HomeMy WebLinkAboutMinutes P&Z 062293r CITY OF PALM BEACH GARDENS • PLANNING AND ZONING COMMISSION JUNE 22, 1993 MINUTES The Regular Meeting of the Planning and Zoning Commission of the City of Palm Beach Gardens, Florida, was called to order by Chairman Jeffrey Ornstein at 7:30 P.M. in the Assembly Room at the Municipal Complex, 10500 North Military Trail, Palm Beach Gardens, Florida, and opened with the Pledge of Allegiance to the Flag. The roll was called by the Secretary and present were: Chairman Jeffrey Ornstein; Vice Chairman Joseph Hamzy; Members Carl Sabatello, Domenick Lioce (arrived at 7:35 p.m.), and Daniel Honig; and Alternate Member Diane Carlino. Absent were Members Alan Strassler and Phillip Lyddon. 0 ANNOUNCEMENTS: Chairman Ornstein announced the resignation of Mr. Dan Shalloway from the Planning and Zoning Commission effective June 4, 1993. Chairman Ornstein also announced Council Liaison to the Planning and Zoning Commission, Mr. David Clark, was on vacation and would, therefore, be absent from this meeting. ITEMS BY PLANNING AND ZONING DIRECTOR: Mr. Richard Walton, Director, Planning and Zoning Department, announced the final PGA Boulevard Design Guidelines would be presented at the July 13, 1993, Planning and Zoning Commission meeting. • Minutes - Planning & Zoning Commission Meeting 6/22/93 Page 2 is APPROVAL OF MINUTES FOR MAY 25 1993 AND JUNE 81199.3- Mr. Joseph Hamzy made a motion for the approval of the minutes of the May 25, 1993. Mr. Carl Sabatello seconded the motion. The motion was approved by a 5 -0 vote, with Ms. Diane Carlino abstaining. Mr. Carl Sabatello made a motion for the approval of the minutes of the June 8, 1993, Planning and Zoning Commission meeting. Ms. Diane Carlino seconded the motion. The motion was approved with a 5 -0 vote, with Mr. Jeffrey Ornstein abstaining. SITE PLAN AND APPEARANCE REVIEW COMMITTEE WORKSHOP: Petition SP- 93 -03, by Keith Pelan, agent for The Home Depot, Inc. and Crossroads At Northlake Associates, for site plan approval to amend the Site Plan for the • Crossroad at Northlake shopping center by enlarging the Home Depot building by 21,385 square feet, Home Depot Garden Center by 17,000 square feet and decreasing the shopping center by 21,600 square feet. The Crossroad at Northlake shopping center is located at the southeast corner Northlake Boulevard and Interstate 95. (19- 42S -43E). Mr. Marty Minor, Planning Technician, reviewed the June 17, 1993, staff report for the above - referenced project and showed slides of present outside storage which is in violation of the Code. In response to a question from Mr. Lioce, Mr. Lee Worsham of Home Depot stated there was an outdoor storage problem at the present time. He stated, however, the size of the store will be increased by 25 %, and there will be wider aisles and more interior storage. He also stated nothing will be stored outside except for a short time between deliveries and when the items are moved into the store. Discussion ensued concerning the outdoor storage is problem. Minutes - Planning & Zoning Commission Meeting 6/22/93 Page 3 The architect for Home Depot displayed a proposed floor plan and responded to questions from the Commissioners concerning the plastic domes over the garden center and the expanded storage area. Mr. Ken Stevens, Real Estate Manager for Home Depot, stated there will be perhaps a delay of one -half to one hour between the time the merchandise is delivered and the time it is moved inside the store. Responding to a comment from Mr. Ornstein regarding loading and unloading for commercial customers at the back, Mr. Stevens stated moving commercial loading to the rear of the store would not work for them since the amount of commercial customers was minimal. He also stated it would be in direct conflict with where they load lumber for the • store. Mr. Honig stated it was unreasonable to assume the area would ever be clear in the back of the store since he believed trucks would be unloading most of time. Mr. Honig expressed his concern about the visual buffer between the back of the store, particularly the back of the garden center, and the homes that exist behind the store. Discussion ensued concerning a buffer between the back of the store and the adjacent homes, and Mr. Worsham offered to provide a fence as a buffer on the south side of the retention pond. In response to a question from Mr. Ornstein concerning disposal of the pallets, the petitioner responded this was a housekeeping problem, and they would do whatever was necessary to remove them from sight. • Mr. Lioce stated they should be concerned not only with a visual buffer for the houses at Minutes - Planning & Zoning Commission Meeting 6/22/93 Page 4 the rear of the store but should also be concerned with the entire strip and whatever commercial development might occur in the future. Mr. Ornstein asked that an aerial view of the property be provided at the next meeting and suggested that the Planning and Zoning Commissioners personally inspect the site. The petitioner stated that any parking spaces which were substandard (less than 10'x20') will be double - striped. The petitioner stated they would provide a cart corral similar to the one at Toys 'R Us consistent with the facade of their building, and they stated a detail would be provided. They also stated they would keep the carts out of the parking spaces by policing the parking lot a couple of times an hour. is Mr. Sabatello stated a more definite statement is needed as to what will be done if the corrals are full. Mr. Worsham agreed to meet with staff to discuss language which would address this problem. Discussion ensued concerning the nursery sign which projected above the wall, and Mr. Worsham stated a drawing would be provided showing the sign relocated below the roof line. Discussion transpired concerning the loading zone in front of the store. Mr. Joe Pollock of Kimley Horn Consulting Engineers explained what is proposed for the loading zone. Discussion ensued concerning the pipe rail fencing in the rear loading dock area, and it was the consensus of the Commission that the pipe fencing should be replaced with a solid wall consistent with the structure of the building. • Following a question from Mr. Sabatello, Mr. Worsham stated the fencing /screening around • Minutes - Planning & Zoning Commission Meeting 6/22/93 Page 5 the dumpster area will be replaced or repaired with a board -on -board fence. Mr. Hamzy stated the landscape plan should be clarified where a hedge is shown with no breaks in front of the three doors on the east side of the building. Mr. Hamzy asked if there would be any change to the water retention area and requested this be shown on existing site plans to indicate what will be modified. Mr. Worsham responded that "as- built" plans had been previously submitted. Regarding the northeast corner, Mr. Hamzy suggested that a landscaped island of trees be introduced instead of new parking spaces. Mr. Hamzy was not pleased with the canopy which would be visible from Sandtree Drive and believed it should be screened. is Mr. Hamzy also suggested that tall palm trees be placed toward the west end of the building. Mr. Lioce stated he preferred the loading zone area on the previous site plan. Mr. Sabatello agreed with Mr. Lioce, and he was in favor of the "island" which afforded a better parking situation and was safer for pedestrians. He stated it was important to add taller landscaping to soften the building. Mr. Sabatello stated a loading zone should be designed north of the proposed Garden Center. Mr. Hamzy indicated he was concerned about a divided loading zone being dangerous from a pedestrian standpoint. It was the consensus of the Commission that they preferred the separated two one -way lanes • in the loading zone. Mr. Walton pointed out that the City's Engineer, David Getz, had Minutes - Planning & Zoning Commission Meeting 6/22/93 Page 6 • concerns with the previously submitted plan. Following discussion, it was the consensus of the Commission that the revised site plan should indicate the closure of the access drive on the west side of the proposed expanded garden center. The closed area shall be landscaped with a stabilized base, which shall allow for access by Fire Department vehicles. It was the consensus of the Commission that, if, acceptable by the City Engineer and the City Fire Department, the site plan should be revised to show a loading zone featuring landscaped dividing islands. If this loading zone area is not acceptable to staff, the petitioner shall indicate the 12 -foot wide loading zone. With the 12 -foot wide loading zone, the main wall- mounted sign should be centered on the face of the building, additional is landscaping shall be added to the front of the building and to the parking lot. PLANNING AND ZONING COMMISSION WORKSHOP: Petition Z- 92 -04, by Scott Bennewitz, agent for M/I Homes, Contract Purchaser, to rezone a 56 -acre site from the Palm Beach County zoning designation of AR, Agricultural Residential to the city's designation of PUD, Planned Unit Development and site plan approval for the construction of 185 single - family detached and zero lot -line residential homes. This site is located a quarter of a mile north of PGA Boulevard on the east side of Central Boulevard (2- 42S -42E). Mr. Domenick Lioce stated he would not participate in the discussion of this petition because of a conflict of interest. He left the meeting at this point and did not return. Mr. Marty Minor reviewed the June 17, 1993, staff report for the above - referenced petition. Ms. Diane Carlino asked for clarification of the Parkway issue. Mr. Rich Walton responded that the Comprehensive Plan has a policy which says the City Council has to establish at • least a portion of the Greenways Program prior to any development orders being adopted. • Minutes - Planning & Zoning Commission Meeting 6/22/93 Page 7 Attorney Marty Perry addressed the Commission on behalf of M/I Homes and introduced Mr. Scott Bennewitz of Gee & Jenson Engineers, who gave a synopsis of the status of the project. He pointed out the changes in the site plan and the changes in the preserve acreage, and he also stated the development would be gated. Mr. Brett Nein, Landscape Architect, Gee and Jenson, summarized the status of the project as to what vegetation would be removed or added. He stated approximately 2,100 trees presently exist on the site; 700 would be saved; and 1,400 would be removed to allow for the development. He also stated approximately 1,800 new trees would be planted on individual lots, and 230 trees would be planted on miscellaneous areas, including the recreation center, entry features, and the Shady Lakes buffer. He also stated the Central Is Boulevard landscaping would have 117 trees for a net gain over the existing total of 1,446 trees. Mr. Chuck Sharman, Architect for M/I Homes, described the streetscape for the project and displayed typical elevations of the homes. He stated the size of the single - family homes would range from 1,900 s.f. to 2,900 +, and the zero -lot -line homes would be 1,415 s.f. to 2,100 s.f. He also stated there were 50 possible combinations of colors to choose from. Mr. Ornstein asked if the petitioner will provide assurance /guidelines which will prevent like home models /colors from being located side by side, and it was the consensus of the Commission that this restriction on colors and elevations should be noted on the site plan. Mr. Ornstein requested photographs be provided showing similar homes previously built by M/I Homes. • Discussion ensued concerning the landscaping and types of homes built elsewhere by M/I • Minutes - Planning & Zoning Commission Meeting 6/22/93 Page S Homes. Mr. Ornstein asked if it were possible, using computers, to locate every existing tree on every lot. Mr. Perry stated that was an unreasonable request, and Ms. Carlino stated it would be very expensive to do that and it was an unreasonable request. Mr. Perry also stated aerials had been provided showing where the trees were located and had overlaid a mylar of the site plan onto the aerial. Discussion ensued concerning the landscaping. Mr. Hamzy stated a better effort should be made to increase the number of trees to be saved, especially the small pines and oaks. It was the consensus of the Commission that a program should be developed for banking and relocating existing trees such as small pines and oaks to the backyards to obtain variety. • Discussion ensued concerning the preserve area and the relocation of the gopher tortoises. Mr. Perry gave an overview of their efforts to date and stated M/I Homes has shown a willingness to work with almost any suggestion. He stated they have been working with the City of Palm Beach Gardens since June of 1992 and all they want is some direction and the ability to go forward. He also stated moving 700 -1000 trees would be very expensive, but the suggestion would be considered. Mr. Jim Schnelle, Environmental Consultant for the City of Palm Beach Gardens, stated tortoises have to be tested for respiratory disease prior to being relocated. He also stated there are three options concerning gopher tortoises: preserve the burrows in place exactly where they are located, relocate them on the site, or relocate off -site. Mr. Schnelle further stated nothing could be accomplished until a permit application had been filed for review. • Further discussion ensued concerning the gopher tortoises, and Mr. Honig suggested that • Minutes - Planning & Zoning Commission Meeting 6/22/93 Page, 9 consideration should be given to relocating the single gopher tortoise to the same area as the others which would allow the entire project to be moved to the west 30 or 40 feet. Discussion ensued concerning moving part of the upland preserve to the buffer area, thereby adding 10 feet to the buffer area. Mr. Walton stated that from the beginning Staff had suggested the highest and best area where most of the canopy exists be preserved, but that did not fit the proposed site plan. It was the consensus of the Commission that the petitioner should provide a cross - section of the buffer area showing distances, berming, etc. Mr. Honig stated he was troubled by the fact that more concern was being shown for the preservation of a few tortoises and trees than the preservation of the lifestyle of the people • who live on the adjacent property. He stated he would encourage M/I Homes and Planning and Zoning Staff to try to find a way to move the entire development up in order to create the buffer area desired by the property owners in the adjacent community. Mr. Ornstein also stated he was troubled by the fact that the Planning & Zoning Commission was placing trees and tortoises above people. Mr. Sabatello mentioned several points which he believed should be addressed: He stated Mr. Strassler had suggested the lake should be more visible to the whole community by shifting Lot 53. He questioned whether the tree replacement program proposed fell within the required formula for the removal and replacement of trees. Mr. Walton said this had not been reviewed since tree preservation requirements were usually met • through the 25% of preserved area set aside. Mr. Scott Bennewitz responded they • Minutes - Planning & Zoning Commission Meeting 6/22/93 Page 10 would be saving 33% of the trees on site and were, therefore, well above the requirements. In response to a question from Mr. Sabatello concerning the median landscaping on Central Boulevard, Mr. Perry stated the developer would landscape the median, but the ultimate maintenance would be the responsibility of the homeowners' association. Mr. Sabatello questioned the color of the railing around the perimeter, and the petitioner confirmed it was a dark brown color. Mr. Sabatello asked for clarification of the height of the homes, and Mr. Bennewitz stated the homes were about 22 feet in height. Mr. Sabatello stated he did not like some of the combination of colors for the homes, • and Mr. Ornstein stated the Commission needed to see the notebook of colors which had been submitted previously. Mr. Sabatello asked if there was a plan of restrictions concerning the colors and adjacent units differing, and Mr. Ornstein stated a note should be made on the site plan as to the restrictions. Mr. Sabatello asked if a note could be included which stated the ridges would be turned down to enhance the view of the homes from the rear. Mr. Sabatello stated if there is a pool or screen enclosure, a landscape plan needed to be provided for them. Mr. Sabatello stated he would like the elevations of the hips turned down along Central Boulevard as well. • - Mr. Sabatello questioned the drainage proposed along the 10 -foot strip from Lots 52- • Minutes - Planning & Zoning Commission Meeting 6/22/93 Page 11 36 and believed this should be reviewed further. Mr. Ornstein reviewed the comments made by Mr. Honig concerning complying with regulations, but also keeping the people in mind. Mr. Perry requested that the petition be scheduled for a public hearing. He stated they had made every effort to comply with the ordinances and believed they were entitled to a hearing. It was the consensus of the Commission that the project was not ready for a hearing. However, Mr. Ornstein stated the State Statutes would be reviewed to see if they were entitled to a public hearing. PUBLIC HEARING: Regarding Revisions to the Natural Resources and Environmentally Significant Lands Code (Ordinance 7, 1993). • Ms. Kim Glas, Planner, reviewed the procedure for the revisions to the ordinance. Chairman Ornstein opened the Public Hearing. Upon hearing no public comments, Chairman Ornstein closed the public hearing. Mr. Carl Sabatello made a motion to recommend approval to the City Council of the above- referenced petition with no conditions. The motion was seconded by Ms. Diane Carlino. The motion was unanimously approved by a 5 -0 vote, with Mr. Domenick Lioce having left the meeting prior to this item being heard. PUBLIC HEARING: Petition TXT- 93 -01, by the City of Palm Beach Gardens, to amend the City of Palm Beach Gardens' Zoning Code, Section 159.057 Churches, and all other applicable sections, to allow churches and other houses of worship as a conditional use in all zoning districts. Mr. Marty Minor reviewed the staff report concerning this petition. 40 Chairman Ornstein opened the Public Hearing. Ms. Diane Carlino made a motion to recommend approval to the City Council of the above- referenced petition with no conditions. The motion was seconded by Mr. Carl Sabatello. The motion was unanimously approved with a 5 -0 vote, with Mr. Domenick Lioce having left the meeting prior to this item being heard. PUBLIC HEARING: Petition TXT- 93 -02, by the City of Palm Beach Gardens, to amend the City of Palm Beach Gardens' Zoning Code, Chapter 159, Zoning Code, to allow security apartments as a conditional use in all zoning districts which allow warehouse and storage establishments. Mr. Marty Minor reviewed the staff report dated June 17, 1993, concerning this petition. Discussion ensued concerning the size of the apartment. • Mr. Joseph Hamzy stated he was opposed to the petition since it should not be limited to warehouse districts, but should be in all zoning areas. Chairman Ornstein opened the Public Hearing. Hearing no comments, Chairman Ornstein closed the public hearing. Mr. Carl Sabatello made a motion to recommend approval to the City Council of the above- referenced petition with one condition: The maximum square footage of the apartment will be 1,200 square feet. The motion was seconded by Ms. Diane Carlino. The motion was approved by a 4 -1 vote. Mr. Hamzy voted "NO" since he believed residential should be allowed in all zoning districts. • NEW BUSINESS • Minutes - Planning & Zoning Commission Meeting 6/22/93 Page 13 LDR's: Mr. Ornstein stated the City Council officially sent back to staff and the Planning and Zoning Commission the Land Development Regulations to rewrite the administrative section of the LDR's. He stated it would be possible to recommend that "residential" be allowed in all zoning districts in the LDR's. Other: Mr. Honig suggested that the landscape plan proposed for PGA Boulevard be applied to Donald Ross Road as well.
