HomeMy WebLinkAboutMinutes P&Z 011095CITY OF PALM BEACH GARDENS PLANNING AND ZONING COMMISSION JANUARY 10, 1995 MINUTES The Regular Meeting of the Planning and Zoning Commission of the City of Palm Beach Gardens, Florida, was called to order by Chairman Elect Carl Sabatello at 7:30 P.M. in the Assembly Room at the Municipal Complex, 10500 North Military Trail, Palm Beach Gardens, Florida, and opened with the Pledge of Allegiance to the Flag. ITEMS BY PLANNING AND ZONING DIRECTOR On behalf of Director Richard Walton, who was not present at the meeting, Mr. Bristol Ellington, Principal Planner, announced that Lawrence Smith, agent for the American Financial -downs Partnership, had requested a postponement due to a violation of public notification on the part of the agent which requires signage on the site for an amendment or planned unit development application. APPROVAL OF MINUTES Mr. William Mignogna made a motion to approve the minutes of the November 22, 1994, Planning and Zoning Commission meeting. The motion was seconded by Mr. Thomas Paganini. The motion was approved by a 4 -0 vote. SITE PLAN & APPEARANCE REVIEW COMMITTEE • Wor ho : Petition SP- 94 -21, by Henry Skokowski, agent for MacArthur Holding A, Inc., is Planning & Zoning Commission Minutes January 10, 1995 requesting site plan approval to construct 48 lot semi - custom single - family zero lot line residential homes on 12 acres on Parcel 29 in the BallenIsles Country Club Planned Community District (PCD). (14- 42S -42E) Mr. Bristol Ellington reviewed the staff report dated January 5, 1995. Henry Skokowski commented on a few of the staff concerns and stated that it would be difficult to preserve pines and palms on the property due to the zero -lot line homes and necessary fill of 2 to 3 feet. Discussion ensued regarding possible transplanting. Mr. Skokowski proposed that 15 slash pines and 10 sabal palms which must be relocated be transplanted in a nearby neighborhood park, and commented that if any did not survive that City guidelines would be followed for replacement. Mr. Ellington explained that City Forester Hendrickson had requested a landscape plan identifying trees proposed for relocation and relocation sites. Mr. Skokowski expressed difficulty in preparing such a plan up front. Chairman Sabatello suggested that prior to excavation, trees be tagged and approved by the City, and that a plan of the park showing approximate relocation sites be submitted within 90 days of approval. Mr. Chris Jones questioned whether any trees were planned for preservation other than the trees proposed for relocation to which Mr. Skokowski responded that BallenIsles' general design philosophy was to use as much landscape and softscape as possible in lieu of hardscape, i.e., continuous walls, and that in order to preserve trees a wall would be necessary. Chairman Sabatello expressed concern that the specific number of trees on the master plan did not • allow for flexibility to which Mr. Jones suggested when trees were selected to be tagged that the best 15 slash pines be selected and possibly 5 extra ones tagged with a different color in case some of the fifteen best could not be moved. Mr. Pastore questioned whether the low elevation of the park site would be a problem to which Mr. Salour responded that the park site would be graded up front to avoid the necessity of using fill later. Mr. Skokowski indicated that the roadway timetable was to go out for bid in 30 -60 days with construction to commence in April and completion of both the roadway and the lakes anticipated in January 1996. Additional timing was indicated to be construction of golf course holes 5, 6, and 7 from June through September, 1995; and collective roadway landscaping from January, 1996 through April, 1996. Mr. Skokowski commented that a mathmatized plan would be submitted prior to the next meeting; agreed to increase the edge of pavement radius to maximum in the cul -de -sac;. requested a waiver so that the sidewalk would be on only one side of the cul -de -sac since the other side would not service any homes; and explained that the Fire Department had agreed to a proposed stabilized construction roadway prior to issuance of the first C.O. Gary Stoth, Architect for the project, reviewed the architecture and assured the Committee that the roof tile samples and paver samples presented at the meeting were described on the plan. Mr. Skokowski explained that the drawings reflected three of six actual models, and one model included a golf cart garage option which if exercised would create an approximate 5 -foot jog in the lot line, and if not exercised that space would become landscaped area creating a wider separation between units. Discussion ensued concerning routes golf carts would use from their garage to the golf course, and Mr. Skokowski explained that the 8 -foot wide drives along BallenIsles Drive would be used by the golf carts. Architect Stoth explained that all units included space for golf cart storage, le 2 • Planning & Zoning Commission Minutes January 10, 1995 with some models providing the storage space within the garage and some using the exterior golf cart garage with separate doors. Rooftop, wall and trim color restrictions were discussed and Chairman Sabatello stated he was comfortable with the proposed approval process of review by an Architectural Committee which already existed in other developments within BallenIsles. Chairman Sabatello requested that graphics presented to the City Council be labeled to indicate that landscaping depicted was for graphics only so that the Council would not confuse the drawings with actual landscaping. Landscape Architect John Lang with Lang Design Group reviewed the typical landscape planting plan for the units. Mr. Lang explained that the casual tropical landscape would contain a lot of color, and that variations along the streetscape were created by assigning a specific landscaping plan to each model. Mr. Salour explained that the New Construction Review Committee could approve different types of palms, etc. to vary the streetscape in case several of the same model were constructed in a row, but could not change the quantities or specifications. Discussion of how to allow for this variation on approved plans was discussed, and applicant was directed to meet with City Forester Hendrickson to determine the appropriate language. Mr. Ellington pointed out that nothing restricted like models located next to each other. Discussion • ensued regarding requiring different color combinations of homes when the same models were side - by -side. Pool landscaping was discussed. Architect Lang explained that a typical landscaping plan existed for homes without pools. Chairman Sabatello requested that all efforts be made to address conditions so that homeowners would not complain that the Site Plan and Appearance Review Committee had not addressed an item. Architect Lang responded to Mr. Mignogna that landscaping within the courtyard areas would be maintained by the homeowners. Perimeter landscaping was reviewed by Landscape Architect Brent Williams. During the ensuing discussion, Chairman Sabatello suggested that the two lots with the zero lot line fronting along the roadway be softened, and was assured by Mr. Williams that the problem had been addressed and the buildings would be basically obscured by a heavy landscaping buffer. Irrigation for the cul -de -sac landscaping which would be provided from a lake was also discussed. Mr. Ellington suggested a condition that the main east -west roadway into the entrance of the development shall be constructed and open to the public before issuance of the first C.O., and explained that this was a normal condition, and that the temporary C.O. for dry models could be agreed to in addition. Mr. Ellington stated that because of the gopher tortoises on the property City Forester Hendrickson had noted that a permit would need to be obtained from the Florida Game and Fresh Water Fish Commission. Chairman Sabatello requested the applicant provide a typical screening detail which would show a 3 Planning & Zoning Commission Minutes January 10, 1995 hedge, height, etc. for the centrifugal irrigation pump. Mr. Mignogna requested additional architectural details be added to the rear of homes on lots 1 and 48. The issue of the sidewalk waiver was discussed. Mr. Ellington explained that the Land Development Regulations contained language requiring a sidewalk around a cul -de -sac. The Committee decided to support the sidewalk waiver since this was a unique situation without homes on one side. After further discussion the Committee Members expressed the following comments and concerns: 1. The language within the landscape plan should account for acceptable alternative types of vegetation that the homeowner would be allowed to choose from when deviating from the standard landscape plan. 2. Petitioner must obtain a sign -off from the Fire Department on the stabilized road construction prior to issuance of the first C.O. 3. Pine Trees and Palms to be relocated should be tagged prior to excavation. 4. A landscape plan shall be submitted within 90 days of approval of the parcel, and shall • reflect the location of the relocated palms and trees. 5. A site plan should illustrate a typical screening of irrigation pump and service panel. • 6. The rear elevation of the two lots adjacent to lot 1 and lot 48 may require that the architectural treatment to be enhanced. 7. The Committee agreed to support the waiver for the required extension of the sidewalk around the cul -de -sac. PLANNING AND ZONING COMMISSION Workshop: Petition PUD- 94 -17, by Lawrence Smith, agent for the American Financial -Downs Partnership, is requesting Planned Unit Development approval for the construction of a restaurant building on a 2.947 -acre site. Located generally at the northwest comer of PGA Boulevard and Ellison Wilson Road. {The Bridge Center PUD} (5- 42S -43E) This petition is to be rescheduled for a later meeting. 4 Planning & Zoning Commission Minutes January 10, 1995 OLD BUSINESS Chairman Sabatello requested that the proposed newspaper rack ordinance process be kept on a schedule to ensure timely presentation to the City Council. Mr. Ellington explained that the ordinance draft had been reviewed by Planning Technician Alice Everard and by Assistant City Attorney Golis, and that the draft had been found lacking in that it did not address abandonment or liability. Mr. Pastore stated that he would send his comments to staff. Mr. Paganini expressed safety concerns in that placement of newsrack boxes could cause traffic accidents, to which Mr. Ellington responded that language in the draft ordinance addressed distances and setbacks. Ms. Carlino commented that typographical errors needed to be corrected, and questioned whether some graphics should be prohibited, but was advised that the ordinance could not limit freedom of the press. Ms. Carlino also questioned whether the ordinance would apply only on public roadways, to which Attorney Golis responded that he believed private property could not be regulated, and would check on that. Chairman Sabatello pointed out that in new petitions a condition could require newsracks to be screened, and suggested that "public right -of- ways" be changed to "City of Palm Beach Gardens" so that all newsracks would have to go through the necessary process. During the discussion on this matter the following points were raised: Grandfathering would not apply, guidelines for typical appearance and screening requirements should be flexible, length of phasing period, setbacks might need to include pull away areas with small signs on main roadways to indicate • newsrack areas, possible limitation to secondary roadways, and comments were needed from the fire and police departments and the City engineer.
