PLANNING AND ZONING COMMISSION
MARCH 12, 1991
r MINUTES
The Regular Meeting of the Planning and,Zoning Commission of the
City of Palm Beach Gardens, Florida, was called to order by
Chairman Jeffrey Ornstein, at 7:30 P.M'., in the Assembly Room at
the Municipal Complex, 10500 North Military Trail, Palm Beach
Gardens, Florida and opened with the Pledge of Allegiance to the
Flag.
The roll was called by the secretary, and present were: Jeffrey
Ornstein, Chairman; Mike Rosen, Vice Chairman ; James Leatherman,
Joseph Hamzy, Alan Strassler and Carl Sabatello; Members. Dome -
nick Lioce Member; Jack White and Rebecca Serra; Alternate Mem-
bers, were not in attendance.
Chairman Ornstein stated he received a letter of resignation from
the Commission from Jack White. Chairman Ornstein expressed his
personal thanks to Mr. White for all the work he has put in and
he wishes Mr. White the best of luck in the future. Chairman
Ornstein stated he would like the City Council to appoint another
alternate to take Mr. White's place.

Mr. Mir -.e Rosen made a motion to approve the minutes of February
12, 1991.. Mr. Alan Strassler "seconded the motion. The motion
carried.unanimously.
Chairra,n.;Ornstein stated at the last meeting he asked for clari-
fcat of�'-cne motion made by.Carl Sabatello for recommendation
of approval to the City Council of the amendment to Devonshire
PUD, petition number PUD- 90 -24. (The motion that Mr. Sabatello

made and the Commission voted on was correct in its wording in
the minutes and there were no changes to the minutes. Chairman
Ornstein's request at the last meeting was just for clarifica-
tion.
Mr. James Leatherman made a motion to approve the minutes of
February 26, 1991. Mr. Joseph Hamzy seconded the motion. The
motion passed with a vote of 5 to 0, Mr. Alan Strassler abstain-
ing.
ITEMS BY PLANNING AND ZONING DIRECTOR
Mr. Bristol Ellington, City Planner, stated the Planning and
Zoning Department has received an application for Palm Beach
Gardens Medical Center Planned Unit Development. The petitioner
has submitted elevations and landscape plans. In addition, the
Planning and Zoning Department has received an application for
• the North County Government Center.
PUBLIC HEARING: PUD -91 -01 - Recommendation to City Council re:
(The Oaks Guardhouses) Amendment to The Oaks Planned Unit Devel-
opment, adopted by Ordinance 31, 1989, for the construction of
guardhouses at the project driveways to the single- family and
multi- family developments. Located east and west of the Gardens
East Drive ektension, north of Burns Road. (7- 42S -43E) (Adv.

Mr. Bristol Ellington gave a presentation of the March 7, 1991
staff report.
Mr. Charles Hathaway, Vice President of DiVosta and Company,
stated the proposed guardhouses are to be built on private roads.
Chairman Ornstein asked if there were gates at the roads exiting
the project. Mr. Hathaway stated they are proposing only entry
gates.
Chairman Ornstein opened the Public Hearing for PUD -91 -01 and

having no response, closed the Public Hearing.
Mr. Joseph Hamzy made a motion to recommended approval of peti-
tion PUD -91 -01 to the City Council with the following conditions:
1. The gate system, when installed, shall comply with all Build-
ing Code standards.
2. When the gate systems are installed, the guardhouses shall be
manned 24 hours a day.
3. If the type of gate system is modified from the type depicted
on the guardhouse elevation (dated 2/14/91), the petition
must be reviewed and approved by the City.
4. Prior to the final inspection for the installation of the
gate system, approval shall be obtained from Waste
Management.
Mr. James Leatherman seconded the motion. The motion carried
unanimously with a vote of 6 to 0.
PUBLIC HEARING: AX- 91 -01: Recommendation to City Council re:
(DiVosta Annexation) Annexation of a 1.826 -acre site located west
of U.S. Highway One, 700' south of PGA Boulevard. (4- 42S -43E)

• Mr. Bristol Ellington gave a presentation of the staff report
dated March 7, 1991 for AX- 91 -01, LU -91 -01 and Z -91 -02 combined.
Mr. William Shannon, General Counsel for DiVosta and Company,
stated he is speaking on behalf of Otto B. and Betty J. DiVosta
who are the owners of the property. Mr. Shannon stated annexa-
tion of this property by the City would square -up the City's
boundary.
The Commission expressed concern with changing the land use and
zoning without knowing what is proposed for the site.
Mr. Shannon stated the petitioner is requesting the land use plan
change and rezoning now due to the long period of time involved
with sending a land use plan change to DCA.
Chairman Ornstein opened the Public Hearing for petition AX -91 -01

and having no response, closed the,Public Hearing.
Mr. Mike Rosen made a motion to recommended approval of petition
• AX -91 -01 to the City Council. Mr. Carl Sabatello seconded the
motion. The motion carried unanimously with a vote of 6 to 0.
PUBLIC HEARING: LU- 91 -01: Recommendation to City Council re:
(DiVosta Land Use Change) Amendment to the City of Palm Beach
Gardens' Comprehensive Land Use Map and Plan to Commercial from
Palm Beach County Land Use designation of CL /5 - Commercial (Low
Intensity), in part, and Residential 8, in part of a 1.826 -acre
site located west of U.S. Highway One, 700' south of PGA Boule-

Chairman Ornstein opened the Public Hearing for petition LU -91 -01
and having no response, closed the Public Hearing.
Mr. Carl Sabatello made a motion to recommended approval of ,
petition LU -91 -01 to the City Council. Mr. Mike Rosen seconded
the motion. The motion carried unanimously with a vote of 6 to
0.
PUBLIC HEARING: Z- 91 -02: Recommendation to City Council re:
• (DiVosta Rezoning) Rezoning a 1.826 -acre site from Palm Beach
County's zoning designation of CG /RH (General Commercial and
Residential High) to City of Palm Beach Gardens' zoning designa-
tion of CG -1 (General Commercial). Located west of U.S. Highway
One, 700' south of PGA Boulevard. (4- 42S -43E) (Adv. 2/25/91)
Chairman Ornstein opened the Public Hearing and having no re-
sponse, closed the Public Hearing.
Mr. Alan Strassler made a motion to recommend approval of peti-
tion Z -91 -02 to the City Council. Mr. James Leatherman seconded
the motion. Mr. Joseph Hamzy questioned the need for the inten-
sity of CG -1 (General Commercial) instead of CN (Neighborhood
Commercial) for a parcel this small. Mr. Shannon stated since
the CG -1 zoning is for auto - generated uses, it would be more
appropriate for this site. The motion carried unanimously with a
vote of 6 to 0.

ADJOURNMENT
There being no further business to discuss, the meeting was
• adjourned at 8:15 P.M. The next meeting of the Planning and
Commission .is sc duled for March 26, 1991.
