HomeMy WebLinkAboutMinutes P&Z 021192CITY OF PALM BEACH GARDENS PLANNING AND ZONING COMMISSION FEBRUARY 11, 1992 MINUTES The Regular Meeting of the Planning and zoning Commission of the City of Palm Beach Gardens, Florida, was called to order by Chairman Jeffrey Ornstein at 7:30 P.M., in the Assembly Room at the Municipal Complex, 10500 North Military Trail, Palm Beach Gardens, Florida and opened with the Pledge of Allegiance to the Flag. The roll was called by the secretary and present were: Jeffrey Ornstein, Chairman; Carl Sabatello, Domenick Lioce, Alan Stras- sler and Joseph Hamzy, Members; and James Kuretski and Dan Shal- loway, Alternate Members. Mike Rosen and James Leatherman were not in attendance. APPROVAL OF MINUTES OF JANUARY 28, 1992 Chairman Ornstein stated on page 3, nine lines down, "revision clause" should read "reversion clause ". On page 4, midway down the page, he stated "Mr. Shalloway suggested a condition of approval for the theater to provide access to the service road to the City's vacant parcel." should read "Mr. Shalloway suggested a condition of approval for the theater to provide access to the service road from the City's vacant parcel." Mr. Alan Strassler abstained on the minutes of the meeting of January 14, 1992. The vote should have been 6 -0 with one abstention. Mr. Joseph Hamzy made a motion to approve the minutes of the meeting of January 28, 1992 with the changes mentioned above. Mr. Domenick Lioce seconded the motion. The motion carried unanimously. 1 0 • ITEMS BY PLANNING AND ZONING DIRECTOR Mr. Rich Walton, Director of Planning and Zoning stated the Commissioners received a Proclamation thanking them for their participation and proclaiming February 1992 as Advisory Board Member Recognition Month. WORKSHOP: Z -91 -04 - Recommendation to City Council re: (North County Government Center) Rezoning a 36.15 -acre site from GU, Governmental Use and PDA, Planned Development Area to a Planned Community District with an underlying zoning designation of Governmental Use and approval for a conceptual master plan ap- proval for a governmental center. Located at the southwest corner of PGA Boulevard and Campus Drive. (6- 42S -43E) Mr. Bristol Ellington, City Planner, gave a presentation of the February 6, 1992 staff report. A discussion ensued regarding parking calculations for the site. Chairman Ornstein stated the Commission is willing to work with the Petitioner on this project, however he did not feel the City is receiving the same cooperation. He stated the City has not received an adequate response to their concerns of the last meeting. Chairman Ornstein asked the Petitioner if they had a traffic study of the overall project. Mr. Hank Skokowski, agent for the Petitioner, stated they are not asking for approval for the overall project, only for approval of the phase I. Mr. Charlie Walker, Director of Traffic Division for Palm Beach County, stated the question being asked is if what they are proposing would meet the County's Traffic Performance Standard. Mr. Walker stated they are requesting approval to build the library and this will meet the Traffic Performance Standard. However, the traffic generated from the whole project will not meet the Traffic Performance Standards. Mr. Walker read a por- E tion of the Traffic Performance Ordinance which allows for what they are proposing. A discussion ensued. • The Commission expressed concern over approving a conceptual master plan without adequate traffic information and because each additional phase in the PCD will not have a public hearing. Mr. Ray Royce, agent for the Petitioner who filed an application for a "Toys 'R' Us" retail store on a parcel of land adjacent to the Government Center site, stated he believes there is a con- flict along the north /south road at the exit to the retail site. A discussion ensued. The Commission suggested moving forward with the Library and working out concerns with the PCD. Mayor Mike Martino, City Council Liaison, stated if the Petition- er cannot meet the requirements for the review of the PCD , he feels.the Petitioner should back away from the request. Mayor Martino stated the infrastructure needs to be concrete, major entrances and exits from the project need to be identified and perimeter buffers need to be identified, among other things. The Commission requested that Kahart Pinder, Traffic Consultant for the City, attend the public hearing to address the concerns of the project. Chairman Ornstein asked Audrey Wolf, Director of Facilities for Palm Beach County, what the timeframe is for the relocation of the DMV. Ms. Wolf stated they have a plan to have a courthouse facility built and in operation by the year 2000. The Commission stated the emergency access from the Sheriff's substation through the library site should be removed. Ms. Wolf • stated the Sheriff has a need for this emergency access and if 3 the Commission does not agree, this should be a condition of approval to the City Council. The Commission suggested extending the north /south road through to connect with the Fairchild Avenue Extension. The Petitioner stated the City Council previously approved the preserve site and the road cannot go through the preserve. Mr. Alan Strassler suggested moving the Sheriff's substation to the west where the gopher tortoises are located. The Commission directed staff to research the permitting process for relocating the gopher tor- toises. Mr. Lioce asked if there were enough parking spaces at the exist- ing courthouse when they remove 21 parking spaces in the first phase. Chairman Ornstein stated he felt the library should be connected to the remainder of the facilities. It was the consensus of the Commission that the library should not be connected to the other facilities. The Commission directed the Petitioner to return in two weeks for a Public Hearing. The Commission requested the following: 1. Respond to the concerns raised by Kahart Pinder regarding the Traffic Analysis and Charlie Walker should contact Mr. Pinder to resolve these issues. Also, the Commission would like the Petitioner to determine if Campus Drive will be wide enough to accommodate the development in this area (i.e., Government Center, Library, Community College Theater, PBG City Building). 2. Clarify the permitting procedures to relocate the gopher tortoises in order to examine the possibility of the north /south road connecting straight through to the Fairchild Avenue Extension. 3. Provide a summary explaining how many gopher tortoises there are, where they are, where they are being move to, and • the position of DER and FGFWFC. Document why a FGFWFC t 4 permit cannot be acquired for the preserve that is left by the relocation of the Sheriff's Substation and the extension of the north /south road, south to the Fairchild Avenue Extension. 4. Provide clarification on the design and timing of the north /south road in relation to the Pappalardo project and sign -off from Mr. Pappalardo. 5. The Sheriff's emergency access, as it is proposed through the library site, is unacceptable. The Commission indicat- ed that a stabilized surface should be provided adjacent to the library entrance. The Commission suggested relocating the Sheriff's substation to the site south of the DMV to alleviate the emergency access concern and the concern regarding the north /south road. 6. Work with City Engineer David Getz on the redesign of the construction plan for the north /south road. 7. The east /west road should go straight through to Campus Drive instead of bending through the two parking lots. 8. Provide parking calculations verifying that after the 21 parking spaces are eliminated at the existing courthouse there is still enough parking spaces for the existing building that will remain there. 9. Provide an overall parking space summary for each PUD, • indicating the parking required versus the parking proposed. _• 9. Resolve concerns raised by City Forester Mark Hendrickson pertaining to the landscaping proposed within Phase I. WORKSHOP: PUD -91 -11 - Recommendation to City Council re: (North County Public Library) Creation of a Planned Unit Development for construction of a 24,000 square -foot regional library facility located within the proposed North County Governmental Center Planned Community District. Located at the northwest corner of Campus Drive and the Fairchild Avenue extension. (6- 42S -43E) Mr. Ellington gave a presentation of the February 6, 1992 staff report. A discussion ensued regarding the proposed landscape plan. The Commission asked if the model was to scale with the elevations on the plans. The Petitioner responded he believes it is to scale. The Commission requested the height of the eleva- tions be brought down to the same scale as the model. 5 Mr. Sabatello asked if the Petitioner could add some trees to the east of the pedestrian walkway. The Petitioner stated they would have to check with the City Engineer. In addition, Mr. Sabatello suggested adding to the landscaping along the wall to soften the appearance. Mr. Hamzy expressed concern with the loading area with respect to the amount of front -to -back space. Mr. Sabatello requested a lighting plan for the site. The Commission requested the Petitioner revise the elevations of the building to be proportionate with the model presented at the meeting. The Commission also requested details on lighting. PREAPPLICATION REVIEW: Z -91 -08 - Recommendation to City Council re: (City Office Complex) Rezoning a 1.348 -acre site from PDA, Planned Development Area, to a Planned Unit Development with an underlying zoning designation of Government Use, and to approve a site plan for a 25,000 square -foot three -story office building with parking garage. Located west of Campus Drive and approxi- mately 400 feet north of RCA Boulevard. (6- 42S -43E) • Mr. Ellington gave a presentation of the February 6, 1992 staff report. The Commission expressed concern with respect to the parking garage in getting from the first floor to the second floor. The Commission requested elevations and floor plans, and suggest- ed the City hire an architect to do the drawings. The Commission expressed concern with the City Engineer and Traffic Consultant reviewing their own work on this project. OLD BUSINESS Mr. Hamzy requested staff to check the building next to the PGA National Spa to be sure it is being built as approved and ques- tioned the building at the FPL Ross Substation. Staff agreed to check into these projects. • ADJOURNMENT There being no further business to come before the Commission, the meeting was adjourned at 11:20 P.M.
