HomeMy WebLinkAboutMinutes Council 102094CITY COUNCIL REGULAR MFFTING CITY OF PALM BEACH GARDENS October 20, 1994 The Regular Meeting of the City Council of the City of Palm Beach Gardens, Florida, was called to order by Mayor Clark at 7:30 P.M. in the Assembly Room of the Municipal Complex, 10500 North Military Trail, Palm Beach Gardens, Florida, and opened with the Pledge of Allegiance to the Flag. ROIL CALI. The Deputy City Clerk called the roll and present were Mayor Clark, Via Mayor Monroe, Councilman Russo, Councilman lablin, and Councilwoman Furtado. ANNOUNCFMFNTS Mayor Clark stated the announcements were as posted on the City's Bulletin Boards. AWARDING OF BIDS: BANKING SERVICES Finance Director Olson announced six bids had been received and opened on 9/27/94, with Barnett Bank being low bidder at $328.00 in monthly fees. Price was weighted 50% of the total rating. Finance Director Olson recommended the City enter into a banking services contract with Barnett Bank commencing December 1, 1994 and ending November 30, 1997. Vice Mayor Monroe moved approval of the staff recoininendation. Motion was seconded by Councilwoman Furtado. Motion passed 5-0. s CITY COUNCIL REGULAR MEETING, 10/20/94 PAGE 2 FERTILIZER BID City Manager Herakovich recommended the fertilizer bid which was advertised 9/9/94 and 9/11/94 and opened and read 9/26/94 be awarded to Harrells, Inc. in the amount of $44,928.00, since the low bidder's fertilizer contained a very high chlorine content not acceptable to the City. Vice Mayor Monroe moved approval of the staff recommendation. Motion was seconded by Council -an Russo. Motion passed 5 -0. ITEMS BY MAYOR AND CITY COOCIL: LAKE CATHERINE BALLFIELD LIGHTS Kim Glas provided a historical review of the Lake Catherine development. Ms. Glas reported that land given to the City under a land grant by the MacArthur Foundation provided for four ball fields and that the approved site plan had a notation which stated *conduit chases shall be provided under all concrete walks and pavements to facilitate possible future recreational lighting'. Councilwoman Furtado stated that the task force had requested that the City Council approve an ordinance that would provide for proper public disclosure at the time of land development in order to avoid future problems similar to the Lake Catherine and Jog Road issues which the property owners knew nothing about when they purchased their property. Councilwoman Furtado suggested also infor-ing purchasers which school their children would attend. Brian McLaughlin l presented enrollment figures for the Little League progran+a using the ballfields. M Councilwoman Furtado stated the problems of traffic, noise, inadequate parking, and vandalism would have to be solved no matter what the outcome was on the M r CITY COUNCIL REGULAR MEETING, 10/20/94 PAGE 3 lighting issue. City Manager Herakovich explained that the vandalism problem was being addressed through the Police Department. City Engineer Lindahl reported research had been done regarding providing additional landscaping with substantial trees and berming in the median and along the roadways which would reduce noise. The City Engineer reported discussion of malting MacArthur Boulevard clearly two lane or clearly single lane traffic indicated the preference was single lane, and traffic and transportation issues would noel to be addressed -- one of which would be to provide an adequate transition onto MacArthur Boulevard from the eastbound Northlake Boulevard dual turn Inc, and that traffic counts were being scheduled to provide more information. City Manager Herakovich suggested the possibility of moving one field to Gardens Park next to the tennis courts in order to provide adequate parking. Councilwoman Furtado suggested temporary lighting which could be removed when other parkland was acquired; not to light the fields on weekends or after 9 P.M. on weeknights, except for the few tournaments that are played there each year. Councilman Jablin and Councilman Russo were not convinced of the feasibility of temporary lighting; Councilman Russo stated he believed the biggest problem was the noise. Donnie Brown Mr. Brown stated he was a member of the task force, discussed the changes that would come about if lighting were granted and stated he would never have purchased his property at f Aire Catherine if he had known lighting would come N s I CITY COUNCIL REGULAR MEETING, 10/20/94 PAGE 4 about. He also stated he had spent many hours researching this matter, that possible lighting was not mentioned anywhere, and that residents had purchased their homes under Ordinance 30, 1989. Ray Ludwig Mr. Ray Ludwig, 1107 Nutmeg, stated at the last meeting everyone tried to fix blame instead of fixing the problem. Mr. Ludwig pointed out that the City will continue to grow, and that when commercial establishments are built on Northlake the Lake Catherine community will have noise from that. Steven Radford Mr. Steve Radford, 4186 Magnolia Street, stated the issue was not compromise but whether the fields would be lit or not, and once lights were in was the time to talc about restricting mu!Se. Mr. Radford cc —ented that with lights games could start at a reasonable time and still end at a reasonable time, and a girls' softball program could be established. Roy Rockoff Roy Rockoff, 439 Fushia Circle North, stressed the need for lights to help meet current needs, provide a safe place for children, and discussed the need for more recreational facilities as the city grows. Steven Selz Steven Selz stated his offices were located at 777 S. Flagier Drive, and that he represented Lake Catherine, and that the residents there had purchased their homes not knowing there was a possibility in the future that the fields would be I lit. He stated that the City would be asking the Lake Catherine residents to sacrifice their property values, and that in his opinion the staff recommendations were vague and unspecific with no concurrence as to specifications to mitigate n M CITY COUNCIL REGULAR MEETING, 10/20/94 PAGE 5 reduction in noise and light transport. He questioned whether the money this would cost could be better used to light other fields not near residential developments. Tracy Shelton Tracy Shelton, 602 Sun Terrace, stated he was one of the first buyers in Lake Catherine, and was mainly concerned with the health, welfare and education of the residents in the cammwtity and asked why 7 to 9 year olds were playing two nights a week. He recommended one practice per week and playing games on Saturdays. He urged the Council to vote 'no' to lights. Councilwoman Furtado expressed her opinion that a format needed to be laid out as to how lighting would work, and not just to vote yes or no. Vice Mayor Monroe suggested a preset automatic cutoff, and commented to Mr. Donnie Brown that Ordinance 30, 1989 which he had referenced, stated the lands were to be developed in accordance with the master site plan, which site plan did carry the reference that the conduit shall be provided under all concrete walks and pavement to facilitate possible future ball field lighting. Vice Mayor Monroe also stated her disagreement with the resident at the prior meeting who said everyone had their mind made up, and stated she would have voted against lights ui the beginning but after considering many things would vote for lights but only if they had a preset time for automatic shutoff. Councilman Russo related his experience of purchasing a home and then fording out an airport would be built nearby; and stressed the hazards to safety without lights, and asked for a 9 p.m. tr CITY COUNCIL REGULAR MEETING, 10/20/94 cutoff without an automatic cutoff. Councilman Russo urged the Council to l recognize the problem of needed facilities and to work on a solution. Councilman Jablin and Mayor Clark expressed agreement with the other ! councilmembers, and all councilmembers expressed regret that there was no good solution for the Lake Catherine residents. After further discussion, the following motion was made: Vice Mayor Monroe moved to approve the lighting at the Lake Catherine ballftelds, that the lights will have an automatic shutoff mechanism that will be preset for 9 P.M., that there shall be no lights permitted on weekends except for two tournaments per year, and that staff be directed to explore buffering alternatives and to bring a recommendation back to City Council and if that should include forming a committee to do so or to use whatever mechanism necessary to bring back the recommendation by the first meeting in January or sooner, if it were determined that date could not be met to bring available information to the City Council sooner so that they could apprise the community of that. Motion was seconded by Councilman Jablin. Discussion ensued regarding shutting off the lights; it was the consensus of the council that the lights would go off at 9 o'clock at all times, even when r tournaments were being played; Councilman Russo requested information regarding how lights could be shut off earlier if the field was not in use. Motion carried 5 -0. CONSENT A * .NDA: Councilwoman Furtado asked that Resolution 9 be pulled from the Consent tf CITY COUNCIL REGULAR MEETING, 10/20/94 PAGE 7 Agenda; Vice Mayor Monroe requested Item 7, Resolution 138 be pulled from the Consent Agenda and recommended postponement until next meeting. Vice Mayor Monroe made a motion to approve the Consent Agenda with items 7 and 9 deleted. Councilwoman Furtado seconded the motion. The motion carried unanimously. The following items were approved on the Consent Agenda: 1. Approval of Minutes of 9/7/94 City Council Special Meeting. 2. Approval of Minutes of 10/6!94 City Council Regular Meeting. 3. Proclaiming October 23 -29, 1994 as "Florida City Government Week ". 4. Proclaiming October 21, 1994, as "Arbor Day ". 5. Resolution 136, 1994 - Providing for Central Boulevard Temporary Landscaping. 6. Resolution 137, 1994 - Consideration of Approval of a minor amendment to Parcet 28, Ballenlsles clubhouse PUD, approved by Resolution 86, 1990. 8. Resolution 139, 1994 - Consideration of Approval of and updating of Job descriptions. PUBLIC fjEARINGS: SUBSTANTIAL DEVIATION DETERMINATION - PGA NATIONAL RESORT CORE DRI (COMMERCE PARK) Mayor Clark stated that there were two agenda items, the public hearing for substantial deviation for the PGA National Commerce Park and the Resolution CITY COUNCIL REGULAR MEETING, 10/20/94 PAGE 8 142,1994 pertaining to the zoning change, which was requested to be pulled and presented at a later date by the developer, so that only the public hearing on the substantial deviation would be considered at tonight's meeting. Councilman R—to objected to pulling the resolution since so many had come to the meeting to talk about it. Henry Skokowski stated that Resolution 142, 1994 was on the agenda for workshop /consideration of approval and that he had no problem going ahead with that; but he had promised to obtain a letter from the State of Florida stating that approval of this resolution would in no way jeopardize the Jog Road situation and he did not have that letter as yet, and therefore asked that approval of the Resolution be delayed. Vice Mayor Monroe reminded the City Council that Jog Road was not the only issue and if the City Council found other reasons not to approve, then there would be no reason to wait for the letter. Mayor Clark declared the Public Hearing Open and called for the staff report, which was presented by Rich Walton who explained that the determination as substantial or not determined the approval process. Consultant Dennis Foltz, hued by the City to review this matter, presented his report which concluded that this was not a substantial deviation. Mr. Foltz further discussed how the proposed development of rental apartments within PGA National, if changed to residential, would impact the amount of land designated as industrial within the City. Discussion ensued regarding whether enough land was available for industrial uses into the future. Rich Walton reported Treasure Coast Regional r I I CITY COUNCIL REGULAR MEETING, 10/20/94 PAGE 9 Planning Council had been very concerned that the City was not acting in good faith stating the number of units in PGA National was 5400 in order to get Jog Road removed and then requesting the number be increased. The Planning and I Zoning Commission had voted to recommend to the City Council that this petition was not a substantial deviation from the DRI Development Order, however, it was also rewm —ended that the City Council defer from further processing of the petition until assurance was received from the State of Florida that the project will not be considered a part of or related to the present application of the Jog Road changes, and to reco —end to the City Council that it deny the rezoning from Industrial use to Residential use. Mr. Walton reported the daily traffic would increase with this project. Mr. Martin Fein, petitioner, summarized the activities of his Houston -based development and management business, which he stated cater to high -end luxury apartments. Mr. Skokowski discussed the history of the property and explained that a marketing study had not been done since real -life history gave enough indication as to what should sell; discussed densities and the fact that PGA National was always intended to be mixed -use; stated that traffic would be less; and asked for a 60-day delay before approval to allow resolution of the Jog Road issue. Councilman Russo stated his position that although the Jog Road issue might not be affected by this request that the City's credibility and PGA National's credibility were affected, and expressed concern over where children living in the proposed apartments P CITY COUNCIL REGULAR MEETING, 10/20194 PAGE 10 would attend school. Vice Mayor Monroe stated she did not believe this was a Jog Road issue but the credibility of the City was questioned, she did have a problem with traffic, and expressed concerns with changing from residential to industrial. The other Council members concurred with the Vice Mayor's position. Calvin Schwartz Calvin Schwartz, 2 Bentwood Road, stated he disagreed with the Planning ad Zoning Commission when they voted the application did not substantially deviate from the original development order because changing zoning from industrial to residential was a major change, and stated the residents of PGA National wanted the industrial zoning for office buildings, tnedlcal facilities, and many other uses. There being no other couuumts from the public, Mayor Clark declared the public hearing closed. Vice Mayor Monroe made a motion to accept the determination that this was not a substantial deviation to the PGA National Resort for DRI. Motion was seconded by Councilman Russo. Motion carried 5 -0. RESOLUTION 142, 1994 Discussion about whether this resolution could be considered at this meeting since the petitioner had requested a 60-day delay resulted in a determination by the City Attorney that he believed due process laws had been met unless all information had not been presented; and a statement by the petitioner that all information had not been presented. Mayor Clark called for any residents who wished to speak in favor of the project. CITY COUNCIL REGULAR MEETING, 10/20/94 PAGE 11 John Kimbal Mr. Kimbal stated he was against the project and knew that a number of other residents also opposed the project and felt with the 11:30 deadline approaching that everyone would not have a chance to voice their positions. Mayor Clark explained he had called for those who wished to speak in favor of the project, and read the names of residents who had signed up to speak: Larry Bagdan, Ben Bennewitz, Louis Hyatt, Bob Lauer, Lorraine Lindguist, Gaye Furtur, and Jack Warner, who all waived their right to speak since their opinions E were in accordance with those expressed by the City Council. Vice Mayo Monroe expressed her opinion that waiting 60 days would not change any of the issues she was concerned about and therefore would not change her opinion. City Attorney Baird advised since the advertisement had included both the substantial deviation determination and the action on the resolution that the proper motion if the City Council did not want to approve the resolution would be to deny the proposed amendment to change the land use. Vice Mayor Monroe moved that the City Council deny the proposed change as requested in Resolution 142, 1994. Motion was seconded by Councilwoman Furtado. Councilman Russo commented in tight of the fad that Mr. Skokowski had stated F I he had not presented all the traffic information that he wanted to clarify that his vote was not based on traffic but on all the other comments made by the City Council. Motion carried 5-0. COMMFNTS FROM TRF. J I CITY COUNCIL. REGULAR MEETING, 10/20/94 ANDREW D'ONOFRIO Andrew D'Onofrio, 267 Kelsey Park Circle, read aloud a letter opposing the improvements to Oaks Park at Gardens East Boulevard, with photographs taken at PGA Park on Northlake Boulevard depicting the conditions at that park. JOSEPH GUAY Joseph Guay, 8668 Satelite Terrace, Lake Park, spoke in regard to the Home Depot expansion which placed a door across the street from his neighborhood which resulted in excessive noise. Council members expressed concerns and explained the problem was being worked on and asked Mr. Gay to allow more time for a resolution. MRS. RITA GUAY Mrs. Guay, 8668 Satelite Terrace, Lake Park, also expressed concern regarding the excessive noise from Home Depot. ORDINANCE 20, 1994 Mayor Clark declared the Public Hearing open for Ordinance 20, 1994, providing for the establishment of a program entitled "Combat Automobile Theft ". Hearing no comments from the public, Mayor Clark declared the Public Hearing Closed. Vice Mayor Monroe moved approval of second reading and adoption of Ordinance 20, 1994. Motion was seconded by Councilwoman Furtado. Motion carried 5 -0. The Deputy City Clerk read on second r -ding Ordinance 20, 1994. ITEMS FOR COUNCIL ACTION_ AUTHORIZATION TO DISBURSE FUNDS RE CONSENT DECREE City Attorney Baird explained the City Council was required to disburse funds under the Consent Decree in the Wiley class action settlement within a cmuin time frame. Vice Mayor Monroe made a motion to authorize disbursement of t� CITY COUNCIL REGULAR MFFTING, 10/20/94 PAGE 13 funds regarding the Consent Decree as noted by Attorney Baird. Motion was seconded by Councilman Jablin. Motion carried 5 -0. RESOLUTION 140,1994 Vice Mayor Monroe moved approval of Resolution 140, 1994 approving the contract for engineering services and appointing a City Engineer for the fiscal year 1994/1995. Motion was seconded by Councilman Jablin. Motion carried 5 -0. CITY MANAGER The City Manager reported grant fumds had been received in the amount of $28,635 from Solid Waste Authority, and received per ---ion from the City Council to enter into the contract for recycling education. ADJOURNMENT There being no further business to discuss, motion was made by Vice Mayor Monroe, seconded by Councilman Jablin, and unanimously approved to adjourn the meeting at 11:27 P.M. We urge you to consider this petition on behalf of the concerned citizens of Palm Beach Gardens, for we do not want the same conditions that are prevalent at PGA Park on North - lake Blvd. Upon visiting PGA Park on October 20, 1994 we were appalled at the conditions that exist there. We do not want these conditions in our backyard. Just to sight a few examples: 1. filthy bathrooms of disrepair 2. rusted water coolers 3. garbage containing flys, maggots and rodents 4. feces in abundance 5. containers left filled for days with rubbish 6. numerous beer cans 7. pavillion in need of repair and painting Attached are color photos of conditions found at PGA Park today. Again, we do not want this type of situation in our residential area. Our committee will be available to discuss all of the above at your earliest convenience.
