HomeMy WebLinkAboutMinutes P&Z 012693CITY OF PALM BEACH GARDENS -46 PLANNING AND ZONING COMMISSION JANUARY 26, 1993 MINUTES The Regular Meeting of the Planning and Zoning Commission of the City of Palm Beach Gardens, Florida, was called to order by Chairman Jeffrey Ornstein at 7:30 P.M., in the Assembly Room at the Municipal Complex, 10500 North Military Trail, Palm Beach Gardens, Florida and opened with the Pledge of Allegiance to the Flag. The roll was called by the secretary and present were: Chairman Jeffrey Ornstein, Vice Chairman Joseph Hamzy, Alan Strassler, Carl Sabatello, James Leatherman, Domenick Lioce, Members; Diane Carlino, Alternate Member. Dan Shalloway, Alternate Member, was not in attendance. ITEMS BY PLANNING AND ZONING DIRECTOR Mr. Bristol S. Ellington, City Planner, reviewed pending Resolution 8, 1993, which proposes to establish submittal deadlines for development plan revisions. Chairman Ornstein instructed the Commission to read the resolution for discussion at the next meeting. APPROVAL OF MINUTES OF MEETING OF JANUARY 12, 1993 Mr. Domenick Lioce made a motion to approve the minutes of the January 12, 1993 Planning and Zoning Commission meeting. Ms. Joseph Hamzy seconded the motion. The motion was approved by a 6 -0 vote, with Mr. Carl Sabatello abstaining. WORKSHOP: Recommendation to City Council re: PUD -92 -22 - Amending the Ballenisles Parcel 18 Planned Unit Development, created by Resolution 150, 1990 and amended by Resolution 68, 1992, to replace 52 single - family detached custom homes with 100 single- 1 _ family attached homes (duplex units). (1142S42E) • Chairman Jeffrey Ornstein reviewed the history of this petition. He said after the Planning and Zoning Commission recommended denial, City Council remanded this petition back to the Commission for further review. Mr. Bristol S. Ellington, City Planner, reviewed the changes made to the plans for the above - referenced petition. He said the Fire Department has determined that the cul -de -sac emergency access can be deleted if the petitioner supplies a stabilized base south of the current project entrance. Mr. Raymond Royce, agent for the petitioner, said the marketing studies indicate a desire for the duplex model. Mr. Royce also reviewed the City Council's recent approval of a model for the Parcel 18 duplexes, which have not been approved. Mr. Hank Skokowski, planner for the petitioner, distributed a handout entitled, "BallenIsles Parcel 18 Comparative Analysis," dated January 26, 1993. He reviewed the handout for the Commission. The document provided a comparison between the proposed development and the Garden Oaks project, Mr. Skokowski said. He said the front setback chart on the site plan needs a correction concerning lots 73 and 74. He said the setbacks should be 15 feet for each lot. Mr. Skokowski said he will correct the front setback table on the site plan. Chairman Ornstein said he would like the front setbacks for lots 73 and 74 to be increased by 10 feet. Mr. Skokowski said that residents prefer a larger rear yard than a large front yard. Chairman Ornstein said there could be more staggering of the setbacks of units in the IP project. He added that he has a concern with the variety of roof types. After Mr. Skokowski showed the color samples to the Commission, Chairman Ornstein, with the agreement of Commission, requested that the petitioner supply a better presentation of the proposed colors for the project at the next meeting. Mr. Skokowski agreed. Mr. Skokowski distributed to the Commission a document entitled, 'BallenIsles Parcel 18 Building Setbacks," dated January 26, 1993. He said the average lot width in the project is 44.7 feet. Chairman Ornstein said the revised site plan should indicate the new location of the emergency access to the project. Chairman Ornstein also added that he preferred that all the perimeter landscaping be installed prior to the issuance of the first certificate of occupancy. Mr. Carl Sabatello suggested that the buffer along BallenIsles Drive should wrap around the north corner of the project. Mr. Domenick Lioce said the eastern buffer should be put in before the construction of the eastern road. Mr. Bob Frien, a representative of the petitioner, said lots 36 through 86 are part of the first phase of construction for the site. Chairman Ornstein said he would like the eastern buffer landscaping extended north to Lot 16. Mr. Royce said he would like the choice of roof types, between "S" tile and flat tile, to be an optional choice for home buyers. The Commission discussed a concern with having a row of houses with the same roof type. 3 Mr. Frien said the "S" tile roof will be a custom option as it will cost more than a flat tile • roof. C] Mr. Lioce asked for an explanation of the difference between the $2,000 of landscaping per unit at Garden Oaks and $4,000 of landscaping per unit at Parcel 18. Mr. Krent Wieland, landscape architect for the petitioner, distributed a document entitled, "Planting Plan Comparison," dated January 26, 1993. The document compared the lot landscaping quantities of Garden Oaks and Parcel 18. Mr. Wieland said the landscaping budget for each duplex in Parcel 18 is $8,000. Mr. Wieland asked the Commission for its preference on the type of street tree for the project. Chairman Ornstein said he prefers a shade tree as the street tree for the project. Mr. Sabatello said he prefers palm trees. Mr. Wieland and Mr. Skokowski distributed to the Commission a document entitled, "BallenIsles Parcel 18 Proposed Condition of Approval," dated January 26, 1993. The document proposed the following condition: "A hedge will be provided around all unit screened enclosures except the side facing the non -zero property line wall. Where the distance between the screened enclosure and the non -zero property line wall is T -0" or greater, the hedge will be extended around the entire screened enclosure. A hedge will always be provided along the zero property line wall and non -zero property line wall." Chairman Ornstein suggested that the petitioner consider building one -car garages on some of the lots in the project. Mr. Royce said he would like to give the suggestion some thought. He said the petitioner's marketing professionals have said people prefer a two -car garages. Several Commission 4 • members said they preferred a two -car garage with each unit. Ms. Diane Carlino and Mr. Lioce said they would prefer palm trees for the proposed street tree. Chairman Ornstein said the consensus of the Commission seems to be in favor of palm street trees. Mr. Alan Strassler said he was impressed by the changes to the plan. He said the project does not feel as claustrophobic. Mr. James Leatherman said he liked the project a lot better. Mr. Sabatello said he liked the change to the average side setbacks. He said he would like the landscape buffer to extend around the corner on the north side of Parcel 18. He said the east landscape buffer should be installed prior to the construction of the eastern road. Mr. Sabatello said he would like the petitioner to come back with a better color board presentation. He added that he preferred two -car garages for the units. He said the petitioner has made a strong improvement to its project. Ms. Carlino said she was extremely pleased with the changes to the plan. Mr. Joseph Hamzy said he was comfortable with the project. Mr. Lioce said the petitioner should be allowed to waive the side - loaded garage on Lots 39 and 40 in order to allow a "straighter" alignment of the duplex. Mr. Skokowski said he preferred the current alignment of the duplex because it allows a better lake view. Chairman Ornstein said the petitioner has made great improvements to the plan. He suggested the petitioner take another look at the staggering of the setbacks for duplexes on lots 67 through 76. At the request of the petitioner, the Commission was polled and the Commissioners 5 indicated that they were satisfied with the setback staggering proposed by the petitioner. Mr. Royce requested that this petition move forward to City Council with a recommendation from the Planning and Zoning Commission. Chairman Ornstein said he would like the petitioner to come back before the Commission with revised plans which contain all the conditions of approval. Mr. Lioce said he would be comfortable with staff ensuring that the petitioner's revised plans contain all the requested information and conditions. The majority of the Commission agreed that the petition should move forward to City Council. Motion Mr. Lioce made a motion to approve the above- referenced petition with the following conditions: 1. Prior to the issuance of the first Building Permit, the petitioner shall furnish the 0 Building Official with a copy of a Permit issued by Northern Palm Beach County • Water Control District and approved by the City Engineer. 2. Prior to the issuance of the first Building Permit, the Lighting Plan shall be reviewed and approved by the Police Department. 3. PCD Buffer C (2,000 L.F.) along the PCD property line to the south of this PUD shall be installed no less than thirty (30) days prior to the issuance of the first residential structure permit in accordance with the Planned Community District condition. 4. The "street trees" shall be installed at the same time as lot landscaping is installed. 5. The perimeter buffer landscaping along BallenIsles Drive from unit 59 at the south Z • to unit 16 at the north, shall be installed, prior to the issuance of the first certificate of occupancy for any dwelling unit in Parcel 18. The perimeter buffer landscaping along the east side of parcel 18 shall be installed prior to the issuance of a certificate of occupancy for any dwelling unit on lots 13 through 34 or lots 91 through 100 or the construction of the east road, whichever occurs first. Cut -de -sacs planting shall occur simultaneously with the planting of adjacent perimeter buffers. 6. All screen enclosures shall provide a screen door access accessible from the street. 7. The 6 -foot high wall along the non -zero lot lines shall extend to the rear of the adjacent screen enclosures. 8. The petitioner shall return to the City for review and approval of the location and elevation of the entry signage. 9. No adjacent duplex buildings shall be painted the same color. 10. A minimum of 35 units (35 %) shall be constructed with a side- loaded garages. 11. No more than two adjacent duplex building elevations shall have the same front elevation. 12. No more than five (5) adjacent front loaded garages shall be permitted. 13. A hedge shall be provided around all unit screened enclosures except the side facing the non -zero property line wall. Where the distance between the screened enclosure and the non -zero property line wall is T -0" or greater, the hedge shall be extended around the entire screened enclosure. A hedge shall always be provided along the zero property line wall and the non -zero property line wall. 14. The landscape and site plans shall be revised to reflect a stabilized subgrade for VA • emergency vehicle access through the open space located south of the project entrance. 15. The emergency access at the cul -de -sac shall be eliminated. The perimeter landscaping and wall shall be extend to cover the former emergency access. 16. The building setbacks shall be revised on the site plan to reflect the January 26, 1993 setback chart presented at the January 26, 1993 Planning and Zoning Commission meeting. 17. The Individual Lot Front Setbacks Chart on the site plan shall be revised to reflect the accurate setbacks. 18. The petitioner shall provide a presentation display for City Council depicting all the proposed colors for the building walls, roofs and shutters. The building elevation plans shall be revised to accurately depict the colors proposed. 19. Palm trees shall be used as the "street trees" for the project. Mr. Hamzy seconded the motion. The motion was approved with a 6 -1 vote, with Chairman Ornstein opposing. ADJOURNMENT There being nothing further to come before the Commission, the meeting was adjourned at 9:17 P.M.
