake Boulevard as opposed to industrial • land use, and made a point that traffic generation was not necessarily related to industrial use. Attorney Royce urged the City Council to act upon this amendment on a planning basis, and stated that there was plenty of time to address all of the other issues. Attorney Royce stated that without concurrency, nothing could be built. There being no comments from the public, Mayor Russo declared the Public Hearing closed. Councilwoman Monroe made comments which included the information that the requested traffic study had recently been completed; commented on industrial designations on PGA Boulevard; agreed that concurrency was not the issue but had the potential to make traffic worse; expressed embarrassment that the City Council had requested the County to delay action on Congress Avenue until traffic impacts could be reduced; expressed concern that the market price of the land might be driving it to commercial use; disclosed that she had received a letter from Mr. Royce which had not affected her decision; and stated that she would not vote for this amendment. Vice Mayor Furtado disclosed that she had also received a letter from Mr. Royce which would not affect her decision; expressed agreement with Councilwoman Monroe; expressed concern that Congress Avenue would end at Northlake Boulevard; and stated that she would also vote against this amendment. Mayor Russo, CITY COUNCIL REGULAR MEETING, 12/7/95 PAGE 16 Councilman Jablin and Councilman Clark also indicated that they had received a letter from Mr. Royce and that it would not affect their decision in this matter. Councilman Clark made a motion that Ordinance 15, 1995 be placed on Second Reading by Title Only and Approved. Motion was seconded by Councilman Jablin and carried 3 -2. Councilwoman Monroe and Vice Mayor Furtado voted Nay for reasons previously stated. The City Clerk read Ordinance 15, 1995 on Second Reading by title only. ORDINANCES• ORDINANCE 30, 1995 Councilwoman Monroe made a motion to place Ordinance 30, 1995 on First Reading by title only. Motion was seconded by Councilman Clark and passed by unanimous vote of 5 -0. The City Clerk read on first reading, by title only Ordinance 30, 1995, rezoning 7.76 acre parcel from Palm Beach County zoning desination of RS, Residential Single - Family, to the City of Palm Beach Gardens zoning designation of PUD. 1996 COMP PLAN AMENDMENT Planning and Zoning Director Walton suggested that the amendments be made for the next round of comp plan amendments would include those recommendations made during visioning sessions. RESOLUTION 132, 1995 After discussion, the City Manager was requested to reschedule Resolution 132, 1995 - Consideration of approval of appointments of members to the Education Advisory Board for a later meeting after consultation with Councilman Jablin to determine whether a CITY COUNCIL REGULAR MEETING, 12/7/95 PAGE 17 sufficient number of names had been submitted. RESOLUTION 133, 1995 After discussion, it was decided to reschedule Resolution 133, 1995 - Consideration of approval of appointments of members to the Code Enforcement Board for a later meeting. RESOLUTION 134, 1995 After discussion, Councilman Clark made a motion to approve Resolution 134, 1995 - Consideration of approval of appointments of members to the Art Advisory Board with the names inserted in Section One as follows: Caren Hackman, Jeffrey Blakely, and David Porter reappointed; and that first alternate Jeni Hamilton be appointed as a regular member, with another alternate to be appointed at a later date. Motion was seconded by Councilwoman Monroe, and • carried by unanimous vote of 5 -0. ITEMS FOR COUNCIL ACTION: POLICE DEPARTMENT COPIER PURCHASE Councilwoman Monroe made a motion to approve staff's recommendation to purchase a Toshiba 8510 Copier for the Police Department from Copyco Business Machines for $7,525 (55% lower than retail achieved by piggybacking a bid by another governmental organization). Motion was seconded by Vice Mayor Furtado, and carried by unanimous vote of 5 -0. ITEMS FOR DISCUSSION: 1996 PALM BEACH COUNTY SHERIFF'S RACE During extensive discussion, all of the City Council members expressed their support for Chief FitzGerald in his bid for Sheriff of Palm Beach County but the majority were not comfortable with allowing an unpaid CITY COUNCIL REGULAR MEETING, 12/7/95 PAGE 18 leave of absence in order to campaign. .RALPH MABIE Mr. Mabie, 8335 Kelso Drive, expressed support for Chief FitzGerald's request for a leave of absence. CITY ATTORNEY City Attorney Baird reported the status of current cases. It was the consensus of the City Council that the City Attorney should proceed with settlement negotiations in both Frenchman's Creek cases. CHIEF FITZGERALD Chief FitzGerald stated he would give further consideration to his decision whether to run for Sheriff of Palm Beach County during the holidays. ADJOURNMENT There being no further business to discuss, motion was made by Councilwoman Monroe, seconded by Councilman Clark, and unanimously approved to adjourn the meeting at 11:30 P.M.
