WORKSHOP MEETING
CITY OF PALM BEACH GARDENS
JULY 23, 1992
The Workshop Meeting of the City Council of the City of Palm
Beach Gardens, Florida, was called to order at 7:45 P.M. by
Mayor Martino in the Assembly Room of the Municipal Complex,
10500 North Military Trail, Palm Beach Gardens, Florida.
Mayor Martino, Councilwoman Monroe and Councilman Kiselewski
were in attendance. Vice Mayor Russo and Councilman Aldred
were not in attendance, as they were out of town.
ITEMS FOR
SS ON
LAND DEVELOPMENT
REGULATIONS Rich Walton, Director of Planning and Zoning, addressed the
City Council stating the Council has workshopped Articles I,
II, III, IV and VII of the Land Development Regulations.
Staff has made the modifications from the previous workshops
and provided revised Articles to the Council this evening.
Mr. Walton stated Articles V, VI, VIII and IX are remaining
to be workshopped, as well as the revised permitted use
chart and parking for shopping centers.
ARTICLE VI Kahart M. Pinder, Transportation Planner with David Plummer
& Associates, Inc., addressed the City Council regarding a
draft copy of the Traffic Performance Standards. Mr. Pinder
stated his letter to Rich Walton, dated July 23, 1992, has
been provided to the Council this evening, summarizing the
differences between the existing City Traffic Performance
Standards Ordinance and the proposed standards. Mr. Pinder

�- stated the two items of significance which have changed are;
1) a peak hour standard has been added and this is
consistent with the Comprehensive Plan and a requirement
from DCA, and 2) insignificant projects have been deleted.
Mr. Pinder stated there was language which described
insignificant projects, if a project was under a certain
size, trip generation, no traffic study was required. With
concurrency that is no longer possible, everything has to be
brought forward for review, no matter how small.
Councilman Kiselewski suggested adding "State" in the
definition of "Performance security" on page 11 -7.
Per a consensus of the City Council, staff was directed to
look into a financial institution rating to incorporate into
"Performance Security ".
ARTICLE V Bristol Ellington, Planer, addressed the City Council
regarding the hand -out entitled "Comparison of Land
Development Regulations (LDR) and the City's Current Zoning
Code, starting on page 3 of the hand -out, II, Article V:
Supplementary Regulations.
In reference to #16., there was a consensus of the City
Council to proceed with the proposed language.
In reference to #17., there was a consensus of the City
Council to not modify "Home Occupation Licenses" in the
present Zoning Code. If staff finds something that needs to
be addressed by the Council, bring it back.
In reference to #18, there was a consensus of the City

�- Council to not modify "Automotive Service Stations ".
In reference to #19, "Food Mart ", there was a consensus of
the City Council to work the problem being experienced into
a reference of a conversion from a traditional automotive
service station as defined in 5.13 and take it to the
Northlake Blvd. situation.
In reference to #20, there was a consensus of the City
Council for Attorney Brant to provide a legal opinion re:
live aboards.
In reference to #211 there was a consensus of the City
Council to leave the new vehicle repair in residential
district section as proposed.
In reference to #231 there was a consensus of the City
Council to add a definition of "ridge" and state "the
satellite dish shall not be installed above the ridge of the
roof ".
Mr. Ellington stated definitions will be included in one
Chapter for Zoning. There will be definitions for
Subdivisions and Currency Management.
Council directed staff to look at merging all definitions
into one chapter and bring back recommendation as to why
staff either agrees or disagrees.
Article VII: Off - Street Parkinq and Loading
In reference to #25, there was a consensus of the Council
directing staff to further research overnight parking and
bring recommendation to Council.

-f In reference to #251 there was a consensus of the Council
for staff to research whether "directly" in the second
sentence could be deleted.
David Getz of Lindahl, Browning, Ferrari & Hellstrom,
addressed the City Council re: Memorandum dated June 5,
1992, regarding parking spaces for a shopping center. Mr.
Getz stated they have the overall requirement of 5 spaces
per 1,000 square feet. Mr. Getz stated the concern raised
by Council was when there is a shopping center that has an
inordinate amount of restaurant space and has a greater
parking requirement that 5 spaces per 1,000 square feet.
Mr. Getz stated they looked at the various uses within a
shopping center that could occur and the proposed code
requirement for each of those uses. Mr. Getz stated they
looked at dance, art & music studios; general business &
retail establishments; medical, dental, optical clinics &
offices; office, including business, commercial &
government; and personal service, banks, financial & lending
institutions, and notice there is an average parking
requirement of 4 spaces per 1,000 square feet. Whereas,
restaurants, grills, bars, similar dining, and /or drinking
establishments; and, theaters, could require more than 2
times that number of spaces. Mr. Getz stated they are
recommending having the developer calculate parking
requirements two ways, compare it and require the greater of
the way. 1) Look at each stand along use within the

shopping center as to parking requirements and compare with
2) overall requirement of 5 spaces per 1,000 square feet,
and require the greater of the two calculations.
There was a consensus of the City Council directing Mr. Getz
to change Theater parking requirement to:
1 sp / 3 seats + 1 sp / employee.
There was a consensus of the Council directing Mr. Getz
change Bar parking requirement to:
1 sp /bar stool, 2 sp /table + 1 sp /employee.
There was a consensus of the City Council for staff to
research and recommend when a General Business becomes a
Shopping Center.
Chart of Permitted Uses
There was a consensus of the City Council to change the
following permitted uses as follows:
Staff to clarify whether GROUP HOMES is residents of the
structure and whether it includes live -in staff.
Appliance Store - C - CN
Bakery, Wholesale - C - CG -1
Bicycle and /or Lawnmower Sales and Repair - C - CG -1
Club or Lounge - C - CG -1 and Not Allowed in M -1
Delicatessen - C - M -1 & M -1A
Add something in supplementary regulations to define
delicatessen in M -1
Delete Fruit and Produce, Wholesale
Add "card" to GIFT SHOP

There was a consensus of the City Council to adopt the Land
Development Review Fee Schedule by resolution.
There was a consensus of the City Council directing the City
Attorney to prepare an Ordinance for first reading.
ADJOURNMENT There being no further business to discuss, the meeting was
adjourned at 10:30 P.M.
