HomeMy WebLinkAboutMinutes P&Z 072793CITY OF PALM BEACH GARDENS PLANNING AND ZONING COMMISSION JULY 27, 1993 MINUTES The Regular Meeting of the Planning and Zoning Commission of the City of Palm Beach Gardens, Florida, was called to order by Chairman Jeffrey Ornstein at 7:30 P.M. in the Auditorium of the Recreation Center, 4404 Burns Road, Palm Beach Gardens, Florida. The roll was called by the Secretary and present were: Chairman Jeffrey Ornstein, Vice Chairman Joseph Hamzy; Members Alan Strassler, Carl Sabatello, and Phillip Lyddon; Alternate Member Diane Carlino; and City Attorney, William Brant. Absent were Members Domenick Lioce and Daniel Honig. Chairman Ornstein announced Mr. Domenick Lioce was absent due to the death of his father, and City Council Liaison David Clark was absent due to his attendance at a City • Council Budget Workshop. Items by Planning and Zoning Director: Mr. Richard Walton, Director, Planning and Zoning Department, asked the Commission for direction regarding the agenda for the upcoming August 10, 1993, Planning and Zoning Commission meeting. He stated the agenda would be quite lengthy, and Mr. Ornstein said the items should be considered according to the order they were received by staff. SITE PLAN AND APPEARANCE REVIEW COMMITTEE RECOMMENDATION TO CITY COUNCIL: Petition SP- 93 -03, by Keith Pelan, agent for The Home Depot, Inc. and Crossroads At Northlake Associates, for site plan approval to amend the Site Plan for the Crossroad at Northlake shopping center by enlarging the Home Depot building by 21,385 square feet, Home Depot Garden Center by 17,000 square feet and decreasing the shopping center by 21,600 square feet. The Crossroad at Northlake shopping center is located at the southeast corner Northlake Boulevard and Interstate 95. (19 -42S- 43E). 0/- Minutes - Planning & Zoning Commission Meeting July 27, 1993 Mr. Bristol Ellington, Planner, reviewed the staff report of July 22, 1993. Page 2 Mr. Ornstein asked if it were possible to have language stating that unloading of merchandise could only occur in designated areas shown on the site plan. Discussion ensued concerning the unloading of merchandise with Mr. Ornstein stating he believed 12 hours was too long for the merchandise to remain outside. Mr. Sabatello stated unloading should be confined to the designated areas. Mr. Ornstein stated nothing should be left in staging areas overnight. Mr. Lee Worsham stated there would be no outside storage of lumber or other materials and stated they were willing to comply with any conditions the Commission wished to • impose. Mr. Keith Pelan displayed a drawing showing the difference between the existing and proposed elevations which showed the sign as being centered and also showed more vegetation at the lumber loading area. He stated they have no problem with the staff recommendations being incorporated into the conditions. Mr. Ornstein stated he would like the following recommendation to be included in the conditions: "3. Outdoor storage shall be prohibited as per Section 159.086(A)(14)(a) of the City's Zoning Code. Staging shall be allowed in areas as shown on the approved Site Plan. There shall be no overnight storage and /or staging on the property past the time of closing." The petitioner stated they would need a couple of hours past the time of closing, until 11:00 p.m., in order to bring the materials inside. 0 Minutes - Planning & Zoning Commission Meeting July 27, 1993 Discussion ensued concerning the pallet storage area and the six-foot high fence. Mr. Strassler stated he believed the fence should be concrete block. Page 3 Mr. Sabatello stated the concrete block pallet storage area on the southwest should be enlarged so that it extends all the way to the wood fence and be no higher than six feet. He also stated it should be stuccoed and painted to match the rest of the building. Mr. Ornstein pointed out that the fire lane should be extended all the way to the pallet storage area. Mr. Hamzy stated the three islands located at the handicapped spaces should be enlarged by moving one handicapped space to the north which would result in a larger landscaped • area. Mr. Hamzy noted he was not comfortable with the two strips of 9 x 18 parking spaces which did not abut landscaped areas. Mr. Ornstein suggested the elimination of six parking spaces in order to achieve more landscaping in the parking area, and Mr. Walton responded the petitioner is "right at" the required number of parking spaces. Mr. Hamzy stated he was concerned with high - volume parking areas and consideration should be given to removing six parking spaces and relocating them to the back of the store. Mr. Hamzy also stated the cart corral areas, where possible, should be against the diamond - shaped areas rather than against curbed areas. Mr. Hamzy mentioned the discrepancy • between the landscaping plan detail and the landscaping plan notes about the 8 -foot fence. Minutes - Planning & Zoning Commission Meeting • July 27, 1993 Page 4 Mr. Hamzy stated the wood fence detail should also be revised to 6 feet. Regarding the fencing around the retention area, Mr. Hamzy asked for confirmation that the South Florida Water Management District had reviewed the plan and that there was room to erect a fence around the pond. Mr. Hamzy questioned the number of doors on the east side of the building and was told by the petitioner that no additional doors would be added. Mr. Hamzy also asked that the areca palm be removed from the landscape plan since it doesn't seem to fit. Mr. Ornstein asked that there be restriping on Sandtree Drive. Mr. Sabatello stated the cart corrals should be moved to the diamond areas and the storage • racks in the nursery should not extend above the wall. Mr. Ornstein stated there were some problems with the site plan which needed to be corrected including extending the fire lane lines and correcting the cart corral locations. Mr. Ornstein pointed out there had been concern at the last meeting about the landscape island in the front of the store. After conferring with his client, Mr. Worsham stated the petitioner agreed to add additional landscaping and to enlarge the three islands in front of the entrance which would require adding six additional parking spaces elsewhere in the project. Mr. Ornstein questioned the 18 -foot parking spaces that did not have landscaping between them, and the petitioner stated that they do meet the Code. • Mr. Hamzy suggested that, instead of having the petitioner return to the Planning and Minutes - Planning & Zoning Commission Meeting • July 27, 1993 Page 5 Zoning Commission, staff be given the authority to review the changes required prior to the petition going to City Council. Discussion ensued concerning the landscape islands and the 20 -foot parking spaces. The Commission decided Mr. Hamzy would mark up a plan to show staff the changes required. Mr. Sabatello reiterated the recommendations that the pallet storage will be restricted to that area which will be enclosed by a concrete block wall and the fences will be six feet high rather than eight feet, and there would be no outside storage. MOTION: • Mr. Carl Sabatello made a motion to recommend approval of recommendations as set forth by staff of the petition to City Council with the following additional conditions: 1. The outdoor pallet storage area will have a 6 -foot high CBS wall covered with stucco painted to match the building, and the gate to the outdoor pallet storage area will be chain link fence with slats. These items will be shown on the detail plans and approved by staff prior to going to City Council. 2. One parking space will be deleted, and one cart corral added. All corrals will have a steel outside corner. The cart corrals will be moved to the diamond- shaped areas, and the plan details will be revised to reflect this change. 3. The staging area on the plans will be used for temporary staging of delivered materials (in those designated areas only). All staging areas will be cleared Minutes - Planning & Zoning Commission Meeting • July 27, 1993 Page 6 of all materials within two hours after store closing or no later than 11:00 p.m. 4. Outdoor storage racks in the Garden Center will not be visible above the top of the walls. 5. As per the detail site plan, the three islands will be enlarged, and the spaces that are deleted will be added back into the site plan per the petitioner at a later date and will be approved -by staff prior to submission to City Council. 6. A "marked -up" site plan will be reviewed and approved by Planning & Zoning staff prior to submission to City Council. 7. The existing landscaped islands will be reduced by 4 feet, and additional space will be added to increase the 18 foot parking spaces to 20 foot spaces. The motion was seconded by Ms. Diane Carlino and was approved by a 5 to 1 vote, with Chairman Jeffrey Ornstein voting 'opposed ". PLANNING AND ZONING COMMISSION WORKSHOP: Petition Z- 92 -03, by Timothy Hernandez, agent for Pulte Homes, Contract Purchaser, to rezone a 80.13 -acre site from the Palm Beach County zoning designation of AR, Agricultural Residential to the City's designation of PUD, Planned Unit Development and site plan approval for the construction of 184 single - family detached and zero lot -line residential homes. This site is located approximately 1,350 feet west of Prosperity Farms Road, immediately west of Crystal Point residential subdivision. (29- 41S -43E) Mr. Bristol Ellington, Planner, reviewed the staff report dated July 22, 1993. He added that according to a letter from Mr. Charlie Walker, the County had taken the position that they would like Hood Road to take a southern alignment rather than a northern alignment which would link with the 123 foot right of way. Mr. Ellington further explained it was indicated Minutes - Planning & Zoning Commission Meeting Page 7 • July 27, 1993 is • that Frenchman's Creek would like the opportunity to have a future connection for emergency access for residents at the southeast corner of their site which is the terminus for this roadway. Discussion ensued concerning the wooden bridge on Prosperity Farms Road and the maximum weight it could sustain as related to emergency /fire vehicles. Mr. Ornstein suggested that Engineer David Getz determine the engineering formula for the weight bridges can hold. Mr. Ornstein also stated the Fire Chief must be willing to use the bridge before he could approve the project. Mr. Sabatello stated letters from the City Engineer, City Attorney, Fire Chief, and staff should be included as part of this petition. Mr. Ornstein stated he was uncomfortable approving a project if the Fire Department could not meet the level of service under the Comp Plan. Mr. Ornstein further stated the City Engineer should meet with City Attorney Brant and the Fire Chief to determine what needs should occur next and to "come up with something ", such as reinforcing the bridge so the Fire Department would be able to meet its response time of 5 minutes. The petitioner provided slides of homes which had been built in The Preserve and displayed samples of roof tiles which would be used. Discussion ensued concerning the elevations of the homes, and concern was expressed about the side walls of some of the homes being "blank" and without adequate landscaping. Mr. Ornstein stated specifications for the roof tiles should be included in the application. Minutes - Planning & Zoning Commission Meeting July 27, 1993 Page 8 Mr. Bob Bentz displayed and explained the landscape overlay and discussion ensued. Mr. Hamzy asked that as many trees as possible be saved or relocated, and Mr. Hernandez responded all trees will be evaluated as to which can be saved and stated under their program they would be able to save a remarkable number of trees. Mr. Ornstein stated no excess trees should be removed since he is concerned about an entire area being cleared, and the petitioner agreed to this condition. Mr. Hernandez explained it is not always possible to locate dissimilar homes next to each other because of the preference of the buyer. Ms. Carlino questioned the "T' turn around. Mr. Hernandez stated Engineer David Getz and Waste Management had no concerns with that, and this was confirmed by . Mr Ellington g who stated the Fire Department and Waste Management had "signed off' on the "T' turn around. Ms. Carlino questioned the signage, and Mr. Hernandez displayed drawings of the proposed entry way signs. Mr. Hamzy stated he liked the site plan and the modifications. However, he stated was still concerned about the two -story units and the side elevations of the homes being bare. Mr. Hamzy requested that photographs be provided of the sides of the two -story buildings. He also stated more variety was needed in the front and side elevations. He further stated there should be some breaks in the elevations, and he believed adding windows to the blank • side walls would be helpful. Minutes - Planning & Zoning Commission Meeting • July 27, 1993 Page 9 Mr. Ornstein questioned if all common areas would be irrigated and maintained, and Mr. Hernandez responded that would be in conflict with all their permits from the various agencies and that the wetlands would not, of course, be irrigated. Mr. Sabatello asked for an explanation of the statement that the wildlife corridor would be maintained by the Homeowners Association. A representative from Pulte Homes stated the wildlife corridor will be maintained by removing all exotic plants every year and that a management plan would be implemented in three to five years for maintaining all natural areas. Mr. Sabatello asked if there was a way to make the buffered area which is about 20 feet off the curb edge more aesthetic and controlled which the Homeowners Association • could maintain. He asked that a green strip in front of the preserve area adjacent to the sidewalk be identified on the plans. Mr. Hernandez stated the swale area which is not paved will be maintained and that the area behind the sidewalk would be natural. He stated their objective was to maintain a natural look. He further stated there is a management plan which had been approved by Jim Schnelle, Environmental Consultant, and had been submitted to all necessary agencies who would tell them what they could do. Concerning the setbacks, Mr. Sabatello asked if there was a way to obtain more privacy between the homes. As an example, he referred to lots 124, 125, and 126 abutting the side yard of lot 123. Mr. Hernandez suggested making it 5 feet. Mr. Strassler stated more landscaping should be used to cover any blank walls and have IS more landscaping along the streets since the buildings appear to be "chaotic ". Mr. Hernandez asked for a public hearing at the next meeting, and Mr. Ornstein stated staff should proceed with advertising for a public hearing at the second meeting in August. Mr. Sabatello asked if everyone was comfortable with the single family homes all having grey roofs. Mr. Ornstein stated he had a problem with the zero lot line homes being the same color, and discussion ensued concerning the colors.
