REGULAR MEETING
CITY OF PALM BEACH GARDENS
MARCH 4, 1993
The Regular Meeting of the City Council of the City of Palm
Beach Gardens, Florida, was called to order by Mayor Martino
at 8:00 P.M., in the Assembly Room of the Municipal Complex,
10500 North Military Trail, Palm Beach Gardens, Florida; and
opened with the Pledge of Allegiance to the Flag.
ROLL CALL The City Clerk called the roll and present were Mayor
Martino, Vice Mayor Russo, Councilwoman Monroe, Councilman
Jablin and Councilwoman Furtado.
ANNOUNCEMENTS The Mayor stated the announcements were as posted on the
City's Bulletin Boards and reminded the audience of the
General Election to be held in the City on Tuesday, March 9,
1993.

City Manager
Search Per the recommendation of the City Manager, vice Mayor Russo
made a motion, seconded by Councilwoman Monroe, to retain
Slavin, Nevins & Associates, per the contract provided, as
the search firm to seek a City Manager. The motion was
unanimously approved by the City Council.
Palm Beach County
Land Use
Amendment Rich Walton, Director of Planning and Zoning, addressed the
Council stating Palm Beach County had requested comments
from the City regarding a proposed land use amendment. Mr.
Walton stated the site is located south of Northlake

Boulevard, west of Military Trail. The petitioner was
requesting to change the land use from LR -1 (one unit per
acre) to CL -1 (commercial -low intensity). Mr. Walton stated
staff was concerned this approval would create strip
commercial along Northlake Boulevard frontage and additional
impacts along Military Trail would be generated. Mr. Walton
stated staff had drafted a letter of comment to Palm Beach
County for Council's consideration.
Councilwoman Furtado made a motion, seconded by Councilwoman
Monroe, instructing staff to forward the letter as outlined
by Mr. Walton. The motion was unanimously approved by the
City Council.
EcoSite 109 Mr. Walton referred to a previous memo pertaining to the
County's attempt to obtain CARL funds to help purchase
EcoSite 109, stating the County had requested a Resolution
in support of the County efforts to obtain these funds.
There was a consensus of the City Council for staff to
prepare a resolution to be placed on the 3/18/93 Consent
Agenda.
Golf Course
Bond Issue The City Manager recommended the City look at refinancing
the bond issue for the City Golf Course. The City Manager
stated the rates had dropped dramatically since the issuance
of the bonds. The City Manger stated if the City went out
for a bond issue at this time, the City could save
approximately $25,000 per year in interest. The City
,. Manager stated he would like to use the same firm, Wm. R.

Hough & Company, to move this along more quickly.
There was a consensus of the City Council directing the City
Manager to obtain materials for Council's consideration.
ITEMS BY MAYOR

Councilwoman Furtado stated in the interest of time, she
would bring her items up under communications.
Councilwoman

There was a consensus of the City Council directing the City
Attorney to prepare a list of items in the Code which needed
to be updated.
Vice Mayor
Russo
Vice Mayor Russo requested ground rules be established for
the Comments From The Public section as to the length of
time allowed to address the Council in order to advise all
business at hand.
There was a consensus of the City Council to allow St. Marks
Episcopal Church to make their presentation next.
Councilwoman Monroe requested the Council abide by the
Resolution on the books at this time regarding Comments From
the Public.
Per the recommendation by Councilwoman Monroe, there was a
consensus of the Council that Comments From The Public be
limited to City business and not used as a political forum.
St. Mark's
Episcopal Church
Mr. Walton addressed the City Council stating the Council
had approved an amendment to St. Mark's Church approximately

one year ago to allow them to have an outdoor pavilion

structure. One of the conditions of that approval was that
within one year of approval the Church would submit a Master
Plan for the ultimate buildout of the subject property for
review by the City Council. Mr. Walton stated this was a
conceptual master plan and was not granting vesting or site
plan approval, as each of the phases would have to meet the
code at the time of application.
Alex Perez, member of the facilities plan committee at St.
Mark's Episcopal Church and School, addressed the City
Council stating they were requesting acceptance by their
Council of the Master Plan. Mr. Perez stated they were
seeking approval, in concept, of Phase 2, two temporary
portable classrooms on the north side of the school, which
they hoped to have constructed by August of this year. Mr.
Perez stated they were not requesting vesting of the project
at this time.
Craig Livingston, project architect, addressed the City
Council and reviewed the phasing schedule.
There was a consensus of the City Council to prepare a
Resolution for the Consent Agenda approving the concept of
the Master Plan and the temporary classroom trailers at the
3/18/93 Regular Meeting.
Comments From
The Public
Sam Carsillo Sam Carsillo addressed the City Council and read ar article
detailing what one vote could do.

Resolution
19, 1993 In response to Councilwoman Furtado, Mayor Martino stated
Resolution 19, 19193, was not scheduled for the Consent
Agenda as he was not in attendance at the Workshop Meeting
and had pulled it from the Consent Agenda.
In response to Mayor Martino, Steve DeLai, Palm Beach County
Fire Rescue, stated in Section 3, last paragraph, Chief
Arrants and Chief Brice would be the individuals
representing the City and County, respectively.
In response to Mayor Martino, Vice Mayor Russo stated at the
top of page 5, the addition of "; or breach of guaranteed
services" was inserted as the result of discussion, however,
there was a consensus of the Council to remove same.
There was a consensus of the Council in Section 6.
Administration, "J"., 4th sentence; to change "responding"
to "arriving ".
In response to Mayor Martino, Mr. DeLai stated in regard to
providing the City with an average of 5 minutes response
time, the County would monitor themselves and submit the
reports to the City on a monthly basis.
In response to Mayor Martino, Attorney Brant stated the
attachment detailing the location of stations could either
be attached or not.
In response to Mayor Martino, Attorney Brant recommended
attaching a rate sheet for services to the contract. Any
changes could be amended by subsequent Resolution.

Councilwoman Monroe read into the record a letter prepared
by Tom Vaughan, along with a petition requesting a
referendum vote. (copy attached)
Vice Mayor Russo stated, in reference to the petition, the
City was not becoming part of a countywide system.
Scotty Howell
Scotty Howell, Palm Beach Gardens resident, addressed the
City Council and turned over petitions, stating she was
representing over 400 residents and was requesting a
referendum vote on this issue rather than the City Council
making the decision.
Rick Rhodes
Mr. Rhodes stated he would donate his time to Ron Beasley.
Bon Beasley
Ron Beasley, Professional Firefighters and Paramedics of
Palm Beach County Union, addressed the City Council stating
the members of the Palm Beach Gardens Fire Department and
the firefighters of Palm Beach County were supportive of
this idea.
Steve Rogers
Steve Rogers stated he would pass on his time.
In response to Mayor Martino, Mr. DeLai stated the process
of obtaining the Certificate of Need for Palm Beach Gardens
was ongoing. Mr. DeLai stated the public hearing for the
Certificate of Need would be sometime in May. Mr. DeLai
stated this contract would expire at the same time as the
Certificate of Need.
Mayor Martino expressed concern about the need for a third
vehicle in the City.
In response to Mayor Martino, Mr. DeLai stated there were

options which could be worked out between the County and the
City.
Mayor Martino stated he was very interested in having the
City's fire department in the EMS business, however, was
concerned in making sure the contract was understood and the
service by Palm Beach County was adequate or better.
In response to Mayor Martino, Councilwoman Monroe stated she
had expressed some of the same concerns as the individuals
signing the petition. She stated she was not as sold on
changing entities at this time and not as sold as the other
councilmembers re: bringing EMS service in- house.
Councilwoman Monroe felt this evening was not necessarily
the time to bring the public into the discussion, as there
was still time to hear from them.
Vice Mayor Russo stated he was frustrated as this is an item
than had been discussed for a long time. Vice Mayor Russo
felt the signers of the petition were not as informed as
they should be. Vice Mayor Russo stated he wanted EMS
controlled by the City's fire department, and that he would
like to form a group to decide if EMS in the City should be
done. Vice Mayor Russo stated he was ready to vote on the
interlocal agreement tonight and get the City going in the
right direction.
Councilman Jablin stated he agreed with Vice Mayor Russo and
was afraid the same thing that happened with Inter -City,
would happen to North County. Councilman Jablin stated he

was ready to vote on this issue tonight.
Councilwoman Furtado stated she agreed with Vice Mayor Russo
and Councilman Jablin and wished to vote on this issue this
evening.
Mr. Alvarez Mr. Alvarez addressed the Council stating he did not
understand how the Council could vote on this issue without
knowing the costs to the City.
John Morse John Morse addressed the Council wanting to know how many
lives have been lost due to poor service.
In response to Mr. Morse, Vice Mayor Russo stated you never
really know how many lives were lost, however, there was an
incident in Frenchman's Creek and by the time Inter -City
arrived, the gentleman had passed away as the result of a
heart attack.
Austin Bowe In response to Vice Mayor Russo, Austin Bowe, 326 Azalea
Street, addressed the City Council and related the details
surrounding the incident involving Inter - City's response
time at the tennis courts at Frenchman's Creek. Mr. Bowe
stated he was on that call to Frenchman's Creek and the
first truck arrived in 5 minutes. Mr. Bowe stated a gate
was not opened to allow the truck to drive to the tennis
courts, therefore, he got his equipment and ran the
additional 200 yards to the tennis courts and did everything
he could for the patient.
Fred Reaver Fred Reaver, 2555 PGA Boulevard, addressed the City Council
stating he was in favor of in -house EMS service, but has not

heard anything about Palm Beach County guaranteeing 4.5
minutes response time as North County can. Mr. Reaver felt
there should be a clause permitting the City to terminate
the County within 30 days, should the need arise.
John Taylor
John Taylor, North County Ambulance and volunteer for Palm
Beach Gardens, addressed the City Council stating he had not
heard anyone speak to the standard of care being provided to
the residents of Palm Beach Gardens and felt the Council
should delay vote on the Resolution until this was
investigated.
Vice Mayor Russo stated he was ready to vote on the issue
this evening, however, he would rather wait 2 weeks and work
this out and have the City come together on this issue.
Steve DeLai
Steve DeLai, Palm Beach County Fire Rescue, addressed the
City Council stating no one in south Florida delivers a
higher level of care than the Palm Beach County Fire Rescue.
Barry Merman
Barry Merman addressed the City Council and felt the Council
should further investigate the issue before voting.
Felicia White
Felicia White addressed the City Council requesting the
Council postpone voting on this issue for a few weeks.
Ron Beasley
Ron Beasley stated he was opposed to the City contracting
with Inter -City and stressed stability would be gained
contracting with Palm Beach County.
Councilwoman Monroe wanted to clarify the record regarding
Palm Beach Gardens' fire equipment leaving the city limits.
She stated if she remembered correctly, the contract read

"and become a part of a countywide service to which our
equipment is available ". She stated she was not aware the
equipment was limited to a certain area. Councilwoman
Monroe stated in four years from 1988 -1992, the increased
millage rate for the district has 55.5 %.
Mike Finnelli Mike Finnelli addressed the City Council and expressed
concern with the City contracting with Palm Beach County at
this time.
Mayor Martino stated it seemed this item needed to be
postponed to allow more input from the public. Mayor
Martino stated the professionals needed to come forward with
more information as requested, and perhaps more language was
needed in the contract to obtain a higher comfort level with
the residents. Mayor Martino stated 4 of the Councilmembers
have indicated they like the idea of the bridge plan of
where the City is today and at some point in the future
having EMS under the control of the City. Mayor Martino
stated Vice Mayor Russo's idea of postponing and holding a
public educational information hearing.
Councilwoman Monroe stated she would like information made
available before the date of the hearing, so the residents
could read and comment.
Vice Mayor Russo felt by having a hearing one night,
everyone would get more comfortable with the issue.
Mike Southard addressed the City Council stating for the
City to control their own destiny as far as the transport

-- company, they must let downtown know what the City intends
to do.
Councilwoman Monroe recommended requesting the residents
here tonight to provide questions which have been unanswered
so staff could put together a comparison. Councilwoman
Monroe requested a map so the residents could see where the
stations would be located.
Barbara Dubre Barbara Dubre addressed the City Council and questioned if
the Councilmembers would change their votes after they hear
the same presentation.
Tom Buretta Tom Buretta, 5770 Whirlwind, addressed the City Council
stating the public and the Council have had ample time to
investigate this issue and recommended the Council make
`r their decision tonight.
Councilwoman Monroe made a motion, seconded by Vice Mayor
Russo, to set an information meeting for Wednesday, March,
17, 1993, at 7:30 p.m. at the Community Center Auditorium
and if the auditorium was already scheduled for use, a sign
would be posted on the door directing people to the City
Council Chambers. The motion was unanimously approved by
the City Council.
Councilwoman Monroe made a motion, seconded by Vice Mayor
Russo, that Resolution 19, 1993, be continued until the
March 18, 1993, Regular Council meeting. The motion was
unanimously approved by the City Council.
There was a consensus of the City Council for Steve DeLai,

-- Chief Arrants and Attorney Brant to schedule the format for
the public informational meeting along the lines of the
conversation this evening.
CONSENT AGENDA Councilwoman Furtado made a motion, seconded by Councilman
Jablin, to approve the following items on the Consent
Agenda:
1. Approval of Minutes of 2/11/93 City Council Workshop
Meeting.
2. Approval of Minutes of 2/18/93 City Council Regular
Meeting.
3. Approval of Minutes of 2/25/93 City Council Workshop
Meeting.
4. Resolution 14, 1993 - Release of Unity of Title for
Palm Beach Business Park, approved by Resolution 58,
1992.
5. Resolution 22, 1993 - Approval of abandonment of Right -
of -Way for Doran TriPlex.
6. Proclaiming February 28, 1993, as "Make A Wish
Foundation Day ".
7. Proclaiming 3/7 -13/93 as "Save Your Vision Week ".
The motion was unanimously approved by the City Council.
RESOLUTIONS
Resolution
23, 1993 Mr. Walton stated the City Council endorsed a concern that
the Palm Beach County's Comprehensive Plan Traffic Element
was not legal and since making the challenge had proceeded
through the process. Mr. Walton sated the Council had also
directed staff to make every effort to try and resolve the
conflict without going to hearing. Mr. Walton stated the
hearing had been scheduled. Mr. Walton stated City and
County staff met a couple of weeks ago and were not able to
work out a compromise. Mr. Walton stated County staff had
proposed 2 general compromises or proposals of amendment to

their Comprehensive Plan in 2 separate areas. One concern
was the existing volumes and proposed volumes in the Capital
Improvement Program relative to PGA Boulevard in their
Comprehensive Plan. The other concern was the residential
exception boundary line in their plan, however, of the legal
proceedings he felt it was important that Attorney Bradshaw
discuss this issue.
Attorney Paul Bradshaw addressed the City Council, stating
the settlement agreement would alter the level of service on
PGA Boulevard and would also require the redrawing of the
residential exception line. Mr. Bradshaw stated it was his
understanding that County staff agreed with the terms of the
agreement. Mr. Bradshaw stated procedurally, they are
requesting the Council to approve the agreement tonight.
Mr. Bradshaw stated it would go to the County for approval
within the next couple of weeks, following that the County
would amend their Comprehensive Plan as specified in the
agreement and carry the amendments forward through land
development regulations to be implemented once the land
development regulations were adopted. Attorney Bradshaw
stated staff was pleased with the agreement and felt it
represented a true compromise.
In response to Mayor Martino, Attorney Bradshaw stated the
County had a choice to lower the level of service or spend
the funds to improve the area to bring the level of service
up. Some of the residential exception line would be redrawn

u and special conditions would apply to the residential
exception area and the Gardens boundaries. There are
special conditions which would promote affordable housing
within Palm Beach Gardens.
Councilwoman Monroe felt a third alternative would be to
totally review the density which affects this area.
Councilwoman Monroe felt a more comprehensive planning
modeling effort to determine what would make those roads
more nearly, if not perfectly, work. Until that has been
done, she could not say she would want to vote on something
that would lower the level of service on PGA Boulevard.
Councilwoman Monroe stated nothing in this document states
in todays dollars, what very low to low, and moderate income
means for Palm Beach Gardens. Councilwoman Monroe stated
Palm Beach Gardens does not have the funds to monitor the
affordable housing qualification for 15 years after initial
sale.
In response to Malyor Martino, Mr. Walton stated the
affordable housing condition was at the County's request.
Gilbert Moore Gilbert Moore, 12820 Calis Circle, addressed the City
Council and expressed his opposition to redrawing the
residential exception line.
Mr. Walton briefly explained the concept of the residential
exception line.
Attorney Bradshaw stated the Council had 3 options: 1) the
Council could decide whatever policy reasons motivated them

2 years ago to do this are no longer relevant and drop the
whole thing; 2) decide the agreement is not acceptable and
direct staff to go to hearing with County; or 3) direct
staff to make changes, provide information and have both
governmental entity's staff work out something agreeable.
Councilwoman Monroe stated she was philosophically opposed
to it and preferred option 1.
There was a consensus of the Council for staff to provide
additional information on the affordable housing information
and school board relative to housing and how staff proposes
to monitor this, bringing this item back to the Council on
3/18/93.
Mayor Martino announced the Candidate Forum will be
televised on Friday and Saturday at 7:00 p.m. on Channel 20.
COMMENTS FROM
THE PUBLIC
Marianne Rogers Chuck Pill, Phil Morel, Lisa Dudroe, Cindy Reppeal, Melanie
Ducruber, Henny Schroth and Hillary Crowe all contributed
their 3 minutes to Ms. Rogers.
Marianne Rogers addressed the City Council re: Donna Cox's
article regarding Jog Road and William Meyer's column
regarding the Gardens Association.
At this point, Councilwoman Monroe requested Ms. Rogers
refrain from discussing campaign material.
In response to Vice Mayor Russo, Attorney Brant stated the
Council had decided that in the couple of days before the
Election, the comments section would not contain political

comments or use this as a political forum, pertaining to
items not on the Agenda but having to do with City business.
The Chair must rule on the issue.
Mayor Martino felt Ms. Rogers comments regarding the
newspaper the Gardens Times, Palm Beach Gardens Association,
YAA were appropriate.
Mayor Martino requested Ms. Rogers be allowed to continue
and if something is said someone doesn't like, they can
speak up.
Vice Mayor Russo requested Ms. Rogers leave names out and
just discuss issues.
Ms. Rogers discussed issues re: Jog Road contained in
mailing for 3 candidates, tape of Council meetings edited
and prepared by Palm Beach Gardens Association and paid for
by 3 candidates, and use of the YAA tax number by the Palm
Beach Gardens Association.
John Larrets John Larrets addressed the City Council and expressed
concern with future traffic on Military Trail if Jog Road is
removed.
Julia Byrd Julia Byrd addressed the City Council and expressed concern
with the Palm Beach Gardens Association and the way the City
had been divided.
Mayor Martino stated he was ashamed of the conduct of
affairs of the election and the distortions and lies which
had been spread over the last year and one -half.

..,reement Councilman Jablin briefly reported on the draft proposal of

the Interlocal Agreement for the removal of Jog Road from
the County's Comprehensive Plan.
Vice Mayor Russo felt the Interlocal Agreement attempted
protection for residents with concerns about Military Trail
and the densities could not be increased, therefore, more
trips could not be put on Military Trail. The agreement
tries to protect the roads that could be affected if
something was ever done to increase densities. The
agreement tries to protect the City from the burden that
some future Council may put on it through increased
densities. Councilman Jablin stated he understood the
theory in the agreement, however, there were a number of
things that needed to be done. Treasure Coast felt the land
holder should be involved in the process. John Gary, agent
for the major landholder, stated he received a copy of the
agreement on Wednesday, after the County Commission meeting
on Tuesday. Vice Mayor Russo felt Mr. Gary should compare
his copy of the agreement to the one the City had and submit
his comments to the City.
Mr. Gary stated he had informed the County that he had
serious legal problems with the agreement. He had spoke
with Barbara Alternam with the County Attorney's office,
and they were trying to arrange a meeting for early next
week. Attorney Gary felt it would be beneficial to the
Council if the City Attorney could attend that meeting.
There was a consensus of the Council for the City Attorney

ADJOURNMENT There being no further business to discuss, the meeting was
adjourned at 12:010 a.m.

Dear Council Members:
I apologize that, due to a prior commitment that takes one out of
town, I cannot be here to personally deliver this statement.
Therefore I respectfully request that Councilwoman Linda Munroe please
read aloud my comments and questions for the public record.
As a taxpayer and ten year resident of the Gardens, I an
disturbed over the proposed interlocal agreement with Palm Beach
County Fire Rescue. It is my understanding that we can work toward
the goal of in -house E.M.S. service without jeopardizing our dedicated
fire department and present E.M.S. service by working toward the same
goal with North County Ambulance Service. These facts have come to ry
attention and, if correct, pose a serious doubt as to the validity of
a combined Fire and E.M.S. interlocal contract with Palm Beach County
Fire Rescue. These alledged facts pose some serious questions which I
don't believe have been answered. Please take a moment to examine the
following comparisons;

3. Will P.B.G. be allowed to dedicate it's own equipment to
P.B.G.?
4. Will first call be placed on P.B.G. Fire equipment, of whicl,
the County does not have, for the County use?
5. What is the cost of agreement?
6. Will County share revenue as N. County Amb. wilt?

County Attorney, alledgely, they will pursue to the full
