HomeMy WebLinkAboutMinutes P&Z 090892F i CITY OF PALM BEACH GARDENS PLANNING AND ZONING COMMISSION SEPTEMBER 8, 1992 MINUTES The Regular Meeting of the Planning and Zoning Commission of the City of Palm Beach Gardens, Florida, was called to order by Chairman Jeffrey Ornstein at 7:30 P.M., in the Assembly Room at the Municipal Complex, 10500 North Military Trail, Palm Beach Gardens, Florida and opened with the Pledge of Allegiance to the Flag. The roll was called by the secretary and present were: Jeffrey Ornstein, Chairman; James Leatherman, Joseph Hamzy, and Domenick Lioce, Members; and Diane Carlino, Alternate Member. Mike Rosen, Alan Strassler, Carl Sabatello and Dan Shalloway were not in • attendance. APPROVAL OF MINUTES OF MEETINGS OF JULY 28, 1992, AUGUST 11, 1992 AND AUGUST 25, 1992 Mr. Domenick Lioce made a motion to approve the minutes of the meetings of July 28, 1992, August 11, 1992 and August 25, 1992. Mr. Jim Leatherman seconded the motion. The motion passed unanimously. SITE PLAN AND APPEARANCE REVIEW COMMITTEE SP -92 -05 - Recommendation to City Council re: (Seacoast Utility Authority) Site Plan Approval for the construction of a raw water storage tank, transfer pumps, high service pumps, a chlorine building and a motor control building. Located west of Interstate 95 and north of Lilac Street (12- 42S -42E) Mr. Bristol Ellington, City Planner, gave a presentation of the September 3, 1992 staff report. • 1 • Mr. James Leatherman made a motion to recommend approval of SP -92 -05 to the City Council with the following conditions: 1. Trees shall be planted every 20' along Lilac Street to west of the existing water treatment plant building. 2. The landscaping shall be installed upon completion of the facility or by December 31, 1993, whichever comes first. The City Forester shall inspect the completed installation of the landscaping for compliance. Mr. Domenick Lioce seconded the motion. The motion passed with a vote of 5 -0. PLANNING AND ZONING COMMISSION PUBLIC HEARING: Z -92 -02 - Rezoning a 9.7 -acre tract from the zoning designation of Residential Medium, RM, to the zoning designation of Government Use, GU. Located west of Interstate 95 and north of Lilac Street. (12- 42S -42E) (Adv. 8/24/92) Chairman Ornstein opened.the Public Hearing and, hearing no response, closed the Public • Hearing. Mr. Lioce made a motion to recommend approval of Z -92 -02 to the City Council. Mr. Leatherman seconded the motion. The motion passed with a vote of 5 -0. • PUBLIC HEARING: DRI -92 -01 - Amending the Development Order for the PGA Resort Investment Community, a Development of Regional Impact, as adopted by Resolution 43, 1978 and amended by Resolution 36, 1985, by deleting the Jog Road Right -of -Way Conveyance condition of approval; adding a condition of approval to reduce the number of residential units of the development from 6,900 dwelling units to 5,400 dwelling units; and, adding a condition of approval which requires a revised master site plan for the project to be submitted to the City. Located south of PGA Boulevard, north of Northlake Boulevard and west of Florida's Turnpike. (8, 9, 10, 15 & 16- 42S- 42E)(Adv. 8/24/92) Ms. Kim Glas, City Planner, gave a presentation of the September 3, 1992 staff report. A discussion ensued regarding dedication of the 'Jog Road Right -of -Way. Chairman Ornstein asked Ms. Yvonne Ziel, Traffic Consultant for the City, if the traffic trips associated with the deletion of the number of units go back into the County's 'bank ". Fa • Ms. Ziel replied that is correct. Mr. George de Guardiola, agent for the Petitioner, presented the Commission with a handout illustrating the concurrency impacts of deleting 1,500 units from PGA National's Master Plan. Chairman Ornstein opened the Public Hearing. Mayor Mike Martino spoke in favor of this petition and applauded the Petitioner for reducing the number of units in the master plan. Chairman Ornstein asked the Petitioner if the County would have to condemn and buy Ryder Cup Boulevard from Northern Palm Beach Water Control District in order to widen the road and can the Water Control District widen the road if they so desire. Mr. Frank Palen, attorney for the Petitioner, stated in order for the County to operate a public road and to actually construct an extension of Jog Road as part of the County's system, they would have to have title to the road. There would have to be a title transfer between the Water Control District and the County. Mr. de Guardiola stated the intention of the petition is to de- politicize this issue to the point where if that road needs to expanded and built on, the justification would have to be set forth in a series of public hearings. A discussion ensued. Mr. Lioce made a motion to recommend approval of DRI -92 -01 to the City Council. Ms. Diane Carlino seconded the motion. The motion passed with a vote of 5 -0. RECOMMENDATION TO CITY COUNCIL RE: PUD -92 -14 - Amending the Devonshire PUD, a 337 -unit life care facility, to modify the architectural design and site plan. Located within PGA National, a Development of Regional Impact, generally south of PGA Boulevard, west of Florida's Turnpike and north of Northlake Boulevard. (16- 42S -42E) Mr. Ellington gave a presentation of the staff report dated August 20, 1992. Mr. Gabriel Salazar, architect for the Petitioner, stated the discrepancy in the parking count 0 3 . will be corrected. In response to the Fire Department's letter of September 3, 1992, Mr. Salazar stated the building will comply with all life safety codes, local building codes, and the building will have a sprinkler system. A discussion ensued regarding the procedure for trash pick -up. The Commission questioned the maneuverability of the area for a garbage truck where the compactor is located. The Commission requested a large -scale detail of the compactor area for the City Council. Mr. Salazar agreed and stated they would also provide a detailed drawing of the enclosures for the temporary pick -up areas. Mr. Lioce made a motion to recommend approval of PUD -92 -14 to the City Council with the following conditions: 1. The support services within the central facility shall be available for use only to residents of the life care facility. Dining room facilities may also be used by guests. • 2. No external signage regarding the support services as referenced shall be allowed for the uses within the central facility. 9 3. Barriers shall be placed around the vegetation to be preserved (prior to and during the construction phases) for protection. Not later than 30 days after barriers are installed, an inventory of all 3 -inch or greater caliper trees and palms shall be made and a copy of this inventory shall be given to the City Forester. 4. The north, south and east buffers, where shown on the site plan, are to be planted and irrigated within thirty days of the next building permit. 5. Twenty -five (25) Sabal palms shall be preserved through relocation on site. These palms shall be tagged and protected prior to and during construction. The palms to be selected and the relocation site for these palms will be coordinated with the City Forester prior to issuance of the first building permit. 6. The removal of all exotics (melaleuca, brazilian pepper and australian pine) from the site and assurance of their elimination perpetuity through the project's landscape maintenance program shall be required. n u • 7. To the extent that the density of the buffer is diminished when the exotics are removed, the developer will replace same with additional foliage of some type to the satisfaction of the City Forester so as to maintain the buffer area. 8. The landscaping along the north side of the new Devonshire Road (south side of canal) shall be planted identical to the approved landscape plans for the south side of the entrance road (north side of the canal) leading to The Islands PUD development. 9. Shade trees to be planted along the north and south perimeters shall be a minimum of 18 feet in height at the time of planting. Palm trees shall have a minimum of 14 feet clear wood at time of planting within the perimeter buffers. 10. Prior to the issuance of the Certificate of Occupancy for each building, the landscaping and amenities around the building shall be inspected by the City Forester using detailed final landscape plans provided by the landscape architect of record. The final landscape plans shall be reviewed and approved by the City Forester prior to the issuance of the Certificate of Occupancy for each building. The final landscape plans shall contain no less than the amount, type and quality of landscaping as contained in the conceptual plan. 11. If Phase 2 is not started within 6 months from the completion of Phase 1, the • undeveloped vacant land shall be cleared of debris and seeded with a ground cover that will stabilize the soil and shall be maintained in a neat appearance. 12. The following contingency plan shall be enacted to replace those trees and palms that die during or from construction within the preserve /buffer area as inventories in condition #3 and relocated per condition #5: three inches of new tree caliper will replace every one inch of caliper lost; palms to be replaced one - for -one. Replacement shall be done prior to the last building Certificate of Occupancy or as deemed appropriate by the City Forester and Landscape Architect of Record. 13. Corners ant turning radii are preferred at 50' radiuses per Fire Department, and in no case shall a radius be less than 42'. 14. The permitted land usage is "adult life care facility" for the elderly. The definition of said permitted land usage shall be defined in Chapter 159, Section 159.003, "Housing for the Elder 1X ", Zoning Code of the City of Palm Beach Gardens Code of Ordinances, which is hereinafter basically set forth together with other rules and regulations which shall apply in conjunction therewith: A facility in the nature of the multiple - family dwelling, the occupancy of which is limited to persons of an elderly age, but where the occupants are generally able to care for themselves and do not require regular personal maintenance 5 • or nursing care. Where the zoning regulation permits housing for the elderly, housing shall be used only for that purpose, and shall not be converted to multiple dwelling use unless all requirements of this code are met for the conversion. In addition thereto, there shall be full compliance with rules and regulations as contained in Chapter 651 F.S., sa same pertains to life and continuing care contracts. In the event, Petitioner shall ever desire to convert the permitted usage of "Housing for the Elderly" to other multiple dwelling use, same may only be done in compliance with Code requirements and the approval of the City Council by subsequent Resolution. 15. The site plan shall be revised prior to a workshop meeting before the City Council reflecting an accurate calculation of the parking spaces provided and that the loop road through Phase II will be constructed during Phase I development. 16. The Petitioner shall provide a large -scale detail of the trash compactor area in the and a detailed drawing showing how the temporary dumpster pick -up area will be screened. Ms. Carlino seconded the motion. The motion passed with a vote of 5 -0. • RECOMMENDATION TO CITY COUNCIL RE: PUD -92 -09 - Creation of a Planned Unit Development to allow for the construction of five one -story buildings, with a total building square footage of 49,360, for a mixture of general office and industrial uses on Lots 1 and 2 of RCA Boulevard Center within the NorthCorp Planned Community District. Located north of RCA Boulevard and west of the Florida East Coast Railway. (1- 42S -42E & 6 -42S- 43E) • Mr. Lioce stated he has a conflict of interest in that he represents the underlying land owner and he will not be voting. Mr. Ellington gave a presentation of the September 3, 1992 staff report. Chairman Ornstein stated this petition is at a point where studies and direction from the City Council could delay this project for months. Chairman Ornstein suggested reviewing the project, voting on it and sending it to City Council with a recommendation as it sits on the paper now, with the condition that any changes to this site plan will start the process over again and the Z • project would again have to go through the Planning and Zoning Commission. Mr. Henry Skokowski, agent for the petitioner, stated they are not in agreement with all conditions of approval. Mr. Skokowski stated they would like the phrase, "maximum of 24,680 square feet of industrial use and a" deleted from condition #2. Mr. Skokowski requested clarification of the phrase in Condition #4 which states "line of sight ". The Commission agreed to change that phrase to "height of equipment ". Mr. Skokowski stated Condition #6 needs to be clarified in such a way that does not hold the petitioner responsible for replacing trees in an easement if they are removed by someone else. Mr. Lioce suggested adding the language "by the land owner or successors" after "any time" to clarify this condition. In Condition #8, Mr. Skokowski suggested deleting in the third line, "approved ", appearing after "per the" and "shall be" to clarify the condition. The • Commission added "prior to the issuance of the Certificate of Occupancy ". Ms. Carlino made a motion to recommend approval of PUD -92 -09 to the City Council with nine conditions: 1. With each application for an occupational license, the building owner shall provide to the City, through the applicant, a copy of the leasing floor plans identifying all existing tenants by name, use and square footage. A summary shall accompany leasing floor plans, tabulating the square footages for the industrial and general office uses. 2. The five buildings, totaling 49,360 square feet, shall be limited to a maximum of 24,680 square feet of general office use. 3. If the City Council requires the petitioner to dedicate right -of -way through the RCA Boulevard Center PUD for a future north /south road, the petitioner shall revise the site plan to reflect the right -of -way for review and recommendation of approval by the Planning and Zoning Commission prior to final approval of said PUD by the City Council. 4. All roof - mounted equipment shall be screened from height of equipment. • 7 5. The landscape plan shall reflect and conform to the approved Northcorp PCD streetscape /buffer plan prior to final approval of said PUD. 6. If any of the existing Pine trees along the northern ditch, within the 50 -foot drainage easement, are removed at any time by the land owner or its successors in the future for any reason, the trees shall be replaced with an equivalent number of trees. Each replacement tree shall be of like specie and a minimum of 12 feet in height. 7. Prior to construction, trees designated for preservation shall be tagged, and the developer shall erect and maintain protective barriers around the drip line of the tree or tree cluster. This work shall be inspected and approved by the City Forester prior to issuance of any building permit. Section 153.5 (Tree Protection), paragraphs B, C, and D, shall also be enforced during construction. 8. Prior to the issuance of the Certificate of Occupancy, the Landscape Architect of Record shall certify, in writing, to the City that the landscaping has been completed per the landscape plans approved by City Council. Once the City has the certified letter from the Landscape Architect, the City Forester shall inspect the site for compliance. Once compliance has been confirmed by the City Forester, the Building Department shall be notified prior to the issuance of a Certificate of Occupancy. 9. If for any reason a north /south road is constructed through the RCA Center PUD, this road shall be landscaped using the approved Northcorp Streetscape /buffer plan • as a guideline, including all applicable conditions to said plan. Mr. Joseph Hamzy seconded the motion. The motion carried with a vote of 4 -0 with Mr. Lioce abstaining. RECOMMENDATION TO CITY COUNCIL: Zoning Code of Land Development Regulations. The Planning and Zoning Commission reviewed the Chart of Permitted Uses in the Zoning section of the Land Development Regulations and made recommended changes to City Council. Articles 1, 2 and 3 of the Zoning section will be reviewed at the next meeting of September 22, 1992. • 8 ADJOURNMENT • There being o further business to come before the Commission, the meeting was adjourned g g J at 10:30 P.M.
