CITY OF PALM BEACH GARDENS
PLANNING AND ZONING COMMISSION
FEBRUARY 25, 1992
MINUTES
The Regular Meeting of the Planning and Zoning Commission of the
City of Palm Beach Gardens, Florida, was called to order by
Chairman Jeffrey Ornstein at 7:30 P.M., in the Assembly Room at
the Municipal Complex, 10500 North Military Trail, Palm Beach
Gardens, Florida and opened with the Pledge of Allegiance to the
Flag.
The roll was called by the secretary and present were: Jeffrey
Ornstein, Chairman; Mike Rosen, Vice Chairman; Carl Sabatello,
Domenick Lioce, Alan Strassler, James Leatherman and Joseph
Hamzy, Members; and Dan Shalloway, Alternate Member. James
Kuretski was not in attendance.
APPROVAL OF MINUTES OF FEBRUARY 11, 1992
Mr. Alan Strassler made a motion to approve the minutes of the
meeting of February 11, 1992. Mr. Joseph Hamzy seconded the
motion. The motion passed unanimously, with Mr. Mike Rosen and
Mr. Leatherman abstaining.
PUBLIC HEARING: Z -91 -04 - Recommendation to City Council re:
(North County Government Center) Rezoning a 36.15 -acre site from
GU, Governmental Use and PDA, Planned Development Area to a
Planned Community District with an underlying zoning designation
of Governmental Use and approval for a conceptual master plan
approval for a governmental center. Located at the southwest
corner of PGA Boulevard and Campus Drive. (6- 42S -43E) (Adv.
2/10/92)
Mr. Bristol Ellington, City Planner, stated staff recommends this
Public Hearing be postponed to a date certain, to be agreed upon
by the County, for them to resolve issues that are still unre-
solved. Staff recommends postponing this Public Hearing until
March 24, 1992. Chairman Ornstein opened the Public Hearing.

Mr. Domenick Lioce made a motion to postpone the Public Hearing
for petition Z- 91 -04, based on staff's recommendation. Mr.
Strassler seconded the motion. The motion carried unanimously.
RECOMMENDATION TO CITY COUNCIL RE: PUD -91 -11 - (North County
Public Library) Creation of a Planned Unit Development for con-
struction of a 24,000 square -foot regional library facility
located within the proposed North County Governmental Center
Planned Community District. Located at the northwest corner of
Campus Drive and the Fairchild Avenue extension. (6- 42S -43E)
Mr. Ellington gave a presentation of the February 20, 1992 staff
report and stated staff recommends approval of this petition with
revised conditions. Mr. Ellington stated staff would like to
expand condition #1 to require that Buffer C be proposed along
the south property line of the Fairchild Avenue Extension which
would include the landscaping within the median to be completed
prior to the Certificate of Occupancy of the library. Mr. Ell-
ington stated the Palm Beach Community College Theater is re-
quired to install vegetation in the buffer adjacent to their
property to be consistent with the final buffer plan. The Com-
mission asked who will maintain the median landscaping. Mr.
Ellington stated City Engineer David Getz is recommending the
roadway be dedicated to the City, the same as Fairchild Gardens
Avenue is currently.
The Petitioner is requesting to revise Condition #4 as follows:
"Sixty days prior to the issuance of a Certificate of Occupancy,
the County shall submit an updated traffic study showing that the
library meets Traffic Performance Standards or identifies im-
provements required to meet standards. A Certificate of Occupan-
cy will not be issued until such time that the County has shown
that it can meet Traffic Performance Standards requirements at

the time of Certificate of Occupancy." Staff had no problem with
• the proposed revision.
Mr. Ellington,stated staff is recommending condition #7 to read:
"All required permits and management plan for the relocation of
the gopher tortoises shall be obtained from the Florida Game and
Fresh Water Fish Commission and submitted to the City Staff prior
to the issuance of any building permit requiring land clearing."
Chairman Ornstein asked Mr. Hank Skokowski, agent for the Peti-
tioner, if they had any objections to these comments. Mr. Sko-
kowski replied he did not.
Mr. Lioce stated at the last meeting there was discussion and the
Commission reviewed an interlocal agreement with the overall
program that was provided with the previous petition for the 36-
acre tract, and asked if that still going to be put into effect
• before the library is done. Mr. Ellington stated that that will
be a condition of the Planned Community District.
Mr. Hamzy stated the plans still show the stabilized emergency
exit and it should be deleted.
Mr. Lioce made a motion to recommend approval of PUD -91 -11 to the
City Council with the following conditions:
1. Fairchild Avenue extension shall be extended as a two -lane
facility from its current terminus easterly to Campus Drive
prior to the issuance of any Certificate of Occupancy for
the library. The proposed Buffer C along the Fairchild
Avenue Extension, including the median as indicated on the
Typical Buffer Detail plan, shall also be installed and
irrigated by the completion of the Fairchild Avenue
Extension.
2. The location of the library access driveway on Fairchild
Avenue shall be coordinated with and aligned with the access
driveway for the Palm Beach Community College Campus
Theater.

3. Each subsequent phase or sub -phase shall provide a traffic
study including the traffic generated by all previously
approved phases or sub - phases within the Master Plan.
4. Sixty days prior to the issuance of a Certificate of
Occupancy, the County shall submit an updated traffic study
showing that the library meets Traffic Performance Standards
or identifies improvements required to meet standards. A
Certificate of Occupancy will not be issued until such time
that the County has shown that it can meet the Traffic
Performance Standards requirements at the time of the
Certificate of Occupancy.
5. The sign elevation and location shall return to the City for
review and approval by subsequent resolution.
6. Prior to construction, trees or vegetated clusters which
have been designated for preservation as per the landscape
plan shall be properly tagged. The vegetation falling
within the drip line of these trees shall be preserved where
desirable. Prior to land clearing, the developer shall
erect and maintain protective barriers around the drip line
of all trees or vegetated clusters to be protected. This
work shall be inspected and approved by the City Forester
prior to the issuance of any building permit requiring
land clearing. Section 153.50 (Tree Protection), paragraphs
B, C, and D shall also be enforced during construction.
7. All required permits and management plan for the relocation
of the gopher tortoises shall be obtained from the Florida
Game and Fresh Water Fish Commission and submitted to City
Staff prior to the issuance of any building permit
requiring land clearing.
8. All trees designated for preservation that die during
construction or because of construction practices, shall be
replaced using the following schedule: For every inch of
tree caliper lost, three inches of new tree caliper shall
be replaced of like specie. The replacement tree shall have
a minimum three inch caliper diameter.
9. All associated landscaping along Fairchild Avenue and Campus
Drive adjacent to the Regional Library PUD shall be
installed and maintained in conjunction with the completion
of said PUD.
10. Prior to the issuance of the Certificate of Occupancy, the
Landscape Architect of Record shall certify in writing to
the City that the landscaping has been completed per the
approved landscape plans. Any changes to the approved
landscape plans shall be approved by City Council. Once the
City has the certified letter from the Landscape Architect
the City Forester shall inspect the site for compliance.

Once compliance has been confirmed by the City Forester,
the City Building Department shall be notified.
11. The stabilized emergency drive from the Sheriff's Department
property shall be deleted.
Mr. Hamzy seconded the motion. The motion carried unanimously.
PREAPPLICATION REVIEW: PUD -92 -01 - Recommendation to City Coun-
cil re: (Toys 'R' Us) Amending the existing Garden Walk (Sigma)
Planned Unit Development (Ordinance 50, 1988) to allow for a
45,378 square -foot Toys 'R' Us store on a 4.5 -acre site. Located
south of PGA Boulevard and approximately 500 feet east of Fair-
child Gardens Avenue. (6- 42S -43E)
Mr. Ellington gave a presentation of the February 20, 1992 staff
report.
Mr. Ray Royce, agent for the Petitioner, stated this site was
approved for a 53,200 square -foot building to contain a Herman's
Sporting Goods store, restaurants and other miscellaneous stores.
The only restriction in the approval was the limitation of square
footage for restaurant because there was some concern that too
• many restaurants created parking problems. A joint easement
agreement was entered into with the State of Florida for the
IFJ
access road off of PGA Boulevard.
Mr. Royce stated the proposed building is 45,378 square feet and
is 12% to 15% less square footage than the current approved plan.
Mr. Royce presented a revised site plan showing a change to the
alignment of the north /south road in an attempt to accommodate
Palm Beach County's plans of this road going through to the
Fairchild Avenue Extension. A discussion ensued. Chairman
Ornstein stated he would like City Engineer David Getz to look at
the proximity of the right turn lane to the first entrance close
to PGA Boulevard.
The Commission expressed concern with the lack of green space on

the site and suggested reducing the number of parking spaces to
accommodate more vegetation. In addition, the Commission re-
quested the parking spaces be 10' X 20' instead of the 9' X 18'
shown on the plan. A discussion ensued regarding parking spaces.
Mr. Lioce asked the Petitioner where the pick -up door is on the
building. Mr. Paul Bobacino, representative of Toys "R" Us,
stated that door will be in the front of the building on the west
side. Mr. Lioce expressed concern with the 15 -foot setback on
the west and south sides of the building because of the height of
the building. Mr. Royce stated the approved plan for the office
building site contemplates a parking garage which is 15 -feet away
from the property line.
Mr. Lioce asked Mr. Royce if the Petitioner is incorporating a
request for an extension of time for the PUD since.the existing
• PUD is expiring this year. Mr. Royce stated they would check
into it.
The result of a poll by the Commission was that this building
design is not appropriate for PGA Boulevard.
The Commission requested the Petitioner provide site lighting and
the type of lighting at the next meeting.
The Commission directed the Petitioner to return for a workshop
on a date to be determined by staff and the Petitioner. In addi-
tion, the Commissioner requested the Petitioner contact staff to
establish a deadline for the submission of revised plans to allow
for sufficient time for staff to review the plans.
The Commission expressed concern with the following:
1. Revise the site plan to show the interior landscaping to
accommodate the 3 -for -1 mitigation for the removal of the
• preserved trees and parking spaces shown as 10' X 201.

2. The right -turn lane at the first entrance appears to be too
close to PGA Boulevard. The Commission requested the City
Engineer review this situation.
• 3. The Commission requested the loading area be reviewed by the
City Engineer to determine if a tractor /trailer can maneuver
in this area.
4. The Commission requested information on the Petitioner's
Lawn Maintenance Program, including how clippings and debris
will be removed from the site.
5. Provide a parking lot lighting plan and cut sheets.
6. The building design and colors of the tile and sign on the
building are unacceptable. The architecture does not blend
with the surrounding architecture nor is it comparable to
the approved elevations for the Gardens Walk PUD. The
landscaping in the rear of the building should be increased
and enhanced and the building sign should be more propor-
tionate to the building.
7. Identify on the site plan the location of the Art in Public
Places.
S. The 55 -foot buffer strip should be redesigned to be more in
line with the buffer at the Regional Center DRI.
9. Identify the location of the shopping cart storage area.
• The Commission is not in favor of shopping carts being
allowed in the parking lot and suggested designing the
building to restrict carts from entering the parking lot.

10. Provide a buffer strip adjacent to the front of the building
rather than the asphalt proposed. The Commission suggested
creating a plaza in front of the building.
11. Ordinance 50, 1988 expires on May 4, 1992. The Commission
questioned whether a time extension is being requested with
this amendment.
NEW BUSINESS
Mayor Mike Martino discussed the proposed university site and the
March 10 Charter Amendment Referendum.
ADJOURNMENT
There being no further business to come before the Commission,
the meeting was adjourned at 10:30 P.M. The next meeting of the
Planning and Zoning Commission is scheduled for March 10, 1992.
