PLANNING AND ZONING COMMISSION
JANUARY 14, 1992
• MINUTES
The Regular Meeting of the Planning and Zoning Commission of the
City of Palm Beach Gardens, Florida, was called to order by
Chairman Jeffrey Ornstein at 7:30 P.M., in the Assembly Room at
the Municipal Complex, 10500 North Military Trail, Palm Beach
Gardens, Florida and opened with.the Pledge of Allegiance to the
Flag.
The roll was called by the secretary and present were: Jeffrey
Ornstein, Chairman; Mike Rosen, Vice Chairman; Carl Sabatello,
James Leatherman, Domenick Lioce and Joseph Hamzy, Members; and
Mr. Dan Shalloway, Alternate Member. Mr. Alan Strassler and
James Kuretski were not in attendance.
APPROVAL OF MINUTES OF DECEMBER 10, 1991
• Mr. Joseph Hamzy made a motion to approve the minutes of the
meeting of December 10, 1991. Mr. Mike Rosen seconded the mo-
tion. The minutes were approved by a 6 to 0 vote.
PUBLIC HEARING: PUD -91 -10 - Recommendation to City Council re:
(Gardens Medical Park) Five -year time extension to the Planned
Unit Development (PUD), created by Ordinance 17, 1983 and amended
by Ordinance 28, 1985 and Ordinance 1, 1989, for the development
of three medical and dental office buildings totaling 75,000 net
square feet. Located north of Burns Road and approximately 1,000
feet east of Gardens East Drive. (7- 42S -43E) (Adv. 12/30/91)
Mr. Bristol Ellington, City Planner, gave a presentation of the
January 9, 1992 staff report. Mr. Ellington stated the petition-
er is responsible for the installation of a portion of a hedge
along Burns Road, however, the petitioner stated they will in-

after Burns Road has been

ened.
The
Commission
asked what
is the time frame on the
widen-

ing of the road. Mr. Rich Walton, Planning and Zoning Director,
• stated he understands the design is complete, however, they have
not acquired all the right -of -way required. Mr. Domenick Lioce
asked staff if we had the funds with which to widen the road.
Mr. Walton stated all funds are not in; some of the funds are
coming in from impact fees from building permits. It was the
consensus of the Commission the hedge should be installed now
instead of waiting for the widening of Burns Road.
The Commission stated they do not grant five -year extensions for
PUD. Mrs. Anna Scheller, applicant for the petition, asked for a
three -year extension of time if they could not have a five -year
extension.
Chairman Ornstein opened the Public Hearing. Hearing no re-
sponse, Chairman Ornstein closed the Public Hearing.
• Mr. Domenick Lioce made a motion to recommend approval of Peti-
tion PUD -91 -10 to the City Council for a term of three years with
the following conditions:
1. Any conditions previously approved through Ordinance 17,
1983 and all subsequent amendments thereto, not specifically
amended herein shall remain in full force and effect.
2. Within sixty days of approval of said petition, the
petitioner shall convey land to the City for the completion
of Burns Road R.O.W.
3. All hedge requirements in the original PUD shall be
installed within 60 days from the approval of this exten-
sion.
Mr. Jim Leatherman seconded the motion. The motion carried
unanimously.
WORKSHOP: Z -91 -07 - Recommendation to City Council re: (Palm
Beach Community College Theater) Rezoning from Planned Develop-
ment Area (PDA) to PUD with the underlying zoning of Government
Use (GU) and site plan approval for a 26,890 square -foot theater

and exhibition hall. Located west of Campus Drive and about
1,250 feet south of PGA Boulevard. (6- 42S -43E)
• Mr. Ellington gave a presentation of the January 9, 1992 staff
report. Mr. Ellington stated at the highest point this structure
will be 85 + feet tall for the rear section which is for the
flywalk.
Mr. Ellington stated the petitioner is preserving 25% of environ-
mental upland, most of it being on the western part of the
property and on the northeast corner of the site.
Mr. Ellington stated the Fairchild Avenue extension jogs to the
south onto Community College property in order to align with the
driveway to the existing college campus. Mr. Ellington stated
that Palm Beach County will be constructing the Fairchild Avenue
extension in conjunction with their application for the North
County Government Center to the north of the College Theater
• site. The Commission asked what the College Theater will use as

an entrance if the North County Government Center is delayed.
Mr. Ellington stated the petitioner indicated they will construct
a temporary driveway within the alignment in the interim. Mr.
Ellington stated this petition has been scheduled for a Public
Hearing on January 28, 1992.
Mr. Dan Shalloway expressed concern regarding lack of pedestrian
walkways from the parking area to the building and from the
sidewalks along the roads to the building. A discussion ensued
regarding parking and drainage.
The Commission questioned handicap access to the building. Mr.
Lioce stated he would like to see dimensions on the elevations.
Mr. Carl Sabatello asked what the petitioner proposed for the

drainage ditch. The petitioner stated when the County puts in
the Fairchild Avenue extension, the ditch will be culverted.
• Mr. Sabatello stated he did not agree with the parking calcula-
tions and the petitioner needs to re -think the calculations. Mr.
Sabatello feels the handicap parking spaces need to be closer to
the building.
The Commission stated the sidewalk along Campus Drive is shown on
the plans to continue down to RCA Boulevard. The Commission
asked the petitioner if they intended to construct this sidewalk
as shown. The petitioner was in agreement.
The Commission requested clarification on the colors to be used
on the building. The Commission preferred the colors displayed
on the model as opposed to the light green and light peach sub-
mitted with the application to the City. The Commission request-
ed a floor plan and elevations with dimensions.
• Mr. Sabatello requested the petitioner show the location of
residences to the west of the property on the plans.
The Commission directed the Petitioner to return on January 28,
1992 for a Public Hearing. The Commission expressed concern with
the orientation of the building in relation to the parking lot
and the location of the entrance to the building. The Commission
stated the main architectural feature of the theater may be
blocked by the preserve area due to the orientation of the build-
ing and suggested pivoting the building to the west for better
access to the building.
The Commission requested that the 5' sidewalk proposed along
Campus Drive continue south to RCA Boulevard as noted on the Site
Plan and Conceptual Planting Plan.

The Commission requested that the site plan be revised to:
• - show the proposed sidewalk within the Fairchild Avenue
extension.
- provide an internal parking lot sidewalk system, including
pedestrian access from the theater site to the proposed
sidewalks on the Fairchild Avenue extension and Campus
Drive.
- show the required turn lanes on Fairchild Avenue extension
and Campus Drive.
- indicate the direction of the drop -off driveway. The
Commission suggested one direction.
- show the location of homes along the western property
line. The Commission expressed concern regarding the
effect of lighting from the parking lot and from the
building on the residents to the west. The Commission
also requested the location of the parking lot lighting
be shown on the plan.
The Commission requested the Conceptual Planting Plan be revised
to reflect the following:
- the Oak tree was deleted from the plant list.
• - continue the 14 -foot landscape buffer proposed by the
County for the North County Government Center along the
Fairchild Avenue extension, within the R.O.W. adjacent to
the Community College Theater property.
- show a two -foot high hedge along the north end of the
parking lot at the northwest corner of the site, adjacent
to Fairchild Avenue extension. This hedge can be of the
same specie proposed on the east side of said parking lot.
The Commission requested the applicant revise the building eleva-
tions to provide dimensions and revise the elevations for the
lower level entrance to allow for handicap access. In addition,
the Commission requested dimensioned floor plans for the theater.
The Commission requested clarification on the color selection of
the building. The colors submitted to the City are not consist-
ent with the colors presented at the meeting. The Commission
• preferred the colors displayed on the model over the color sam-

ples submitted to the City.
• The Commission expressed concern over the number of parking
spaces provided. It was suggested that the Public Hearing pre-
sentation should include the 215 + additional parking spaces
proposed on the College campus east of Campus Drive. In addi-
tion, the Commission requested verification of the amount of
parking needed, not what the City's Zoning Code requires.
The Commission requested clarification regarding a service en-
trance and /or construction entrance off Campus Drive, including
the timing, duration and type of road (i.e., one lane, paved vs.
gravel, etc.).
NEW BUSINESS:
Mr. Rich Walton, Director of Planning and Zoning, stated the Palm
Beach County Commission held a hearing on Tuesday, January 7,
• 1992, regarding a referendum to have all land use planning han-
dled by Palm Beach County Commissioners. Mr. Walton requested
the Commission inform other City residents and other organiza-
tions they are involved with of the ramifications of this.
Mr. Walton stated the City is processing an application for a
City- initiated PUD for a piece of vacant property north of the
fire station on the corner of Campus Drive and RCA Boulevard.
The City is proposing an office building on a parcel less than
two acres.
Mr. Sabatello asked Mr. Walton about the status of the landscape
buffers along Military Trail where the road was widened. Mr.
Walton stated staff is in the process of contacting each property
owner that is in violation of the City's Code along Military
•
Trail attempting to get the property owner to cooperatively
comply with the landscape requirements. A discussion ensued
.� regarding landscaping along PGA Boulevard.
ADJOURNMENT:
There being no further business to come before the Commission,
the meeting was adjourned at 9:30 P.M. The ne eeting of the
Plannin and Zoning Commission is scheduled J; nuary 28, 1992.
