The Regular Meeting of the City Council of the City of Palm Beach Gardens, Florida, was called to order by Mayor Russo at 7:30 P.M. in the Assembly Room of the Municipal Complex, 10500 North Military Trail, Palm Beach Gardens, Florida, and opened with the Pledge of Allegiance to the Flag. ROLL CALL The City Clerk called the roll and present were Mayor Russo, Vice Mayor Monroe, Councilwoman Furtado, and Councilman Clark. Councilman Jablin arrived at 7:50 PM. PRESENTATIONS: Since no scientific conclusions had been drawn to date, the Landfill Committee's presentation was postponed; however, Councilman Jablin reported on the committee's areas of concern which were the landfill, condition of the water supply, and allegations of cancer clusters. Since nothing had yet linked the landfill to the water supply it was the lay conclusion of the Committee that the City's water supply was pure, and a presentation would be made when all data had been received from all agencies involved and actual scientific conclusions had been drawn. The committee had been trying to speed up the process and to get the Health Department to work with them concerning the cancer cluster allegations. ITEMS BY MAYOR --AND CITY COUNCIL Mayor Russo asked for direction from the City Council COUNCIL REGULAR MEETING, 12/2/93 PAGE 2 regarding the request by City Manager Herakovich that the Council reconsider the hiring of an in -house attorney. It was the consensus of the Council that in the absence of the City Manager this matter be considered at the next City Council Meeting along with justification for going in -house and whether another RFP should be undertaken. Mr. Loudaros Mr. Antonis Loudaros, a teacher at Palm Beach Gardens Elementary School, spoke asking the City to make a donation to help defray the cost of a trip to Providence, Rhode Island, for the school's track team to participate in the National Junior Olympic Cross Country Championships. Vice Mayor Monroe made a motion that the City of Palm Beach Gardens donate $30 for each documented city resident who participates in this team trip conditioned upon receipt of said documentation before the check would be written and determination by City staff of a legal mechanism for handling the donation. Motion seconded by Councilwoman Furtado and unanimously passed. ITEMS BY MAYOR AND CITY COUNCIL Councilwoman Furtado Councilwoman Furtado reported a new state -wide program which would be put into operation in January, 1994, called Student Crime Stoppers, which would work just like the adult crime stoppers so that students could call in COUNCIL REGULAR MEETING, 12/2/93 PAGE 3 and remain anonymous. She recommended the council consider passing a resolution at the next council meeting in support of this organization and networking with other municipalities, councils to solicit their support. Councilwoman Furtado stated she had spoken with a resident who lives on Gardens East Drive and learned that large trucks had been using this residential street for deliveries to the hospital and merchants. Suggestions were made that she find out if trucks may legally be restricted from using this street, and if so, work with the City Manager, the police chief and the engineering department to accomplish restriction. Vice Mayor Monroe Vice Mayor Monroe reported the Military Trail Task Force had met to consider the alternatives that had been submitted to the County Commission and to review their previous recommendation. Their recommendation will be presented at the December 16 City Council Meeting to allow time to prepare a written presentation with graphics. Vice Mayor Monroe also reported the Chief of Police had investigated the helicopter landings at Palm Beach Gardens Medical Center and found no safety hazards. Mayor Russo Mayor Russo commented the traffic light has been made operational at Northlake Boulevard and Ryder Cup Boulevard, and proposed that a thank -you letter be written to Mr. Walker at the County Engineering COUNCIL REGULAR MEETING, 12/2/93 PAGE 4 Department. Mayor Russo reported that closing Ryder Cup Boulevard during Festa Italiana caused problems and the City should not close this street for events in the future. Mayor Russo reported he had learned of a meeting of the Board of Regents in Miami at eight a.m. tomorrow morning regarding the proposed FAU site. Kim Glas was appointed to attend and to present a statement from the City Council in support of the proposed site. COMMENTS FROM THE PUBLIC Sam Carsillo Sam Carsillo spoke regarding people hitting golf balls in the open area next to Lake Catherine which could be dangerous to people flying kites, fishing, etc.; and suggested a large garbage can be placed near the big tree where many people eat lunch. Mr. Carsillo also questioned whether the proposed changes to Military Trail would help cut down on speeding, and suggested police officers be posted to catch speeders. CONSENT AGENDA Vice Mayor Monroe made a motion, seconded by Councilman Jablin, to approve the following items on the Consent Agenda. The motion was unanimously approved. The following items were approved: 1. Resolution 142, 1993 - Approving Mission Statement and Appointing Members to the Building Committee. 2. Resolution 123, 1993 - Approval of "The Oaks -Oaks East -Plat 211 created 11/16/89 by Ordinance 31, 1989. PUBLIC HEARINGS Drdinance 8, 1993 Kim Glas presented Comprehensive Use Plan Amendment #93 -1 COUNCIL REGULAR MEETING, 12/2/93 PAGE 5 (Ordinance 8, 1993) for consideration of the density reduction in TAZ 848 from 4 dwelling units per acre to 2 dwelling units per acre. Staff had added a provision to designate Ryder Cup Boulevard (that portion outside of the 60 feet needed for a 2 -lane Jog Road) with the Recreation and Open Space (ROS) category. Vice Mayor Monroe questioned as to when land designated Recreation and Open Space would be included in land for parks and when it would not. Kim Glas answered that there are 3 kinds of parks defined: neighborhood, community, and district. A linear park would not fall under any of these three categories. Mayor Russo then opened the Public Hearing, which was duly advertised 11/17/93. Milton Stern, resident of Palm Beach Gardens, addressed the City Council stating the Council was well aware of his position and that he had been looking forward to this for many months. There being no other comments, Mayor Russo closed the Public Hearing. Per a unanimous vote of the City Council, the City Clerk read, by title only, in second and final reading, Ordinance 8, 1993. Vice Mayor Monroe made a motion to adopt Ordinance 8, 1993. Motion seconded by Councilwoman Furtado and unanimously passed. Ordinance 11, 1993 Kim Glas presented Comprehensive Use Plan Amendment #93 -2 (Ordinance 11, 1993) for consideration of the designation of land uses for the properties annexed in 1990 and 1991. COUNCIL REGULAR MEETING, 12/2/93 A change to water and sewer level of service standards was withdrawn from the Ordinance with the agreement of Rim Bishop of Seacoast Utilities, to be considered at a later date. Councilman Clark stated the following amendments: cross out the word which and insert the words as necessary to in the first sentence of Policy 1.1.1.2.a on page 5 of Exhibit A, and the same change on Policy 1.1.1.4 and on Policy 1.1.5. Mayor Russo then opened the Public Hearing, which was duly advertised 11/17/93. Since there were no comments for or against the Ordinance, Mayor Russo closed the Public Hearing. Per a unanimous note of the City Council, the City Clerk read Ordinance 11, 1993, on second and final reading, by title only. Vice Mayor Monroe made a motion to adopt Ordinance 11, 1993. Motion seconded by Councilwoman Furtado and unanimously passed. RESOLUTION 146, 1993 It was the consensus of the Council after discussion and comments by Roy Davidson, former Chairman and current Board Member of the School Board of St. Mark's School, to table Resolution 146 which would grant permission for St. Mark's School to use the City's Park located at "The Oaks" until next meeting so that an official of St. Mark's school might attend to clarify questions raised by the Council members and to allow time for City staff to COUNCIL REGULAR MEETING, 12/2/93 ORDINANCE RE- -- QLUTZA-N 23, 19 9 3 PAGE 7 prepare a report relating to level of usage of the park by the public. Per a unanimous vote of the City Council, the City Clerk read on first reading, Ordinance 23, 1993 authorizing the Planning and Zoning Director in consultation with City Staff to make minor amendments to land development plans and site plans; providing a list of amendments to land development plans that shall be considered major amendments and outside the purview of this ordinance.
