HomeMy WebLinkAboutMinutes Council 021392CITY COUNCIL SPECIAL MEETING CITY OF PALM BEACH GARDENS FEBRUARY 13, 199 ,)� V The Special Meeting of the City Council of the City of Palm Beach Gardens, Florida, convened at 7:30 P.M. in the Assembly Room at the Municipal Complex, 10500 North Military Trail, Palm Beach Gardens, Florida. ROLL CALL Present were: Mayor Martino, Councilman Kiselewski, Councilwoman Monroe and Councilman Russo. Vice Mayor Aldred was not in attendance. CONCURRENCY CEMENT SYSTEM Mr. Lennart Lindahl, City Engineer, addressed the City Council stating the definitions used in the Concurren- cy Management System were taken from Statutes provided by the City Attorney. Mr. Lindahl offered clarifi- cation of the terms "development permit" and "develop- ment order" explaining that a development permit is associated with a request and a process. A "develop- ment order" pertains to the granting, denying or granting with conditions, of an application or devel- opment permit. Mr. Lindahl advised that a list of definitions have been created which are consistent throughout the entire Land development Regulations package, part of which is the Concurrency Management System. Mr. Lindahl stated the Concurrency Management draft is the result of composite work through Manatee and Palm 1 CITY COUNCIL SPECIAL MEETING, 2/13/92 Beach Counties, other municipalities, and the model developed by the Department of Community Affairs. After discussion by City Council and staff, the fol- lowing changes and /or comments were made: 1. Page 2, C. Adopted Levels of Service Shall Not Be Degraded, l.a., 4th line, replace "degrade" with "meet the ". 2. Page 2, C. Adopted Levels of Service Shall Not Be Degraded, 1.b., 2nd line, delete "the first" before "Development "; add a period after "Permit ", and strike "for a project ". 3. Page 2, D. Determination of Available Capacity, l.a., 2nd line, add "when" before "operating ". 4. Page 3, 2nd paragraph, 1st line, replace "an" with "a" and add "legally" before "enforceable" on the 2nd line. 5. Page 3, 2. Delete "That Number" from the sub- section title, to read "Subtracting From The Sum Of". 6. Page 4, Paragraph 2, 2nd line, replace "projected" with "adopted "; delete "no less than the adopted level of service." and replace with "not exceeded ". 7. Page 4, Paragraph 3, 2nd line, replace "projected" with "adopted "; delete "no less 2 CITY COUNCIL SPECIAL MEETING 2/13/92 than the adopted level of service." and replace with "not exceeded ". 8. Page 4, F. Burden of Showing Compliance by Developer, 2nd line, after "requirements shall be upon the ", strike "developer" and add "applicant for the development permit." 9. Page 5, Paragraph a., staff will review and correct grammar. 10. Page 5, Paragraph b., 3rd and 4th asterisks, delete "and outstanding Building Permits" after "Certificates of Occupancy" in both paragraphs. 11. Page 6, Paragraph d., second line, change "Section "H" to "Section I.H". 12. Page 6, Paragraph d., 2nd asterisk, 2nd line, delete "reserved" and add "subject to a concur- rency certification" after "capacity ". 13. Page 6, 2. Use of the Annual Report, 3rd line, after "purpose of" add "evaluating and "; delete "Development orders" after "issuing" and re- place with "Concurrency Certifications ". The City Engineer and staff will modify this section to include wording such as "recapture of capacity is also part of the evaluation process." 3 CITY COUNCIL SPECIAL MEETING, 2/13/92 14. Page 11, II. Concurrency Certification, Paragraph A., delete 2nd sentence under #3, and consider moving the 1st sentence under #3 to page 13. 15. Include "Vested" in definition section of Land Development Regulations. 16. Page 14, 3. Certificate of Conditional Con- currency Reservation, 5th line, delete "would" after "applicant" and add an "s" to "enter ". 17. Page 14, C. Approvals Not Requiring Concurrency Review, change "Review" to "Certification ". 18. Page 15, D. Approvals Requiring Concurrency Review, 1st line, replace "Permits" with "Order" after "Development ". 19. Page 16, A. Application Procedure, Paragraph 1., 2nd line, add "or conditional concurrency certification" after "Certification ". 20. Page 19, Paragraph 9., Reword to combine 1st and 2nd sentences. 21. Page 19, C. Completeness Review, 2nd line, change to read "The Department shall affix a date to the application. ", and on 4th line, City Engineer advised that consideration is being given to changing "fourteen (14) days" to "ten working days ". 4 CITY COUNCIL SPECIAL MEETING 2/13/92 22. Page 21, Paragraph e., staff will review and consider revisions. 23. Page 21, Paragraph f., City Engineer advised that revised language will be inserted. 24. Page 21, last paragraph, 3rd line, add "auto- matically, without City Council action" after "expire ", and replace "Exemption" with Con- currency". 25. Page 22, B. Planning and Zoning Department, reference only Departments, not individuals. 25. Page 22, A. Concurrency Summary Log, consider revision to include the date the notifica- tion was mailed. 27. Page 23, D. Concurrency Certificate Decisions, restructure Ist sentence. The City Council directed the City Attorney and City Engineer to prepare an ordinance for the Concurrency Management System, separate from the Land Development Regulations. COUNCILMAN KISELEWSKI Councilman Kiselewski reported that all billboards have been removed from PGA Boulevard. Councilman Kiselewski stated he will not be in attend- ante at the next meeting of the City Council, as he will be in Tallahassee to meet with the Department of 5 CITY COUNCIL SPECIAL MEETING, 2/13/92 Transportation to discuss the Intermodal Strategic Transportation Efficiency Act. City Engineer The City Engineer stated the implementation of the Concurrency Management System Ordinance will greatly impact the City's administration in terms of the computer hardware and software that will be needed to keep the required records, as well as new assignments and job descriptions for staff. Mayor Martino Mayor Martino congratulated and welcomed Councilwoman Monroe to another three -year term on the City Council, as she is unopposed in the upcoming election. ADJOURNMENT APPROVALS Mayor Martino introduced Jeannette Hobby, candidate for Group 2, and wished her luck with her election campaign.
