SPECIAL MEETING
CITY OF PALM BEACH GARDENS
JANUARY 9, 1992
The Special Meeting of the City Council of the City of
Palm Beach Gardens, Florida, was called to order by Mayor
Martino at 7:35 P.M., in the Assembly Room of the
Municipal Complex, 10500 North Military Trail, Palm Beach
Gardens, Florida; and opened with the Pledge of Allegiance
to the Flag.
ROLL CALL The Assistant Deputy City Clerk called the roll, and
present were Mayor Martino, Councilwoman Monroe and
Councilman Kiselewski. Councilman Russo arrived at 8:00
P.M. and Vice Mayor Aldred was not in attendance.
1D DEVELOPMENT
REGULATIONS Mayor Martino stated this evening's meeting was to review
the proposed Land Development Regulations and make any
changes the Council requested.
Councilman Kiselewski requested Staff prepare a written
analysis describing what the impact would be on the City
by adopting the Land Development Regulations.
There was a consensus of the Council to begin the review
process with the Zoning Regulations. After discussion by
the Council and Staff, the following changes were made:
1. Article II. Definitions: Add the definition of
"anatomical areas" and any other definitions that are
missing in the definition section.
2. Page II -15, Structure, 2nd line: After "ground ",

delete "or attachment" and insert "and attached ".
3. Page 111 -1, 3.3 Submission of Application , (3):
after "be", add "formally" and after "accepted,"
insert "as a complete application ".
4. Page III -1, 3.4 Application Review Procedure, (2),
after "review by the" insert "Development Review
Committee ".
5. Page III -3, 3.7 Rezoning Process, (A), after
"application" delete "was" and insert "must be".
6. Page III -3, 3.7 Rezoning Process, (C), after
"Commission" delete "may" and insert "shall ".
7. Flowchart "City of Palm Beach Gardens Standard
Rezoning Process ", Under "Application" box, after
"Council" delete "Public Hearing "; Under the
"Application" box, add another box to read "Council
Public Hearing Optional "; Under the "Ordinance" box,
insert "Council Public Hearing" above 112nd Reading ".
8. Flowchart "City of Palm Beach Gardens Planned
Community District (PCD) Approval Process ", Under
"DRC" box, after "Council" delete "Public Hearing ";
Under the "DRC" box, add another box to read "Council
Public Hearing Optional "; Under the "Ordinance" box,
add "Council Public Hearing" above 112nd Reading ".
9. Flowchart "City of Palm Beach Gardens Planned Unit
Development (PUD) Approval Process ", Under "Minor"
"Final Development Plan" box, delete "Public Hearing"

"Council Public Hearing Option "; Under the
"Ordinance" box, add "Council Public Hearing" above
112nd Reading ".
11. Page III -10, 3.8 Site Plan Review, Below "Site Plan
Review" give a specific explanation of what "Site
Plan Review" means.
12. Page III -10, 3.8 Site Plan Review, 2nd paragraph,
Delete 1st sentence and in 2nd sentence, change "the"
to "a" and after "change ", add "of use ".
13. Page III -16, (A), add "cumulative" after "the" and
decide on a maximum, i.e., square footage, instead of
"five (5) percent ".
14. Page III -16, (4), look at 115 percent" for
clarification.
15. Page III -16, (8), look at 115 percent" for
clarification.
16. Page III -17, 3.10 Effective Period of Approved Final
Plans, (1), change "one (1)" to "two (2)11; after
"submitted" and before "Construction" add "complete ";

add "complete" after "If" and before "Construction ".
17. Page III -17, 3.12 Conditional Use, staff to review
advertising for conditional uses.
18. Page III -19, (3), 2nd paragraph. Sentence beginning
"The Council shall have a right of action" should
become a new paragraph.
19. Page III -19, (3), 3rd paragraph, Strike "Building
Official" and insert "Code Enforcement ".
20. The City Manager, City Attorney, and Staff are to
work on conditional uses to maintain status quo
legally.
21. Add "Days" to definitions and define "calendar" and
"working" as it relates to days.
There was a consensus of the City Council to schedule a
Special Meeting every 2nd Thursday to review the Land
Development Regulations and schedule for any Regular
Meeting Agenda for which time would allow.
ADJOURNMENT There being no further business to discuss, the meeting
was adjourned at 10:25 P.M.
