HomeMy WebLinkAboutMinutes P&Z 051292CITY OF PALM BEACH GARDENS PLANNING AND ZONING COMMISSION MAY 12, 1992 MINUTES The Regular Meeting of the Planning and Zoning Commission of the City of Palm Beach Gardens, Florida, was called to order by Chairman Jeffrey Ornstein at 7:30 P.M., in the Assembly Room at the Municipal Complex, 10500 North Military Trail, Palm Beach Gardens, Florida and opened with the Pledge of Allegiance to the Flag. The roll was called by the secretary and present were: Jeffrey Ornstein, Chairman; Dornenick Lioce, Joseph Hamzy, James Leatherman, Carl Sabatello Members; Dan Shalloway and Diane Carlino, Alternate Members. Alan Strassler and Mike Rosen were not in attendance. ITEMS BY PLANNING AND ZONING DIRECTOR Mr. Bristol Ellington, City Planner, distributed copies of a letter from City Manager John Orr to the Planning and Zoning Commission responding to a letter Chairman Ornstein wrote. Mr. Ornstein's letter requested the Planning and Zoning staff be involved in review of construction plans prior to issuance of a Building Permit for any kind of approval and the review of Occupational Licenses. Mr. Orr's letter stated a meeting was held to discuss initiating the procedure to ensure conditions of development are met. In addition, the Planning and Zoning Department is currently reviewing Occupational Licenses to ensure appropriate uses are allowed per the zoning district and /or City ordinances. Mr. Ellington stated at the last City Council meeting, the North County Regional Library was approved and a workshop meeting was held for Toys'R'Us. • 1 i • r: APPROVAL OF MINUTES OF APRIL 28, 1992 Chairman Ornstein made a correction to the minutes on page 11, item 15 adding the sign will be one color. Mr. Lioce stated he would like to add on page 8 that Mr. Sabatello concurred with his comment that the sign is ugly. Mr. Nick Lioce made a motion to approve the minutes of April 28, 1992 as amended. Mr. Carl Sabatello seconded the motion. The motion carried unanimously with Mr. Jim Leatherman abstaining. SITE PLAN AND APPEARANCE REVIEW SP -92 -01 - Recommendation to City Council re: (Tropical Sands Church) Site Plan Approval for a 5,600 square -foot expansion to the existing 6,678 square -foot Tropical Sands Christian Church for educational and social function facilities. Located at the southeast corner of Burns Road and Allamanda Drive. (8- 42S -43E) Mr. Bristol Ellington, City Planner, gave a presentation of the May 7, 1992 staff report. Chairman Ornstein asked the Petitioner what "proposed fire sprinkler" on the plans meant. Mr. SanGiovanni, agent for the Petitioner stated that this is the backflow preventer. Chairman Ornstein stated this needs to be screened all the way around. Mr. Domenick Lioce made a motion to recommend approval of the petition SP -92 -01 to City Council with the following eight conditions: 1. Prior to occupancy of the building, the Landscape Architect of Record shall certify, in writing, to the City that the landscape has been completed per the approved landscape plans. Any minor changes 'to the approved landscape plans shall be approved by City Council. Once the City has the certified letter from the Landscape Architect, the City Forester shall inspect the site for compliance prior to the Certificate of Occupancy. 2. Prior to construction, trees or vegetated clusters which have been designated for preservation as per the landscape plan shall be properly tagged. The vegetation falling within the drip line of these trees shall be preserved where desirable. Prior to land clearing, the developer shall erect and maintain protective barriers around the drip line of all trees or vegetated clusters to be protected. This work shall be inspected and approved by the City Forester prior to issuance of any building permit 2 requiring land clearing. Section 153.50 (Tree Protection), paragraphs B, C, and D shall also be enforced during construction. 3. All trees designated for preservation that die during construction or because of construction practices, shall be replaced using the following schedule: For every inch of tree caliper lost, three inches of new tree caliper shall be replaced of like specie. The replacement tree shall have a minimum three -inch caliper diameter. 4. If the City finds that maintenance of the grass parking area is in disrepair or poor appearance, the City shall notify the property owner in writing that within thirty (30) days of said notice the deficiencies shall be rectified. Should the deficiencies not be corrected within thirty (30) days, the City may require the parking area to be totally paved to City standards within one hundred fifty (150) days upon written notification. 5. The irrigation system shall be installed over the entire site. 6. All site improvements must be completed before the issuance of the Certificate of Occupancy for the southern wing as part of Phase I. 7. All new and existing mechanized equipment on the building will be screened from line -of -site view. 8. The proposed back -flow preventer identified on the site plan shall be screened with • landscaping from line -of -site view. Mr. Carl Sabatello seconded the motion. The motion carried with a vote of 7 -0. PLANNING AND ZONING COMMISSION PUBLIC HEARING: Z -91 -04 - Recommendation to City Council re: (North County Government Center) Rezoning a 36.15 -acre site from GU, Governmental Use and PDA, Planned Development Area to a Planned Community District with an underlying zoning designation of Governmental Use and approval for a conceptual master plan approval for a governmental center. Located at the southwest corner of PGA Boulevard and Campus Drive. Postponed from 4/28/92 meeting. (6- 42S- 43E)(Adv. 2/10/92) Chairman Ornstein recommended that the Commission skip over the traffic issue and make a recommendation to the City Council that the County produce a traffic study prior to getting any approval. A discussion ensued. Mr. Ellington gave a presentation of the May 7, 1992 staff report. Mr. Ellington distributed • 3 an additional condition of approval to be added to the list of conditions in the staff report. Ms. Audrey Wolfe discussed the conditions of approval with the Commission and requested changes to conditions 3, 4, 9 and 11. A discussion ensued. The Commission agreed to changes on conditions 4 and 11 and deleted condition 3. Chairman Ornstein opened the Public Hearing and hearing no response he closed the Public Hearing. Mr. Domenick Lioce made a motion to recommend approval of petition Z -91 -04 to the City Council with the following conditions: 1. Each subsequent phase or sub -phase shall provide a traffic study including the traffic generated by all previously- approved phases or sub - phases within the Master Plan. The City's drafted Interlocal Agreement shall be adopted and any road improvements required under the traffic study shall be addended to any site plan approval of Phase II or thereafter. • 2. A five -foot sidewalk shall be constructed along the north side of Fairchild Avenue extension. 3. Prior to approval of Phase II improvements, Palm Beach County shall obtain an agreement with the owner of the Garden Walk PUD site and the State regarding the use of the existing joint access Easement and extension of the easement to the south to serve the North County Governmental Center. The said agreement shall include an exhibit showing the roadway alignment and typical sections that are satisfactory to the City Engineer. 4. The installation of the 15 -foot landscape buffer along Campus Drive, excluding the buffer adjacent to the library site, shall occur in Phase II of the PCD rather than in Phase I. 5. With the submittal of the first application for development approval within Phase II, the petitioner shall submit an overall signage package for review and approval by the City. 6. At the completion of the landscaping for each phase of development, or prior to the issuance of a Certificate of Occupancy for a building, the Landscape Architect of record shall certify, in writing, to the City that the landscaping has been installed per • the approved landscape plans. Any minor changes to the approved landscape plans shall be approved by the City Council. Once the City has received the certified letter, the City Forester shall inspect the site for compliance. 7. The County shall provide buffering consistent with the PGA Boulevard corridor landscape scheme as part of its Phase II improvements. 8. All interior and perimeter streets shall have, wherever possible, a common landscaping theme including trees. These streetscape plans shall be approved by the City prior to the completion of the road. All street landscaping shall be maintained by the County. 9. The landscaping associated with the construction of the Fairchild Avenue Extension, including the median, as indicated on Exhibit "C" of the typical Buffer Details Plan shall be installed by the completion of said road. The associated landscaping shall have an irrigation system that meets or exceeds FDOT standards. 10. The Florida Game and Fresh Water Fish Commission (FGFWFC) shall be notified of each phase of development as long as there is a Gopher tortoise population. on site. All required FGFWFC permits and management plans shall be obtained prior to issuance of any building permit for land clearing. Prior to submission of any portion of Phase II, the PCD Master Plan shall be survey platted with the 5.3 -acre preserve area dedicated as a conservation area. No easements or building construction shall be permitted within the preserve area unless approved by the City Council. 11. Prior to land clearing, the developer shall erect and maintain protective barriers around the drip line of all trees or vegetated clusters to be protected. Prior to final approval of Phase II improvements, which includes the extension of the north /south road, the County shall grant an easement at the southeast corner of the Toys -R -Us site for future vehicular access to the north /south road. • 5 14. Before Phase II is approved, the Planning and Zoning Commission must review the • requirement of a road cut from the Library parcel into the north section of the Master Plan. Mr. Joseph Hamzy seconded the motion. The motion carried with a vote of 7 -0. Recommendation to City Council Re: PUD -92 -02 - ( Anspach Effort PUD) Allowing for the renovation and expansion of an existing building on Lot 2 of West Park Center Plat within the NorthCorp Center Planned Community Development. Located east of Interstate 95, at the southwest corner of NorthCorp Parkway and Riverside Drive. (7- 42S -43E) Mr. Ellington gave a presentation of the May 7, 1992 staff report. Chairman Ornstein showed a picture of the ground sign which states it is an existing sign on the site. However, it is inaccurate because it is a sign existing on another piece of property to be relocated to this site and the plans should be changed. Chairman Ornstein asked if the traffic study as prepared for Phase I is based on the industrial use of the property rather than the Anspach Effort use of the building and • therefore if this building were sold to another industrial use would the same traffic counts • hold and if somebody else coming in using this square footage would increase the number of trips. Mr. Joseph Pollock, traffic engineer for the Petitioner, stated there should be no change in the number of trips for another project using this building for the same use. Chairman Ornstein stated there are a lot of off -site improvements needed to be done when the south half of the project is developed and part of this site is in that south half. Chairman Ornstein asked if this development would trigger these improvements and if so, how do they get done. Mr. Pollock stated he does not believe this development would not trigger these improvements. Mr. Ellington stated the realignment of Riverside Drive is required prior to the issuance of a Building Permit for any of the lot for South Park Center. 0 A portion of Lot 1 of South Park Center is included with this petition, however it is only the • parking. Chairman Ornstein suggested incorporating a condition of approval to allow the City Council and City Attorney to work out this problem. A discussion ensued. Mr. Joseph Hamzy raised a concern regarding the lack of landscaping along the west elevation of the building if Phase II does not get built. Ms. Young Song, agent for the Petitioner, presented the Commission with a preliminary landscape plan for landscaping around the lake. The Commission requested more detail on the landscaping. The Commission stated the lighting proposed in the plans does not look like the lighting in the NorthCorp Center. Ms. Song stated the Police Department requested this type of lighting. The Commission requested the lighting match the NorthCorp Center and if additional footcandles are needed, they can add more lighting. • A discussion ensued regarding the realignment of Riverside Drive. Mr. Pat Gordon addressed the Commission requesting the 'Commission condition the Certificate of Occupancy and not the Building Permit for the realignment of the road. Mr. Dan Shalloway made a motion to recommend approval of Petition PUD -92 -02 to the City Council with the following conditions: 1. The five -foot sidewalks proposed on the subject property along Northcorp Parkway and Riverside Drive shall be constructed prior to the issuance of the Certificate of Occupancy. 2. The property owner or successors shall comply with Condition 25 of Section 4 as set forth in Ordinance 1, 1990. 3. The property owner or successors shall comply with the Department of Environmental Regulation's consent order. • 7 4. The replacement tree shall have a minimum three -inch caliper diameter. 5. Prior to the issuance of the Certificate of Occupancy the Landscape Architect of Record shall certify in writing to the City that the landscaping has been completed per the approved landscape plans. Any minor changes to the approved landscape plans shall be approved by City Council. Once the City has the certified letter from the Landscape Architect, the City Forester shall inspect the site for compliance. Once compliance has been confirmed by the City Forester, the City Building Department shall be notified. 6. Prior to construction, trees or vegetated clusters which have been designated for preservation as per the landscape plan shall be properly tagged. The vegetation falling within the drip line of these trees shall be preserved where desirable. Prior to land clearing, the developer shall erect and maintain protective barriers around the drip line of all trees or vegetated clusters to be protected. This work shall be inspected and approved by the City Forester prior to issuance of any building permit requiring land clearing. Section 153.50 (Tree Protection), paragraphs B, C, and D shall also be enforced during construction. • 7. All roof - mounted equipment shall be screened from line -of -sight view. 8. A detailed landscape plan, including lighting consistent with the lighting in the NorthCorp Centre, shall be submitted to the Planning and Zoning Commission and approved prior to the issuance of a building permit. 9. This approval is for a Light Manufacturing use only with trip generations based on the submitted traffic study. 10. No Building Permit for construction of this project shall be issued until a Building Permit for the construction of Riverside Drive to the southern limits of the project is issued. No Certificate of Occupancy for this project shall be issued until the construction of Riverside Drive is completed from Burns Road to Northcorp Parkway. Mr. Joseph Hamzy seconded the motion. The motion carried with a vote of 6 -0 with Mr. Lioce abstaining. WORKSHOP: Z -91 -08 - Recommendation to City Council re: (City Office Complex) Rezoning a 2.515 -acre site from PDA, Planned Development Area, to a Planned Unit Development with an underlying zoning designation of Government Use, and to approve 0 8 a site plan for a 23,760 square -foot office building. Located west of Campus Drive and • north of RCA Boulevard. (6- 42S -43E) Chairman Ornstein stated he and Mr. Alan . Strassler donated their time to design this project, therefore there is no conflict of interest because they are not being paid. Mr. Ellington gave a presentation of May 7, 1992 staff report. The Commission suggested 14 -foot high lights in the parking lot instead of 20 -foot high lights. In addition, the Commission stated the landscaping could be upgraded and taller trees could be used. Mr. Lioce requested the dumpsters be turned so they do not face the street. The Commission directed staff to advertise this petition for a Public Hearing on June 9, 1992. PREAPPLICATION REVIEW: PUD -92 -07 - (Lake Catherine) Amending the Lake Catherine Planned Unit Development, adopted on October 19, 1989 by Ordinance 30, 1989, to permit an electronically- operated gate system east of the intersection of Lake Catherine • Drive and Silverthorne Road. (18- 42S -43E) Mr. Ellington gave a presentation of the May 7, 1992 staff report. The Commission expressed concern with the gate swinging inward in the development. Mr. William Shannon, agent for the Petitioner, stated the reason why the gates swing in is because there is a lot of concern for the operator mechanism of the gate and the gate arms and the possibility of vandalism. A discussion ensued. The Commission expressed concern with the 30 -foot distance from Silverthorne Road to the Gate and suggested 40'. The Commission suggested the following: the gate opening outward from the development instead of inward, six-foot high chain link fence instead of seven -foot high, the gate to be set back at least 40' to allow for stacking of two vehicles off Silverthorne Road. 0 9 The Commission would like to see a landscape plan showing how the chain -link fence will • be screened. The Commission directed staff to advertise this petition for a Public Hearing on June 9, 1992. ADJOURNMENT There being no further business to come before the Commission, the meeting was adjourned at 10:30 P.M.
