V t CITY COUNCIL REGULAR MEETING CITY OF PALM BEACH GARDENS MARCH 3, 1994 The Regular Meeting of the City Council of the City of Palm Beach Gardens, Florida, was called to order by Mayor Russo at 7:30 P.M. in the Assembly Room of the Municipal Complex, 10500 North Military Trail, Palm Beach Gardens, Florida, and opened with the Pledge of Allegiance to the Flag. ROLL CALL The City Clerk called the roll and present were Mayor Russo, Vice Mayor Monroe, Councilman Jablin, and Councilman Clark. Councilwoman Furtado arrived at 7:40 P.M. ANNOUNCEMENTS Mayor Russo stated the announcements were as posted on the City's Bulletin Boards. PRESENTATIONS: Linda Hodgkins, Intergovernmental Coordinator for the Solid Waste Authority, presented an award to the City of Second Place for outstanding residential performance by a municipality. ITEMS BY MAYOR AND CITY COUNCIL Vice Mayor Monroe Vice Mayor Monroe stated her third request for an answer as to why Palm Beach Gardens High School had not been keeping the lights on at the tennis courts so that residents could use the courts in the evenings, since this had been their agreement with the City. City CITY COUNCIL REGULAR MEETING, 3/3/94 Manager Herakovich reported the school had stated the they would leave the lights on if there was proper supervision. The City Manager stated staff would review the interlocal agreement further and present their findings in this matter to the City Council at their next regular meeting. Councilman Clark Councilman Clark reported a member of the City of Palm Beach Gardens' Police Department, Officer Mike Rispoli, had been awarded the "Top Cop" award for 1993 at the Exchange Club Dinner last week. Councilman Jablin Councilman Jablin reported he had attended a meeting of the Recreation Advisory Board, where they stated their concern that the Building Committee was including upgrading of the Garden Park Recreation Facility as well as new buildings needed for the police department and other needs that the City has for new buildings and facilities. They passed a resolution at their meeting that if Building Committee does not act on this matter before the next meeting of the Board they will act to refurbish ball fields themselves. City Manager Herakovich reported a decision was to be made tomorrow to one of two firms recommended by the Building Committee to do a conceptual master plan which would take approximately 60 days to complete; and that the Recreation Board would need to see the master drainage CITY COUNCIL REGULAR MEETING, 3/3/94 for the site since it could affect any plans for the ball fields. The city Manager recommended the Council act to change the designation of the Klock property from Public Use to Parks and Recreation. COUNCILWOMAN FURTADO Councilwoman Furtado reported the new coach for Palm Beach Gardens High School's football team, Rudy Jones, has motivated potential football players so well that over 90 young men tried out for the team, and 47 now f attend a volunteer scholastic tutoring program from 2 to 4 p.m. every afternoon, for which more volunteer tutors are needed. County Commissioner Karen Marcus updated the Council regarding the new Palm Beach Gardens High School Principal and Assistant Principal, who have been enthusiastically accepted by the teachers and students. She announced a March 23rd School Board boundary meeting, and suggested a letter be sent from the City Manager or the Mayor to the City of Riviera Beach expressing the City's desire to work together since many Palm Beach Gardens children attend Suncoast High School and many Riviera Beach children attend Palm Beach Gardens High School. Commissioner Marcus also updated the City Council on the parks issue, stating the County would like to work with the City and both staffs would be meeting next week to establish communication guidelines between the two groups. Commissioner Marcus offered the Cabana CITY COUNCIL REGULAR MEETING, 3/3/94 PAGE 4 Colony pool to the City at no charge if they would be interested, since the County's needs would be met by the regional pool in Jupiter. Mayor Russo stated this matter will be considered, and expressed his thanks to both Commissioner Marcus and Councilwoman Furtado for their work on school problems. Councilwoman Furtado thanked County Commissioner Marcus for her work on expansion of the foreign trade zone. Councilwoman Furtado announced one of our police officers had volunteered to chair a buy -a -brick committee when the new City Hall /Police Station complex becomes a reality, and a resident had donated a fountain if a courtyard setting was chosen. Mayor Russo Mayor Russo listed major accomplishments of the City Council during his current term as Mayor, i.e., many tasks incorporating intergovernmental cooperation with surrounding governments (the main one being the emergency medical service); also, the Jog Road issue and Military Trail widening had been resolved; the planning forum for North County had been successful; an aggressive management program for the City had been instituted; a site for FAU campus had been selected in North County; Charter Review Committee, Building Review Committee and Landfill Advisory Board had been established; many lawsuits were settled; North County Economic Advisory Board had been established to help locate quality businesses in North County; the schools' problems had CITY COUNCIL REGULAR MEETING, 3/3/94 PAGE 5 been improved, and volunteer programs had been successful. He expressed his thanks for the endless hours devoted to these projects and others by the City Council members, the City Manager, County Commissioner Marcus, Staff and residents. CONSENT AGENDA Councilwoman Furtado requested Resolution 25, 1994 be pulled from the Consent Agenda for a change of verbiage. It was the consensus of the Council to place Resolution 25, 1994 under Resolutions on the agenda. Councilman Clark then made a motion to approve Consent Agenda, seconded by Councilwoman Furtado and approved by a vote of 4 -0, with one abstention by Mayor Russo regarding approval of minutes since he was not present at the last meeting. The following items were approved on the Consent Agenda: 1. Approval of Minutes of 2/17/94 City Council Regular Meeting. 2. Proclaiming March 6 -12, 1994, "Save Your Vision" Week. 3. Proclaiming week of 2/3/94 as "International Clergy Appreciation Week ". 5. Resolution 26, 1994 - Authorizing the Mayor & Police Chief to sign the Palm Beach County Law Enforcement Agencies Combined Operational Assistance and Voluntary Cooperation Mutual Aid Agreement. COMMENTS FROM THE PUBLIC Scott Raynor Scott Raynor, Palm Beach Gardens, extended an invitation to everyone to attend the Fire Department open House and Safety Fair to be held March 5. CITY COUNCIL REGULAR MEETING, 3/3/94 -.In c RESOLUTION 21. 1994 Mayor Russo introduced Resolution 21, 1994, which was the Approval of Awarding of Bid for the Management of the Municipal Golf Course as advertised 11/28/93, 12/1/93 and 12/5/93, and opened and read at the Regular Meeting of 12/16/93, and continued from Regular Meeting of 2/17/94. Frank Allemana Frank Allemana, resident of Palm Beach Gardens, reported the success of a municipal golf course operated by city residents in his hometown of Glen Ellen, Illinois. He recommended that present golf course management be retained until the end of the current fiscal year and a 5- member committee consisting of the Assistant City Manager, the City Finance Director and three volunteers be established to review the operation during that time, and that no decision on changing the golf course management be made until the end of the current fiscal year. Bill Stock Bill Stock, of 62 Dorchester Circle, voiced his concern and spoke in favor of continuing low rates so that more people could play and recommended Dubin & Associates as his choice between the two management companies being considered because of their lower rates. He also recommended a summer membership be offered, and that some guidelines be given the management selected by the City Council. Jeff Cole Jeff Cole voiced his concern that if the golf course were found incapable of carrying the debt obligation from the 1 CITY COUNCIL REGULAR MEETING, 3/3/94 Milton Stern Lou King bonds no matter who manages the course, that it would not make sense to add management fees to this debt amount. He recommended that volunteers from the many golfers in the City be utilized to advise present management and thereby solve the problem within the community. Milton Stern, resident of Palm Beach Gardens, stated the annual $750,000 budget deficit must be eliminated as promised by the Council. Mr. King spoke in favor of building junior golf programs which would help the community's youth problems immeasurably. He recommended slowing down and not giving the golf course away. Mayor Russo commented he wanted to keep the golf course but felt a change in management was necessary in order to reduce the annual deficit. Councilwoman Furtado stated the interests of all the residents needed to be considered. Vice Mayor Monroe suggested that possibly after a year or two of management by a management company that the City might then be able to manage the course again. Councilman Clark stated the issue was to find the best balance of protecting taxpayer money and keeping access by the citizens to the golf course. Councilman Jablin stated his discomfort with the two proposals because they were only proposals and not definite numbers, After discussion, it was the consensus of the City Council to direct City Manager Herakovich to CITY COUNCIL REGULAR MEETING, 3/3/94 PAGE 8 negotiate a contract proposal with Dubin and Associates. RE -ORDER OF AGENDA Vice Mayor Monroe made a motion, seconded by Councilman Jablin and unanimously approved to place Ordinance 2 after ordinance 5 to allow time for copies to be made in order for the meeting to continue. PUBLIC HEARINGS ORDINANCE 5. 1994 Mayor Russo declared the Public Hearing open, which was duly advertised 2/16/94, and held on the intent of Ordinance 5, 1994, Text amendment to eliminate approval for sale of liquor, beer & wine sales in conjunction with a restaurant. There being no comments from the public, Mayor Russo declared the public hearing closed. Vice Mayor Monroe made a motion, seconded by Councilwoman Furtado, to adopt Ordinance 5, 1994. The motion was unanimously carried. The City Clerk read, by title only, on second and final reading, Ordinance 5, 1994. ORDINANCE 2, 1994 Vice Mayor Monroe requested the following changes to Ordinance 2, 1994: on page 2, F, change "follow" to "following" , and change "requirements" to "regulations "; on page 2, change number 113" to 11211, and number line 7 from the bottom of the page "a" and line 5 from the bottom of the page "b "; in the last sentence of 112" change "plan" to "plans" and insert "any of" after the word "if ". In the first sentence of "b" change "accept" to "accent ". In the second sentence of "b" delete "is" CITY COUNCIL REGULAR MEETING, 3/3/94 PAGE 9 and replace with "must be". on page 4 change item numbered 114" to 013 ". Add "of" after 11(1/3) ". Mayor Russo declared the Public Hearing open, which was duly advertised 2/2/94 and continued from the Regular Meeting of 2/17/94, and held on the intent of ordinance 2, 1994, Amending Chapter 153 "The Landscape Code" of the Palm Beach Gardens Code. There being no comments from the public, Mayor Russo declared the public hearing closed. Vice Mayor Monroe made a motion, seconded by Councilwoman Furtado, to adopt Ordinance 2, 1994, as amended. The motion was unanimously carried. The City Clerk read, by title only, on second and final reading, Ordinance 2, 1994. Ordinance 6, 1994 Rich Walton introduced Ordinance 6, 1994. After discussion, City Attorney Baird recommended the following changes: In paragraph "B" on page 2, in the first sentence, delete "the issuance of" and replace with "applications for ". In sentence two of paragraph "B" after the words "apply to" insert "approved developments of regional impact ", and delete the entire last sentence in this paragraph. Mayor Russo declared the Public Hearing open, which was duly advertised 2/16/94 and held on the intent of Ordinance 6, 1994, Providing for an Interim Zoning ordinance; providing for legislative intent and limited time of duration. There being no comments from the public, Mayor Russo declared the Public 1 CITY COUNCIL REGULAR MEETING, 3/3/94 PAGE 10 Hearing closed. Vice Mayor Monroe made a motion, seconded by Councilwoman Furtado, to adopt Ordinance 6, 1994, as amended. The motion was carried by a vote of 4- 1, with Mayor Russo opposing only because of the 6 -month duration of time. The City Clerk read, by title only, on second and final reading, Ordinance 6, 1994. RESOLUTIONS RESOLUTION 25.1994 Councilwoman Furtado requested Section 1 be changed to read: "The City Council of the City of Palm Beach Gardens, Florida, hereby supports the recommendations of the Palm Beach Gardens High School Task Force attached hereto as Exhibit "A" and made a part hereof, by recommending the compromise position for a phase -in of home SAC's 082, 083 and 084 should be assigned students to Suncoast beginning with the ninth grade in 1994 -95 school year ". Councilwoman Furtado made a motion that Resolution 25, 1994 be adopted as amended. Motion was seconded by Vice Mayor Monroe and passed 5 -0. RECONSIDERATION OF j RESOLUTION 26, 1994 Vice Mayor Monroe made a motion that the City Council reconsider Resolution 26, 1994, seconded by Councilman Jablin, and unanimously passed. Vice Mayor Monroe stated she had just recognized that Section III, paragraph 3 contained the word "with" which should be replaced with "without ". Vice Mayor Monroe then made a motion to approve Resolution 26, 1994 as amended. Councilman Clark CITY COUNCIL REGULAR MEETING, 3/3/94 TT - 1 1 seconded the motion, which passed 5 -0. Resolution 27, 1994 Rich Walton introduced Frank Pelan, agent for PGA Venture Ltd., who spoke and stated the petitioner had agreed to all conditions imposed by the Planning and Zoning Commission. Vice Mayor Monroe stated after this project, the Council still needed to reach a consensus regarding minimum right -of -ways for Planned Unit Developments, so that staff would be able to inform developers what they might face when their projects were presented to the Council for approval. It was the consensus of the City Council to workshop this matter at i a future date. Motion was made by Councilman Clark, seconded by Vice Mayor Monroe, to approve Resolution 27, 1994. Motion passed 5 -0. ORDINANCES ORDINANCE 1, 1994 Rich Walton introduced for workshop Ordinance 1, 1994 - Amending Chapter 159 of the Palm Beach Gardens Code by the creation of Section 159.065 "Covered Parking Structures ". Staff had prepared a set of guidelines to be followed. Larry Smith, agent for Harbour Shop retail center whose request for the installation of five covered parking awnings over 25 parking spaces at the October 28, 1993 City Council Meeting instituted the creation of this ordinance, spoke for the petitioner stating they had no problems with the guidelines as presented and that their structure could be engineered to withstand 120mph winds. CITY COUNCIL REGULAR MEETING, 3/3/94 PAGE 12 Staff was directed to schedule Ordinance 1, 1994 for first reading. CITY MANAGER REPORT City Manager Herakovich announced "Battle of the Wings" would be held March 6. The City Council directed the City Manager to refer a letter received from PBGA concerning districting to the Charter Review Committee for review. The City Manager reported the Police Department had received an award from the Minority Law Enforcement Agency for efforts in hiring minorities in the Police Department. City Manager Herakovich asked the council members to complete a form for her 6 -month performance appraisal. Since the ICMA program had not been approved in time for a deferred contribution per contract to be made, the City Manager requested approval by the council to authorize a check in that amount be given to the City Manager. Attorney Baird stated he would look into this matter for legality. It was the consensus of the City Council to meet for a workshop on March 24, 1994. CITY ATTORNEY'S REPORT City Attorney Tom Baird reported the Reno Wells trial had been set for the week of March 14. An offer of Judgement for $300,000 had been made, which if not accepted and if CITY COUNCIL REGULAR MEETING, 3/3/94 DAMP 11 the award amount is less than that amount, the City would be entitled to attorneys' fees and costs.
