HomeMy WebLinkAboutMinutes Council 032593CITY COUNCIL WORKSHOP MEETING CITY OF PALM BEACH GARDENS MARCH 25, 1993 The Workshop Meeting of the City Council of the City of Palm Beach Gardens, Florida, was called to order by Mayor Russo at 7:39 P.M., in the Assembly Room of the Municipal Complex, 10500 North Military Trail, Palm Beach Gardens, Florida; and opened with the Pledge of Allegiance to the Flag. ROLL CALL The Deputy City Clerk called the roll and present were Mayor Russo, Vice Mayor Monroe, Councilwoman Furtado and Councilman Clark. Councilman Jablin arrived at 7:51 P.M. ANNOUNCEMENTS Mayor Russo reported a public information meeting regarding the Landfill would be held Monday, March 29, 1993, at 7:00 P.M. at the Palm Beach Gardens Community High School Auditorium. ITEMS FOR DISCUSSION CITY COUNCIL PENDING LIST After a lengthy discussion, there was a consensus of the Council to proceed with the Council's pending list as follows: Natural Resources and Environmentally Sensitive Lands Code Revision Staff would provide the draft to Vice Mayor Monroe for her review. The draft would be workshopped in April with the first reading scheduled for sometime in May. Staff was to provide a flowchart with the dates of the pending projects. PGA Boulevard Planninq and Desiqn Guidelines The Planning and Zoning Commission should workshop this CITY COUNCIL WORKSHOP MEETING, 3/25/93 PAGE 2 item. Staff should be ready to return to the City Council for approval by the first of June. The Council did request periodic updates. Joq Road - Related Comprehensive Plan Amendment This item will be discussed in conjunction with the Jog Road Interlocal Agreement. Conceptual Linkage Plan and Parkway Systems Staff should provide a conceptual plan for discussion at the 4/1/93 Regular Council meeting. Public Safety Impact Fees Mayor Russo would review the draft copy of the Ordinance and would like to adopt the Ordinance in June. Recreation Impact Fees Bobbie Herakovich, Acting Assistant City Manager, would provide a RFP for the 4/1/93 Regular Council Meeting. Administrative Hparinq Re: PBC Traffic Element The Hearing had been postponed for the present time. Cordani (Gardens Country Club) Review Process Mayor Russo felt this item should not be on the Council Pending List. Staff would provide procedures for the Council's approval at the 4/1/93 Regular Council Meeting. PGA National Development Order Appeal By TCRPC on Joq Road Council not interested in expediting the appeal by TCRPC on Jog Road. If TCRPC expedites the appeal, the Council would consider the issue at that time. CITY COUNCIL WORKSHOP MEETING, 3125193 PAGE 3 Comprehensive Plan Amendment for County Land Uses in City Council agreed to postpone until the Urban Forum Study by the County was completed. Land Development Requlations: Zonina Code Schedule workshop for the 4/22/93 Workshop Council Meeting and schedule first reading for the 5/6/93 Regular Council Meeting. New Council members to be brought up to date by staff on the LDR's. Landscape Code Schedule for workshop at the 4/8/93 Workshop Council Meeting and schedule for second reading at the 4/15/93 Regular Council Meeting. Roadway Beautification Proqram Council would like to see what could be salvaged from the previous Roadway Beautification Program. Vice Mayor Monroe suggested volunteers be requested to submit to the City signage plans for review. Schedule for workshop in April. Amendment to Art in Public Places Staff to provide current copy of Art in Public Places Ordinance to Council. Schedule for workshop in April or May. Holly Drive Signage Staff to provide Council with prices for signage along Holly Drive. Council will also look into widening bridge on Holly Drive. CITY COUNCIL WORKSHOP MEETING, 3/25/93 PAGE 4 Facilities Plans /Space Allocation /Referendum Council would like to form a committee to look at locations and proposals. Mrs. Herakovich to provide comments from staff in couple of weeks. Recognition of PBGYAA Years of Service Award Mrs. Herakovich will return to Council with suggestions for recognition of PBGYAA. Appointments: Emergency Medical Task Force: The following members were selected to form an Emergency Medical Task Force Committee: H. B. Lipschetz, Mike Hoffman, Palm Beach Gardens Medical Center, David Pania, and Barry Merman. Vice Mayor Monroe will contact Dave Talley of the Northern Palm Beaches Chamber of Commerce for suggestions of a business professional to serve on the committee. David Pania will chair the committee. Mayor Russo stated he will attend the first meeting of the Committee. Charter Review Committee: Council will submit names to serve on the Charter Review Committee at the 4/1/93 Regular Council Meeting. Siqn Code Committee: Council will submit names to serve on a Sign Code Committee at the 4/1/93 Regular Council Meeting. Golf Course Committee: Mayor Russo stated he would make a recommendation on forming a golf course committee at a later date. Code Enforcement Officers Vice Mayor Monroe recommended adding an issue to the pending CITY COUNCIL WORKSHOP MEETING, 3/25/93 PAGE 5 - list which would allow Code Enforcement Officers to issue citations. PENSION FUNDS Mr. H. Lee Dehner, Christiansen & Dehner, P.A., 2975 Beridge Road, Sarasota, Florida, briefly addressed the City Council regarding the administration of pension funds. Vice Mayor Monroe requested Attorney Brant propose changes which would bring the General Employee Pension Fund into compliance with the law. COUNCIL LIAISONS Per a consensus of the City Council, the following Council Representations to the City's Advisory Boards were selected as follows: APPOINTMENTS TO s Mayor Russo: Loxahatchee Council of Governments and Municipal League. Vice Mayor Monroe: Code Enforcement Board and Zoning Board of Appeals. Councilman Jablin: Art Advisory Committee and Recreation Advisory Board. Councilwoman Furtado: Merit System Board and Palm Beach County Metropolitan Planning Organization. Councilman Clark: Beautification and Environmental Committee and Planning and Zoning Commission. Council was advised an application to serve on the various City Advisory Boards would be included in the next resident's newsletter. Vice Mayor Monroe requested a note be included in the resident's newsletter indicating if the resident was not chosen for an advisory board the first time CITY COUNCIL WORKSHOP MEETING, 3/25/93 PAGE 6 around, there was a possibility they could be chosen at a later date. JOG ROAD �NTE�L��AL AGREEMENT Mayor Russo reported attending the County Commission meeting on Tuesday, March 23, 1993. Mayor Russo stated Councilman Jablin and Commissioner Marcus had negotiated an agreement which he felt was fair to both the City and the County. Mayor Russo stated John Gary, representing the MacArthur Foundation, had prepared and presented an Interlocal Agreement which Mr. Gary felt was fair to the County, City and residents. Mayor Russo stated the County Commission was in favor of the Interlocal Agreement prepared by the MacArthur Foundation by a 4 -2 vote, without the "banking" provision. Mayor Russo stated the County Commission was not in favor of the Interlocal Agreement prepared by Councilman Jablin and Commissioner Marcus. Mayor Russo stated the Foundation's Agreement was not much different from the Interlocal Agreement the City Council voted to approve on December 17, 1992. Mayor Russo stated the Agreement prepared by Councilman Jablin and Commissioner provided more protection for residents should the City Council not do their job. Lennart Lindahl, City Engineer, addressed the City Council and reviewed how the surrounding roadways would be impacted with the removal of Jog Road, along with the reduction of density in TAZ 848. CITY COUNCIL WORKSHOP MEETING, 3/25/93 PAGE 7 Mayor Russo reported the County Commissioners had requested the City pay administrative costs and to post a $10 million bond. Mayor Russo stated he informed the County Commissioners he felt it unfair to require the City to post $10 million bond when other roads had been removed and no bond was required. In response to Mayor Russo, Attorney Brant stated the Interlocal Agreement required specific notice requirements and would not be able to be adopted at the 4/1/93 Regular Council Meeting. Councilman Jablin expressed his disappointment with the County Commission dismissing the Interlocal Agreement he and Commissioner Marcus negotiated and not dealing in good faith. Palm Beach County Commissioner Karen Marcus addressed the City Council stating she felt the Interlocal Agreement she and Councilman Jablin negotiated could be adopted, as legal counsel for the County and City stated it could be adopted in a fashion which would provide protection for all neighborhoods and still allow for buildout. After further discussion by the City Council, there was a consensus to schedule the Jog Road Interlocal Agreement for an Item for Discussion at the 4/1/93 Regular Council Meeting.
