SPECIAL MEETING
CITY OF PALM REACH GARDENS
MARCH 19, 1981
Thr Spertal Mcetang of the City Council of Palm Beach Gardens was
callr�d io nrdor by M,owr- Fut,ne� at 8:00 P.M., in the Assembly Room,
10500 '— Mil>t.ary Trail, Palm Beach Gardens, Florida; and opened with
the Pledge of Allegiance to the Flag.
ROLL CALL: The roll war al led Ly the City Cleri - d )resent. were: Mayor Peeney,
Vice Mayor Aldred, Councilman Kiedis, Councilman Laurie, and Council-
woman Monroe. City Manager John Orr and Attorney George Baldwin were
ilso in attr-ndance.
PURPOSE; 7h- purpose of the rrreetinq was for the Cnuncil/Canvasserg Board to
c�,nvnss the rel_urnc; of the City's March 17, 1981 Run-Off Electron via
Resolution 19, 1981, and foe the Council to organize (i.e., appoint a
Pa�cr and Vice Mayor) pursuant to Secs on 4 -3 of the City's Charter.
f3ESOLl1rIONS: With no objections fron the other members of the Counc .Ll /Canvassing
i?ESOLUTION 1.9, Board, Mayor Feeney requestp.1 that the City Clerk read in full Resolu-
tion 19, 1981, declaring the resul[3 of the Run -Off Election hrld
ApraI 17, 1961.
The City Clerk read Resolution 19. 1981 In its entirety with the figures
prnirldc,d by the Palm 13each County Supervisor of Elections' office
inserted in the blanks of the second Nheraas" paragraph and Section 1,
and the name "Donald L. Kiselewski" inserted in the blank of Section 2.
Courlc Elm3n Kiedis made a motion that Resolution i9, 1981 be adopted by
the City Council /Convae ;arnq Board. ncc mot,_on, wa , seconded by Vice Mnvcr
Aldred.
Counciiucman Monroe noted that when the total number of votes received
by the two candidate, are added together in each precinct, the sums do
not correspot;d with the total number of ballots tabulated by the voting
cquipmenL ;L.e., in Precinct 31, there were a total of 388 bal7nts versus
a total of 3,54 vote;;; un PrecinrL 42, there were a totol of' 358 Lallots
versus a total of 357 votes; an PreeLnct 45, there ucre a total of 392
Am baailots versus a total of 390 votes; and in Precinct 47, there were a
total of 453 ballots versus a total of 456 votes).

IL was explained that the Figures in the blanks opposite the "Total
Recorder Voter;" and "Total Absentee Votes" reflect the total number of
ballots tabulated; the blanks opposite each candidate's name reflect
the total number of votes they ieceived. The possibility of some
electors choosing not to cast a vote for either candidate was briefly
discussed.
By a unanimous vote of the Council, Resolution 19, ]981, declaring the
results cif the March ]i, 1981 run -Off Electron, was adopted.

Councilman Martino proposers that in light of the fart a full_ Council was
not in attendance, the organizational meeting be rescheduled.
In response to Councilman [Martin` }'s inquiry re: Section 4.3 of the City's
Charter prohihrttnq.'perrnittinr3 the appointment-, of a flavnr of Vic° flavor
without a full Council in attendafwc -, the City Attorney advised that
Sect-on 4.3 of the City's Charter noes not prohibit the organizai_;onal
meeting or the attempt of an urganzzational meeting in the absence of a
Councilman, uhether of not to be suoa.n in.

Councilman Martino related that one of the honors and duties of being a
Councilman a,; to portacipate in the appointments of a Mayor and Vice,
Mayor of the City; and that iL was very unfortuante fir. !<iuelewski had
the circumstances he was faced with and was unable to be in attendance
at the meeting.

tional meeting, the City Attorney advised that pursuant to Section 4.3
of the Charter, the Council uas rn,,ndated to proceed with the organiza-

COUnCi1HOn Martino withdrew his motion.
Councilman Martina nominated Councilman Kiedis for appointment as Mayor.
With no further nominations from the floor, Councilman Aldred declared
the,, nominations closed.
Councilman Martine and Councilman K.edi-, voted in favor the appointment
of Councilman Kiedis as Mayor; Counc_-.,u.,an Monroe and Councilman Aldred
voted in favor of the appointment of Councilman Aldred as Mayor.
By a vote of two Council me,Tbers in favor of Councilman Kiedis being
appointed Mayor, and a vote of L °I— r_UUncil members in favor of Council-
man Aldred being appointed Mayor, a deadlock situation was created.
The City .Attarnev advised that baseo on the deadlocked move for Mayo,,

could not be nccomplished. Huth the Charter and the By -Lays require
that the oroanizaticn take place Fit this meeting and that the Mayor and
Vase Mavor be appointed by a majority vote of those of the majority
present. Since this +vas not accomplished, it was hit, opinion the Council
could riot proceed with the items scheduled for the Regular Meeting with -
out a Mayor '3nd;'or Vice flnvor and that Lhe Chairman, Councilman Aldred,
